Abstract

Dalam era transformasi industri 4.0 yang kini berkembang menjadi Society 5.0, profesi notaris telah mengalami banyak perubahan signifikan yang dipengaruhi oleh kemajuan teknologi. Salah satu wujud dari perkembangan tersebut adalah munculnya konsep cyber notary. Sebagai fenomena baru, cyber notary menarik perhatian untuk dibahas lebih lanjut, mulai dari proses perkembangan dan kemunculannya, hingga potensi manfaat, tantangan dalam penerapannya, serta risiko yang mungkin dihadapi. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan studi literatur yang melibatkan bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa, hingga saat ini, Indonesia belum memiliki regulasi yang secara khusus mengatur penerapan cyber notary ataupun aplikasi yang mendukungnya. Meskipun demikian, Pasal 15 ayat (3) Undang-Undang Jabatan Notaris memberikan "kewenangan lain" yang dapat menjadi dasar hukum bagi implementasi profesi cyber notary. Cyber notary memungkinkan proses pembuatan akta dan dokumen hukum dilakukan secara online, memanfaatkan teknologi digital untuk meningkatkan efisiensi dan aksesibilitas layanan notaris. Namun, penerapan cyber notary juga menghadirkan tantangan besar, terutama terkait serangan siber yang dapat mengancam keamanan data dan integritas dokumen yang dikeluarkan. Risiko lain yang timbul adalah penggunaan artificial intelligence, yang meskipun dapat meningkatkan produktivitas, juga menimbulkan kekhawatiran akan keamanan data dan potensi penyalahgunaan. Oleh karena itu, diperlukan adanya mekanisme perlindungan dan strategi penanggulangan lanjutan untuk memastikan keamanan para pemangku kepentingan yang terlibat dalam proses penandatanganan akta notariil secara elektronik.

Abstract

This study examines the authority and legal liability of Notaries in drafting the Sale and Purchase Binding Agreement (PPJB) for land and its implications for legal certainty and the protection of the parties involved. The main issue addressed is the inaccurate understanding of a Notary’s authority in practice (dassein), which is often equated with that of the Land Deed Official (PPAT), whereas normatively (dassolen) both have distinct boundaries as stipulated in the Law on Notary Positions and regulations on land rights transfer. The purpose of this research is to analyze the scope of a Notary’s authority, the forms of legal responsibility, and their contribution to ensuring legal certainty in land sale and purchase transactions. The research employs a normative juridical method with a statutory and conceptual approach through an examination of doctrines, legislation, and relevant court decisions. The results show that Notaries are authorized to prepare PPJBs as authentic deeds that provide perfect evidentiary value and secure the principal agreement between the seller and the buyer. However, the authority to transfer ownership rights remains with the PPAT through the Sale and Purchase Deed (AJB). A Notary’s legal liability covers civil, criminal, and administrative aspects, playing an essential role in preventive and repressive legal protection to ensure legal certainty in land transactions.

Abstract

Ownership and the transfer of freehold land to heirs who are foreign nationals constitute a critical issue in Indonesian agrarian law, as they intersect with the principle of nationality, limitations on property rights, and the pluralism of inheritance law. This study aims to provide a comprehensive examination of the normative foundations of the Basic Agrarian Law (UUPA), the regulation of ownership rights, and the mechanisms for transferring or converting the status of inherited land received by foreign national heirs. The research employs a normative legal method using statutory, conceptual, and comparative approaches to analyze relevant legal regulations and doctrines. The findings show that foreign national heirs may inherit freehold land but are required to transfer it within one year through sale, donation, APHW/APHB, or by converting the land status to a right of use. The study concludes that the Indonesian legal framework offers legal certainty while safeguarding national interests, although its implementation still requires strengthening through public outreach and improved administrative mechanisms.

Kasus mafia tanah seringkali menjadi tantangan serius dalam sistem pertanahan di Indonesia, mengganggu keadilan agraria serta merugikan konsumen tanah. Penelitian ini menganalisis peran mafia tanah dalam konflik agraria yang melibatkan Notaris dan PPAT. Dalam penelitian ini, penulis menganalisis dampak sosial, ekonomi, dan politik yang ditimbulkan oleh mafia tanah serta langkah-langkah yang telah diambil oleh pemerintah untuk mengatasi masalah ini. Abstract

General Background: Interfaith marriage in Indonesia remains a complex legal issue due to the intertwining of religious norms and state administrative authority. Specific Background: The Constitutional Court Decision No. 24/PUU-XX/2022 and Supreme Court Circular No. 2/2023 further restrict court-granted registration of interfaith marriages by reaffirming the primacy of religious validity. Knowledge Gap: Despite extensive debate, limited research analyzes the combined legal, administrative, and human rights implications arising from both instruments. Aims: This study examines the legal consequences of the Court’s decision and the Circular, focusing on their impact on legal certainty, constitutional rights, and the status of interfaith families. Results: Using a normative juridical approach, the findings show that delegating substantive validity to religion and limiting administrative registration creates legal uncertainty, a regulatory vacuum, and discriminatory outcomes affecting marital status, children’s rights, inheritance, and civil documentation. Novelty: This research offers an integrated assessment of constitutional, administrative, and human rights dimensions, highlighting normative dissonance between constitutional guarantees and religion-based administrative practices. Implications: The study underscores the need for regulatory harmonization and proposes exploring civil marriage mechanisms to ensure legal certainty, equality before the law, and protection of fundamental rights within Indonesia’s pluralistic society. Abstract

General Background: The development of the new capital city, Ibu Kota Nusantara (IKN), as a National Strategic Project requires large-scale land acquisition, including areas traditionally occupied by Indigenous communities. Specific Background: Although legal frameworks such as the Basic Agrarian Law, the IKN Law, and Presidential Regulation No. 65/2022 formally acknowledge Indigenous land rights, their implementation remains inconsistent. Knowledge Gap: There is still no clear mechanism for verifying customary (ulayat) rights, determining culturally appropriate compensation, or ensuring meaningful participation of Indigenous communities in land acquisition processes. Aims: This study aims to examine the effectiveness of the existing legal framework governing land acquisition for IKN and assess the extent of protection afforded to Indigenous peoples. Results: The findings show that despite normative recognition of Indigenous rights, practical implementation faces barriers, including unclear procedures, limited community involvement, and compensation that fails to reflect the social, cultural, and spiritual value of customary land. Novelty: This research highlights the urgent need for specific legal instruments regulating the recognition and protection of ulayat rights within national strategic projects—an aspect largely absent in current regulations. Implications: Strengthening regulations, establishing holistic compensation standards, and ensuring inclusive participation and dispute-resolution mechanisms are essential to achieving a fair and sustainable land acquisition process for Indigenous communities affected by the IKN project. Highlights: The legal framework recognizes Indigenous land rights, but implementation remains inconsistent. Customary land holds cultural and spiritual value that is not reflected in current compensation models. Abstract

This study examines the legal status of duplicate land certificates for the same parcel and the mechanisms available for resolving such issues within the Indonesian land law system. Employing a normative juridical method with statutory, conceptual, and case-study approaches, the study evaluates the validity of certificate issuance, procedural compliance, and the evidentiary basis used to determine the rightful owner. The findings show that duplicate certificates typically arise from inconsistencies between physical and legal records, procedural irregularities, or unlawful actions during the land registration process. Resolution may be pursued through administrative procedures at the National Land Agency (BPN) or through litigation in administrative, civil, or criminal courts. Administrative procedures enable the correction or annulment of certificates issued with procedural defects, whereas litigation provides legal certainty in disputes over substantive rights or allegations of forgery. The study underscores the need for greater integrity in the certificate issuance process, as well as enhanced coordination and law enforcement to prevent the occurrence of duplicate certificates.

Abstract

Peningkatan jumlah penumpang perempuan di Commuter Line rute Jurangmangu–Tanah Abang tidak diimbangi ketersediaan fasilitas yang memadai, sehingga berpotensi meningkatkan risiko pelecehan dan ketidaknyamanan, terutama pada jam sibuk.Penelitian ini bertujuan menganalisis perlindungan hukum bagi konsumen perempuan berdasarkan regulasi yang berlaku serta mengkaji implementasinya dalam layanan PT KCI. Metode penelitian menggunakan pendekatan yuridis normatif dengan menelaah peraturan perundang-undangan, doktrin, serta bahan hukum sekunder. Hasil penelitian menunjukkan bahwa meskipun secara normatif regulasi telah menjamin hak keamanan, kenyamanan, dan keselamatan bagi penumpang perempuan, pelaksanaannya masih belum optimal, terutama terkait ketersediaan gerbong khusus perempuan dan upaya pencegahan pelecehan. Konsumen perempuan memiliki hak atas keamanan, kenyamanan, dan keselamatan, termasuk gerbong khusus, kompensasi jika dirugikan, serta mekanisme pelaporan dan penanganan keluhan. Di lapangan, hak-hak ini belum terpenuhi karena jumlah gerbong khusus terbatas, pengawasan keamanan lemah, kompensasi minim, dan sistem pelaporan kurang memadai, sehingga perlindungan hukum masih bersifat formal dan belum sepenuhnya memenuhi kebutuhan perempuan.Diskusi menekankan pentingnya inovasi layanan oleh PT Kereta Commuter Indonesia (KCI), seperti penambahan jumlah gerbong khusus perempuan dan peningkatan pengawasan pada jam sibuk, untuk memastikan perlindungan hukum berjalan efektif. Kesimpulan penelitian menegaskan bahwa perlindungan hukum konsumen perempuan membutuhkan kombinasi antara kerangka regulasi yang kuat dan strategi operasional proaktif dari penyedia layanan agar hak-hak perempuan benar-benar terlindungi.

Abstract

This study aims to analyze the implementation of cyber notary in Indonesia in relation to personal data protection, particularly after the enactment of the Personal Data Protection Act (UU PDP). Using a normative legal research method, the study examines primary legal materials such as UU ITE, UU PDP, and UUJN, as well as secondary sources from legal literature and comparative studies between civil law and common law jurisdictions. The findings show that although cyber notary offers efficiency and accessibility through electronic deeds and digital authentication, it also raises serious challenges regarding data privacy, security risks, and regulatory disharmony. Notaries potentially act as both data controllers and processors, requiring clear legal obligations and technological safeguards to prevent misuse or leakage of personal data. The study concludes that the future of cyber notary in Indonesia depends on harmonizing relevant laws, adopting responsive law principles, and reinforcing notaries’ role as guardians of privacy. Furthermore, the integration of regulatory sandbox mechanisms, national technical standards, and joint supervision by state institutions and professional associations is essential to ensure that digitalization in the notarial field aligns with both legal certainty and citizens’ right to privacy.

Abstract

The development of information technology has driven transformation in various aspects of life, including the field of notarial services. The concept of the Cyber Notary has emerged as a solution for efficiency and effectiveness of notarial services with digital technology. However, the implementation of the Cyber Notary in Indonesia still faces several challenges, particularly in ensuring legal certainty in electronic transactions. This study aims to analyze the effectiveness of the Cyber Notary in guaranteeing legal certainty in electronic transactions in Indonesia. The research method used is normative juridical, with statutory and conceptual approaches. The findings indicate that despite the great potential of Cyber Notary implementation, there are still legal voids and regulatory inconsistencies that hinder its application. Legal reform and regulatory harmonization are required, as well as improvements in infrastructure and notary competence in information technology, in order to realize legal certainty in electronic transactions through Cyber Notary.
