Abstract

In order to implement the maximum national vaccination program, President Joko Widodo issued Presidential Regulation (Perpres) Number 14 of 2021 concerning Amendments to Presidential Decree Number 99 of 2020 concerning Procurement of Vaccines and Implementation of Vaccinations in the Context of Overcoming the 2019 Corona Virus Disease (Covid-19) Pandemic. The Presidential Decree contains provisions governing the procurement of vaccines and the implementation of vaccinations in the context of dealing with the Covid-19 pandemic. Regarding administrative sanctions, it is one of the things regulated in this regulation. The administrative sanctions in question are aimed at people who have previously been declared as target recipients of the Covid-19 vaccine and basically this is contrary to Law No. 36 of 2019. People who then refuse to receive Covid-19 vaccination may be given administrative sanctions. These sanctions are stated in Article 13A paragraph (4) which states: "Every person who has been designated as a target recipient of the Covid-19 vaccine who does not take part in the Covid-19 vaccination as intended in paragraph (2) may be subject to administrative sanctions, in the form of, Postponement or termination of the provision of social security or social assistance. Postponement or termination of government administration services, and/or fines. This research method uses a normative juridical review method. This research is expected to increase knowledge for writers and readers regarding the Covid-19 Vaccination Policy Based on Presidential Regulation Number 14 of 2021 Amendments to Presidential Regulation Number 99 of 2020 concerning Implementation and Procurement of Vaccinations in Efforts to Control the Covid Virus -19.The legal policy that the public will accept if they refuse to be given the Covid-19 vaccine, in Article 13A paragraph 4 and paragraph 2, is that every person who has been designated as a target recipient of the Covid-19 vaccine who does not take part in the Covid-19 vaccination, may be subject to administrative sanctions in the form of: postponement or termination of the provision of social security or social assistance; Delays in administrative services cause obstacles to the implementation of controlling the spread of Covid-19. In addition to being subject to sanctions, sanctions can be imposed in accordance with the provisions of Law Number 4 of 1984 concerning infectious disease outbreaks. The appropriate government policy regarding the issue of implementing vaccination in efforts to contain the Covid-19 virus is to review Presidential Decree No. 14 Article 13 A regarding the obligation that every citizen is obliged to carry out vaccination and if this is not carried out, administrative sanctions will be imposed; re-collect data regarding vaccination recipients, especially the elderly and people who have congenital diseases; and aligning the presidential decree with the contents of Health Law Number 36 of 2009 that every citizen has the right to determine the health facilities they will receive without any coercion from any party.

Abstract

The 1945 Constitution (UUD 1945) is one of the sources of Indonesianlaw. The age limit is stated in Article 169 letter q of Law Number 7 of 2017concerning Elections so it is felt to be inappropriate because the ConstitutionalCourt is a judicial institution or negative legislator, which means it does notimmediately make new rules and add legal norms to Law Number 7 2017concerning General Elections. The Constitutional Court has no authority toreplace or insert new norms into the content (paragraphs, articles and/or parts)of laws that have been declared contrary to the 1945 Constitution and thereforedo not have binding legal force.This type of legal research can be categorized as using a normative type oflegal research. Normative legal research is library legal research. The datasources used are secondary data consisting of primary legal materials, secondarylegal materials and tertiary legal materials. The data collection technique comesfrom the library research method. After the data is collected, conclusions aredrawnFrom the results of the research, 2 (two) main things were obtained,namely first, even though a judicial tip occurred, a criminal act or violation of thecode of ethics committed by a judge, does not make the Constitutional Court'sdecision invalid or wrong. Second, in this case the role of the ConstitutionalCourt is as a judicial institution which has the task of examining laws that arealready in force or that have been passed.Keyword: Constitutional Court, Ethics, Conflict of Interest

Abstract

This research analyzes juridically the regulation and ideal criteria of theSelection Committee for the Supervisory Board of the Corruption EradicationCommission (KPK) based on Law Number 19 of 2019 concerning the SecondAmendment to Law Number 30 of 2002 concerning the KPK. The existence of theKPK Supervisory Board has been met with pros and cons because it is consideredto be able to affect the independence of the anti-corruption institution. Theformation of the Supervisory Board is feared to actually erode the authority andinternal supervisory function of the KPK and disrupt the corruption eradicationprocess.This research is a normative legal research with a qualitative approachthat examines secondary data in the form of primary and secondary legalmaterials. Primary data is obtained from relevant laws and regulations such asLaw Number 19 of 2019 and its derivative regulations, while secondary data isfrom legal literature such as books, scientific journals, research results, andscientific articles. The thinking method used is the deductive method to drawconclusions from general statements to specific ones, and inductive to concludefrom specific matters to general ones.This research analyzes juridically the regulation of the SelectionCommittee for the Supervisory Board of the Corruption Eradication Commission(KPK) based on Law Number 19 of 2019 concerning the Second Amendment toLaw Number 30 of 2002 and examines the ideal criteria for the selectioncommittee.. Abstract

In order to realize the availability of accessibility of transportation facilities and infrastructurefor people with disabilities, a full understanding of policy makers is still needed both in the center and inthe Pekanbaru City area. There are still many public facilities and infrastructure that need attention.People with disabilities have the same right to mobility in order to fulfill their daily activities. Providingaccessibility for people with disabilities is an obligation, not a compulsion. Article 17 paragraph (1) of theRiau Provincial Regulation Number 18 of 2013 concerning the Protection and Empowerment of Peoplewith Disabilities states that every person with disabilities has the right to the provision of accessibility inthe utilization and use of public facilities and infrastructure, the environment and transportation facilitiesand infrastructure.This type of research is sociological legal research, because it is based on field research,namely by collecting data through interviews, questionnaires, and literature studies, reviews related to theproblems to be studied assisted by primary, secondary and tertiary data. This research was conducted atthe Pekanbaru City Transportation Service, the Pekanbaru City Social Service, while the population andsample were all parties related to the problem being studied. This research uses qualitative data analysisand produces descriptive data.From this study, it can be concluded that the implementation of the fulfillment of the rights ofpersons with disabilities in the use of transportation facilities and infrastructure has not been runningoptimally. Inhibiting factors in the implementation of the fulfillment of the rights of persons with disabilitiesin the use of transportation facilities and infrastructure are due to inadequate budget factors, unpublishedsupporting regulations, weak human resources, limited facilities and infrastructure, and lack ofsocialization, education and supervision from the Pekanbaru City Social Service and the Pekanbaru CityTransportation Service. Efforts made by the Pekanbaru City Government through the Pekanbaru CityTransportation Service in implementing the fulfillment of the rights of persons with disabilities are toincrease the procurement and renovation of special road signs/markings for persons with disabilities,provide bus stops and terminals that are more friendly to persons with disabilities.Keywords: Disability, Implementation of Regional Regulations, Transportation Facilities andInfrastructure

Abstract

Every Indonesian citizen has the same right to get public services provided by the government, including the blind. The blind need special facilities in carrying out their activities in public spaces, such as the accessibility of guide lines/tactile paving. The purpose of this study is to explain the implementation of accessibility rights for the blind in Pekanbaru City. This type of empirical research is used in this study, with a sociological approach, which aims to observe the fulfillment of accessibility rights for blind people in Pekanbaru City. The results found, the provision of tactile paving in Pekanbaru City is still very minimal. It can be concluded that, the implementation of the fulfillment of guideline accessibility rights for persons with visual disabilities in Pekanbaru City has not been carried out properly, and the obstacles to fulfilling guideline accessibility rights in Pekanbaru City are regulatory issues, budgets which result in the unavailability of sidewalks on the roadside. Abstract

This research delves into the critical role of women within the Village Consultative Body in Siak, Indonesia, with the aim of bolstering their involvement in local community empowerment endeavors. Employing a comprehensive sociological-legal research approach and drawing from a diverse array of data sources—ranging from primary field research to secondary and tertiary literature—the study offers profound insights into the multifaceted dynamics of women's roles within these bodies. Despite strides made in recent years towards gender equality, the study reveals persistent limitations hindering women's full participation in the Village Consultative Body. Cultural norms, deeply ingrained in societal structures, often perpetuate traditional gender roles, constraining women's agency in decision-making processes. Additionally, disparities in education levels and limited access to resources further marginalize women's involvement. However, amidst these challenges, the study illuminates the invaluable contributions of women to community development within the Village Consultative Body. Their participation not only brings diverse perspectives to the decision-making table but also fosters the development of better human resources within the community. In light of these findings, the study advocates for concerted efforts to bolster women's engagement in local governance structures. This includes initiatives aimed at challenging and reshaping entrenched cultural norms that inhibit women's agency, as well as addressing systemic barriers to education and resource access. Furthermore, recognizing the vital role of women in community development, the study underscores the need for targeted interventions to support and empower women within the Village Consultative Body. In conclusion, the research underscores the imperative of addressing the multifaceted challenges faced by women in their pursuit of equality and active participation in local developmental processes. By fostering an environment that values and amplifies women's voices and contributions, local governance structures can become more inclusive, responsive, and effective in addressing the diverse needs of their communities.

Abstract

Introduction: The circulation of alcoholic beverages in Tembilahan District is a social problem that requires strict supervision from the local government. Based on the Regional Regulation of Indragiri Hilir Regency Number 3 of 2023, supervision of the circulation of alcoholic beverages is the responsibility of the Pamong Praja Police Unit to maintain public order, peace, and community protection. Purposes of the Research: The purpose of this study is to find out the Regional Government's supervision of the circulation of alcoholic beverages in Tembilahan District, to find out the inhibiting factors in the supervision, and the efforts made by the Regional Government in this regard. Methods of the Research: The type of research carried out is sociological legal research conducted in the Regional Government of Indragiri Hilir Regency. The data sources used are primary data and secondary data. The data collection techniques used were interviews, and literature reviews. The data is then analyzed which is qualitative and then concluded using a deductive thinking method. Results Main Findings of the Research: The result of this study is that the supervision of the circulation of alcoholic beverages by the Pamong Praja Police Unit is still not optimal, as seen from the low intensity of raids and the lack of strict action against violators. The main inhibiting factors in this supervision include limited facilities and infrastructure, information leakage, and lack of community participation. To overcome this obstacle, the local government plans to increase monitoring facilities and facilities and the use of technology such as Closed-Circuit Television in areas prone to alcohol trafficking. The establishment of a Rapid Reaction Unit involving the Pamong Praja Police Unit, the police, and the community is expected to strengthen supervision and increase the effectiveness of local law enforcement.

Abstract

Large nets pulled on the seabed with the help of ships that function to catch fish in large quantities, but trawl nets hurt the sustainability of marine ecosystems, especially coral reefs. This study is a type of normative research. Data were obtained from laws and regulations and literature related to the object of research. The data obtained were analyzed using qualitative descriptive methods. The results of the study showed that Law No. 45 of 2009 concerning Fisheries has normatively prohibited the use of trawls; sanctions for fishermen who use trawls can be in the form of administrative sanctions, criminal sanctions, and fines. Likewise, the Regulation of the Minister of Marine Affairs and Fisheries Number 2 / PERMEN-KP / 2015 regulates the subject of the prohibition of the use of trawls because of the many losses caused by the use of trawls (trawl nets), namely damage to coral reefs, non-selective fishing, affecting fish populations, disruption of marine ecosystem habitats, increasing marine pollution, and shrinking marine natural resources. So, it is necessary to pay attention to ethical norms and the principle of legal justice in utilizing resources, especially fish, so as not to damage the marine ecosystem.

Abstract

Stunting merupakan masalah kesehatan serius yang berdampak multidimensional terhadap pembangunan ekonomi dan sosial, khususnya di negara berkembang. Penelitian ini bertujuan untuk mengulas berbagai kebijakan pencegahan stunting dari perspektif ekonomi, studi pembangunan, dan kebijakan kesehatan. Metode yang digunakan adalah tinjauan pustaka sistematis dengan sumber utama dari basis data Web of Science, menggunakan kata kunci “Stunting Policies” pada artikel yang terbit antara tahun 2004 hingga 2023. Sebanyak 68 artikel yang relevan dianalisis berdasarkan kategori ekonomi, pembangunan, kebijakan kesehatan, hukum, dan ilmu politik. Hasil analisis menunjukkan bahwa kebijakan ekonomi yang efektif seperti peningkatan pendapatan rumah tangga miskin, pendidikan perempuan, ketahanan pangan, serta akses terhadap layanan kesehatan dan sanitasi berperan penting dalam pencegahan stunting. Selain itu, Studi pembangunan menegaskan bahwa pengurangan stunting membutuhkan pendekatan yang menyeluruh dan berkelanjutan dengan fokus pada peningkatan pelayanan publik, pemberdayaan perempuan, pengentasan kemiskinan, serta penguatan infrastruktur di daerah tertinggal. Temuan ini menegaskan bahwa penanggulangan stunting memerlukan kebijakan yang inklusif, lintas sektor, dan berkelanjutan, dengan mempertimbangkan konteks sosial serta ekonomi masyarakat secara menyeluruh.

Abstract

Kewenangan Mahkamah Konstitusi (MK) untuk melakukan pengujian undang-undang terhadap Undang-Undang Dasar Tahun 1945 memberikan pengaruh besar dalam bidang hukum, berdasarkan kewenangan ini MK dapat memutuskan apakah norma suatu UU, baik sebagian maupun seluruhnya, bersesuaian dengan norma UUD 1945 (bernilai konstitusional) ataukah justru bertentangan (bernilai inkonstitusional). Kewenangan pengujian undang-undang menimbulkan sebuah kewenangan yang mutatis mutandis (dengan sendirinya) ada, yaitu kewenangan  untuk melakukan penafsiran dalam sebuah pengujian UU, yang secara eksplisit tidak diatur dalam konstitusi. Tidak adanya aturan terkait kewenangan penafsiran ini menimbulkan permasalahan tentang bagaimana batasan MK dalam melakukan penafsiran. Dalam kasus putusan MK nomor 90/PUU-XXI/2023 yang amarnya dikabulkan sebagian dengan penambahan norma baru, padahal putusan pendahulunya yaitu nomor 29/PUU-XXI/2023, 51/PUU-XXI/2023, dan 55/PUU-XXI/2023 diputus ditolak karena ditafsirkan sebagai kebijakan hukum terbuka padahal objek JR dan petitumnya kurang lebih sama, hal ini menunjukkan sikap inkonsistensi yang disebabkan tidak adanya batasan dalam penafsiran yang dilakukan MK. Jenis penelitian ini dapat digolongkan ke dalam jenis penelitian hukum normatif dengan pendekatan studi kasus (case approach). Penelitian ini dikonsepkan dalam hukum sesuatu yang tertulis dalam peraturan perundang-undangan atau hukum dikonsepkan sebagai kaidah/norma yang menjadi patokan dalam berperilaku yang dianggap pantas. Penelitian ini menggunakan sumber data sekunder, dan teknik pengumpulan data dengan metode kajian kepustakaan. Dari hasil penelitian dapat diambil kesimpulan. Pertama, pembatasan penafsiran kebijakan hukum terbuka dalam putusan Mahkamah Konstitusi Republik Indonesia terkait batas usia capres/cawapres yang paling utama adalah muatan materi tidak diatur oleh konstitusi. Kedua, akibat hukum penafsiran kebijakan hukum terbuka oleh Mahkamah Konstitusi Republik Indonesia terkait batas usia capres/cawapres adalah perubahan regulasi, dinamika pemilu dan implikasi hukum. Saran yang dapat penulis tujukan pada MK adalah Pertama memperjelas konsep kebijakan hukum terbuka. Kedua, mencantumkan dengan jelas pembatasan kebijakan hukum terbuka dalam pertimbangan sebuah putusan. Ketiga, konsisten dengan keputusan dalam perkara dengan pokok dan substansi yang sama.
