Abstract

The writing of this law is about a house located on the river border in SiakRegency. The formulation of the problem is whether the existence of a house on theSiak river border in Pekanbaru City is in accordance with Pekanbaru CityRegional Regulation No. 7 of 2020 concerning the Pekanbaru City DevelopmentPlan for 2020-2040 and what steps are being taken by the government to overcomethis problem. This legal research aims to identify, study, and analyze houseslocated in the riparian area of the river in Siak Regency. This Legal article is anempirical research. Based on the results of the study it can be concluded that thehouse which is located on the border of the Siak river in Pekanbaru City violatesPekanbaru City Regional Regulation No. 7 of 2020 concerning the Pekanbaru CityDevelopment Plan for 2020-2040 and until now there has been no governmenteffort to overcome this problem.Keywords: River border, Siak river, house located in the river border area.

Abstract

Whereas according to the Petitioners, the Elucidation of Article 6paragraph (1) letter a and Article 8 paragraph (1) of Law 35 of 2009 concerningNarcotics has resulted in the loss of the Petitioners' rights to obtain healthservices as stipulated in Article 28H paragraph (1) of the 1945 ConstitutionArticle 7 paragraph (1) Law Number 35 of 2009, Article 7 stipulates thatnarcotics can only be used for the benefit of health services and/or scientificdevelopment knowledge and technology. But in article 8 paragraph 1 of Lawnumber 35 of 2009.Regarding this research, it can be classified into the type of normativelegal research related to the Constitutional Court decision number 106/puu-xviii/2020. From the results of the research problem there are two main thingsthat can be concluded. First, there is a discrepancy or unconstitutionality becausethere is a difference in sound, so a review is needed. Because in Article 7 it isclear that for health it may be used by any group as long as it is still usedaccording to doctor's recommendations and according to Health Law number 36of 2009 concerning health.Second, the Constitutional Court should not at all close the loophole onthe use of Narcotics Category I, which not only cannabis can be used for thebenefit of health services. The Constitutional Court realizes that for the use ofNarcotics Category I for the benefit of health services it must be supported by thereadiness of facilities and infrastructure as well as supporting scientific evidence,so that the Government needs to start by conducting comprehensive studies andresearch.Key Words : Decision, Constitutional Court, Narcotics, Medical.

Abstract

Visit visa free has a positive impact on increasing foreign tourists to West Sumatra in the tourism sector. The granting of a visit visa-free can be interpreted as freeing the recipients of a visit-free visa from the obligation to have a visit visa to enter Indonesian territory. The visit visa-free arrangement is expected to increase the number of foreign tourist visits to Indonesia so that it will have an effect on increasing state revenues, as well as advancing the nation's welfare. However, in reality this policy creates problems, namely the implementation of visit visas is widely misused. And the next problem is the lack of human resources on the part of immigration in carrying out supervision. The objectives in writing this thesis are: First, to find out in the application of Presidential Regulation Number 21 of 2016 concerning Visa-Free Visits, whether it is in line with the government's expectations. Second: find out what efforts have been made by related parties under the supervision of foreign nationals in misusing Presidential Regulation Number 21 of 2016 concerning visa-free visits in the province of West Sumatra. The type of research used is sociological juridical, namely research conducted by identifying the law and how the effectiveness of the implementation of the law applies in society. Because in this study the authors directly conducted research at the location or place under study to provide a complete and clear description of the problem under study. From the results of the study, it was found that the Implementation of Presidential Regulation Number 21 of 2016 concerning Visa-Free Visits to Supervision of Foreign Citizens in the West Sumatra region has not been maximized in its implementation because it will indirectly reduce non-Tax state income from the sector of purchasing visas by foreigners. The visit visa-free policy is also considered to add to TPI Padang's Class I Immigration work which basically lacks Human Resources to carry out surveillance of foreigners in the quite extensive area of West Sumatra. Immigration Control against foreigners carried out with involving relevant agencies in the field of supervision foreigners like establishment The foreigner monitoring team (TIMPORA) which Its members consist of immigration, police, prosecutors, tourism office, employment agency, BIN, BNN and agencies or institutions that have direct contact with foreigners. Author's suggestion, First, there is a need for an assessment of the policy Presidential Regulation Number 21 of 2016 regarding visa-free visits which are considered to have a threatening impact on state security. Second Increase the ability of resources officers not only in terms of quantity but also quality.

Abstract

Indonesia adalah negara hukum yang sekaligus juga menjunjung tinggi Hak Asasi Manusia dan menjamin hak-hak seluruh warga Negara Indonesia termasuk penyandang disabilitas. Salah satu yang menjadi persoalan adalah hak untuk mendapatkan informasi oleh penyandang disabilitas, dalam praktiknya penyiaran di Kota Pekanbaru yang dilakukan oleh stasiun televisi masih banyak yang tidak memperhatikan hak-hak dari penyandang disabilitas terutama tunarungu dalam menggunakan bahasa isyarat sebagai penghubung antara tunarungu dengan inforomasi televisi. Jenis penelitian yang digunakan penulis adalah penelitian yang bersifat empiris atau penelitian hukum sosiologis. Penelitian hukum sosiologis adalah penelitian yang dilakukan langsung dilokasi atau dilapangan untuk memperoleh data guna memberikan gambaran secara lengkap dan jelas terkait Pemenuhan Hak Tunarungu Dalam Penggunaan Bahasa Isyarat pada Media Televisi Di Kota Pekanbaru. Pada Pasal 28 F UUD Negara Republik Indonesia Tahun 1945. Indonesia mengakui dan melindungi setiap HAM warga negara Indonesia, ini memberikan artian bahwa Pemerintahan Indonesia berkewajiban untuk memenuhi setiap kebutuhan dan keterbukaan informasi kepada masyarakat. Kemudian pada Pasal 39 ayat 3 Undang-Undang Nomor 32 Tahun 2002 Tentang Penyiaran, berbunyi “Bahasa isyarat dapat digunakan dalam mata acara tertentu untuk khalayak tuna rungu”. Pemenuhan hak tunarungu dalam penggunaan bahasa isyarat pada media televisi di kota Pekanbaru masih belum terpenuhi secara utuh. Adapun yang menjadi faktor penghambat tidak terpenuhinya pemenuhan hak tunarungu dalam penggunaan bahasa isyara di media televisi kota Pekanbaru untuk mendapatkan hak informasi karena lemah serta tidak tegasnya regulasi yang ada, Kurangnya kesadaran hukum tunarungu, minimnya dana, serta sedikitnya JBI di kota Pekanbaru

Abstract

This research is related to the implementation of supervision of the implementation ofbillboards which is regulated in Article 35 Paragraph 1 of the Dumai City RegionalRegulation Number 2 of 2021 concerning the Implementation of Billboards which are carriedout routinely. In the field there are still many illegal billboards that are posted not inaccordance with the established provisions. Therefore, it is necessary to study the firststimulant, the supervision of the Civil Service Police Unit over the implementation ofbillboards based on the Regional Regulation of the City of Dumai Number 2 of 2021concerning the Implementation of Billboards, Second, the obstacles for the Civil ServicePolice Unit in carrying out supervision of the implementation of billboards in the City ofDumai.This research is a sociological research, because it is based on field research, namelyby collecting data from observations, interviews, and literature studies that have somethingto do with the problems studied assisted by primary, secondary and tertiary data. This studyuses qualitative data analysis, produces descriptive data, and concludes with a deductivethinking method.From the results of the study, it was concluded that, First, the arrangement forholding billboards based on the Dumai City Regional Regulation Number 2 of 2021 has notbeen maximized, Second, the supervision of the Civil Service Police Unit on theimplementation of billboards based on the Kita Dumai Regional Regulation Number 2 of2021 concerning the implementation of billboards has not run optimally. Third, the inhibitingfactors for the Civil Service Police Unit in carrying out supervision of the implementation ofbillboards in Dumai City are the lack of operational staff, the lack of coordination betweenlaw enforcers, the lack of facilities, and the lack of regulations. As for the supporting factorsfor the Civil Service Police Unit in carrying out supervision of the implementation ofbillboards, it is supported by the existence of regulations governing the implementation ofbillboards, good coordination with Satpol PP responses and supported by motivation andcommitment from Satpol PP leaders.Keywords : Arrangement-Supervision of Civil Service Police Unit-Reklame

Abstract

Fuel is a vital need for the community, this can be seen from the high level ofpublic demand for means of transportation, currently transportation is no longer aluxury item but a basic need. in everyday life the use of fuel both in industry andtransportation is increasing. With increasing demand, fuel is not supported bynatural resources and continues to decline, therefore management must be carriedout as optimally as possible. In view of this, to ensure the safety and availability offuel, it is necessary to carry out supervision. In this case, the central governmentthrough representatives of each region or local government, namely the PekanbaruCity Industry and Trade Service, supervises the distribution of fuel in PekanbaruCity. The Department of Industry and Trade of Pekanbaru City is the agencyresponsible for the technical implementation of guidance and supervision of thedistribution of fuel in accordance with regional regulation Riau Province Number 12of 2002 concerning guidance and supervision of the distribution of fuel. The practiceof selling retail fuel oil is prohibited by PT. Pertamina as the main distributor.However, judging from the facts on the ground, there are still many people who dothis by buying fuel oil using jerry cans, purchasing in this way is clearly prohibitedand regulated in the regional regulation of Riau Province Number 12 of 2002concerning guidance and supervision of the distribution of fuel to Article 6paragraph 1 "Each SPBU/PSPD and SPBB are prohibited from selling fuel tobuyers using drums, jerry cans and the like". This research will be structured usingthe type of legal sociological research, namely research that is said to be fieldresearch by examining applicable legal provisions and what happens in people'slives. The data collection technique in this study was a literature study followed byempirical data collection obtained from relevant agencies, as well as conductinginterviews to obtain information directly from informants. The results of the researchconducted by the author are first, every result of supervision can be used as animprovement in improving the quality of service quality. Second, even though thesupervision carried out was in accordance with the procedure, the violations thatwere committed still continued to occur. Not only from within, obstacles also occurfrom outside the management. Where the manager of fuel oil who has responsibilityin the buying and selling process does not understand the applicable rules, andresults in problems for many people (community).

Abstract

This research aims to analyze the legal considerations of the Constitutional Court judgesin deciding a decision and see the inconsistency of the Constitutional Court in interpretingConstitutional Court Decision Number 97/PUU-XI/2013 and Constitutional Court DecisionNumber 85/PUU-XX/2022.This type of research can be classified into normative juridical research. By usingsecondary data which includes primary legal materials, secondary legal materials, and tertiarylegal materials and data collection techniques using literature studies. This research also usesqualitative data analysis and draws conclusions deductively.From the results of research on the problem, First, in the Constitutional Court DecisionNumber 97/PUU-XI/2013, the Constitutional Court judges considered that regional elections arenot included in the electoral regime as regulated in the 1945 Constitution of the Republic ofIndonesia, then in the Constitutional Court Decision Number 85/PUU-XX/2022, theConstitutional Court judges consider that there is no distinction between election and regionalelection regimes. Second, the cause of the Constitutional Court's inconsistency in interpretingdecisions regarding the authority to adjudicate regional election disputes is the lack of clarity inthe 1945 Constitution regarding the regulation of elections and regional elections, differences inthe logic of thinking of Constitutional Court judges in deciding and adjudicating regionalelection disputes, changes related to the composition of the members and chairman of the panelof Constitutional Court judges in Constitutional Court Decision Number 97/PUU-XI/2013 andConstitutional Court Decision Number 85/PUU-XX/2022, and changes to statutory regulationsrelated to resolving disputes over regional head results.Keywords : Regional Head Election – Regional Head Election Dispute Resolution

Abstract

The hallmark of the rule of law is a democratic system of government. In aconstitutional democratic system, the existence of political parties is a necessitybecause it will be a place to convey people's aspirations. The purpose of this studyis to find out how the legal arrangements for the dissolution of political parties inIndonesia and Slovenia. The research used is normative legal research which isusually only a document study.The data used are secondary data consisting of primary legal materials,secondary legal materials, and tertiary legal materials. The method used in thisresearch is the literature method, namely by conducting research from variousreading sources related to research. This data collection technique is carried outby reading, studying, reviewing and analyzing legal materials (primary andsecondary legal materials) by adjusting the problems studied by the author. Dataanalysis is by conducting an analysis with qualitative measures that rely onsubstance with data collection that concludes.The result of the study is the arrangement of the dissolution of politicalparties in Indonesia that the government has the right as an applicant in the caseof dissolution of a political party, while Slovenia that Everyone can apply.Keywords : Dissolution, Applicant, Government, Political Party.

Abstract

Artikel ini bertujuan untuk menganalisis efektivitas kegiatan sosialisasi pendaftaran merek bagi pelaku usaha di Desa Semunai, Kecamatan Pinggir, Kabupaten Bengkalis. Pendaftaran merek merupakan langkah krusial dalam melindungi hak kekayaan intelektual dan menciptakan keunggulan kompetitif bagi pelaku usaha, terutama di tingkat lokal seperti desa. Namun, kesadaran dan pemahaman akan pentingnya pendaftaran merek seringkali masih kurang di kalangan pelaku usaha skala kecil di daerah pedesaan. Metode yang digunakan adalah metode diskusi dan praktek (learning by doing) dan hasil kegiatan menunjukkan bahwa sebagian besar pelaku usaha di Desa Semunai pada awal kegiatan belum memiliki pemahaman yang baik tentang pendaftaran merek dan manfaatnya, sehingga dengan dilaksanakannya kegiatan ini telah meningkatkan pemahaman dan kesadaran peserta terkait regulasi, urgensi, dan tatacara pendaftaran merek. Upaya sosialisasi yang lebih intensif dan berkelanjutan akan membantu melindungi hak kekayaan intelektual pelaku usaha, meningkatkan daya saing, dan mendorong pertumbuhan ekonomi di tingkat desa, khususnya di Desa Semunai, Kecamatan Pinggir, Kabupaten Bengkalis.

Abstract

Women are creatures of God Almighty, just as men have natural rights that are inherent and must be protected. In the Islamic legal system, women get a glorious position and many letters in the Qur'an tell about women. Yet today's tendency, many violations of women's human rights, especially occur in the domestic so-called domestic violence.This study raises the problem of how the protection of women victims of domestic violence according to the Indonesian legal system and Islamic legal system and how the ideal future form of protection of women victims of domestic violence. This type of research is normative juridical, using secondary data types. The results showed that the protection of women victims of domestic violence in the legal system of Indonesia already has a legal umbrella that is Law No. 23 of 2004 on the Elimination of Domestic Violence, but there are still weaknesses, while the protection of women victims of domestic violence in the Islamic legal system refers to Al Quran and Hadith especially in the Surah An Nisa but need to be interpreted contextually not just textual. The ideal form of protection of women victims of domestic violence in the future that is the articles in the Act abolition of domestic violence should apply the principles of marriage in Islamic law, so as to create peaceful, peaceful and eternal home forever
