Abstract

The nature of law enforcement in resolving multi-dimensional information disputes has a logical consequence on the need for constructive law enforcement. This research aims to examine the forms of law enforcement that exist in resolving disputes over requests for public information and to formulate a constructive mechanism to realize a series of law enforcement procedures with legal certainty. This research is normative legal research using a statutory and conceptual approach. The results showed that law enforcement in the settlement of public information disputes consists of the objection, non-litigation adjudication, and litigation covering civil, state administration, and criminal law. In this case, The Criminal law instruments are placed as the final law enforcement if the relevant public agency does not carry out a decision that has permanent legal force. In addition, in the context of realizing comprehensive and constructive law enforcement, a Memorandum of Understanding was held between the Information Commission and the Police to synergize and effectively implement the criminal law as a final resort.

Abstract

Dalam perkembangannya, dapat dilihat bahwa gugatan pembatalan perjanjian akibat tidak adanya kesepakatan di dalam Syarat pertama Pasal 1320 BW, tidak terbatas hanya di dalam Pasal 1321 BW, seperti kekhilafan, paksaan, dan penipuan, namun dalam perkembangannya lahir alasan baru yaitu penyalahgunaan keadaan (misbruik van omstandigheiden). Namun, dalam praktiknya, menimbulkan pertanyaan terkait dengan dalurasa pengajuan gugatan pembatalan perjanjian akibat adanya penyalahgunaan keadaa. Penelitian ini bertujuan untuk menganalisa eksistensi dalurasa gugatan pembatalan perjanjian akibat adanya penyalahgunaan keadaan. Rumusan masalah dalam penelitian ini adalah, Pertama, penyalahgunaan keadaan sebagai alasan pembatalan perjanjian dan Kedua, dalurasa gugatan pembatalan perjanjian akibat adanya penyalahgunaan keadaan. Penelitian ini adalah penelitian normatif dengan pendekatan peraturan perundnag-undangan dan konseptual. Berdasarkan penelitian ini, ditemukan bahwa Pertama, penyalahgunaan keadaan merupakan alasan baru dalam pembatalan perjanjian yang merupakan cacat kehendak modern, Kedua,  dalurasa gugatan pembatalan perjanjian akibat adanya penyalahgunaan keadaan berdasarkan analogi Pasal 1454 BW adalah lima tahun sejak diketahui adanya penyalahgunaan keadaan dalam membuat perjanjian tersebutKata kunci: Analogi, Daluarsa, Pembatalan Perjanjian, Penyalahgunaan Keadaan

Abstract

This article aims to analyze the position of unpleasant acts as a form of hate speech (haatzaai articlesen), which in fact the concept of unpleasant acts has been eliminated by the Constitutional Court Decision Number 1 / PUU-XI / 2013, The problem is focused on the constitutionality of wrongdoing. fun as a form of hate speech (haatzaai articlesen). In order to approach this problem, a theoretical reference from the element theory of crime and the theory of constitutionality of norms is used. This research is a normative legal research, so that the data is collected through literature studies, both on primary, secondary and tertiary legal materials. This research was analyzed qualitatively. This study concludes that: (1) With the Constitutional Court Decision Number 1 / PUU-XI / 2013 which is legally binding, then every legal norm in statutory regulations made after the Constitutional Court Decision must comply with the provisions with does not bring back the existence of the phrase "unpleasant actions". (2) Chief of Police Circular Number: SE / 6 / X / 2015 is not a statutory regulation (regeling), but a policy regulation (beleidsregel) which juridically results in the lack of authority to create new norms or restore the existence of norms that have been abolished by the Constitutional Court, so the concept of unpleasant acts in such a Chief of Police Circular is unconstitutional.

Abstract

The aim of this legal research is toto analyze the relationship between the head of the foundation who has concurrent positions so that there is the potential to create a conflict of interest. The formulation of the problem in this study is First, namely, how is the chairman of the foundation's arrangement in Indonesia? and Second, namely, how are provisions related to concurrent positions that can cause conflicts of interest to the chair of the foundation in Indonesia? This research is legal research using a statutory and conceptual approach. Based on this research, it was found that there are two models of concurrent positions that have the potential to cause conflicts of interest, namely concurrent positions with internal positions and concurrent positions with external positions. In Indonesia, related to the chairman of the foundation, what is banned is a dual position with an internal position, such as supervisors and supervisors. Associated with the chairman of a foundation who has concurrent positions with an external position, such as being an administrator in a different foundation is not prohibited, but if the concurrent positions cause the foundation's chairman, it harms the foundation, then the chairman of the foundation can be dismissed, and even has the potential to be held personally responsible.

Abstract

Pancasila sebagai dasar filsafat negara (philosopische grondslag) menjadikan Indonesia sebagai negara yang memandang kebebasan beragama dengan prinsip “netral-aktif”. Paradigma ini tertuang dalam Peraturan Bersama Menteri Agama dan Menteri Dalam Negeri No. 9 Tahun 2006 dan No. 8 Tahun 2006 (selanjutnya disingkat PBM No. 9/2006 dan No. 8/2006) yang mengatur terkait perizinan pendirian tempat ibadah. Namun dalam praktiknya, penggunaan syarat materiil dan formil yang sama terhadap seluruh jenis tempat ibadah yang didirikan justru menimbulkan berbagai celah diskriminasi yang pada akhirnya melanggar kebebasan beragama itu sendiri. Penelitian ini adalah penelitian hukum dengan menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian ini menunjukkan bahwa, PBM No. 9/2006 dan No. 8/2006 yang menggunakan landasan filosofi keadilan egaliter karena memberikan kewajiban yang sama untuk memperoleh izin pendirian tempat ibadah pada akhirnya akan selalu menimbulkan celah diskriminasi terhadap umat agama minoritas. Sejatinya, landasan filosofi yang tepat untuk digunakan dalam mengatur perizinan pendirian tempat ibadah di Indonesia adalah keadilan proporsional karena perbedaan dinamika tiap agama hendaknya juga diberikan kewajiban yang berbeda pula.

Abstract

The Constitutional Court as the guardian of the constitution and the guardian of human rights has the duty to ensure that the Law does not contradict the constitution and does not violate human rights. One of the manifestations of this can be seen in the Constitutional Court Decision Number 1 / PUU-X / 2013, where the Constitutional Court removed the element "Some other deeds or unpleasant treatment/act" in Article 335 paragraph (1) of the Criminal Code. With the removal of the core elements of Article 335 paragraph (1) of the Criminal Code, raises questions related to the existence of the offense whether it still exists or not. Based on this, this study will examine 1) Application of Article 335 of the Criminal Code Before the Decision of the Constitutional Court Number 1 / PUU-X / 2013 and 2.) Application of Article 335 of the Criminal Code After the Decision of the Constitutional Court Number 1 / PUU-X / 2013. This research is a normative legal research with a statute approach, conceptual approach, and case approach. Based on this research, it was found that after the Constitutional Court Decision Number 1 / PUU-X / 2013 that offenses of unpleasant acts had been reconstructed into forced offenses.

Abstract

In Article 22E paragraph (1) of the 1945 Constitution of the Republic of Indonesia, it is explained that General Elections (Elections) are held based on the principle of œluberjudil (direct, general, free, confidential, honest and fair). One of the manifestations of this principle is through the final voter list in the implementation of the election. This research is normative research with statute approach and conceptual approach. The issues discussed in this study are 1. Can the validity of the Permanent Voters List be seen as a manifestation of a direct, general, free, confidential, honest and fair election? 2. What are the problems that arise in determining the Permanent Voters List? 3. How is the guarantee of political rights for citizens due to problems that arise in the determination of the Permanent Voters List? Based on this research, it was found that the validity of the Permanent Voters List was part of the realization of the election system which was direct, general, free, confidential, honest and fair. This research also describes the problems in determining the Permanent Voters List and the mechanism for protecting the political rights of citizens in the event of problems in the final voter list

Abstract

Good faith is a principle embodied under Article 1338 Paragraph (3) of the Indonesian Civil Code, which is required in every stage of a contract, including in a land sale and purchase contract. Under several decisions of the Supreme Court, good faith is considered to exist, for instance, when a buyer purchased a land through the auction of the State Receivables Affairs Committee (PUPN). Nevertheless, based on a conviction in the judicial practices, this article believes that purchases through official auctions are not necessarily the indicators for the existence of good faith principle in a land sale and purchase contract. Therefore, this study is focused on the concept of good faith buyer with a land object as well as the characteristic of auction winner as a good faith buyer protected by law. In conclusion, parties of a land sale and purchase contract through auction can be considered to have performed in good faith when they have fulfilled the criteria under Supreme Court Circular Letter and other criteria such as purchasing through state auction office in accordance with the applicable laws and regulations, purchasing in a reasonable price, and the auction winner is not the creditor himself who purchases at a price far below the collateral limit price.

Abstract

Salah satu bentuk kegiatan yang dilakukan pemerintah untuk mengelola uang negara adalah dengan melakukan pinjaman kepada BUMN. Hal ini dilakukan untuk melaksanakan kegiatan pembangunan nasional terutama percepatan pembangunan infrastruktur. Meskipun pinjaman tersebut untuk kegiatan BUMN, namun tetap harus sesuai dengan prinsip good governance. Perlu ada upaya pemerintah untuk meminimalisir risiko gagal bayar yang muncul dalam pemberian pinjaman kepada BUMN. Berdasarkan latar belakang tersebut, rumusan masalah dalam penelitian ini adalah 1) Apa upaya preventif terhadap risiko gagal bayar dalam pemberian pinjaman kepada BUMN? 2) Apa upaya represif terhadap risiko gagal bayar dalam pemberian pinjaman kepada BUMN? Penelitian ini adalah penelitian hukum. Pendekatan yang digunakan adalah pendekatan perundang-undangan dan pendekatan konseptual. Berdasarkan penelitian ini, ditemukan bahwa 1) Upaya preventif yang dapat dilakukan oleh pemerintah berupa penerapan sikap kehati-hatian dalam setiap tahap pelaksanaan pemberian pinjaman serta adanya penilaian, pengawasan, serta evaluasi terhadap pelaksanaan pemberian pinjaman kepada BUMN dan 2) Upaya represif yang dapat dilakukan berupa pengenaan denda administrasi serta penerapan sanksi pidana.

Abstract

Korupsi yang merupakan masalah global telah menyebabkan tingginya kerugian keuangan dan perekonomian negara di Indonesia. United Nation Convention Against Corruption telah mencanangkan rekomendasi kepada negara-negara untuk membuat pengaturan mengenai Non-Conviction Based Asset Forfeiture sebagai upaya untuk mengembalikan kerugian negara secara maksimal. Kerugian negara yang telah kembali saat ini masih tidak sebanding dengan kerugian negara yang secara nyata ada akibat korupsi. Urgensi ini lah yang menghadirkan konsep perlunya pengaturan mengenai Non-Conviction Based Asset Forfeiture di Indonesia. Penelitian yang digunakan bersifat yuridis normatif dengan pendekatan peraturan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Peraturan perundang-undangan di Indonesia sejatinya telah mengadopsi konsep Non-Conviction Based Asset Forfeiture, namun tidak memenuhi secara maksimal dasar filosofis adanya konsep tersebut, yaitu mengembalikan kerugian negara akibat korupsi secara maksimal dan cepat dengan mekanisme peradilan perdata. Sehingga, undang-undang yang mengatur mengenai perampasan aset perlu dibuat tersendiri dan diundangkan untuk mengakomodasi upaya pengembalian kerugian negara akibat korupsi secara maksimal.
