Abstract

Tujuan Penelitian yaitu Untuk mengetahui dan menganalisis ketentuan dan penerapan restorative justice terhadap anak yang berkonflik dengan hukum dalam sistim peradilan pidana anak, Untuk mengetahui dan menganalisis bentuk tindak pidana yang dilakukan oleh anak yang memungkinkan untuk diterapkan keadilan restorative justice. Metode penelitian yang digunakan dalam penelitian ini adalah Penelitian hukum normatif adalah penelitian hukum yang dilakukan dengan cara meneliti bahan kepustakaan (data sekunder) Bahan hukum yang digunakan dalam penelitian ini bersumber dari bahan hukum primer yang diperoleh secara langsung dari bahan hukum, baik bahan hukum primer maupun bahan hukum sekunder. Untuk memperoleh bahan hukum yang diperlukan dalam penelitian ini, digunakan teknik studi kepustakaan (library research). Untuk kejaksaan agung dalam penerapan restorative justice terhadap anak ada Peraturan Jaksa Agung Republik Indonesia No. PER-006/A/J.A/05/2015 tentang Pedoman Pelaksanaan Diversi Pada tingkat Penuntutan. Kemudian ada Surat Keputusan Bersama Ketua Mahkamah Agung Republik Indonesia, Jaksa Agung Republik Indonesia, Kepala Kepolisian Negara Republik Indonesia, Menteri Hukum dan Hak Asasi Manusia Republik Indonesia, Menteri Sosial Republik Indonesia, dan Menteri Negara Pemberdayaan Perempuan dan Perlindungan Anak Republik Indonesia Nomor 16бА/KMA/SKB/XII/2009, 148 A/A/JA/12/2009, B/45/XII/2009, M.HH-08 HM.03.02 Tahun 2009, 10/PRS-s/KPTS/2009, 02/Men.PP dan PA/XII/2009 tentang Penanganan Anak Yang Berhadapan Dengan Hukum.

Abstract

In accordance with Gorontalo Province Regional Regulation on Retribution of Fish Auction Place (TPI), the retribution is levied on the use of fish auction place along with facilities and infrastructure provided or organized by Gorontalo Province Regional Government which is called retribution object. The purpose of the study is to determine the effectiveness of the government's implementation of Gorontalo Province Regional Regulation Number 6 of 2018 concerning Port Service Levies on Fish Auction and to determine the impact and efforts taken in the government's implementation of Regional Regulation Number 6 of 2018 concerning Port Service Levies on Fish Auction. The type of research used by researchers is using normative and empirical legal research, which is basically a combination of normative legal approaches with the addition of various empirical elements. In this normative and empirical research method is also about the implementation of normative legal provisions (laws) in action in every certain legal event that occurs in a society. The effectiveness of the implementation of retribution collection shows that port service retribution in Tenda Village, Hulontahlangi Subdistrict is still less effective in retribution collection. There is a discrepancy between what is expected in Regional Regulation Number 6 of 2018 concerning Port Service Levies against Fish Auction Sites. So that the effectiveness of the application of port service levies on service rates at the fish auction site is less effective and efforts in implementing Regional Regulation Number 6 of 2018 concerning Port Service Levies on Fish Auction Sites, which consists of socialization, target achievement, and community participation.

Abstract

Social media has changed the way people communicate and share information, opening up great opportunities as well as challenges such as hoaxes and polarization. In Indonesia, these platforms have become important spaces for public discussion, especially in politics. Wise management is needed for social media to support transparency, accountability and democracy. The purpose of this study is to analyze the role of social media in constitutional dispute resolution, identify challenges that arise, and provide recommendations for wise management so that social media can support transparency, accountability, and democratic principles. This research uses a normative method. Social media has a major role in constitutional disputes, both as a tool for information dissemination and a space for public discussion. On the one hand, social media helps transparency, participation, and community mobilization in constitutional issues. However, on the other hand, it also poses challenges such as disinformation, hoaxes, and political polarization that can escalate conflicts. Regulation and supervision are needed to address the misuse of social media without compromising freedom of expression. Digital literacy education is also important to encourage responsible use of social media, so that it can be a tool to support democracy and peaceful dispute resolution. Social media can worsen the political situation through hoaxes and hate speech. Therefore, clear regulations are needed to prevent abuse without reducing freedom of speech. Policy reforms that balance surveillance and freedom of expression are important, with collaboration between the government, platforms and communities to create a safe digital space. Digital literacy also needs to be improved so that people can sort out information and support political stability.

Abstract

This research examines the negative impact of misuse of official vehicles by State Civil Apparatus (ASN) on their image and morality, as well as the legal consequences that accompany it. The main focus of this research is to analyze how this behavior forms negative perceptions among the public and damages the integrity of ASN. The methodology used is a literature study, utilizing various sources related to law and government ethics as analysis material. The research results show that this act of abuse can weaken the level of public trust in government institutions.

Abstract

Theimplementation of the merit system in civil servant management has shown its effectiveness in supporting the principles of justice and equality. However, to achieve more optimal results, efforts are needed to increase the capacity of human resources, strengthen supervision mechanisms, and enforce sanctions for violations. In addition, the government needs to encourage changes in organizational culture to better support the principle of meritocracy. Further studies are needed to evaluate the long-term impact of implementing the merit system at different levels of government. The merit system is a reflection of professional personnel management where the placement of employees and officials uses performance competencies and track records as a measure of appointment. The main purpose of the implementation of the merit system is to improve professionalism, fairness, and equality in the management of Civil Servants (PNS). The purpose of this research is to find out the Effectiveness of the Implementation of the Merid System on the Principles of Justice and Equality in Translating Civil Servants. Abstract

Prinsip dari sebuah negara demokrasi adalah dengan menjunjung tinggi Konstitusi dan ideologi dalam sebuah negara. Kebebasan dalam hak sosial dan politik menjadi sebuah jaminan yang sangat diperlukan untuk dapat mencapai sebuah negara yang menjunjung tinggi demokrasi sehingga aspirasi yang ada dapat tersalurkan dengan baik. Permasalahan yang muncul yaitu Bagaimana Prinsip Dan Jaminan Hak Warga Negara Menurut UUD 1945 dan Bagaimana Dinamika Sosial Politik Dalam Sistem Demokrasi di Indonesia. Metode penelitian yang digunakan berupa penelitian hukum yuridis normatif yang merupakan penelitian kepustakaan, yaitu penelitian terhadap bahan hukum primer dan bahan hukum sekunder yang terdiri dari peraturan perundang-undangan dan literatur-literatur terkait untuk memecahkan persoalan hukum atau permasalahan yang akan dibahas. Kemerdekaan menyampaikan pendapat dimuka umum harus dilaksanakan dengan bertanggung jawab, sejalan dengan ketentuan peraturan perundang-undangan yang berlaku. Oleh karena itu negara wajib dapat mengelola dan mengendalikan dominasi iklim kapitalis agar tetap berjalan pada koridor yang tidak merugikan warga. Negara juga harus membuka dan memberdayakan ruang publik secara optimal sebagai instrumen warga dalam menyalurkan aspirasinya, serta menutup keran tumbuh suburnya praktek politik uang baik di kalangan elit politik maupun di kalangan masyarakat, karena dengan membiarkan politik uang berlangsung, maka tidak hanya berimpilkasi melahirkan politisi yang korup dan mengekang hati nurani masyarakat dalam memberikan partisipasi politiknya, namun juga berakibat tercederainya suatu pemilu yang demokratis.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis Penerapan Sistem Presidential Thereshold Terhadap Ambang Batas Pencalonan Presiden dan Wakil Presiden Tahun 2019 Dalam Prespektif Hukum Tata Negara. Untuk mengetahui dan menganalisis Relevansi Pemberlakuan Presidential Threshold Terhadap Ambang Batas Pencalonan Presiden dan Wakil Presiden Tahun 2019 Yang Tidak Sejalan Dengan Pasal 6A ayat (2) Undang – Undang Republik Indonesia 1945. Dalam penelitian ini penulis menggunakan metode penelitian normatif. Sumber data yang digunakan dalam penelitian ini adalah data sekunder. Dalam penelitian ini, penulis melakukan analisis data dengan menggunakan metode kuantitatif, yaitu melakukan analisis data dan memberikan penjelasan yang relevan, masalah dibahas lebih lanjut penelitian dan analisis dilakukan dan menjadikannya suatu kesimpulan. Penerapan Sistem Presidential Thereshold menimbulkan pro kontra yang keduanya mempunyai basis alasan masing-masing. Menelaah pro kontra presidential threshold dalam pemilu serentak melahirkan kesimpulan bahwa adanya putusan Mahkamah Konstitusi Nomor 14/PUU-XI/2013 yang mengamanatkan pemilu serentak sejatinya secara substansi telah menghapuskan sistem presidential threshold, sehingga persyaratan ambang batas untuk mencalonkan Presiden dan Wakil Presiden menjadi tidak relevan dalam pemilu serentak 2019. pemberlakuan Presidential Threshold tidak sejalan dengan Pasal 6A ayat (2) UUD NRI Tahun 1945 yang menyatakan: “Pasangan calon presiden dan wakil presiden diusulkan oleh partai politik peserta pemilihan umum sebelum pelaksanaan pemilihan umum.”

Abstract

The purpose of the research is to find out the causes of differences in interpretation between the Gorontalo Regency KPU and Bawaslu Gorontalo Regency regarding administrative violations of the 2020 elections in Gorontalo Regency and how the process of resolving administrative violations of the 2020 elections in Gorontalo Regency by the Gorontalo Regency KPU and Bawaslu Gorontalo Regency. This research uses two legal research methods, namely: Normative and empirical legal research to find answers to the differences in interpretation between the KPU and Bawaslu Gorontalo Regency regarding administrative violations of the 2020 Pilkada in Gorontalo Regency. The difference in interpretation between the Regency KPU and Bawaslu Gorontalo Regency regarding administrative violations is caused by overlapping statutory provisions. Where in Law Number 10 Year 201 concerning Pilkada, the two institutions are given the authority to examine and decide administrative violations, then the two institutions in deciding administrative violations have their own guidelines where Bawaslu is guided by Perbawaslu while the KPU itself is guided by KPU Regulations. This certainly does not provide legal certainty for justice seekers in election administration violations and the process of resolving administrative violations in the 2020 Pilkada in Gorontalo Regency, namely through DKPP and Constitutional Court decisions. We do not have to face different decisions between the two institutions because DKPP is an ethical judicial institution while the Constitutional Court is a legal judicial institution. Although there has been a decision from the Constitutional Court, it does not change the DKPP's decision because until now there has been no ethics court to appeal the DKPP's decision.

Abstract

This study aims to analyze the importance of professional laws and codes of ethics for members of the National Police of the Republic of Indonesia (Polri). The National Police professional code of ethics is a code of conduct that must be followed by every member of the National Police in carrying out their duties and responsibilities. This study examines the legal aspects that govern the code of ethics, as well as evaluating the challenges and its implementation in police practice. Data was collected through literature studies, analysis of laws and regulations, and in-depth interviews with members of the National Police. The results of the study show that effective enforcement of the code of ethics can strengthen integrity, professionalism, and public trust in the National Police. However, several challenges are still faced in the implementation of the code of ethics, such as the lack of socialization and strict supervision. This research provides recommendations to increase awareness and compliance of members of the National Police with the code of ethics, as well as strengthen its enforcement mechanism to strengthen.
