Abstract

A request in a district court for annulment of an arbitration, or arbitral, award is a form of legal remedy that claims dissatisfaction with the award by one or more parties. It contravenes the provisions that stipulate the finality of the award and its permanently binding legal force. The attempt to invalidate the arbitral award seems to reflect the party’s (or parties’) disobedience to it. The research method here employed normative juridical review of various library materials consisting of primary legal sources from related laws and regulations, secondary materials which formed the explanations used in the analysis of the primary legal materials in the form of doctrine, academic views, judicial decisions, document searches, books, and scientific works. The legal material is identified and analyzed to achieve the objectives of the study. The results indicate that there is legal uncertainty related to the provision, specifically whether a district court can overturn a final arbitration award and that it carries the legal force to bind the parties. Therefore, it is necessary to create that certainty, and write off Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, article 70. Arbitrators are encouraged to act more professionally in examining and delivering fair arbitration awards without being tainted by false evidence or gimmicks.

Abstract

Rutan Pondok Bambu is one of the technical implementation units of the Ministry of Law and Human Rights of the Republic of Indonesia under the directorate general of corrections. Rutan Class I Pondok Bambu was established in 1974 by the Regional Government or DKI Jakarta Regional Government which consists of the Orchid Pavilion with a total of 18 (eighteen) residential rooms which are female residents with criminal cases. Related to the understanding of legal aid, the State has an obligation to realize the implementation of a fair judiciary by guaranteeing the creation of a situation where each individual has the right to get a justice, which, among others, is carried out by providing legal assistance in the form of legal assistance and consultation related to civil, criminal and administrative issues, both in litigation and non-litigation as stipulated in  Law Number 16 of 2011 concerning Legal Aid. Although legal aid has been regulated in the laws and regulations, there are still many assisted residents in Rutan Klas 1 Pondok Bambu who do not know and understand it. This is then the reason behind the implementation of Community Service at Rutan Klas 1 Pondok Bambu. The implementation method is carried out through a process of dialogue with the target residents / community and discussions in counseling activities, after the delivery of the material, a question and answer is held. All activities are carried out by taking into account administrative order, so that each activity must obtain a permit and be recorded at the Klas I Pondok Bambu Detention Center which is a partner in the implementation of this community service.

Abstract

The use of social media has become inevitable in modern life. Although it has many benefits, using social media can also bring risks and negative impacts, especially when not used wisely. This community service aims to increase the Depok community's understanding of using social media wisely. The method used in the implementation of community service is by conducting community service activities face to face with the people of Depok City , which is located in the Rangkap Jaya Sub-District, Pancoran Mas District - Depok City. The results of this program show a significant increase in understanding among the people of Depok. Community service program participants reported being better able to spot fake news, maintain online privacy, and interact ethically on social media. In addition, participants were also more aware of potential dangers such as online bullying and the spread of false information. This community service program has succeeded in creating positive changes in the social media usage behavior of the people of Depok. This proves the effectiveness of a community-based approach in increasing digital literacy. These findings can serve as a reference for similar efforts in other communities, promoting wiser and more responsible use of social media throughout society.

Abstract

Pendampingan terhadap Tenaga Satuan Pengamanan dimulai dengan kegiatan pendidikan sertifikasi Gada Pratama yang diadakan oleh PT. Pratama Siaga Mandiri pada Januari 2019. Peserta yang merupakan Satpam dari salah satu Universitas di Jakarta diwajibkan membayar biaya pendidikan sebesar Rp.5.000.000,00-, yang dapat diangsur selama 10 bulan sebesar Rp.500.000,00- per bulan. Jika ada peserta yang terlambat membayar angsuran, ATM mereka akan ditahan dan gaji bulan tersebut akan dipotong untuk menutup tunggakan. Setelah menyelesaikan pendidikan sertifikasi Gada Pratama, peserta yang lulus dijanjikan akan menerima asli ijazah Sertifikasi Gada Pratama dan Karta Tanda Anggota (KTA) yang disahkan oleh Kapolda METRO JAYA. Pada Januari 2020, semua peserta telah melunasi biaya pelatihan, termasuk biaya ijazah sebesar Rp.5.000.000,00-. Namun, hingga saat ini, PT. Pratama Siaga Mandiri belum menyerahkan asli ijazah sertifikasi kepada peserta yang telah lulus. Meskipun sudah ada upaya mediasi, belum tercapai kesepakatan damai. Tim Pengabdi akan memberikan pendampingan hukum kepada peserta Satpam untuk mengajukan gugatan perdata terhadap PT. Pratama Siaga Mandiri melalui Pengadilan Negeri Jakarta Timur. Sebelum proses pendampingan di pengadilan dimulai, Tim Pengabdi memberikan materi tentang Satuan Pengamanan, Tugas dan Kewajiban, Sengketa Perdata, Wanprestasi, Bantuan Hukum, dan Proses Peradilan Perdata kepada peserta. Tim Pengabdi bertekad memberikan bantuan hukum yang diperlukan agar hak-hak peserta Satpam terpenuhi dan masalah ini dapat diselesaikan melalui jalur hukum yang berlaku. Dalam upaya ini, kerjasama antara Tim Pengabdi, peserta Satpam, dan Pengadilan Negeri Jakarta Timur sangat penting untuk mencapai penyelesaian yang adil bagi semua pihak yang terlibat

Abstract

This study examines the usage of toll road sections that have fully recovered their investment as state-owned assets, and evaluate the compatibility of the Toll Road Concession Agreement (Perjanjian Pengusahaan Jalan Toll/PPJT) about granting concessions for the operation of these toll road sections that have paid off their investment. This research employs a normative juridical method, analyzing relevant literature on using toll road sections that have reached the return on investment as state-owned assets. The findings indicate that the State's utilization of these toll road sections does not uphold justice, as it fails to maximize the community's welfare. The PPJT on the concession of operating toll road sections that have paid off their investment differs from the utilization of state-owned assets as stipulated by existing regulations due to the imposition of general contributions and profit sharing. It is the government to consider the concession agreement to include toll road sections that have completed their investment to return into the government for maximizing public welfare.

Abstract

Abstract This study was conducted to determine the legal arrangements for termination of employment by employers who experienced the impact of Covid-19 on workers according to labor laws and legal protection of workers who experienced termination of employment by employers who were affected by Covid-19. This study uses normative juridical research methods. Legal protection for workers experiencing termination of employment during the Covid-19 pandemic until now there is still a lack of explicit efforts to heed workers' rights from employers to implement the provisions of the law. Since the issuance of Presidential Decree (Keppres) No.12 of 2020 concerning Determination of Non-Natural Disasters Spread of Corona Virus Disease 2019 (Covid-19) As National Disasters employers certainly have reason to terminate employment in the face of this pandemic in terms of the state of the company. Legal provisions for termination of employment are regulated in Act Number 13 of 2003 concerning Manpower. The impact of employment due to this pandemic on employment relations that led to termination of employment due to the closure of the company, the Work From Home work system, causing unemployment. Abstract

Abstrak Tanah Negara merupakan tanah yang tidak dilekati suatu hak atas tanah dan bukan merupakan barang milik Negara/Daerah dan atau Badan Usaha Milik Negara / Daerah. Tanah yang berstatus tanah negara dapat dimintakan suatu hak untuk kepentingan tertentu dan prosedur tertentu. Kendatipun terhadap tanah negara dapat dimintakan suatu hak, namun dalam prakteknya baik perorangan maupun Badan Hukum masih kesulitan untuk mendapatkan hak atas tanah negara. Rumusan masalah yang diangkat dalam penelitian ini, bagaimana pengaturan pemberian hak kepemilikan atas tanah negara kepada perorangan atau Badan Hukum menurut sistem hukum di Indonesia dan kepastian hukum untuk mendapatkan hak atas tanah negara. Metode penelitian yang digunakan adalah yuridis normatif yakni melalui studi pustaka dengan menggunakan pendekatan perundang-undangan dan kasus. Hasil penelitian menunjukkan bahwa pengaturan pemberian hak kepemilikan atas tanah negara belum dapat memberikan kepastian hukum atas diterimanya permohonan hak atas tanah negara yang diajukan oleh perorangan atau Badan Hukum. Tidak semua tanah negara bisa dimintakan mejadi hak milik, sehingga perlu ada sosialisasi mengenai jenis tanah negara yang dapat dimintakan menjadi hak milik, sehingga dapat memberikan kepastian hukum bagi perorangan ataupun badan hukum dalam mengajukan permohonan hak milik atas atas tanah negara. Kata kunci: Tanah Negara, Perorangan, Badan hukum Abstract State land is land that is not attached to a land right and is not property of the State/Regional and/or State/Regional-Owned Enterprises. Land with the status of state land may be asked for a right for certain interests and certain procedures. Even though a right to state land can be requested, in practice both individuals and legal entities are still having difficulty obtaining rights to state land. The formulation of the problem raised in this study, how to regulate the granting of ownership rights to state land to individuals or legal entities according to the legal system in Indonesia and legal certainty to obtain state land rights. The research method used is normative juridical, namely through library research using a statutory and case approach. The results of the study indicate that the arrangement for granting ownership rights to state land has not been able to provide legal certainty on the receipt of applications for state land rights submitted by individuals or legal entities. Not all state land can be requested as property rights, so there needs to be socialization regarding the types of state land that can be requested as property rights, so as to provide legal certainty for individuals or legal entities in applying for property rights on state land.

Abstract

This research uses normative juridical methods. The research technique begins by sorting the laws and regulations governing Gender, and this is done to find out how available work facilities are in the Depok City Government. PPPA Ministerial Regulation No. 5 of 2015 concerning Providing Gender Responsive Work Facilities and Caring for Children in the Workplace, the aim is to fulfil the right to protection for women and children; Fulfillment of children's rights and guarantee children's growth and development; Environmental responsibility in the care and protection of children; Increase work productivity. The unavailability of lactation rooms, the availability of special waiting rooms for children in the workplace, and the implementation of curfews for female workers are the main focus, and this certainly supports SDS5, namely Gender Equality. Thus, workplaces must provide facilities and infrastructure that take into account the principles of gender equality and the best interests of children. The provision of gender-responsive facilities and infrastructure is intended to increase work productivity and pay attention to the best interests and growth and development processes of children. Apart from fulfilling and protecting the rights of women and children, this includes fulfilling the rights and protection of people with disabilities and the elderly. The result is that the Depok City Government has not yet demonstrated work facilities that have a gender perspective. Therefore, to accelerate this fulfilment, the Government should be able to utilize old, habitable buildings to fulfil work facilities with a gender perspective.

Abstract

This study aims to explore the intricate legal landscape surrounding the cryptocurrency market in Indonesia, specifically addressing the prevalent challenges and risks of market manipulation. The writing method is anchored on a comprehensive examination of primary, secondary, and tertiary legal resources, including pivotal legislations such as the Capital Market Regulation (UUPM) and various other Indonesian laws. Furthermore, a library research technique has been employed, drawing from a broad spectrum of theoretical studies, past literature, and expert opinions to provide a holistic understanding of the subject. The novelty of this study emerges from its specialized focus on market manipulation within the rapidly evolving context of the Indonesian cryptocurrency realm. This focus differentiates it from more generic studies on cryptocurrency, offering tailored insights and recommendations for the Indonesian scenario. Based on the research undertaken, we conclude that Indonesia's strategic and proactive legal measures, coupled with the inherent advantages of regulated cryptocurrency platforms, play a pivotal role in countering market manipulation risks. For the practical application of these findings, it is imperative for Indonesian policymakers and regulatory entities to sustain an adaptive approach, ensuring continuous monitoring and timely updates to the legal frameworks. This adaptability guarantees their resonance with the ever-shifting paradigms of the cryptocurrency domain. Additionally, the research underscores the significance of robust investor education initiatives and advocates for a synergistic collaboration between regulatory bodies, cryptocurrency platforms, and the broader investor community. Such collaborative efforts are instrumental in nurturing a transparent, secure, and resilient cryptocurrency environment in Indonesia, setting a benchmark for similar emerging markets globally.

Abstract

 Influencer doctors are prohibited from promoting skincare products on social media as regulated in MKEK Decree 029/2021. This has pros and cons, where influencer doctors are considered to help people pay more attention to a skincare product before buying and it is feared that there will be excessive claims on a product because they have expertise in the field of beauty. This research aims to analyze the responsibilities of influencer doctors who promote skincare products on social media and legal protection for consumers who experience losses from the promotion of skincare products carried out by influencer doctors on social media through normative juridical research methods which are supported by primary, secondary, and tertiary data. The study shows that the responsibility of influencer doctors needs to be looked at further regarding the fulfillment of mistakes made, if they are not at fault, then full responsibility falls on the business actor. Meanwhile, if guilty, the influencer doctor can be subject to sanctions as regulated in the 2018 MKEK Guidelines and the Consumer Protection Law. The embodiment of consumer protection is to provide rights and obligations for consumers, business actors and advertising business actors. Consumers often think impulsively when buying skincare products because of other people's reviews. Therefore, to avoid losses, consumers need to be more careful when purchasing skin care products. If they experience losses, consumers can apply for compensation or peace efforts, in court and outside of court.Keywords: Responsibility, Consumer Protection, Influencer Doctors, Skincare
