Abstract

Dalam rangka meningkatakan kesejahteraan di desa-desa, Undang-Undang Nomor 6 Tahun 2014 tentang Desa memberikan sebuah instrument bagi Desa untuk melakukan kegiatan usaha melalui Badan Usaha Milik Desa. Penelitian ini bertujuan untuk mengenalkan Badan Usaha Milik Desa kepada masyrakat di Desa Sumberanyar, Kecamatan Nguling, Kabupaten Pasuruan dalam rangka meiningkatkan kesejahteraan di desa tersebut. Penelitian di awali dengan Assesement Masalah dan Kebutuhan Desa, Focus Group Discussion, dan diakhiri dengan Legalitas BUMDes. Dari penelitian ini menunjukan, bahwa masyrakat di Desa Sumberanyar, Kecamatan Nguling, Kabupaten Pasuruan memiliki antusiasme yang tinggi terhadap pembentukan Badan Usaha Milik Desa di desa tersebut dan berharap kedepannya terdapat pelatihan-pelatihan terkait dengan pengurusan Badan Usaha Milik Desa tersebut agar pengurus-pengurus yang ada dapat menjalankan fungsi dan tugasnya dengan baik

Abstract

AbstractThis study aims to firstly analyze clerical errors in court decisions that have permanent legal force and secondly analyze related legal remedies for clerical errors in court decisions that have permanent legal force. This research is a doctrinal research with a statute approach, a conceptual approach, and a case approach. The results of this study are that first, a clerical error in a court decision that has permanent legal force is an error that is minor in nature or in the form of an accident and is not related to the substance of the judge’s legal considerations and this error can be corrected by the court, even after the judge makes a decision. . Second, legal remedies that can be filed against typos in decisions that have legal force consist of various kinds, but generally the right one is through an application. It is based on nature, complexity, time, cost, and evidentiary.Keywords: Clerical Eror; Non-Executable Judgement; Legal Action. AbstrakPenelitian ini bertujuan untuk pertama menganalisis kekeliruan pengetikan (clerical eror) dalam putusan pengadilan yang berkekuatan hukum tetap dan kedua menganalisis terkait permohonan terhadap adanya kekeliruan pengetikan (clerical eror) dalam putusan pengadilan yang berkekuatan hukum tetap. Penelitian ini adalah penelitian hukum (doctrinal research) dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach). Adapun hasil dari penelitian ini adalah pertama kekeliruan pengetikan (clerical eror) pada putusan pengadilan yang berkekuatan hukum tetap adalah kesalahan yang sifatnya ringan atau berbentuk ketidaksengajaan dan tidak berkaitan dengan substansi pertimbangan hukum hakim dan kesalahan ini dapat diperbaiki oleh pengadilan, meskipun setelah hakim menjatuhkan putusan. Kedua, exit plan yang dapat diajukan terhadap adanya kekeliruan pengetikan pada putusan yang berkekuatan hukum terdiri dari beraneka ragam, namun umumnya yang tepat adalah melalui permohonan. Hal ini didasarkan pada hakikat, kompleksitas, waktu, biaya, dan pembuktian. Kata Kunci: Clerical Eror; Putusan Non-Executable; Exit Plan.

Abstract

Article 171 section c the Compilation of Islamic Law which was ratified through the Presidential Instruction of the Republic of Indonesia Number 1 of 1991 stressed that one of the conditions for heirs in Islamic inheritance law is Mulsim. In its development, the requirement of the Islamic religious obligation is deemed not to provide justice, this can be seen from the many complaints filed by the community to the court. Based on this background, the formulation of the problem in this study is Firstly position of Non-Muslim Inheritance of Islamic Inheritance Inheritance according to positive law in Indonesia Secondly, to find out the position of Non-Muslim Inheritance Against Islamic Inheritance Inheritance from various court decisions in Indonesia. This research is a juridical research, with a statutory, conceptual, and case approach. The results of this study indicate, that First, according to positive law in Indonesia, Non-Muslim Heirs are not entitled to Islamic Inheritance. Secondly, in its development, to fulfill the sense of justice in the community, the judge in Indonesia, decided that the Non-Muslim heirs, although not entitled to become heirs, were still entitled to the inheritance of the Islamic heirs through the obligatory wills. This can be seen from the various court decisions that exist, such as Supreme Court Decision Number 368 K/AG/1995, Supreme Court Decision Number 51 K/AG/1999, Supreme Court Decision Number 16 K/AG/2010, and Supreme Court Decision No. 331 K/Ag/2018

Abstract

Registration of copyright patent or registration is a letter approved and issued by the Ministry of Law and Human Rights for copyright. To protect the rights to indigenous land, the Moi tribal community has registered 2 (two) registrations that have been issued by the Ministry of Law and Human Rights, including 1) Registration of copyright with types of creation: Database and title of work: Results of the Open and Close Tribe Meeting with the head of the Tribe Council of Malamoi Sorong and Indigenous Peoples of the Moi Tribe on the Status of Indigenous Land Ownership in the Sorong City Government Area on behalf of the Malibela Klawalu clan, the Kalagison Milo clan, the Mubalus clan, the Kalawaisa clan, the Bawela Mubalus clan, the Osok Malaimsimsa clan. , Marga Kalami Klaglas Klaglas On 10 April 2013. 2). Letter of Registration of copyright with the type of copyrights: Map of the 7 Boundary of the Moi Indigenous Land Owners in the Sorong City Area. Based on the document, the Moi tribal community used it as a basis to claim the lands in the Sorong City government territory were the indigenous land belonging to the Moi tribe. This study uses a statutory and conceptual approach. The results of this study are that the registration document does not have legal force as evidence to prove ownership of indigenous land rights. A letter of registration remains important if there are legal issues with copyright in the future. The document can be used as initial evidence to determine who has the rights to the subject or the copyright holder or ones who is more entitled to the subject.

Abstract

From Article 45A paragraph (1) jo. Paragraph (2) of Law 5/2004, it can be understood that a state administrative case whose object of lawsuit is a decision of a regional official whose decision range is valid in the region concerned cannot be filed for cassation, but things that are not regulated are related about request civil. Based on the background above, it can be understood that the formulation of the problem in this article are: 1) Limitation of legal remedies against state administrative cases where the object of the lawsuit is a regional official's decision whose range of decisions applies to regional areas; and 2) Legal remedies to review state administrative cases where the object of the lawsuit is a decision by a regional official whose decision range is valid in a regional area. This research is legal research with statute approach and conceptual approach. Abstract

One of the things that can make it easier for consumers to be able to distinguish products from one another is the presence of a brand that is a marker of the existence of a product. In this case the Law No. 15 of 2001 concerning brands, precisely in Article 1 describes the definition of the brand itself as a sign in the form of images, names, words, letters, numbers, color arrangements, or a combination of these elements which has a distinguishing power and is used in trade or service activities. As time goes on and the development of technology increases, new concepts are called non-traditional marks or non-traditional brands. These non-traditional brands are further divided into two types, namely non-traditional visual brands (including three-dimensional brands, colors, holograms, slogans, film and book titles, multimedia signs, positions, and gesture) and non-visual non-traditional brands (including sounds, aroma, taste, and texture). Speaking about the Three Dimensional Brands in Indonesia, it turns out that there is no clear concept regarding the Three-Dimensional Brand itself even though in Law No. 20 of 2016 replaced the 2001 Trademark Law has provided protection for Three-Dimensional Brands as well as through the Law Minister Regulation and Ham (Pemenkuham) No. 67 of 2016 that Three-dimensional Brands can be registered. From this, the question arises, "Does the existence of the Three Dimennsi Brand have the potential to overlap with other types of intellectual property rights?" Abstract

This article aims to answer what is the scope of pretrial in statutory regulations and whether expiration can be used as an excuse to file a pretrial lawsuit. By using legal research methods through statutory, conceptual, and case-based approaches, this article concludes that the absence of a clear categorization regarding the formal and material aspects of the expiration case creates a dilemma. In its development, expiration has begun to be recognized as a formal reason which incidentally does not touch the subject matter of the case, an thus can be used as a pretrial excuse. This can be seen in the Pre-trial Decision Number: 143/Pid.Prap/2016/PN.Jkt.Sel. Ultimately, this article suggests the need for a clear regulation in the Perma regarding the categorization of formal and material aspects in pretrial hearings.

Abstract

The Indonesian Trade Secrets Law Number 30/2000 (ITS Law) postulates exemptions for acts that are not considered infringements to protect trade secrets. One of them is the reverse engineering of other people’s trade secrets. The problem is that the ITS Law does not limit the extent to which reverse engineering can be justified. The absence of these limitations also allows attempts to disclose trade secrets under the pretext of reverse engineering. This problem ultimately results in the absence of legal certainty for the protection against trade secret disclosure, which is the sole responsibility of the trade secret owner. This article aims to re-analyze the protection provided by the ITS Law and examine the extent to which the limitations on reverse engineering can be justified in the ITS Law. This article used normative juridical research methods combined with statutory, conceptual, and case approaches. It revealed a paradox in the protection of trade secrets against the possibility of trade secret disclosure. This article concluded that changes are necessary to the ITS Law, specifically by adjusting to the basic principles of IPR protection, limiting the extent to which the reverse engineering of other people’s trade secrets can be justified, and adding a “Good Faith” clause in performing reverse engineering actions.

Abstract

In the futuristic era, transportation is one of the essential necessities for society. The dynamism of urban and rural life makes all groups of people need adequate and usable accommodation in general. However, land transportation infrastructure in Indonesia is not maximally available so it requires a lot of development. The construction of transportation infrastructure requires enormous costs, so the solution that can be used is to use a financing scheme. One of the simpler financing schemes is direct lending. The purpose of this research are to explain two main topics. First, is to analyze the legal relation of the parties in providing direct lending to finance transportation infrastructure. Second, is to determine the legal remedies that the government can take when the borrowers default on lending to finance transportation infrastructure. The type of research used is doctrinal legal research so as to produce a clear and detailed legal analysis regarding direct lending to finance land transportation infrastructure. When a borrower, who has been bound in an agreement with a lender, breach of contract, the borrower can be subject to two options of legal remedies.

Abstract

The development and industrialization of the new capital city "Nusantara" which aims to realize equitable development, has an impact on reducing forest and marine sustainability, related to environmental rights and rights to the environment as mandated in Article 28H of The 1945 Constitution. In addition, this development also threatens national defense because the archipelago is adjacent to international borders, thus triggering territorial disputes between countries. The research uses normative legal research methods with the statute and conceptual approach. This research purposed to analyze the preservation of forests and seas, security, and defense as a result of the development and industrialization of the new capital city "Nusantara" based on the Sustainable Development Goals (SDGs). The result showed that implementing the development and automation of the new capital city "Nusantara" must pay attention to the values of Pancasila and the 1945 Constitution. In addition, the management and conservation of forests and seas need to refer to the 15th SDGs goal and the 16th SDG related to defense. and national security.
