Abstract

This research aims to find out the protection of workers' rights for unilateral termination of employment (PHK) carried out by the company. specifically aims to find out: first, how is the form of legal protection of the rights of workers / labourers who experience unilateral termination of employment (PHK) carried out by the company based on Law Number 6 of 2023 concerning Job Creation, second, how can legal remedies be taken by workers / labourers who experience termination of employment (PHK) who are not fulfilled their rights by the employer. This research uses normative juridical legal research methods with a statue approach and conceptual approach. The results of this study indicate that in the event of termination of employment (PHK) has a legal regulatory basis listed in Article 151 of the Job Creation Law which discusses the ways to terminate employment (PHK). Exceptions regarding termination of employment (PHK) are contained in Article 153 of the Job Creation Law. Various reasons for termination of employment (PHK) can be done but not done in a unilateral manner by the company which will harm workers/labourers. Legal protection against unilateral termination of employment (PHK) has been regulated in Article 153 of the Job Creation Law, where in the termination of employment (PHK), the company will be responsible for the termination of employment (PHK).

Abstract

This study discusses the process of termination of employment (PHK) for reasons of retirement at PT Ascot and legal protection for the fulfillment of workers' rights based on the provisions of the applicable labor law in Indonesia. This study uses a normative juridical approach by examining laws and regulations such as Law Number 13 of 2003, Perppu on Job Creation, and Government Regulation Number 35 of 2021. The findings of the study show that the layoff process carried out by PT Ascot does not pay attention to the principle of fairness in compensation, where workers who have reached retirement age receive compensation that is equal to other workers. This is contrary to the positive legal provisions that give greater rewards to workers with long working periods. The study also emphasizes the importance of government oversight and the role of unions in ensuring the rights of retired workers. This study contributes to strengthening the legal protection of elderly workers and encouraging fair labor practices.

Abstract

Perubahan lanskap ketenagakerjaan akibat globalisasi dan revolusi industri menuntut sistem penyelesaian perselisihan hubungan industrial yang adaptif dan efektif. Penelitian ini bertujuan menganalisis metode dan skema PPHI dalam meningkatkan efektivitas sistem hukum ketenagakerjaan Indonesia. Metode yang digunakan adalah deskriptif-analitis dengan pendekatan normatif-empiris melalui telaah UU 13/2003 dan UU 2/2004, literatur bereputasi, serta pembacaan praktik mediasi, konsiliasi, arbitrase, dan PHI. Temuan menunjukkan: (1) sengketa didorong ketimpangan daya tawar, kepatuhan regulasi yang timpang, dan model kerja baru berbasis platform; (2) efektivitas mekanisme berjenjang masih terkendala durasi proses, kapasitas mediator/hakim, dan literasi hukum; (3) integrasi mekanisme non-litigasi, dialog sosial tripartit, dan digitalisasi prosedur berpotensi memangkas waktu penyelesaian dan biaya serta meningkatkan transparansi. Implikasinya, diperlukan strategi komprehensif yang menggabungkan penguatan kelembagaan dan SDM, pembaruan regulasi yang responsif terhadap gig economy, serta penerapan teknologi (termasuk AI) untuk analitik sengketa guna memperkuat perlindungan pekerja sekaligus menjaga iklim investasi yang sehat

Abstract

Permasalahan perlindungan hukum bagi pekerja outsourcing di Indonesia menjadi isu penting dalam dinamika hubungan industrial, baik di tingkat nasional maupun global. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum bagi pekerja outsourcing, mengidentifikasi hambatan implementasi, serta membandingkannya dengan praktik terbaik di beberapa negara lain. Penelitian menggunakan pendekatan yuridis normatif dan empiris, dengan data primer diperoleh melalui wawancara mendalam terhadap 28 informan, meliputi pekerja outsourcing, manajer HRD, pengawas ketenagakerjaan, dan aktivis serikat buruh, sedangkan data sekunder diperoleh dari literatur akademik, jurnal bereputasi, dan laporan resmi. Hasil penelitian menunjukkan adanya kesenjangan signifikan antara kerangka hukum dan implementasi di lapangan, ditandai dengan lemahnya pengawasan, rendahnya literasi hukum pekerja, dan minimnya perlindungan serikat buruh. Perbandingan dengan praktik internasional menunjukkan bahwa negara-negara seperti Jerman, Belanda, Filipina, dan India berhasil memperkuat perlindungan pekerja melalui regulasi ketat, pengawasan berbasis teknologi, dan penerapan prinsip kesetaraan upah.

Abstract

The management of HIV/AIDS cases in correctional facilities faces various challenges related to medical confidentiality, social stigma, and limited healthcare facilities. This study aims to examine the implementation of medical confidentiality in HIV/AIDS management in correctional facilities, considering both medical ethics and legal perspectives. Prisons, as detention centers that tend to be overcrowded, are high- risk environments for the spread of infectious diseases, including HIV/AIDS. The stigma associated with prisoners infected with HIV/AIDS often prevents them from accessing necessary healthcare services, further complicating their treatment. This study analyzes existing regulations concerning medical confidentiality, as well as the obstacles that arise in the practice of HIV/AIDS management in correctional facilities, with a focus on health policies and the role of medical staff in balancing confidentiality and disease prevention. The results of the study indicate that clear policies regarding the management of medical information are essential to prevent violations of prisoners' rights, as well as to facilitate more effective prevention and treatment of HIV/AIDS.

Abstract

Hukum perkawinan adat di Indonesia masih memiliki eksistensi yang signifikan, meskipun berada di bawah tekanan unifikasi hukum nasional melalui Undang-Undang Perkawinan. Ketegangan antara hukum adat yang bersifat lokal dan fleksibel dengan hukum nasional yang lebih universal menciptakan dinamika yang kompleks, terutama dalam konteks adaptasi dan resistensi masyarakat adat. Penelitian ini menggunakan pendekatan hukum normatif-empiris, di mana data sekunder diperoleh melalui studi literatur peraturan perundang-undangan dan penelitian terdahulu, sementara data primer dikumpulkan melalui wawancara mendalam dengan pelaku hukum adat dan masyarakat lokal. Hasil penelitian menunjukkan bahwa hukum perkawinan adat tetap dipertahankan oleh masyarakat adat, terutama di Bali, Sumatera Barat, dan Kalimantan, meskipun di beberapa aspek terdapat penyesuaian terhadap aturan hukum nasional, seperti dalam pencatatan perkawinan dan perlindungan hak-hak perempuan. Di sisi lain, ditemukan adanya resistensi di beberapa daerah ketika hukum nasional dianggap bertentangan dengan norma adat yang sudah lama berlaku. Implikasi dari penelitian ini adalah perlunya kebijakan hukum yang lebih inklusif dan responsif terhadap pluralisme hukum di Indonesia, yang dapat mengakomodasi keberagaman tradisi lokal tanpa mengorbankan prinsip-prinsip keadilan sosial yang dijamin oleh hukum nasional.

Abstract

This research analyzes the role of professional ethics in the context of the use of intelligence by law enforcement agencies, with a focus on the police. Through a literature study approach, the professional ethics framework in police law is examined to understand how the collection, analysis and use of intelligence information is regulated. Next, the impact of violations of professional ethics in the use of police intelligence on human rights, individual privacy, and the integrity of law enforcement agencies is analyzed. This study concludes that maintaining compliance with the principles of professional ethics is essential in maintaining a balance between public safety and the protection of individual human rights

Abstract

This research investigates the comparison of professional ethics between legal practice and medical practice and how practitioners in both fields face ethical dilemmas and resolve moral conflicts. Through comparative analysis, we clarify the similarities and differences in the ethical codes and moral principles governing the practice of law and medicine and their implementation in practical situations. We found that both professions have a focus on individual interests, integrity, and fairness, although there are differences in the emphasis and application of these values. Legal practitioners and physicians face complex ethical dilemmas daily, and they rely on the guidance of ethical codes, moral principles, and consultation with colleagues or ethics committees to resolve moral conflicts that arise. Continued research could deepen understanding of the factors that influence ethical decision making and develop more effective strategies for dealing with moral challenges in the workplace

Abstract

Praktik politik uang dalam pemilihan umum di Indonesia tetap menjadi ancaman serius terhadap integritas demokrasi, meskipun Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum telah mengatur larangan dan sanksi terhadap pelakunya. Penelitian ini bertujuan untuk mengevaluasi efektivitas pencegahan dan penegakan hukum terhadap politik uang berdasarkan implementasi undang-undang tersebut, serta mengidentifikasi faktor-faktor penghambatnya. Metode penelitian menggunakan pendekatan normatif-empiris dengan analisis data dari wawancara dengan pejabat Bawaslu dan laporan resmi pemilu. Hasil penelitian menunjukkan bahwa lemahnya koordinasi antar lembaga penegak hukum, keterbatasan sumber daya manusia, dan intervensi politik menghambat penegakan hukum yang efektif. Selain itu, penerimaan politik uang oleh masyarakat di wilayah pedesaan, akibat minimnya pendidikan politik, memperparah permasalahan. Penelitian ini menyarankan perlunya reformasi struktural dalam koordinasi antar lembaga, penguatan kapasitas Bawaslu, serta peningkatan pendidikan politik untuk masyarakat. Implikasi dari penelitian ini menekankan perlunya perbaikan penegakan hukum dan kesadaran masyarakat untuk menciptakan pemilu yang bersih dan adil.

Abstract

The Business Competition Supervisory Commission (hereinafter referred to as the commission) plays the role of supervising and enforcing Law Number 5 of 1999 concerning Prohibition of Monopoly Practices and Unfair Business Competition (hereinafter referred to as the LPM and PUTS Law). This role is carried out by examining, investigating, and even imposing fines on business actors who violate this law, such as in cases of business discrimination carried out by PT. Garuda Indonesia (hereinafter referred to as PT. GI) which has been decided by the commission panel through its decision number 06/KPPU-L/2020, and the business discrimination case carried out by Lion Air Group (hereinafter referred to as LAG) which has also been decided by the commission panel through its decision number 07/KPPU-I/2020. This research examines the role of the commission and fines in the two a quo decisions. The type of research used is normative legal research, with a statutory approach, case approach and comparative approach. The data used is secondary data. The data is then analyzed by carrying out legal interpretation. Research findings show that the role of the commission has not been maximized in the two a quo cases, this can be seen from the light fines for business actors in the two a quo decisions. The fines imposed on business actors are ineffective because they do not take into account the profits received by business actors from their discriminatory behavior. Estimated profits should be the basis for calculations, and the imposition of fines can be adjusted based on the value of the transactions carried out, so that if the amount of the fine imposed is too small, then business actors who act discriminatorily can still gain profits from their behavior, which ultimately leads to the aim of imposing penalties. , namely causing a deterrent effect, being unattainable.
