Abstract

In environmental crimes, if a corporation has been sentenced to a criminal sentence, it is as if the sentence has been fulfilled. Considering that environmental crimes can result in many victims, both physically and psychologically, who feel disadvantaged as a result of criminal acts committed by corporations. However, along with the number of environmental crime cases, there are also many rights of social victims and social objects that have not been fulfilled. Therefore, this research wants to find the ideal legal protection for victims of environmental crimes. This research method uses a qualitative type of literature review. Primary data source UUD RI and research journals. This data analysis uses content content. The results of the study show that the main form of legal protection for victims of environmental crimes besides the form of Corporate Social Responsibility (CSR) is environmental restoration for the benefit of environmental preservation. In resolving environmental disputes, the parties can use out-of-court channels, namely mediation or court channels with the concept of restorative justice that emphasizes the rights of victims and the interests of perpetrators of environmental crimes.

Abstract

In the digital era, personal data protection has become a crucial aspect to maintain social stability and public trust. This article examines the implementation of the principle of caution in personal data protection in Indonesia based on Law Number 27 of 2022 concerning Personal Data Protection. This research uses a normative method with a conceptual and legislative approach, supported by descriptive- qualitative analysis. The results show that despite the regulations being implemented, there are still several obstacles such as lack of understanding, technological limitations, high costs, shortage of experts, and suboptimal coordination between institutions. To overcome these obstacles, efforts are needed to increase education and socialization, invest in security technology, train experts, and enhance coordination between related institutions. Thus, personal data protection in Indonesia can be more effective in facing the challenges of the digital era.

Abstract

The importance of the existence of Green Open Space (RTH) in urban areas is undeniable. From the view of many experts, the existence of Green Open Space (RTH) is important for improving air quality in urban areas, regulating urban microclimate, sweeping dust in urban areas, reducing noise, supporting water management systems in urban areas, supporting germplasm preservation, as well as supporting urban use and management. land preservation. The aim of this research is to find synchronization of the role of the Samarinda City Government's policies in efforts to realize Taman Sejati as a Green Open Space with local wisdom for the Samarinda City Community. The local wisdom of living communities needs to be actualized and strengthened in the form of regulations by the Regional Government of Samarinda City in the form of regional government policies so that it can be accepted in plural and heterogeneous society. Taman Sejati as a green open space that embodies local wisdom can be used as a model for protecting, maintaining and preserving the natural resources of Samarinda City.

Abstract

This study analyzes the forms of maladministration in the issuance of Mining Business Permits (IUP) and examines the legal responsibilities that may be imposed on officials or government institutions involved in such practices. The research employs a normative legal method using statutory, conceptual, and case approaches. The legal materials consist of primary, secondary, and tertiary sources, which are analyzed qualitatively to identify the applicable legal norms and accountability mechanisms. The findings indicate that maladministration in mining licensing may occur in several forms, including abuse of authority, procedural deviations, prolonged delays, neglect of legal obligations, and conflicts of interest. These practices may create legal uncertainty, social harm, environmental damage, and potential state losses. In legal terms, such maladministration may give rise to administrative, civil, and criminal liability depending on the nature of the violation and the consequences caused. Administrative responsibility may result in sanctions, cancellation of decisions, or revocation of permits; civil responsibility may involve compensation for harmed parties; and criminal responsibility may apply when the act fulfills the elements of corruption or abuse of authority. The study also shows that oversight institutions, particularly the Ombudsman and administrative courts, play a vital role in preventing and addressing maladministration in the mining permit process. Strengthening these accountability mechanisms is essential to ensure good governance, legal certainty, and public interest protection in the management of mineral and coal resources.

Abstract

This study aims to formulate a model of legal protection based on local wisdom that is capable of safeguarding the social sustainability of small-scale oil palm farmers in East Kalimantan Province. This research is based on the reality that small-scale oil palm farmers frequently face legal uncertainty, economic inequality and the marginalisation of local wisdom values due to the expansion of the plantation industry. Therefore, a legal framework is required that is not only grounded in formal regulations but also accommodates local cultural values and Islamic principles. The method employed is sociological legal research using an interdisciplinary approach. Primary data was obtained through interviews with small-scale farmers, traditional leaders, religious figures and village officials in Paser Regency and Kutai Kartanegara Regency. Secondary data was gathered from legislation, academic literature, as well as fatwas and principles of Sharia. The analysis was conducted by integrating development law theory, justice theory, concepts of local wisdom and Islamic principles that emphasise the values of maslahah (public interest), ‘adl (justice) and hifz al-bi’ah (environmental protection). The research findings indicate that legal protection for small-scale oil palm farmers remains weak because existing regulations have not accommodated the social sustainability of small-scale farmers due to the dominance of an industrial paradigm in plantation management. An integrative legal protection model combining positive law, local wisdom, and the principles of Maqasid Shari’ah is proposed as an alternative to achieve substantive justice, social sustainability and environmental protection, is illustrated through the “Tali Bapintan Adat Paser” model a form of preventive legal protection comprising three main elements: land restitution based on customary consultation (mufakat adat), a social safety net (through corporate zakat (qardhul hasan), and the application of Shari’ah contracts such as musaqah.
