Abstract

Indonesian civil code generally regulates inheritance rights between blood relatives which in fact aanvullen recht (openness). Openness here means that they are not required to follow what has been regulated or in other words each and every heir is entitled to the inheritance as long as they are tolerant to the results of the distribution portion and they are contend with it. However, the problem arises when there is one or more heirs who start a dispute which ultimately resulted and processed in court. Even more so complicated when the inheritance object had previously been mortgaged to the Bank. The form of debt repayment that occurred on the collateral could significantly affect the inheritance, especially when subrogation happened. The legal consequences focus on whoever holds the subrogative rights and as such gets preferential rights in the distribution of the inheritance.

Abstract

The application of restorative justice in a criminal case must involve coordination from all levels of law enforcement agencies. Theft is an action that falls into the criminal category where the perpetrator of the theft takes property belonging to another person illegally without the owner's permission. Of course, this act of theft harms one party, namely the victim. At this time, many thefts are found to occur within the environment, not far from those close to the environment itself, it is not uncommon for theft to be carried out by those closest to us. Basically, every person who commits theft must be proven to have fulfilled all the elements of a criminal act as stated in the formulation of Article 362 of the Criminal Code, stealing here is defined as taking something that wholly or partly belongs to another person with the intention of possessing it unlawfully, punishable by a maximum sentence of five years. prison and fine... As for the Problem Formulation: 1. How are the Principles of Restorative Justice Applied to Judges' Considerations in Decisions to Release All Legal Claims (Case Study Decision Number: 28/Pid.B/2022/PN.LBB)? and 2. What are the obstacles in applying the principles of restorative justice to the judge's considerations in making a decision to release all legal claims? The conclusions of this research are: 1. The panel of judges who handled the cases in this research were not guided by the Decree of the Director General of the General Justice Agency Number: 1691/DJU/SK/PS.00/12/2020 concerning guidelines for implementing restorative justice in the General Court environment .The defendant Dedi's case does not meet the requirements for restorative justice as stipulated in National Police Regulation no. 8 of 2021 concerning Handling Criminal Acts Based on Restorative Justice and Attorney General Regulation no. 15 of 2020 concerning Termination of Prosecution based on Restorative Justice and does not fulfill legal objectives, namely the principles of legal certainty, justice and expediency and conclusion 2. The implementation of the concept of restorative justice in the integrated criminal justice system in Indonesia has not been implemented in an integrated manner with the absence of high-level regulations regarding implementation of restorative justice, including clear technical instructions with the aim of ensuring that the perpetrator truly recovers and is accepted back into society. This is why the criminal justice sub-systems (police, prosecutor's office, judiciary, correctional institutions) in Indonesia do not fully understand what is actually meant by the concept of restorative justice.

Abstract

The mode of Money Laundering Crime (TPPU) that often occurs in Indonesia is by utilizing the role of Notary and PPAT in performing their duties. Notaries and Land Deed Officials ("PPAT") become co-suspects in criminal cases, because they are suspected of assisting in the implementation of money laundering crimes, or other criminal acts involving deeds made. The research method used in writing this article is normative juridical research with a research approach using statutory regulations and using a theoretical or conceptual approach. The results of the analysis of the Notary and PPAT in carrying out their duties to anticipate money laundering apply the principle of Recognizing Service Users, if the Notary or PPAT finds suspicious transactions, they can report it to the Financial Transaction Reporting and Analysis Center (PPATK). In addition, Notary and PPAT are not responsible for the criminal act of money laundering committed by the parties or their clients who use the services of Notary or PPAT who require their services based on their authority. The position of the Notary and PPAT in exercising their authority to make authentic deeds is only as a recorder that is poured into a deed that gives rise to legal acts and has perfect evidentiary power. Notaries and PPAT are only obliged to report to PPATK if there are indications of money laundering committed by the parties or their clients through their services as Notaries or PPAT.

Abstract

Penelitian ini mengkaji akibat hukum peralihan harta warisan tanpa persetujuan ahli waris, sebagaimana tertuang dalam Putusan Penelitian Nomor: 107/Pdt.G/2019/Pn. Tolong. Didalami juga tanggung jawab Pejabat Pembuat Akta Tanah (PPAT) dalam tata cara ini, dan sistem pewarisan di Indonesia yang dituangkan dalam Pasal 111 Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 16 Tahun 2021. Penelitian ini bertujuan untuk mengkaji akibat hukum peralihan harta warisan tanpa persetujuan ahli waris, serta kewajiban PPAT (pejabat yang berwenang melakukan peralihan harta) sehubungan dengan akta yang dibuat, dan sistem pewarisan yang berlaku. Penelitian ini diharapkan menambah wawasan mengenai akibat hukum dan tanggung jawab PPAT, serta memberikan pemahaman mengenai sistem pewarisan di Indonesia. Metode yang digunakan adalah yuridis normatif dengan pendekatan deskriptif, mengandalkan bahan hukum sekunder melalui studi kepustakaan dan wawancara. Kesimpulan menunjukkan bahwa pengalihan warisan tanpa persetujuan semua ahli waris adalah tidak sah dan dapat dibatalkan oleh pengadilan, dengan PPAT memiliki tanggung jawab besar untuk memastikan legalitas proses peralihan hak. Saran diberikan agar semua pihak memastikan kepatuhan terhadap prosedur hukum untuk melindungi hak ahli waris dan mencegah sengketa hukum.

Abstract

By issuing it and displaying regulations related to the concept of balanced housing, the criteria for implementing balanced development have also changed. The publication of the Perppu Ciptaker and its derivative regulations, namely PP No. 12 of 2021 relating to implementation and residential areas, provides another alternative for developers who cannot construct simple houses or flats with conversions in the form of funds for the construction of public houses. The research method to be used is the normative juridical qualitative method. A new alternative for developers is regulated through Perppu Ciptaker, namely, payment of conversion funds for the construction of public houses. Housing with balanced housing is built utilizing conversion funds as an alternative to the requirement to build subsidized simple housing. These funds can be managed or come in the form of grants from development actors. A fee is assessed to the Agency for the Acceleration of Housing Implementation (AHIC) for the conversion (BP3). To speed up the delivery of inexpensive public housing for working class individuals, the federal government established BP3. Land is provided, simple houses and public flats are built, infrastructure, services, and public utilities are developed, and housing is managed and invested using the money BP3 receives

Abstract

Exchange agreements for immovable objects are still carried out in the community, especially in exchange agreements for land and building objects. This article discusses the lack of detailed regulation on the imposition of income tax for the exchange of immovable objects, such as land and buildings, in Indonesia. It explains the importance of taxes as a source of revenue for the government and explores the differences between central and local taxes, as well as how taxes are closely related to legal relations in civil law. This research uses normative legal research methods. The results show that the legal relationship outlined in an agreement called exchange is equated with buying and selling which is subject to income tax. The exchange that is carried out and equated to buying and selling from the understanding of the object of income tax is not appropriate. This incompatibility is because the exchange is essentially carried out not to obtain profit. This article concludes by highlighting the need for more detailed regulations on the imposition of income tax for the exchange of immovable objects, as it cannot be equated with a sale and purchase transaction.

Abstract

Background: Interfaith marriages occur in Indonesia, one of which is in the city of Surabaya. Once the marriage is valid, it must be reported to the Civil Registry Occupation Service and issue an Ottentic Deed. Authentic Deeds that are considered official must comply with the provisions of Article 1868 of the Civil Code. What is meant by official in this article is a notary. This is regulated in Article 1 Article 15 paragraph 1 of UUJN. The Notary Department plays an important role in the ratification of Marriage Certificates both of the same religion and different religions in Indonesia. Aim: The author's purpose in creating this journal is to find out how interfaith marriage relations in Indonesia with the civil law of interfaith marriage and the hierarchy of laws and regulations related to interfaith marriage. Method: The research method that researchers use is juridical normative with qualitative research. Findings: The result of this study is that the Interfaith Marriage Agreement in Indonesia based on Law No. Article 16 of 2019 concerning Marriage clarifies the role of religion in marriage and the confirmation of faith, stating that a valid marriage is a marriage carried out according to the laws of each religion and its adherents. The state leaves the assessment of the validity of marriage to the religion and beliefs of the people concerned.  Thus, Law Number 16 of 2019 concerning Marriage is a standard that regulates not prohibits. The state does not prohibit individuals from interfaith marriages.

Abstract

Background: In order for a law to evolve, a comparative law is needed, one of which is in Notary Law. Each country has a lot of differences and of course there is a similarity in terms of Positions, Function and Regulation on how to be appointed as a Notary Public. Aim: This study examines the advantages and disadvantages by examining the similarities and differences in Terms, Functions and Position of a Notary between Act Number 2 of 2014 concerning amendments to Act Number 30 of 2004 concerning Notary Positions and the Singapore’s Notaries Public Act 1959. Method: The research method that was used in this research is normative legal research methods that focus on research in legislation, written regulations, and comparative law research. Findings: In Indonesia, notary has more functions and powers compare to Notary in Singapore. To become a Notary, a Notary must have a bachelor degree in law, a Master degree in Notary Education and Undergoes an internship or worked 24 months in a row at notary's office. Meanwhile in Singapore, Notary public is not a legal professional.

Abstract

Perjanjian kerja sama dagang menjadi instrumen penting dalam mendukung kegiatan ekonomi, namun tidak jarang terjadi pelanggaran kontrak berupa wanprestasi yang berdampak pada terganggunya hubungan hukum antarpihak. Sanksi terhadap wanprestasi menjadi krusial guna memberikan efek jera dan menjamin kepastian hukum dalam dunia usaha. Penelitian ini bertujuan untuk menganalisis penerapan sanksi wanprestasi dalam perjanjian kerja sama dagang berdasarkan ketentuan Kitab Undang-Undang Hukum Perdata. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan peraturan perundang-undangan dan studi putusan pengadilan. Hasil kajian menunjukkan bahwa ketentuan Pasal 1238–1267 KUHPerdata telah memberikan kerangka hukum mengenai jenis dan mekanisme penjatuhan sanksi atas wanprestasi. Dalam praktiknya, efektivitas penerapan sanksi masih menghadapi berbagai kendala, antara lain redaksi kontrak yang ambigu, kesulitan pembuktian, serta lemahnya penegakan hukum. Selain itu, tumpang tindih kewenangan antar-lembaga penegak hukum turut memperumit penyelesaian sengketa. Meskipun alternatif penyelesaian seperti mediasi dan arbitrase kian berkembang, kualitas perjanjian awal tetap menjadi penentu utama efektivitas penegakan hak. Penelitian ini menyimpulkan bahwa perlindungan hukum terhadap pihak yang dirugikan akibat wanprestasi membutuhkan reformasi regulasi, peningkatan kompetensi aparat, dan standardisasi klausul kontrak secara menyeluruh.

Abstract

Zaman sekarang terjadi perubahan sistem alat pembayaran dari konvensional ke digital. Saat ini orang banyak dipengaruhi oleh kemajuan teknologi, inovasi yang terus meningkat telah menyebabkan banyak kemudahan, dan sekarang sistem pembayaran telah berubah gaya. Gaya hidup Cashless Society semakin banyak di masyarakat Indonesia, khususnya generasi milenial. Dalam hal menggunakan uang elektronik, setiap orang harus terlebih dahulu menyatakan persetujuannya untuk tunduk dan terikat pada syarat dan ketentuan yang terkandung dalam perjanjian baku. Perjanjian baku yang dibuat secara sepihak oleh pelaku usaha biasanya mengandung klausula yang menguntungkan pihak-pihak pelaku usaha. Negara Indonesia merupakan negara berlandaskan hukum yang memiliki peraturan perundang-undangan yang melindungi masyarakatnya sebagai konsumen dari pelaku usaha yang curang. Salah satu undang-undang yang dimaksudkan adalah Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK). Dengan adanya UUPK dapat memberi tahu masyarakat Indonesia tentang hak dan kewajibannya sebagai konsumen atas pelaku usaha barang dan/atau jasa. Dengan mengetahui hak dan kewajiban tersebut, masyarakat Indonesia diharapkan dapat melindungi dirinya sendiri sebagai konsumen.
