Abstract

Pengelolaan hasil pertanian masih belum baik, sehingga keuntungan dari produksi belum dapat dinikmati secara maksimal oleh kelompok Wanita Tani Manunggal, Kampung Dumpoh, Kota Magelang. Pemasaran produk yang ditawarkan hanya sebatas menunggu datangnya konsumen, belum ada pemasaran berbasih online. Selain itu, kondisi adanya pandemic covid-19 menyebabkan terbatasnya penjualan produk. Mengingat, perkembangan teknologi informasi yang pesat akan menjadi titik perubahan akan teknik memasarkan suatu produk barang dari memasarkan secara konvensional beralih menggunakan pemasaran digital. Solusi yang ditawarkan adalah rintisan digital startup dalam rangka perluasan pemasaran produk tani, Kelompok Wanita Tani, Kampung Dumpoh, Kota Magelang. Metode yang digunakan diskusi dan tutorial mengenai pemasaran digital. Hasil dari program kemitraan masyakarat adalah peserta mempunyai motivasi dan paham konsep pemasaran digital produk tani melalui rintisan digital startup serta pengaplikasian pemasaran digital produk tani yang mudah dipahami serta esuai dengan kebutuhan konsumen.

Abstract

Settlement of land cases through mediation carried out by the Land Office of Boalemo Regency refers to Regulation of Agrarian Affairs Minister and Spatial Planning/Head of the National Land Agency Number 21 of 2020 concerning Handling and Settlement of Land Cases. Mediation as an alternative for resolving land cases, it is necessary to popularize "mediator". A mediator must know psychologically the condition of the parties, so that they feel comfortable and the problem is resolved comfortably. In addition, the mediator must have analytical skills and expertise in creating a personal approach for the parties involved in the dispute. The mediator must be able to understand and give a positive reaction to the perceptions of each party. The goal is to build good relationships and trust. The parties' trust in the mediator makes it easier to reach a consensus. The priority regarding the purpose and function of the mediator is to resolve land cases in order to resolve cases without creating new ones. The research method that the author uses in this study is the empirical juridical law method, empirical juridical law is a study in addition to looking at the positive legal aspects, it also looks at its application or practice in the field. Thus the empirical juridical approach is a legal research method that seeks to see the law in a real sense or it can be said to see, examine, how the law works in society. The results shows that the handling and settlement of land cases through mediation at the Land Office of Boalemo Regency Land Office is done and carried out based on the Agrarian Affairs Minister Regulation and Spatial Planning/Head of the National Land Agency Number 21 of 2020 concerning Handling and Settlement of Land Cases. Constraints faced in handling and resolving land cases through mediation at the Land Office of Boalemo Regency are in the form of juridical and non-juridical constraints. The juridical constraint is the technical instructions for the mediation procedure referred to by the regulation have not yet been published, while the non-juridical constraint is in the form of limited qualified human resources as mediators. Based on this, the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency in the future must make structured, systematic and massive improvements to the mediation process by immediately issuing technical instructions and improving the quality of human resources in terms of being a mediator through guidance, training and direction.

Abstract

Law enforcement of road transportation traffic is one of the important aspects in maintaining road safety and order. However, the effectiveness of monitoring and evaluating the performance of Civil Servant Investigators (PPNS) in law enforcement is often hampered by unstructured processes and lack of transparency in reporting. This research aims to analyze the role of information technology (IT)-based system development in improving transparency, efficiency, and accountability in monitoring and evaluating PPNS performance. This research uses a qualitative method with a case study approach, which involves analyzing the application of information systems in institutions that handle traffic law enforcement. The results showed that IT systems can improve transparency by providing clear and real-time data access, increase efficiency by speeding up data processing and analysis, and strengthen accountability through auditable digital records. The study concludes that the development and implementation of IT systems in the oversight of PPNS performance not only improves the effectiveness of traffic law enforcement, but also strengthens the integrity and public trust in the institutions that carry out these tasks. The implementation of IT systems is expected to be a strategic solution in improving the quality of public services in the field of traffic law.

Abstract

The purpose of this study is to determine and analyze the effectiveness of the application of Article 22 of the Regulation of the Chief of the Indonesian National Police Number 14 of 2011 concerning the Code of Professional Ethics of the Indonesian National Police in the Gorontalo Regional Police and to determine and analyze what factors affect the effectiveness of the application of Article 22 of the Regulation of the Chief of the Indonesian National Police Number 14 of 2011 concerning the Code of Professional Ethics of the Indonesian National Police in the Gorontalo Regional Police. The research used is empirical research. Empirical legal research is conducted by examining directly into the field to see directly the application of legislation or rules of law relating to law enforcement, as well as conducting interviews with several respondents who are considered to be able to provide information regarding the implementation of law enforcement. The application of the Regulation of the Chief of the Indonesian National Police (Perkap) is not yet effective, because from the results of the interview that the Gorontalo Regional Police prioritizes the Circular Letter (SE) rather than the Regulation of the Chief of the Indonesian National Police (Perkap), moreover that the debate regarding the application of legal norms does not only occur among law enforcers in general but within the internal police also becomes a debate caused by the existence of conflicting legal norms between high legal norms and low legal norms. Factors affecting the effectiveness of the application of the article on the Regulation of the Chief of the Indonesian National Police regarding the Police Professional Code of Ethics within the scope of the Gorontalo Regional Police, which is the formulation of the problem in this study, including; 1) Legal Substance, 2) Legal Structure, 3) Legal Culture.

Abstract

 penelitan ini  untuk mengetahui kewenangan bagian hukum setda kabupaten bolmut dalam penanganan perkara bantuan hukum. Untuk mengetahui faktor apa yang menyebabkan penanganan perkara bantuan hukum tidak berjalan secara maksimal. Dalam penelitian ini penulis menggunakan metode penelitian Empiris. Sumber data yang digunakan dalam penelitian ini adalah data primer dan sekunder. Penulis menggunakan teknik pengumpulan data secara Observasi dan Wawancara secara langsung. Dalam penelitian ini, penulis melakukan analisis data dengan menggunakan metode kuantitatif, yaitu melakukan analisis data dan memberikan penjelasan yang relevan, masalah dibahas lebih lanjut penelitian dan analisis dilakukan dan menjadikannya suatu kesimpulan. Menurut Patrianto pembentukan perda bantuan hukum dapat dijadikan upaya penyempurnaan dan perluasan pemberian akses keadilan yang tidak hanya mencakup kelompok orang miskin melainkan juga kelompok yang diprioritaskan mendapatkan layanan bantuan hukum. Efektifitas Hukum sebagaimana yang telah dikemukakan oleh Soerjono Soekanto yakni kondisi berjalannya hukum sebagaimana tujuan hukum itu diciptakan. dengan mengacu pada hasil penelitian yang diperoleh, dapat diklasifikasi dan dibedakan menjadi 3 faktor yakni, faktor substansi hukum (legal substance), struktur hukum (legal structure), dan budaya hukum (legal culture).

Abstract

This study analyzes the operationalization of Gorontalo customary law as a living constitution within the framework of Islamic Constitutional Law in two different demographic contexts: a Muslim majority society in Gorontalo Province (98.1%) and a Muslim minority enclave in Ternate Tanjung Sub-District, Manado City (86.7% at the sub-district level and 31.9% at the city level). Using a socio-legal comparative research approach, this study examines how adat-Islamic constitutional norms function, adapt, and obtain legitimacy within different constitutional structures. Data were collected through in-depth interviews with four key informants, comprising two Gorontalo customary leaders and two Manado community leaders. The findings demonstrate that the principle "Adati hula-hulaa to Syara’, Syara’ hula-hulaa to Qur’ani" functions as the basic norm (substantive grundnorm) of Gorontalo Islamic Constitutional Law that remains stable across demographic contexts. However, the constitutional operationalization mechanism undergoes transformation. In the Muslim majority context, customary law operates formally through the Buwatulo Taulongo institution, which enjoys dual legitimacy, both customary and state, thereby forming a local living constitutional order. Conversely, in the Muslim minority context, customary law operates flexibly-informally through family deliberation and ad-hoc mediation by sub-district officials, imams, and the Office of Religious Affairs. This transformation is not degradation, but rather constitutional rearticulation aligned with the principles of Fiqh al-Aqalliyyat: yusr, maslahah mursalah, muwatanah, and tadarruj. This research develops a layered Living Fiqh al-Aqalliyyat model from an Islamic Constitutional Law perspective, expanding the concept of a living constitution from temporal adaptation to demographic adaptation, particularly in the context of domestic Muslim minorities in Eastern Indonesia.
