Abstract

Monopoly is regulated in the regulation of State-Owned Enterprises (SOEs) as the right to regulate (bestuur) all state resources as mandated by the constitution of Article 33 of the 1945 Constitution and also the BUMN Law Number 19 of 2003 where one of them is a company that is an entity a government-owned business in the form of a limited liability company. The capital is divided into wholly or at least 51 percent of the shares owned by the Republic of Indonesia with the main objective of pursuing profit. In the case of SOEs, corporate actions are determined by the direction of state policies in their economy. Problem formulation based on the above background, is monopolistic and de-monopoly practices against SOEs, inconsistency of the government? This research used normative juridical with a quantitative analytical approach and examines literature studies that conclude. The study results showed that corporate action was not doubt or inconsistency in implementing a state monopoly. However, this holding was to increase the capacity and existence of SOEs as agents of development and the state in managing resources related to many people’s lives.

Abstract

The development of information technology gives two sides of the coin in the dynamic of human life, whether positive or negative. This condition is also pertinent to transactions involving cosmetics and psychotropic substances; without close supervision, it may result in consumer harm. In light of this concern, the present study aims to examine how law reviewing the online spreading of medicines gives law protection. This research uses the normative juridical method with the legislative approach. This research uses a qualitative research method in the form of normative juridical research with a statutory approach regarding Online Counterfeit Drugs and examines the synchronization and consistency of its implementation. The legal sources used are primary and secondary sources relating to Online Counterfeit Drugs guarantees. The data collection technique uses library research by examining references to primary and secondary legal sources. Furthermore, the author investigated and evaluated the efficacy of legal sources. This study was carried out from the perspective of Maqashid al-Sharia. The findings of this study indicate a pressing need for regulations that protect consumers engaging in online transactions, particularly those involving pharmaceuticals, cosmetics, and psychotropic substances. Such regulations are essential to prevent consumer losses by ensuring strict liability for manufacturers if their products cause harm. Additionally, the study highlights the crucial role of pharmacists and the National Agency of Drug and Food Control (BPOM) in overseeing the distribution of drugs and cosmetics prior to their market release.

Abstract

AbstractOne of the State-Owned Undertakings which is locked in within the conveyance and deal of normal gas from normal gas providers to clients, counting mechanical clients, little clients, commercial and family clients through a gas transmission and dissemination pipeline organize, specifically PT Perusahaan Gas Negara Tbk (PGN) which as of now a Pertamina sub holding gas. In back of the government program to quicken the transformation of household fuel from oil to normal gas. In supporting this building infrastructure for distribution, a natural gas throughout existing and new operational areas so that it can be distributed to customers as intended. This research contains a problem formulation, namely: can the private sector participate as a partnership to support gas infrastructure projects for Customer Attachment? The point of this research is to find out where the private sector can participate as a partnership to support the Customer Attachment work gas infrastructure project. This research uses theory of utilitarianism by Jeremy--Bentham. The aim of this uses empirical normative, legal research methods. From the comes about of this inquire about, it is obvious that the private sector can participate as a partnership to support gas infrastructure projects, Customer Attachment work, providers of goods and services with subsidiaries of PT Perusahaan Gas Negara Tbk (PGN) within PT Perusahaan Gas Negara Tbk (PGN). Keywords: Gas distribution, Partnership, Project  AbstrakSalah satu Badan Usaha Milik Negara yang bergerak di bidang penyaluran dan penjualan gas bumi dari pemasok gas bumi ke pelanggan, baik pelanggan industri, pelanggan kecil, komersial maupun rumah tangga melalui jaringan pipa gas transmisi dan distribusi yaitu PT Perusahaan Gas Negara Tbk (PGN) yang saat ini menjadi subholding gas Pertamina. Dalam mendukung program pemerintah untuk melakukan percepatan konversi bahan bakar domestik dari minyak bumi ke gas bumi. Dalam menunjang program tersebut, PT Perusahaan Gas Negara Tbk (PGN) membangun infrastruktur untuk penyaluran gas bumi di seluruh wilayah operasional eksisting maupun operasional baru agar dapat tersalurkan ke pelanggan sebagaimana dimaksud. Penelitian ini terdapat rumusan masalah yakni: apakah pihak swasta dapat ikut serta sebagai kemitraan penunjang keproyekan infrastruktur gas pekerjaan Customer Attachment? Tujuan penelitian ini agar mengetahui di mana pihak swasta dapat ikut serta sebagai kemitraan penunjang keproyekan infrastruktur gas pekerjaan Customer Attachment. Pada penelitian ini menggunakan teori utilitarisme oleh Jeremy Bentham. Dan juga dalam penelitian ini menggunakan metode penelitian hukum normatif empiris. Dari hasil Penelitian ini menjelaskan bahwa pihak swasta dapat ikut serta sebagai kemitraan penunjang keproyekan infrastruktur gas pekerjaan Customer Attachment penyedia barang dan jasa bersama anak perusahaan PT Perusahaan Gas Negara Tbk (PGN) di lingkungan PT Perusahaan Gas Negara Tbk (PGN). Kata kunci: Distribusi Gas, Kemitraan, Keproyekan

Abstract

Insurance is an important instrument that functions as a savior when someone experiences a disaster, whether in illness, accident, or even death. General insurance is a critical task, especially if it is related to covering disasters that occur in a business. Banking customers have a guarantee of a return of their savings or deposits at the bank's institution and insurance. Customers do not have a guarantee of a return of the premium they have paid for the policy they own. This research aims to study, understand, and analyze the implementation of the Policy Guarantee Program as mandated by the Insurance Law. The research is normative juridical with a statutory regulatory approach involving primary and secondary legal sources and theoretical studies used to analyze problems related to insurance and premium guarantees. The results show that the Government has not seriously handled the issue of policy guarantees because it still imposes this task on the LPS. At the same time, the duties and authority of the PPP are very urgent, and the PPP is an independent institution, as is done by other countries.Keywords: Insurance, Policy, Policy Guarantee Program.

Abstract

Opening a savings account, a common practice in modern society, is subject to specific bank requirements, including the criterion of adulthood regulated by Indonesian law. This juridical research navigates challenges such as legal disparities and regulatory changes related to the criteria for opening savings accounts. Ethical considerations and consumer protection play a pivotal role in determining adulthood criteria, contributing to a nuanced understanding of the legal aspects of banking transactions. The study provides insights for banks to adapt account opening policies to Indonesia's evolving legal landscape. Despite technological advancements in the banking sector, compliance with account opening requirements remains crucial. The study sheds light on legal aspects, particularly digital identification and identity verification in the context of savings account opening. Legal frameworks such as Law No. 19 of 2016 and Bank Indonesia's regulations underpin the review of savings account opening requirements, addressing consumer protection and banking transaction security. Relevant to the banking industry's current technological landscape, this research aids regulatory compliance and fosters consumer trust in digital banking services. The study offers insights into how technology shapes savings account opening requirements, providing a foundation for enhancing banking policies in the digital era.

Abstract

The principle of taxation must fulfill the element of justice for all taxpayers including in the tax amnesty program. The elimination of taxes that should be owed and tax sanctions for taxpayers who participate in the tax amnesty program and the Voluntary Disclosure Program (PPS) is done by paying ransom. However, the small amount of ransom payment is allegedly not fulfilling the element of legal justice. The purpose of this study is to determine the implementation and effectiveness of the Tax Amnesty Law and PPS. The method used in this research is the normative juridical law study method, using a statutory approach in studying, examining and exploring the problems in this study. The conclusion is that the elimination of taxes that should be payable does not fulfill the principle of justice, while the exemption of tax sanctions has fulfilled the principle of justice. The implementation of the tax amnesty program is ineffective due to the insignificant tax revenue and compliance of tax return submission after tax amnesty and PPS, as well as the increase in tax ratio which tends to stagnate and even still below neighboring countries in ASEAN.

Abstract

Land stands as a fundamental aspect of human existence, serving as a cornerstone for meeting diverse needs and holding considerable economic significance. Its limited capacity often becomes a trigger for societal conflicts, spanning both vertical and horizontal dimensions. A well-crafted land policy holds the potential to foster community prosperity and ensure environmental sustainability. However, the imposition of state-driven evictions often leads to agrarian conflicts, undermining customary rights. This study examines the intricate relationship between land and humanity through the lenses of legal philosophy and the concept of land property rights within legal culture. Employing a formative juridical research approach, the authors aim to uncover a comprehensive human understanding rooted in philosophical perspectives, legal theory, dogmatic legal norms, and legal culture. From a philosophical standpoint, land represents a space where the spiritual connection between humans and their divine entities takes form. Furthermore, within the realm of legal culture, land is perceived as an integral part of the human essence, symbolizing the place of birth, growth, mortality, and final resting.

Abstract

Banks, recognized as trusted institutions mandated to mediate financial transactions by collecting and channeling funds, are legally authorized entities obligated to operate with utmost diligence to thwart suspicious transactions susceptible to exploitation for illicit activities, particularly money laundering crimes. This research endeavors to explore the pivotal role of banks in Indonesia in combating money laundering. Employing a normative legal research methodology with a statutory approach, the study investigates the mechanisms employed by banks to prevent money laundering. Abstract

A standard agreement is a legally binding document containing pre-formulated clauses that govern the relationship between banks and their customers. Although regulated by the Consumer Protection Act No. 8 of 1999, such agreements can unilaterally place customers in vulnerable positions, necessitating legal safeguards to ensure customer security and prevent potential harm. This study employs an empirical legal research method, analyzing how laws are applied in society by focusing on public behavior through the distribution of questionnaires. Based on the collected data, customer rights are generally well-protected, as indicated by respondents' high level of trust in banking institutions to safeguard their funds. Furthermore, a low number of respondents reported experiencing losses due to standard agreement clauses, resulting in few complaints to banks, regulatory institutions, or authorities.Keywords: Consumer Protection, Standard Agreement, Banking

Abstract

Early marriage is a contributing factor to low levels of health, education, and family welfare. Early marriage is a worldwide occurrence that warrants the attention of all stakeholders, including UNICEF. The objective of this study is to address the issue of early marriage in Indonesia by employing the quadruple helix approach and doing legal and economic analysis to effectively reduce the prevalence of early marriages. The author employed a type of normative juridical study that incorporated both national law and the Islamic legal method approach known as maqāṣid al-sharī‘ah. This was done by utilizing the quadruple helix and economic analysis of law (EAL) theory. Ultimately, early marriage is influenced by ineffective regulations as well as cultural, economic, and educational factors. To address this issue, it is crucial to establish a strong collaboration between academics, businesses, government, and society. Additionally, raising awareness among the public about the benefits of delaying marriage until the appropriate age can contribute to the well-being of couples, families, and society as a whole. This approach can also incentivize the community by facilitating access to education, the economy, and healthcare and addressing issues such as stunting.
