Abstract

Permasalahan dalam pengelolaan pasar rakyat dan Pedagang Kaki Lima (PKL) di Kota Pekanbaru, khususnya di kawasan Pasar Kodim. Kota Pekanbaru sebagai salah satu sentra ekonomi di Sumatera menghadapi tantangan besar dalam mengatur pertumbuhan ekonomi, urbanisasi, dan kegiatan Peraturan Daerahgangan, termasuk penataan Pedagang Kaki Lima yang sering kali menimbulkan gangguan ketertiban, kemacetan, dan permasalahan kebersihan. Pemerintah Kota Pekanbaru telah mengatur pengelolaan pasar melalui Peraturan Daerah Nomor 09 Tahun 2014 tentang Pengelolaan Pasar Rakyat, Pusat Perbelanjaan, dan Toko Swalayan. Peraturan Daerah ini bertujuan untuk menata pasar secara menyeluruh, memberikan kepastian hukum bagi pedagang, dan mendukung pemberdayaan ekonomi lokal. Dalam konteks otonomi daerah, kajian terhadap Politik Hukum di balik pembentukan dan pelaksanaan Peraturan Daerah ini menjadi penting untuk memastikan kebijakan tersebut mampu mencapai keseimbangan antara kepentingan pemerintah daerah, masyarakat, dan hak-hak Pedagang Kaki Lima. Penelitian ini diharapkan dapat memberikan solusi komprehensif dan adil dalam pengelolaan pasar rakyat di Kota Pekanbaru. Penelitian ini termasuk kedalam penelitian Hukum Empiris, karena hendak mengetahui Politik Hukum pemberlakuan Peraturan Daerah Kota Pekanbaru Nomor 09 Tahun 2014 Tentang Pengelolaan Pasar Rakyat, Pusat Perbelanjaan Dan Toko Swalayan Pada Pedagang Kaki Lima di Pasar Kodim pekanbaru. Penelitian ini menganalisis peran Politik Hukum dalam kebijakan penataan Pedagang Kaki Lima (PKL) di Kota Pekanbaru, dengan fokus pada implementasi Peraturan Daerah (Peraturan Daerah) Kota Pekanbaru Nomor 09 Tahun 2014. Hasil penelitian menunjukkan bahwa Politik Hukum memegang peranan penting dalam menyeimbangkan kepentingan umum dan hak-hak Pedagang Kaki Lima sebagai bagian dari ekonomi informal. Regulasi ini bertujuan untuk menjaga ketertiban, kebersihan, dan tata ruang kota, namun pelaksanaannya menghadapi tantangan akibat tekanan sosial-ekonomi, seperti meningkatnya jumlah Pedagang Kaki Lima. Penelitian juga menemukan bahwa pelaksanaan Peraturan Daerah ini melibatkan berbagai instansi, seperti Dinas Perindustrian dan Perdagangan, Satpol PP, DLHK, dan Dinas Perhubungan Kota Pekanbaru. Namun, pengelolaan Pasar Kodim saat ini sebagian besar dialihkan kepada pihak swasta melalui konsep Bangun Guna Serah (BGS), dengan peran pemerintah lebih bersifat konsultatif dan pengawasan. Tantangan utama meliputi konflik kewenangan antara pemerintah dan swasta, penegakan hukum yang belum optimal, serta keterbatasan infrastruktur. Selain itu, aspek sosial-ekonomi pedagang turut memengaruhi keberhasilan penataan, karena area Pasar Kodim menjadi sumber penghidupan utama bagi banyak Pedagang Kaki Lima. Oleh karena itu, diperlukan pendekatan kebijakan yang responsif, dengan mempertimbangkan keseimbangan antara penegakan aturan dan pemberdayaan Pedagang Kaki Lima, untuk mendukung pembangunan ekonomi lokal dan menciptakan tata ruang kota yang lebih teratur.

Abstract

The state, through its government, both central and regional, is obliged to deal with street children, homelesspeople and beggars as the government's responsibility in the field of welfare according to the 1945Constitution of the Republic of Indonesia, who are called homeless people and beggars. In the context ofadministering regional government in accordance with the mandate of the Constitution, controlling homelesspeople and beggars in the city of Dumai is carried out by the Civil Service Police Unit. So the aim of thisresearch is to find out the role of the Civil Service Police Unit in curbing vagrants and beggars (Gepeng) inDumai City and to find out what obstacles are faced by the Civil Service Police Unit in curbing vagrants andbeggars in Dumai City and also to find out the efforts made. must be carried out by the regional government incontrolling homeless people and beggars.The research method in this thesis uses a type of sociological juridical research, namely a researchapproach that emphasizes the legal aspects relating to the main issues to be discussed, linked to the reality inthe field. This research was conducted at the Dumai City Social Service and Satpol PP. The data sources usedare primary data and secondary data, data collection techniques in this research are observation, interviewsand literature reviewBased on research results, the role of the Civil Service Police Unit in controlling homelesspeople and beggars in Dumai City has not been implemented well, because of the gap between legalregulations and what is happening in the field. The inhibiting factors are budget factors, facilities andinfrastructure factors, and human resource factors. The efforts made by the Dumai City Government throughthe Civil Service Police Unit to control homeless people and beggars are efforts that have been made by theDumai City Government.Keyword: Homeless, Beggar, Dumai.

Abstract

A person with visual impairment is any person who has limited vision dueto one thing or another who in interacting with the environment experiencesobstacles and difficulties to participate fully and effectiveli in the socia. E-Courtis an instrument in court as a form of service to the public in terms of online caseregistration, online payments, online summons, and online trials. The E-Courtapplication itself is an implementation of information technology where thegovernment must be sharp in seeing opportunities with the presence oftechnology, so an internet-based application called E-Court was created.In accordance with the background above, the author formulates the mainproblem to be studied, namely: 1) How is the Justice Information System (E-Court) implemented in the Pekanbaru District Court? 2). What are the inhibitingfactors faced in implementing the E-Court application at the Pekanbaru DistrictCourt? 3). What are the appropriate efforts to optimize the implementation of theE-Court application at the Pekanbaru District Court?Based on the research results, it is known that the implementation of theJustice Information System (E-Court) at the Pekanbaru District Court is aneffective, efficient and hassle-free process, carried out quickly and case costsincurred can be borne by the case parties. Abstract

Health care is a form of realization of the implementation of human rights and is one ofthe elements of welfare that must be realized in accordance with the ideals of the Indonesiannation. All citizens have the right to obtain health services. Article 4 of Law Number 36 of 2009concerning health says "everyone has the right to health".This type of research is sociological or empirical juridical legal research, namelyresearch obtained directly from the community or primary data research. This research aims tosee the correlation between legal regulations and their implementation in the community byinstitutions.Based on the results of temporary research, the implementation of the MinistryRegulation has not been as expected. This is due to limitations in facilities and infrastructure andthe unavailability of health workers at the Pasir Pengaraian Class IIB Penitentiary. Healthservices in its implementation have been carried out in collaboration with the local CommunityHealth Center in the form of health service visits 2 (two) times a week and there is a PrimaryClinical Clinic at the Pasir Pengaraian Class IIB Correctional Institution, but in its enforcementit is still not appropriate and must be adjusted to the Regulation of the Minister of Law andHuman Rights Number M.HH.02.UM.06.04 of 2011 concerning Guidelines for Health Serviceswithin the Ministry of Law and Human Rights.Keywords: Health Services, Correctional Institution, Human Rights

Abstract

Micro, Small, and Medium Enterprises (UMKM) are business units thathave independent productive activities, and can be run by individuals or businessentities, which operate in various economic sectors. operate in various economicsectors. Speaking of labor issues, wage issues remain a major concern inIndonesia as a developing country. The law regarding minimum wage regulationis Government Regulation Number 36 of 2021 concerning Wages. Article 6paragraph (1) of this regulation explains that the policy on minimum wage aimsto ensure that workers/laborers receive sufficient income to meet their livingneeds. Further details regarding this arrangement can be found in Chapter VI ofGovernment Regulation No. 36 of 2021 Article 36 on the Lowest Wage in Microand Small Enterprises which states that the wage is at least 50% of the averagecommunity consumption at the provincial level. However, there are still UMKMworkers who receive wages below the regulated standard.This research is a sociological legal research, namely research thatlooks at the relationship between law and society with the gap between the lawthat should and the law that actually occurs. The research was conducted at theManpower Office of Pekanbaru City and at the Manpower and TransmigrationOffice of Riau Province. This research also contains questionnaires distributed toworkers and employers in Pekanbaru City. Data collection techniques throughinterviews, questionnaires and literature review.From the results of the research that has been conducted, theimplementation has not been maximized. This is because the relevant agenciesmove only based on reports or complaints that are obtained. Factors that causeless than optimal implementation are the lack of human resources or members toinspect throughout Riau Province and the lack of facilities and infrastructureobtained from the government. Efforts made by related agencies if they get areport, namely by providing guidance, supervision and action to the reportedparty.Keyword : Wage, Labor, UMKM.

Abstract

Personal data protection is very important in today's modern world. Personal data isconfidential and sensitive information about a person. In the personal data protection law, aperson's personal data must be protected from unauthorized access or misuse. However, thequestion that arises is how is the protection of personal data of a deceased person regulatedin the personal data protection law? In fact, the protection of a deceased person's personaldata is actually also very important to consider. Even though the person has passed away,their personal data must still be kept confidential as it can still be used by irresponsibleparties. In many countries, personal data protection laws regulate the protection of personaldata of deceased persons. In Indonesia, the protection of personal data of deceased personsdoes not yet have a clear legal umbrella. The protection of the personal data of a deceasedperson is important to prevent misuse of data that can harm the family or other living partiesand the state. The personal data of someone who has died can be used for bad purposes,such as identity theft or fraud.This research aims to find out and explain how the protection of personal data of adeceased person in terms of respect for individual privacy. Even though the person is dead,there is still a right to privacy that must be respected. In this case, the government andrelated institutions must ensure that Law No. 27 of 2022 on Personal Data Protection alsocovers the protection of personal data of deceased persons. In addition, it is important tosocialize and educate the public about the importance of protecting personal data, includingthe personal data of deceased persons. Thus, the protection of personal data of deceasedpersons is an important part of the overall protection of personal data. With cleararrangements and firmness in maintaining the confidentiality of the personal data ofdeceased individuals, it is hoped that it can prevent the misuse of personal data of deceasedindividuals which can harm many parties including the state.Keywords: Protection, Personal Data, Death

Abstract

Banjar Seminai Village, Dayun Subdistrict, Siak District, Riau Province, is known as a production center for its distinctive honey salak. Although the salak business in this area has grown rapidly, farmers face challenges in marketing their products, especially in finding direct buyers. This service aims to analyze the factors that influence the marketing strategy of honey salak and explore alternative effective online-based marketing strategies. Using survey methods and statistical analysis, this service evaluates the extent to which the application of digital platforms can increase sales and consumer satisfaction. It is hoped that the results of this service can provide insights and practical recommendations for business actors and policy makers to optimize the use of digital technology, so that the salak business in Banjar Seminai Village can continue to grow and provide benefits to the local community. The success of adaptive and innovative marketing strategies is expected to increase the competitiveness and sustainability of agricultural businesses in the area.

Abstract

Abstrak Masa jabatan Kepala Desa tidak diatur secara explisit dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 seperti halnya masa jabatan Presiden dan Wakil Presiden serta masa jabatan kepala daerah, tetapi hanya diatur dalam Pasal 39 UU No.6/2014. Mahkamah Konstitusi (MK) dalam Putusan Perkara Nomor 15/PUU-XXI/2023 menyatakan dinamika perubahan pada pengaturan mengenai masa jabatan Kepala Desa sangatlah tergantung pada faktor filosofis, yuridis, dan sosiologis yang memengaruhi pada saat ketentuan tersebut dibuat. Masalah pokok dalam penelitian ini adalah: Apakah yang menjadi pertimbangan dari putusan mahkamah konstitusi Nomor 15/PUU-XXI/2023 terhadap masa jabatan Kepala Desa dan Bagaimanakah implikasi putusan mahkamah konstitusi Nomor 15/PUU-XXI/2023 terhadap masa jabatan Kepala Desa. Jenis Penelitian penelitian hukum normatif Penelitian ini merupakan penelitian yang akan mengkaji sistematika hukum, yaitu penelitian yang dilakukan terhadap peraturan perundang-undangan tertentu atau hukum tertulis, Dalam pengumpulan data untuk penelitian hukum normatif digunakan metode kajian kepustakaan. Analisis Data dalam penelitian hukum normatif data dapat dianalisis secara kualitatif dengan menguraikan secara deskriptif dari data yang telah diperoleh. Mahkamah Konstitusi dalam pertimbangan hukum Putusan Nomor 15/PUU-XXI/2023 menyatakan beberapa alasan. Ada sedikitnya lima alasan Mahkamah Konstitusi kemudian menyatakan masa jabatan Kepala Desa tetap 6 tahun, dengan maksimal 3 periode.  Keywords: Kepala Desa, Mahkamah Konstitusi, Masa jabatan. Abstract The term of office of a village head is not explicitly regulated in the 1945 Constitution of the Republic of Indonesia as is the term of office of the president and vice president and the term of office of regional heads, but is only regulated in Article 39 of Law No.6/2014. The Constitutional Court (MK) in Case Decision Number 15/PUU-XXI/2023 stated that the dynamics of changes to regulations regarding the term of office of village heads really depend on the philosophical, juridical and sociological factors that influenced the time the provisions were made. The main problem in this research is: What are the considerations of the decision of the constitutional court Number 15/PUU-XXI/2023 regarding the term of office of the village head and what are the implications of the decision of the constitutional court Number 15/PUU-XXI/2023 for the term of office of the village head. Types of research: normative legal research. This research is research that will examine legal systematics, namely research carried out on certain statutory regulations or written laws. In collecting data for normative legal research, the literature review method is used. Data Analysis In normative legal research, data can be analyzed qualitatively by describing descriptively the data that has been obtained. The Constitutional Court in its legal considerations on Decision Number 15/PUU-XXI/2023 stated several reasons. There are at least five reasons why the Constitutional Court then stated that the term of office for village heads remains 6 years, with a maximum of 3 terms.  Keywords: Village Head, Constitutional Court, Term of Office.

Abstract

The entry of Covid-19 requires the government to make policies and regulations. A number of existing rules cannot in fact be in accordance with what is mandated in the Article. The goal of this study are to knowing the regulation of Rapid Test and Polymerase Chain Reaction (PCR) Corona Virus Disease-19 in positive law in Indonesia and the rules of Rapid Test and Polymerase Chain Reaction (PCR) in Positive Law are in accordance with the theory of Legislation Formation. This research was prepared using a normative legal method that focuses on vertical legal synchronization. As a result, the creation of rules regarding the use of rapid antigen and PCR tests through the Decree of the Minister of Health needs to be strengthened and expanded again considering that this Ministerial Decree is limited to recognition and has not touched a more substantive dimension of protection and the regulations and policies issued regarding rapid antigen and PCR tests do not have permanent legal force and are weak and also not in accordance with existing positive law. The Government should pour regulations in one format of laws and regulations that are included in the hierarchy of laws and regulations

Abstract

This research aims to see whether or not chemical castration sanctions are applied to sex offenders when viewed from the Relative Theory of Punishment and is associated with several examples of decisions. From the research results. The application of chemical castration sanctions against sex offenders has not been implemented effectively in law enforcement in Indonesia because there is still a discrepancy between the provisions of additional punishment determined by the legislator with the facts or circumstances that occur. The Relative theory of punishment views the provision of punishment not as retaliation for the wrongdoing committed by the perpetrator, the justification of punishment lies in its purpose, namely to reduce the frequency of crime. Therefore, it is necessary to reformulate the sanction of chemical castration from various aspects, including socio-philosophical, socio-political, and socio-cultural aspects. The need for a legal breakthrough to provide therapeutic/treatment effects to perpetrators of sexual crimes through psychiatric rehabilitation efforts. Because basically, punishment is no longer solely as retaliation, but to re-educate the person who committed the criminal act to become a useful member of society.
