Abstract

This doctrinal research aims to analyze the development of legal consequences and legal protection related to the Government's omission on applications to state administrative officials. Until the enactment of the Job Creation Act, there were 3 (three) different legal norms regarding the legal consequences of the Government's omission on applications to state administrative officials, namely fictitious rejection, in the State Administrative Court Law, fictitious approval followed up with applications, in the Government Administration Act, and fictitious approval without being followed up with an application, in the Job Creation Act. Based on the principle that the new law overrides the old law, the applicable legal consequences are as regulated in the Job Creation Act. Then, legal protection related to the Government's omission on applications to state administrative officials are the imposition of administrative sanctions, submitting applications for the determination of fictitious approval of state administrative decisions to the Administrative Court, filing claims based on government actions disputes, or submitting reports to the Ombudsman.

Abstract

Nowadays, using GPS as a navigator from smartphone is increasing, but it turns out there is a legal issue. This is related to the concept of driving with full concentration in Article 106 paragraph (1) of Law Number 22 Year 2009. In the explanation of Article 106 paragraph (1), there is an ambiguity in the interpretation between being able to use GPS, as long as it does not cause a concentration disturbance in driving or it is prohibited from using a cellphone at all, which means, using GPS via a smartphone is not allowed. This research is a study using normative law, with primary legal materials is legislation related to the use of GPS through smartphones during driving, such as, Law Number 22 Year 2009 concerning Road Traffic and Transportation and Constitutional Court Decision No. 23 / PUU-XVI / 2018, while materials Secondary law consists of books, journals, and other sources that are relevant. Based on the results of this study, it was found that the Constitutional Court provided an interpretation, that using GPS via a smartphone during driving was permitted, but it should not cause a concentration disturbance while driving and the application of such sanctions was casuistic. Abstract

Pada Pasal 49 ayat (1) UU 7/1989, disebutkan bahwa kompetensi absolut dari peradilan agama terlimitasi pada 6 (enam) bidang, yaitu perkawinan, kewarisan, wasiat, hibah, wakaf, dan shadaqah. Dan dalam pasal 50 UU 7/1989 disebutkan, bahwa apabila terdapat sengketa hak yang berkaitan dengan bidang-bidang pada Pasal 49 ayat (1), maka harus diputus pada peradilan negeri. Dalam perkembangannya, terkait dengan kompetensi absolut dari peradilan agama ini mengalami perubahan dengan lahirnya UU 3/2006. Di dalam UU 3/2006, selain terkait dengan penambahan kompetensi absolut, juga terdapat penambahan Pasal 50 ayat (2) yang mengatur terkait dengan sengketa hak menjadi kompetensi absolut dari peradilan agama. Penelitian ini adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan kasus. Berdasarkan penelitian ini ditemukan bahwa Pertama, pada UU 3/2006, terdapat 3 (tiga) bidang baru pada kompetensi absolut pada peradilan agama menjadi perkawinan, waris, wasiat, hibah, wakaf, zakat, infaq, shadaqah, dan ekonomi syari'ah dan di UU 3/2006 telah menghapus adanya hak opsi pada perkara waris bagi orang Islam, sehingga mutlak harus melalui peradilan agama dan Kedua, dengan adanya penambahan Pasal 50 ayat (2) pada UU 3/2006, maka dalam hal adanya sengketa, maka apabila para pihak sesama beragama Islam, maka bisa langsung melalui pengadilan pada lingkungan peradilan agama. Hal ini, dalam rangka mewujudkan peradilan yang cepat, sederhana, dan biaya ringan.

Abstract

Fenomena kekerasan seksual masih terjadi bahkan di lingkungan pesantren dengan korbannya adalah santri. Hal tersebut kiranya tidak sesuai dengan esensi pesantren, bahkan telah bertentangan dengan ajaran Islam rahmatan lil’alamin. Artikel ini merupakan artikel hukum dengan pendekatan peraturan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach). Melalui artikel ini, ditemukan bahwa kasus-kasus kekerasan seksual yang terjadi di lingkungan pesantren juga dapat disebabkan karena kurangnya tindakan pencegahan kekerasan seksual di pondok pesantren, misalnya berupa pendidikan seksual (sex education). Oleh karenanya, pesantren harus bertransformasi sesuai kebutuhan dan tantangan zaman, salah satunya dengan mengintensifkan pendidikan seksual (sex education) kepada para santri yang sesuai dengan nilai-nilai ajaran agama Islam. Islamic Sex Education Program merupakan upaya pencegahan kekerasan seksual di pesantren melalui kurikulum yang sesuai standar internasional yang dikemas secara islami dengan menggunakan metode pengajaran yang modern, menyenangkan dan mudah untuk dipahami para santri.

Abstract

After the issuance of Law Number 11 of 2020 on Job Creation, several policies in Indonesia are amended, including the Manpower Law, especially regarding the termination of employment relationship on worker/labor suspected of committing a criminal action. This research is a normative legal research that uses a statutory approach and a conceptual approach. The result of this research shows that there has been a change of paradigm on the policy of termination of employment relationship against worker/labor suspected of committing a criminal action, which previously was based on the principle of presumption of guilt and became the principle of efficiency of justice. This happened since the policy on the termination of employment relationship based on the principle of presumption of guilt creates several issues, such as the lengthy period to wait for a legally binding decision, employers are unable to get a substitute worker/labor, worker/labor who has not been working in a long period will find difficulties when he returns to work.

Abstract

In handling criminal acts, the Police have begun to use a restorative justice approach based on Perpol 8/2021, but there is legal ambiguity regarding whether or not labor crimes can be resolved based on Perpol 8/2021. The problem formulation in this article is 1. What are the characteristics of handling labor crimes? 2. Does the police's handling of labor crimes based on a restorative justice approach conflict with Perpol 8/2021? The results of this research are that employment crimes can be resolved by the police based on a restorative justice approach, because they do not conflict with Perpol 8/2021.

Abstract

Indonesian legislation is frequently enacted in disregard of essential foundation, rendering the legislative process merely formalistic. This results in compromised quality and a lack of systematic evaluation regarding regulatory effectiveness, contradicting legal pragmatism which prioritizes practical utility and social impact. To bridge this gap, implementing a Sunset Review mechanism is highly necessary in Indonesia. This mechanism mandates the legislature to periodically review regulations within a spesific timeframe to determine their continued validity. Consequently, this ensures that Indonesia’s legal instruments remain responsive, accountable, and adaptive to societal dynamics.

Abstract

Indonesia’s construction sector faces acute payment risk, particularly for subcontractors and suppliers positioned downstream in multi-tier contractual chains. Unlike many common law jurisdictions that mitigate this risk through statutory construction lien rights, non-possessory security interests that attach to the improved aset, Indonesia lacks an equivalent construction-specific proprietary protection, leaving payment security largely dependent on contract remedies and general security devices. This article examines (i) how construction lien regimes function as project-specific security mechanisms in selected common law jurisdictions and (ii) the normative and functional gap created by their absence in Indonesia, along with feasible accommodation pathways. Employing doctrinal (normative) legal research using statutory, conceptual, and comparative approaches, the study analyzes representative lien frameworks in North Dakota, Texas, and Ontario. The analysis finds that, despite jurisdictional variations, lien regimes share a regulatory core: lien rights arise upon performance, are made transparent through notice/registration systems, operate under calibrated priority rules, and are enforceable against the project asset through structured procedures. By contrast, Indonesia’s principal security instruments, Mortgage Rights (Hak Tanggungan) and Fiduciary Security (Jaminan Fidusia), are structurally ill-suited to secure progressively embedded construction value and to protect parties lacking privity with owners. The article concludes that strengthening Indonesia’s construction security framework requires a construction-specific proprietary mechanism, preferably statutory recognition of construction lien rights with carefully designed registration, time limits, and priority rules to balance contributor protection with owner and financier certainty.

Abstract

Public service is a series of actions carried out in order to meet the service needs of each citizen. In the department of corrections, public service arrangements also hold an essential element in creating a quality environment. It is on the reason that prisoners as god's creatures are also entitled to proper service as is guaranteed by article 34 verses (3) of Constitution 1945. On the other hand, in implementing abovementioned, service in correctional service is not actually implemented properly. This is due to many factors, such as shortage of prison officers, overcrowded prison, and other factors.  Based on abovementioned, the author formulated 2 (two) legal problems: a) the prisoner's right to good public service under the Correctional Service Act; and b) AUPB applications upon service arrangements in the penitentiary. The method of research is legal research. It is concluded that: a) eventhough a convict has committed an offense, the state has to ensure he gets proper service during his time; b) Public service officers in prison should always refer its conduct to the General Principles of Good Governance such as impartiality, good service, and principle to not commit abuse of power. Abstract

Introduction to the Problem: The problem explored in this study is that the Indonesian legal system does not provide any legal protection for ‘Good Samaritan’ acting to aid others’ in grave danger. This legal vacuum might cause a shift in humans' good nature. Purpose/Study Objectives: The purpose of this study is to examine how other jurisdictions regulate Good Samaritan immunity in civil disputes, addressing the research gap in Indonesia where no protection exists, and how such frameworks may be adapted. Design/Methodology/Approach: Normative juridical research combining statute, conceptual, comparative, and case approaches across Indonesia, Canada, and China to map immunity/liability rules in emergency civil disputes and extract transferable principles relevant to international law debates on protecting life and enabling bystander aid. Findings: The study finds that implementing a Good Samaritan Doctrine in Indonesia addresses the current legal vacuum by providing immunity to individuals who render aid in emergencies. Comparatively, Canada grants civil immunity for Good Samaritans acting in good faith, while China’s Civil Code provides similar protection with limitations. These models demonstrate that clear immunity provisions can encourage voluntary assistance without exposing helpers to liability. In the Indonesian context, the idea of having legal immunity and liability for ‘Good Samaritans’ could be achieved in the short term through advocation clarifying judicial interpretation of Article 1354 of the Indonesian Civil Code, and in the long term through dedicated legislation establishing Good Samaritan protection.  Paper Type: Research Article
