Abstract

The existence of a lawsuit for unlawful acts by the authorities (onrechtmatige overheidsdaad) is one of the means of providing legal protection for the citizens from actions (handling) carried out by the government. Over time, the concept of onrechtmatige overheidsdaad has develops dynamically. The change in the concept of the State Administrative Decree in Article 87 of Law Number 30 of 2014 concerning Government Administration has caused an onrechtmatige overheidsdaad lawsuit which was once the absolute competence of the District Court, and now became the absolute competence of the State Administrative Court. This research attempts to explain the changes in the regulation and changes in the concept of onrechtmatige overheidsdaad after the enactment of Law Number 30 of 2014. The transfer of authority to examine onrechtmatige overheidsdaad lawsuit from the general court to the state administrative court has various juridical consequences, ranging from changes in procedural law, petitum and posita. One of the important consequences is a change related to the implementation or execution of the judicial decision, where in the past, when an onrechtmatige overheidsdaad lawsuit was an absolute competence of a district court, the implementation of the decision depended on the good will of the government. However, after becoming absolute competence of the Administrative Court, there is a mechanism of forced efforts so that the decision can be carried out by the relevant government agencies (defendants).AbstrakKeberadaan gugatan perbuatan melanggar hukum oleh penguasa (onrechtmatige overheidsdaad) merupakan salah satu sarana pelindungan hukum masyarakat atas tindakan (handeling) yang dilakukan oleh pemerintah. Adapun konsep mengenai onrechtmatige overheidsdaad berkembang secara dinamis dari waktu ke waktu. Perubahan konsep Keputusan Tata Usaha Negara (KTUN) di dalam Pasal 87 Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan, menyebabkan gugatan onrechtmatige overheidsdaad yang dahulu merupakan kompetensi absolut Pengadilan Negeri, berubah menjadi kompetensi absolut Pengadilan Tata Usaha Negara. Penelitian ini berusaha memaparkan mengenai perubahan pengaturan dan perubahan konsep onrechtmatige overheidsdaad pasca berlakunya Undang-Undang Nomor 30 Tahun 2014. Beralihnya kewenangan untuk memeriksa gugatan onrechtmatige overheidsdaad dari lingkungan peradilan umum ke peradilan tata usaha negara memiliki berbagai konsekuensi yuridis, mulai dari perubahan hukum acara, petitum, dan posita. Salah satu konsekuensi yang cukup penting adalah perubahan terkait dengan pelaksanaan putusan atau eksekusi. Dahulu, gugatan onrechtmatige overheidsdaad merupakan kompetensi absolut pengadilan negeri, sehingga pelaksanaan putusan tergantung dari itikad baik (good will) dari pemerintah. Pasca-beralih ke kompetensi absolut PTUN, terdapat mekanisme upaya paksa agar putusan tersebut dapat dijalankan oleh instransi pemerintah terkait (tergugat).

Abstract

The authority of the Constitutional Court in the current regulations in Indonesia still does not fully protect the constitutional rights of the citizens. This is reflected by seeing that the examination that were accommodated only covered the abstract review (there were no concrete cases in the court). This condition causes the absence of legal remedies to resolve the issue of constitutionality of legal norms in the court (concrete review), even though often the issue of constitutionality of laws is precisely found in court proceedings. This research is a dogmatic legal research. The primary legal material usedis the Law of the Constitutional Court, whilst the secondary legal material consists of books, journals, and other relevant sourcesrelated to the issues discussed in this research. Based on this research, it was found that it is necessary to raise a constitutional question so that the Acts that are being examined can be annuled by the Constitutional Court and articles that are considered in contrary to the constitution cannot be used as a basis by the judge to decide related cases that being examined concretely. AbstrakWewenang Mahkamah Konstitusi yang ada dalam peraturan perundang-undangan di Indonesia saat ini masih belum melindungi hak-hak konstitusional warga negara secara penuh. Hal ini tercermin dari pengujian yang diakomodasi hanyalah melingkupi abstract review (belum adanya kasus konkrit di pengadilan). Kondisi ini menyebabkan tidak adanya upaya hukum menyelesaikan persoalan konstitusionalitas norma hukum di pengadilan (concrete review), padahal sering kali persoalan konstitusionalitas undang-undang justru ditemukan dari proses di pengadilan. Penelitian ini merupakan penelitian hukum dogmatik. Bahan hukum primer yang digunakan yaitu Undang-Undang Mahkamah Konstitusi, sedangkan bahan hukum sekunder terdiri dari buku, jurnal, dan sumber lain yang relevan dengan masalah yang dibahas dalam penelitian ini. Berdasarkan penelitian ini, ditemukan bahwa perlu diterapkannya constitutional question supaya undang-undang yang diujikan dapat dibatalkan oleh Mahkamah Konstitusi dan pasal yang dinilai bertentangan dengan konstitusi tersebut tidak dapat dijadikan dasar oleh hakim untuk memutus terkait kasus yang diujikan secara konkrit.

Abstract

This legal research aims to determine the consequences of criminal law and civil law consequences for buyers who purchase motorized vehicles without complete and valid documents. This legal research is a normative juridical research. The nature of this legal research is an analytical description to describe an ongoing situation or situation as data for the object of research so that it can explore ideal things which can then be analyzed based on legal theory or applicable laws and regulations. Based on the results of research and discussion, the consequences of criminal law against buyers who purchase motorized vehicles without complete and valid documents are that Article 480 paragraph (1) of the Criminal Code on criminal acts of detention must be fulfilled with subjective and objective elements  Furthermore, the effect of civil law on buyers who purchase motorized vehicles without complete and valid documents is that it is possible for the owner of the motor vehicle to file a lawsuit against the law based on Article 1365 of the Civil Code.

Abstract

Abstrak: Di Kota Surabaya, dalam rangka untuk memudahkan mobilisasi terdapat kebijakan terkait dengan kendaraan bermotor umum, yaitu Suroboyo Bus. Sistem sistem pembayaran yang digunakan adalah denganmenggunakan sampah botol plastik dengan tujuan untuk menjaga kebersihan Kota Surabaya.  Dalam praktiknya, ternyata Surboyo Bus ini beroperasi dengan plat nomor berwarna merah, padahal di dalam Peratuan Kepala Kepolisian Negara Republik Indonesia No. 5 Tahun 2012 tentang Registrasi dan Identifikasi Kendaraan Bermotor, dijelaskan bahwa kendaraan dengan plat nomor berwarna merah adalah kendaraan milik pemerintah yang notabene tidak boleh memungut pembayaran. Berdasarkan hal tersebut, maka rumusan masalah dalam penelitian ini adalah: 1) Apakah penggunaan plat nomor berwarna kuning pada Suroboyo Bus telah sesuai dengan ketentuan peraturan perundang-undangan? 2) Bentuk pengelolaan seperti apa yang sesuai dalam mengelola kendaraan bermotor umum Surboyo Bus? Penelitian ini merupakan penelitian normatif, dengan mengaji dan menganalisa peraturan perundang-undangan ataupun bahan hukum lain yang berkaitan dengan pengelolaan Suroboyo Bus di Kota Surabaya. Penelitian ini menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Berdasarkan hasil penelitian ini, ditemukan bahwa 1) Penggunaan plat merah pada kendaraan bermotor umum bertentangan dengan  Pasal 39 Peratuan Kepala Kepolisian Negara Republik Indonesia No. 5 Tahun 2012 tentang Registrasi dan Identifikasi Kendaraan Bermotor, dan 2) Pengelolaan Suroboyo Bus sebaiknya beralih dari Dinas Pemerintah Kota Surabaya ke BUMD, karena Pengelolaan dengan sistem BUMD akan menyebabkan pengelolaan manajemen baik manajemen keuangan maupun manajemen organisasinya akan bersifat lebih luas dan tidak terikat pada APBD Kata Kunci: Suroboyo Bus, BUMD, Plat Nomor Berwarna Kuning, Plat Nomor Berwarna Merah Abstract: In the city of Surabaya, to facilitate mobilization a public means of transportation exists, namely the Suroboyo Bus. The payment system applied for the bus is by using plastic bottle waste to maintain the Sanitation of the city. In practice, it turns out that Surboyo Bus operates with a red plate number, even though in the Indonesian Police Chief Association No. 5 of 2012 concerning Registration and Identification of Transportations, it is explained that vehicles with red plate numbers are government-owned vehicles which in fact should not collect payments.Based on the stated issue, the problem formulations in this study are: 1) Does the use of yellow plates number on the Suroboyo Bus comply with statutory provisions? 2) What forms of management are appropriate in managing Surboyo Buses public transportation? This research is a normative study, by reviewing and analyzing laws and regulations or other legal materials relating to the management of Suroboyo Bus in Surabaya. This research uses the statutory approach and conceptual approach.  Based on the results of this study, it was found that 1) The use of a red plate on public transportation is contrary to Article 39 of the Indonesian Police Chief Regulation No. 5 of 2012 concerning Registration and Identification of Transportations, and 2) Management of Suroboyo Buses should move from the Surabaya City Government Office to become a Province owned business because the management system in province owned business will cause the management of both financial management and organizational management to be broader and not bound to the regional budget.Keywords: Suroboyo Bus, Region owned business, Yellow Plate number, Red Plate Number

Abstract

Abstrak: Indonesia merupakan negara hukum yang demokratis. Salah satu konsekuensi yuridis dianutnya sistem demokratis tersebut adalah adanya pemilihan umum, termasuk dalam hal ini adalah pemilihan anggota legislatif, khususnya DPR dan DPRD. Sebagaimana konstitusi yang mengamanahkan bahwa peserta pemilu untuk memilih anggota DPR dan DPRD adalah partai politik, maka partai politik memiliki peranan yang besar dalam menentukan siapa-sapa saja yang akan mewakili partai dalam kursi parlemen. Salah satu wewenang yang dimiliki oleh partai politik adalah terkait adanya hak recall. Namun, keberadaan hak recall tersebut masih menimbulkan beberapa perdebatan. Berdasarkan hal tersebut, maka rumusan masalah dalam penelitian ini adalah: 1) Bagaimana keberadaan hak recall partai politik dalam konsep negara demokrasi? dan 2) Bagaimana implementasi hak recall partai politik di Indonesia? Penelitian ini dilakukan dengan penelitian normatif, dengan mengaji dan menganalisa peraturan perundang-undangan ataupun bahan hukum lain yang berkaitan dengan hak recall. Penelitian ini menggunakan pendekatan peraturan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Berdasarkan pembahasan konsep hak recall, hak recall ternyata tidak sesuai dengan konsep negara demokrasi. Sekalipun hak recall merupakan kewenangan partai politik, namun hak recall tersebut pada hakikatnya telah mengkhianati konstituen yang telah memberikan legitimasinya terhadap anggota partai politik untuk menjadi wakil di parlemen.Kata Kunci: hak recall, partai politik, pemilu, demokrasi. Abstract: Indonesia is a democratic law state. One of the legal consequences of the democratic system adopted by Indonesia is general elections, including the election of legislators, specifically the DPR and DPRD. As the Indonesia constitution mandates that election participants to elect members of the DPR and DPRD are political parties, then political parties have a large role in determining who will represent the party in the parliament. One of the authorities possessed by political parties is related to recall rights. However, the existence of recall rights is still involves several considerations. Based on this fact, the problems in this study are: 1) How is the existence of the political party recall rights regarding to the concept of a democratic law state? and 2) How is the implementation of recall rights of political parties in Indonesia? This research was conducted by normative research, by reviewing and analyzing statutory regulations or other materials relating to the recall rights. This study uses a statute approach, conceptual approach, and case approach. Based on the result of this study, it found that indeed, the recall rights is incompatible with the concept of a democratic state. Even though the recall rights is the authority of a political party, the recall rights has essentially betrayed the constituents who have given the legitimacy for the political party’s member to become the member of the parliaments. Keywords: recall rights, political party, elections, democracy.

Abstract

In Indonesia, there is a debate regarding the repatriation of former ISIS citizens. One of the main issues is related to the legal protection that will be provided by the state to them, especially their citizenship status. Based on this background, the formulation of the problem in this article is legal protection for Indonesian Ex- ISIS. This article uses a legal research method with a statutory and conceptual approach. Based on the results, it was found that several Indonesian laws and regulations and several international legal instruments expressly recognize the existence of citizenship as a fundamental right for everyone, and no one can arbitrarily revoke or be denied the right to change their citizenship. Sanctions for revocation of one's citizenship status cannot be applied equally to someone whose involvement is only limited to believing in theories, doctrines, or understanding terrorism under the guise of a certain religion. Elimination of citizenship rights by a country is an act that is not taken for granted. The decision-making on the Indonesian Ex- ISIS must still refer to the principle of protecting Human Rights (HAM) and several other international legal instruments.

Abstract— The electronics industry has been a key driver of economic growth and employment in many developing countries, including Indonesia. Abstract

The purpose of this research is to compare the direct election of regional heads by the people and the election of regional heads through the Regional House of Representatives, and the aspects that must be improved, which certainly is not only improvements to political parties. This study uses a normative legal research method, with the statutory approach, conceptual approach, and case approach. Based on the discussion of the weaknesses and strengths of the two regional head election mechanisms that have been carried out in Indonesia, the best regional head election mechanism is still to maintain the direct election mechanism by the people. Elections are the best way to carry out the process of changing positions in government.Keywords: Comparison; Direct-election; People; Penelitian ini bertujuan untuk mengkomparasi antara pemilihan kepala daerah secara langsung oleh rakyat dengan pemilihan kepala daerah melalui DPRD, dan  aspek-aspek yang harus dilakukan perbaikan, yang pasti tidak hanya perbaikan terhadap partai politik saja. Penelitian ini menggunakan metode penelitian hukum  normatif, dengan pendekatan peraturan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Berdasarkan pembahasan atas kekurangan dan kelebihan kedua mekanisme pemilihan kepala daerah yang pernah dilakukan di Indonesia, mekanisme pemilihan kepala daerah yang terbaik adalah masih dengan tetap mempertahankan mekanisme pemilihan secara langsung oleh rakyat. Abstract

The preservation of the stability of world peace became one of the wishes of the entire international community. But these expectations seemed to be a sense of concern in the event of a war between countries using nuclear weapons. International law governs the nuclear weapons of international treaties, one of which is the Treaty on Non-Proliferation of Nuclear Weapons in 1968. In addition to providing a guarantee of a sense of security was formed No First Use Policy to ensure the country owners of nuclear weapons are not the first party to use nuclear weapons in the event of a conflict with other countries. The purpose of this research is to learn about the implementation of No First Use Policy on the use of nuclear weapons by the countries that have them and the international security of the world. The method used in the study is normative juridical is supported by data obtained by library research. Regarding the implementation of the No First Use Policy each country with nuclear weapons has different attitudes about it. Whereas No First Use Policy has had a positive impact on the arrangement of the use of nuclear weapons of the world for security and order.

Abstract

Abstrak: Salah satu bentuk pengaturan untuk mencegah praktik persaingan usaha tidak sehat di Indonesia adalah pengaturan terkait notifikasi penggabungan, peleburan, dan pengambilalihan (3P). Namun, pengaturan di Indonesia dirasa belum cukup efektif, karena noitifkasi yang diwajibkan adalah pasca transaksi 3P, sehingga, Komisi Pengawas Persaingan Usaha tidak dapat mencegah terjadinya persaingan usaha tidak sehat di Indonesia. Artikel ini bertujuan untuk mengkaji terkait penerapan kewajiban notifikasi pratransaksi 3P di Indonesia. Penelitian ini merupakan penelitian menggunakan hukum dogmatik. Jenis bahan hukum primer yang digunakan yaitu Undang-Undang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat, sedangkan bahan hukum sekunder terdiri dari buku, jurnal, dan sumber lain yang relevan dengan masalah yang akan dibahas dalam penelitian ini. Dari hasil penelitian ini ditemukan bahwa kewajiban notifikasi pasca transaksi 3P tidaklah cukup efektif dalam rangka mencegah persaingan usaha tidak sehat di Indonesia, sehingga harus diubah menjadi notifikasi pra transaksi 3P.Kata Kunci: Kewajiban Pra Notifikasi; Peleburan; Pengambilalihan; Penggabungan; Hukum Persaingan Usaha Tidak Sehat;
