Abstract

Latar belakang penelitian ini berangkat dari maraknya keterlibatan anak di bawah umur dalam praktik judi online, yang semestinya menjadi generasi penerus bangsa namun justru terjerumus dalam tindak pidana karena faktor ekonomi dan pengaruh lingkungan. Penelitian ini bertujuan untuk menganalisis penegakan hukum dan upaya pencegahan tindak pidana judi online yang dilakukan oleh pelaku anak oleh Kepolisian Resor Pangandaran, dikaitkan dengan Undang-Undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik. Pendekatan penelitian yang diterapkan bersifat deskriptif kualitatif, dengan pengumpulan data yang dilakukan melalui pengamatan langsung, wawancara, serta penelusuran dokumen yang relevan. Hasil penelitian menunjukkan bahwa upaya penegakan hukum terhadap pelaku anak telah dilakukan sesuai dengan ketentuan Pasal 45 UU No. 1 Tahun 2024, namun implementasinya belum optimal karena kurangnya pengawasan dan kesadaran orang tua terhadap aktivitas anak di dunia digital. Upaya pencegahan yang dilakukan kepolisian masih terbatas pada penyuluhan di sekolah tanpa melibatkan peran aktif masyarakat luas. Oleh karena itu, diperlukan sinergi antara pihak kepolisian, lembaga pendidikan, orang tua, dan tokoh masyarakat dalam membangun kesadaran hukum serta literasi digital bagi anak.

Abstract

Penelitian ini bertujuan untuk mengevaluasi implementasi dan implikasi hukum perubahan nomenklatur Bank Perkreditan Rakyat (BPR) menjadi Bank Perekonomian Rakyat (BPR) berdasarkan Undang-Undang Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan (UU P2SK). Dengan menggunakan metode penelitian hukum deskriptif-analitis dan studi kasus di Kabupaten Bandung serta wilayah sekitarnya, penelitian ini menganalisis proses transformasi regulasi, dampaknya terhadap regulasi daerah, dan kontribusinya terhadap pembangunan ekonomi daerah. Data diperoleh dari peraturan perundang-undangan, publikasi OJK, LPS, BPS, serta laporan pemerintah daerah. Hasil penelitian menunjukkan bahwa perubahan nomenklatur BPR membawa konsekuensi hukum signifikan, terutama pada kewajiban penyesuaian dokumen hukum, sinkronisasi regulasi daerah, dan peningkatan tata kelola. Secara ekonomi, transformasi ini berpotensi memperkuat peran BPR dalam pembiayaan UMKM dan inklusi keuangan di daerah, meskipun masih terdapat keterbatasan data dan kesiapan kelembagaan di tingkat lokal. Temuan ini menegaskan pentingnya sinergi antara pemerintah pusat, pemerintah daerah, dan otoritas keuangan dalam mengawal transformasi BPR agar mampu mendorong pertumbuhan ekonomi daerah secara berkelanjutan.

Abstract

Hukum perkawinan adat di Indonesia masih memiliki eksistensi yang signifikan, meskipun berada di bawah tekanan unifikasi hukum nasional melalui Undang-Undang Perkawinan. Ketegangan antara hukum adat yang bersifat lokal dan fleksibel dengan hukum nasional yang lebih universal menciptakan dinamika yang kompleks, terutama dalam konteks adaptasi dan resistensi masyarakat adat. Penelitian ini menggunakan pendekatan hukum normatif-empiris, di mana data sekunder diperoleh melalui studi literatur peraturan perundang-undangan dan penelitian terdahulu, sementara data primer dikumpulkan melalui wawancara mendalam dengan pelaku hukum adat dan masyarakat lokal. Hasil penelitian menunjukkan bahwa hukum perkawinan adat tetap dipertahankan oleh masyarakat adat, terutama di Bali, Sumatera Barat, dan Kalimantan, meskipun di beberapa aspek terdapat penyesuaian terhadap aturan hukum nasional, seperti dalam pencatatan perkawinan dan perlindungan hak-hak perempuan. Di sisi lain, ditemukan adanya resistensi di beberapa daerah ketika hukum nasional dianggap bertentangan dengan norma adat yang sudah lama berlaku. Implikasi dari penelitian ini adalah perlunya kebijakan hukum yang lebih inklusif dan responsif terhadap pluralisme hukum di Indonesia, yang dapat mengakomodasi keberagaman tradisi lokal tanpa mengorbankan prinsip-prinsip keadilan sosial yang dijamin oleh hukum nasional.

Abstract

The Job Creation Law is one of the structural reform policies that have been implemented by the Indonesian government with the aim of improving the investment climate and expanding employment opportunities. Despite its positive aims, the law has also generated debate and controversy regarding the resulting implications for labor rights. This study aims to analyze the impact that the Job Creation Law has had on the protection of labor rights in Indonesia. This research uses a normative juridical method with a statutory approach. In addition, this research also includes monitoring changes in policies, company practices, and workers' attitudes towards the implementation of the Job Creation Law. The results of the research show that the work copyright law has been rejected by various community clusters with the view that it does not provide adequate benefits and protection for Indonesian workers or laborers. Some of the implications of this law for the protection of workers' rights in Indonesia based on Article 81 chapter IV of the Job Copyright Law which discusses employment are the abolition of several provisions regarding severance pay, ease of entry of foreign workers, abolition of the maximum limit for contract workers, and abolition of the system City/District Minimum Wage.

Abstract

This study aims to analyze the methods and schemes for industrial relations dispute resolution (PPHI) in order to improve the productivity of the labor law system in Indonesia. Unresolved industrial relations issues can negatively impact employment stability and national productivity. This study uses a qualitative approach with juridical-normative and juridical-sociological methods to examine laws and regulations and dispute resolution practices in the field. Data were collected through literature studies and interviews with legal practitioners, employers, and labor unions. The results indicate that an ideal PPHI scheme should be fast, fair, affordable, and easily accessible to the parties. In addition, increasing the capacity of dispute resolution institutions, such as mediation at the Manpower Office and arbitration institutions, significantly influences the effectiveness of labor law. Therefore, comprehensive improvements to the PPHI system are essential to create harmonious and productive industrial relations.

Abstract

The settlement of industrial relations disputes in labor law after the enactment of Law No. 2 of 2004 concerning the Settlement of Industrial Relations Disputes is known as a voluntary settlement model through bipartite, conciliation, mediation, and arbitration; and a mandatory settlement model, namely through the Industrial Relations Court. The existence of the Industrial Relations Court raises problems, both the knowledge of workers/laborers about formal law and material labor law, long processes, and inadequate legal substance. Problems regarding the settlement of industrial relations disputes can consist of many factors, namely disputes regarding rights, disputes of interest, disputes of rights, disputes over termination of employment and disputes between trade unions/labor unions in one company, in addition to that also regarding the competence of the Industrial Relations Court so that it cannot effectively resolve labor disputes. This research uses a normative juridical research approach. Considering that this research is normative legal research, the approach used is a normative juridical approach based on the study of positive law, namely Law No. 2 of 2004 and to examine the principles of justice. The research results identified several weaknesses, both in terms of legal structure and substance in the renewal of Industrial Relations Dispute Settlement in the Industrial Relations Court. Efforts to overcome this by reforming the settlement process in the Industrial Relations Court, namely by establishing a PHI in each District Court, Regency/City. The revision of Law No. 2 of 2004 is considered unable to accommodate and does not reflect the principles of simplicity, speed and low cost in the trial process in the Industrial Relations Court.

Abstract

Setiap tahun, Ikatan Dokter Indonesia (IDI) mencatat sekitar 210 kasus dugaan malpraktik medis di Indonesia yang melibatkan dokter umum maupun spesialis. Kasus-kasus tersebut berdampak pada reputasi tenaga medis dan citra rumah sakit, terutama jika berujung pada proses hukum perdata atau pidana. Di Kota Bekasi dan sekitarnya, sejumlah kasus serupa umumnya diselesaikan melalui jalur mediasi, meskipun sebagian berlanjut ke ranah hukum. Penelitian ini bertujuan menganalisis dua kasus persengketaan dugaan malpraktik medis oleh dokter dan perawat di salah satu rumah sakit di Kota Bekasi pada tahun 2024–2025. Pendekatan yang digunakan adalah kualitatif dengan metode yuridis normatif melalui studi kepustakaan dan wawancara. Hasil penelitian menunjukkan bahwa sengketa terkait tindakan pencabutan gigi oleh dokter spesialis bedah mulut dan pemasangan venflon infus oleh tim medis pada pasien anak diselesaikan secara damai melalui mediasi. Kesepakatan perdamaian tercapai tanpa melanjutkan ke jalur perdata maupun pidana. Proses ini sejalan dengan Pasal 310 Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan yang menekankan penyelesaian sengketa medis melalui mediasi. Penelitian ini menegaskan bahwa penyelesaian nonlitigasi lebih efektif menjaga hubungan baik antara pasien dan tenaga medis serta mengurangi dampak hukum dan psikologis bagi kedua pihak.

Abstract

This research examines the enforcement of the Advocate's Code of Ethics among fellow law enforcers in Indonesia, particularly in relation to the interactions between advocates, police officers, prosecutors, and judges within the criminal justice system. The study aims to analyze how violations of the Advocate's Code of Ethics affect the judicial process and to assess the effectiveness of existing enforcement mechanisms. A qualitative normative legal research approach was employed, focusing on secondary legal materials such as legislation, court decisions, and professional ethical guidelines. Data were collected through library research, drawing on legal documents and codes of ethics to examine the relationship between advocates and other law enforcement professionals within the Catur Wangsa framework. The findings indicate that breaches of professional ethics such as contemptuous conduct toward law enforcement officers or undue judicial influence adversely affect the integrity of the legal system. Such violations are subject to sanctions ranging from formal warnings to temporary suspension and, in severe cases, permanent dismissal from the professional organization. The study underscores the need for strengthened enforcement of the Advocate's Code of Ethics to uphold the fairness and transparency of the judicial process. This research offers significant insights into how the legal profession can cultivate greater accountability and mutual respect among law enforcement institutions, thereby contributing to a more equitable legal system in Indonesia.

Abstract

The development of industrial relations in Indonesia demonstrates a structural shift toward the dominance of informal and precarious employment, characterized by fixed-term employment contracts (Perjanjian Kerja Waktu Tertentu/PKWT) and outsourcing arrangements that often weaken legal protection and social security coverage. This study examines the gap between normative labor regulations and the practical implementation of legal protection for precarious workers in Indonesia. Rather than employing an empirical field-based method, the research adopts a qualitative socio-legal doctrinal approach, analyzing primary legal materials, including Law No. 13 of 2003 on Manpower, Law No. 11 of 2020 on Job Creation and its implementing regulations, Constitutional Court decisions, and relevant ministerial regulations as well as secondary legal literature and policy documents. The unit of analysis focuses on the regulation and governance of fixed-term contracts and outsourcing arrangements in the post–Job Creation reform period. The findings reveal three central themes. First, regulatory reforms aimed at increasing labor market flexibility have expanded the scope of fixed-term and outsourced work, thereby intensifying employment insecurity and blurring employment status. Second, although labor standards are formally regulated, substantive protection remains limited due to ambiguities in employment classification and weak enforcement mechanisms. Third, institutional constraints in labor inspection and dispute resolution mechanisms contribute to a predominantly reactive and fragmented enforcement pattern. These dynamics reflect structurally unequal industrial relations, where workers’ bargaining power remains limited and access to effective remedies is uneven. The study concludes that legal protection for precarious workers in Indonesia remains structurally constrained despite formal regulatory guarantees. To enhance effectiveness, the paper recommends strengthening labor inspection institutions, clarifying the legal boundaries of fixed-term and outsourcing arrangements, expanding access to legal aid and collective representation, and rebalancing labor policy to ensure that flexibility does not undermine fundamental labor rights.
