Abstract

AbstrakPerkembangan ekonomi syariah dibidang keuangan syariah sangat pesat, dengan pertumbuhan tersebut harus mengacu pada regulasi yang berlaku dan mennjadi bagian dari sumber serta norma dalam menjalankan kegiatannya. Metode yang digunakan dalam penelitian ini ialah kualitatif deskriptif dengan teknik dalam menggubnakan datanya ialah literature atau pustaka. Hasil dari penelitian ini yaitu al-qur’an dan hadits menjadi bagian dari sumber ekonomi syariah yang utama, sedangkan dari sisi hukum positif sebagai sumber hukum yakni bagi pelaku perbankan syariah berlaku Undang-Undang No 21 tahun 2008 tentang perbankan syariah. Untuk kalangan koperasi syariah berlaku Undang-undang No. 25 tahun 1992 tentang perkoperasian. Dari kedua UU tersebut, terkandung di dalamnya nilai-nilai ke-Islaman, dan hal ini merupakan nilai positif bahwa Al-Qur’an dan Hadits merupakan bukti atas rahmatan lil’alamin yang tidak akan pernah salah. Dalam kegiatan ekonomi syriah harus mengacu pada norma-norma terkait yaitu bebas riba, bebas maisir, harus sesuatu yang halal.Kata Kunci: Sumber, Norma, Ekonomi Syariah

Abstract

AbstrakEkonomi yang berlandaskan syari’ah memiliki konsep dan ajaran yang dapat memberikan kesejahteraan secara merata kepada umat manusia. Maka dari itu filsafat ekonomi syariah menjadi kunci utama dalam pembangunan perekonomian manusia. Tujuan dari penelitian ini adalah untuk membahas eksistensi filsafat ekonomi syari’ah di era digital (kenapa filsafat ekonomi syari’ah diperlukan? Penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif. Dengan menjelaskan pandangan Muhammad Abdul Mannan tentang pentingnya ilmu ekonomi Islam. Hasil penelitian menunjukkan bahwa eksistensi ekonomi Islam di era digital mulai meningkat. Hal ini tidak hanya diakui oleh internal umat Islam, tetapi juga oleh kalangan non muslim. Urgensi sistem ekonomi Islam memberikan kesadaran kuat bahwa ekonomi Islam dapat menanggulangi permasalahan yang muncul dari sistem ekonomi konvensional. Ada tujuh alasan yang membuat ilmu ekonomi Islam sangat diperlukan; kepentingan ideologi (ideological imperatives), kepentingan ekonomi (economics imperatives), kepentingan sosial (social imperatives), kepentingan moral dan etika (moral and ethical imperatives), kepentingan politik (political imperatives), perspektif Sejarah (historical perspective), dan kepentingan internasional (international imperatives). Alhasil, perbankan syariah yang notabene sebagai lembaga keuangan yang sesuai dengan ideologi bangsa Indonesia perlu dikembangkan, sehingga perekonomian di Indonesia dapat maju dengan mengembangkan perbankan-perbankan syariah.Kata Kunci: Filsafat;Ekonomi Syari’ah; Landasan Filosofis; Perbankan Syari’ah

Abstract

Era digital atau biasa dikenal dengan istilah 4.0 dimana segala sesuatu diupayakan beralih menuju digitallisasi. Salah satu dampak dengan adanya digitalisasi yakni dalam bidang muamalah (transaksi jual beli). Terlebih saat ini di Indonesia mengalami wabah virus corona (Covid-19), dimana pemerintah memberikan aturan hidup kepada masyarakat agar aktivitas dilakukan di rumah saja sebagai upaya perindungan diri. Aktivitas tersebut akan memberikan lonjakan dalam transaksi jual beli secara online, baik itu melalui shoope, tokopedia, lazada, dan lain sebagainya. Perlu adanya upaya hukum untuk mengidentifikasi apakah transaksi tersebut sudah sesuai hukum dalam bermuamalah yaitu fiqih muamalah? Metode yang digunakan dalam penelitian ini yakni metode penelitian hukum dengan analisis kualitatif, pendekatannya menggunaan dara normative. Hasil penelitiannya yakni transaksi online sudah sesuai dengan fiqih muamalah, penggunaan akadnya ialah akad salam. Hal ini karena masarakat memesan dengan memberikan ciri-ciri dari obyek barang yang akan dibeli, sedangkan penjual telah memberikan deskripsi dari barang itu sendiri dengan detail.

Abstract

Penelitian ini adalah untuk menelusuri peran perbankan syariah dalam pembangunan perekonomian nasional serta respon masyarakat akan kehadiran perbankan syariah di Indonesia, penulis mengarahkan tulisan ini kepada kebijakan baru pemerintah dalam melakukan merger terhadap bank syari’ah BUMN. Jenis penelitian ini menggunakan metode penelitian hukum normatif atau doctrinal legal research yang merupakan jenis penelitian kepustakaan atau studi dokumen. Hasil penelitian menunjukkan bahwa perkembangan ekonomi syari’ah di Indonesia memberikan dampak yang positif dan mendapat perhatian negara. Perlu mengembangkan kepercayaan yang tinggi dari pemerintah sebagai pengelola dan pembuat relgulasi untuk meyakinkan masyarakat bahwa ekonomi syari’ah yang dijalankan di Indonesia bisa meningkatkan perekonomian umat.

Abstract

The purpose of this study is to reveal the sharia compliance of the halal tourism business in Bandung Regency, where halal tourism in its implementation must be carried out by prioritizing the principles of Islamic business ethics (Professional Ethics), meaning that the principles of Islamic business ethics in the context of halal tourism in Bandung Regency must submissive (obedient) in a syar'i, especially in promoting the principles of Islamic business ethics, namely by prioritizing Islamic services with the aim of providing comfort for Muslim tourists in particular. In addition, the principles of Islamic service are expected to be able to realize professional ethics in doing business in an Islamic way, especially in carrying out halal tourism activities, especially for tourism industry players in Bandung Regency. This literature review uses the theory of Islamic business ethics as coined by Hamid Salam and Abdalla Hanafi including: a) Ethics to always convey the truth; b) Ethics to be trusted; c) Ethics to do something sincerely; d) Brotherhood ethics; e) Mastery of science; f) Ethics of Justice. The findings of this study are the principles of Islamic business ethics (professional ethics) in the implementation of the halal tourism business in Bandung Regency referring to the Bandung Regency Regional Regulation (Perda) Number 6 of 2020 concerning Halal Tourism, where there are several principles that must be met in running tourism. Halal in Bandung district which includes: a). set as needed; b). facilitate; c). according to ability; d). gradually; e). priority scale; and f). Inclusive. In addition, there is the concept of the Code of Ethics for Tourism (GCET) or the Global Tourism Code of Ethics as a reference for sustainable tourism development in Bandung Regency which includes economic, social, cultural, and environmental components. This is because Indonesia is not an Islamic country but a country where the majority of the population is Muslim, so it is necessary to prioritize the values of Rahmatan lil 'Alamin in business (muamalah), especially in terms of additional service activities in halal tourism in Bandung Regency. In addition, indicators of sharia compliance in halal tourism in Bandung district are referring to 2 regulations, namely local regulations (perda) Bandung district number 6 of 2020 concerning halal tourism, and DSN-MUI fatwa No: 108/DSN-MUI/2016 concerning guidelines for tourism implementation. based on sharia principles.

Abstract

The problem of fiqh continues to develop toward the progress of the times, the purpose of this study is to examine the comparison of fiqh about buying and selling connected between the concept of fiqh in Islam and buying and selling online. The method in this study uses a qualitative method with literature or library research. The research materials were obtained from the books, scientific journals, and the internet related to fiqh comparisons about buying and selling. The results of the study showed that Islam clearly regulates buying and selling, related to online buying and selling in the form of e-commerce through online buying and selling applications, it is legal as long as the business does not contain prohibited elements. Online sales transactions where the goods are only based on the description provided by the seller are considered valid, but if the description of the goods does not match then the buyer has the right of khiyar which allows the buyer to continue the purchase or cancel it. The practice of khiyar in e-commerce transactions can be seen in the form of the consumer's ability to return goods, returned goods can be exchanged for similar goods or ask for a refund that has been paid.

Abstract

The purpose of this study is to analyze the reconstruction of Islamic sharia implementation policies during the Islamic Empire in Indonesia from the perspective of siyasah syar'iyyah and their relevance to Indonesian government policies in regulating Islamic financing instruments in Cash Waqf Linked Retail Sukuk (CWLS Retail). The statutory approach and descriptive analysis are used in this research. Sources of data were obtained from various literary materials both from books, journals and the internet, as well as other relevant sources regarding the politics of Islamic law (siyasah syar'iyyah) during the Islamic period and its relevance to the regulation of Islamic financing instruments in Indonesia, especially with regard to the application of retail sukuk cash waqf (CWLS Retail). The results of the study show that first, the political application of Islamic law during the Islamic empire in Indonesia was carried out through the politics of the king's power (ruler). Second, the application of political Islamic law has relevance to current Indonesian government policies, namely in regulating Islamic financing instruments for Cash Linked Retail Sukuk (CWLS Retail), where the Government through various Islamic policies is embodied through laws, government regulations, MUI Fatwa, and other regulations. However, implementing this policy requires 6 variables of Islamic politics (siyasah syar'iyyah) in the opinion of Ibn Khaldun, namely mutual synergy between law, government, society, economy, development and justice.

Abstract

This study investigates the integration of QRIS (Quick Response Code Indonesian Standard) in mosque architecture as both a digital innovation and a cultural intervention. Using qualitative case studies of three iconic mosques in Indonesia: Al-Jabbar (Bandung), Sheikh Zayed (Solo), and Hubbul Wathan (Lombok), the research analyzes how QRIS impacts visitor experience, philanthropic participation, and the preservation of architectural and cultural values. Drawing on theories of technology acceptance, vernacular architecture, and experiential learning, the study finds that QRIS can enrich mosque functionality without disrupting sacred spatial aesthetics. It also reveals the importance of inclusive design in ensuring that digital tools benefit diverse visitor groups. While emphasizing the transformative potential of QRIS, the study also notes challenges related to digital literacy and infrastructural disparities. This research contributes to current debates on digital heritage, smart religious spaces, and the adaptive use of technology in sustaining Islamic cultural identity.

Abstract

The institutional framework and sustainability of waqf in Indonesia hold immense potential for supporting the social and economic development of the Muslim community. However, despite its promise, the sector remains fragmented, and its utilization has not yet been optimized due to the lack of specific legal regulations governing stock waqf. This study analyzes the regulatory framework for stock waqf from the perspectives of institutionalization and sustainability in Indonesia. Employing a qualitative method through normative legal research using a conceptual approach, this study examines the reconstruction of stock waqf from the perspectives of institutionalization and sustainability in Indonesia. The research findings emphasize the need for legal reconstruction regarding the institutional framework and sustainability of stock waqf to integrate collaborative legal regulations among the Indonesia Stock Exchange, the Financial Services Authority, and the Indonesian Waqf Board, as well as to strengthen Islamic financial literacy. Collaborative legal regulation is not only necessary for operational effectiveness but also to integrate waqf into a modern economic framework, including the integration of digital governance systems and the strengthening of electronic nazhir certification systems without compromising their ethical foundations. Recommendations include strengthening specific legal regulations for stock waqf, fostering synergy between the government and religious authorities, and implementing collaborative legal integration among the Indonesia Stock Exchange, the Financial Services Authority, and the Indonesian Waqf Board. These findings contribute to the reconstruction of the endowment system from an institutional perspective and to the sustainability of endowments that are responsive to national socioeconomic needs and the needs of the endowment itself.

Abstract

Fairness in inheritance distribution between men and women in Indonesia is still an exciting topic to discuss. It is proven that classical Islamic thought says that men's and women's portions in inheritance distribution are final, as stated in the Qur'an Surat an-Nisa verse 11. However, contemporary Islamic thought sees it as a rule that needs to be contextualized to current situations. This progressive thinking about inheritance distribution was pioneered by gender activists who saw that Fiqh Mawaris has a gender bias and discrimination. Therefore, the application of the "gender-friendly justice" concept in the inheritance distribution in Indonesia needs to be put forward. This research analyses the "gender-friendly justice" concept in inheritance law and its application in Indonesia. This study uses Sigmund Freud's gender theory, with an analytic descriptive method focusing on the problem of inheritance distribution in Indonesia. The research results prove that the concept of "gender-friendly justice" in the inheritance distribution refers to the agreement principle and the gender equity principle, where the application is carried out based on the fairness principle. The gender equality principle is implemented by prioritizing the concept of rahmatan lil'alamin, namely equality as servants and caliph of Allah, equality in receiving primordial agreements and cosmic drama events, and reaching achievements.
