Abstract

Women are a group or group that is vulnerable to violence that occurs in society. To overcome various issues of violence that occur against women, special attention is needed from all groups, both community groups and government circles, consisting of the central government and regional governments. This certainly has an impact on the existence of women's groups in the social order amidst demands for achieving Sustainable Development Goals (SDG's). If we refer to the concept of "mainstreaming" itself, it can be interpreted as a process that is carried out to bring aspects that were previously considered unimportant or marginal into the decision-making and management of main institutional activities and work programs. This series of strategies was prepared based on insight, critical awareness and data obtained from gender analysis. Therefore, this study is considered important to look at gender representation in Siak Hijau policies.

Abstract

The diversity of religions and beliefs in Indonesia has led to the occurrence of marriagesbetween followers of different religions and beliefs, commonly referred to as interfaithmarriages. Interfaith marriages should not occur based on Article 2 paragraph (1) inconjunction with Article 8 sub f of the Marriage Law and the Supreme Court Circular LetterNumber 2 of 2023. This study discusses the Position of the District Court Decision Number423/Pdt.P/2023/PN Jkt.Utr in adjudicating interfaith marriage applications from theperspective of the Supreme Court Circular Letter Number 2 of 2023 and the Synchronizationof the District Court Decision Number 423/Pdt.P/2023/PN Jkt.Utr with the Supreme CourtCircular Letter Number 2 of 2023.This research employs a normative legal research method by examining the core issuesthrough a legislative and regulatory research approach related to legal issues. The data sourcesconsist of secondary data, which includes primary legal materials, secondary legal materials,and tertiary legal materials. The data collection method was conducted through literature study,followed by normative qualitative data analysis methods.Based on the research results and discussion, the Position of the District Court DecisionNumber 423/Pdt.P/2023/PN Jkt.Utr contradicts the Guidelines in the Supreme Court CircularLetter Number 2 of 2023. The District Court Decision Number 423/Pdt.P/2023/PN Jkt.Utr andthe Supreme Court Circular Letter Number 2 of 2023, based on the theory of the legislativehierarchy, do not synchronize. The Supreme Court Circular Letter No. 2 of 2023 contains policyregulations and guidelines for judges in adjudicating interfaith marriage applications. However,the District Court Decision Number 423/Pdt.P/2023/PN Jkt.Utr, in approving the interfaithmarriage case, only refers to Article 35 Letter a of Law Number 23 of 2006 concerningPopulation Administration. Judges should be more cautious in deciding on interfaith marriageapplications and also refer to the Marriage Law, Supreme Court Circular Letter Number 2 of2023, and other related regulations regarding the regulation of interfaith marriages so that legalcertainty in a court decision is properly implemented.Keywords: Court Decision, Interfaith, Circular Letter

Abstract

The position of the deputy regional head in Indonesia is not actually statedand stated clearly in the constitution, but in normative juridical terms the positionof the deputy regional head in Indonesia can be seen from Article 66 paragraph(1) of the law on regional government number 23 of 2014.The main problem in this research is regarding the vacancy of the deputygovernor, and the vacancy of the deputy regent which creates political intereststhat clearly show that the elite is not taking sides with the broad public benefit.The vacant positions of Deputy Governor, Deputy Regent and Deputy Mayor willbe filled if the remaining term of office is more than 18 (eighteen) months from thevacancy of the position.This research is normative legal research. This is based on libraryresearch which takes quotations from reading books, or supporting books that arerelated to the problem to be researched. This research uses secondary datasources consisting of primary, secondary and tertiary book materials. Thisresearch also uses qualitative data analysis and produces descriptive data.From the results of the research and discussions carried out, severalconclusions were obtained, namely: First, the procedures for filling vacancies fordeputy regional heads who come from political parties and combinations ofpolitical parties in this context give rise to multiple interpretations. Therefore theauthor conducted this research. Second, there are several efforts that thegovernment can take, namely normative juridically in Law Number 10 of 2016Regarding the Second Amendment to Law Number 1 of 2015 concerning theStipulation of Government Regulations in Lieu of Law Number 1 of 2014concerning the Election of Governors, Regents and Mayors into Law, precisely inthe provisions of Article 176 paragraph (4) requires the filling of vacant positionsdeputy regional heads who still have more than 18 (eighteen) months remaining inoffice.Keywords: Juridical Review-Filling the Position of Deputy Regional Head.

Abstract

A legally aware village is a form of orderly and obedient society from the lowest level, so that it will further increase compliance with applicable laws and regulations. It is considered more appropriate for villages to empower the community so that a village will be aware of the law. This empowerment was carried out in Batu Belah village, Naumbai village and Ranah Baru village, Kampar District, Kampar Regency. The aim of this empowerment is to increase legal awareness and improve the economy of the community in the village so that the village can be more advanced than before and more prosperous. This activity is carried out through legal outreach, training and assistance which includes techniques for drafting village regulations, and legal assistance. The method used is a participatory approach, where the community is actively involved in every stage of the activity. The results of this service show an increase in community knowledge about the village's readiness to be aware of the law. This effort not only aims to create order and security, but also to improve the local economy. With collaboration between the government, community and the private sector, it is hoped that Batu Belah Village, Naumbai Village and Ranah Baru Village can become models for other villages in integrating legal awareness with sustainable economic development, so that community welfare can be realized as a whole.

Abstract

Stunting is a problem caused by a child's lack of nutritional intake for a long time, resulting in growth disorders in children, namely a height that is lower than the age standard. Based on the results of monitoring nutritional status and measuring stunting at the village level in 2023, it was recorded that in Kampar District, Ranah Baru Village is the village with the largest number of stunted children, namely 5 (five) children. Through the Community Service activities of the Ministry of Education, Culture, Research and Technology, the University of Riau Community Empowerment Scheme (PMM), seeks to carry out various stunting prevention programs and activities to make the village 0 (zero) stunting by increasing the community's knowledge regarding stunting prevention. and increasing self-grown food crops to fulfill children's daily nutrition, organizational management and entrepreneurship training. Not only the community, these programs and activities must also involve various parties and cadres in the village, including the village government, health workers, community leaders and families to work together to prevent and reduce the number of stunted children in the village. The aim of this service is to change people's habitual patterns so that they are more responsive to stunting. Abstract

The salak business community is struggling with marketing due to a lack of awareness about salak plantations in Banjar Seminai and skepticism regarding the existence of pondoh salak in Dayun Siak Riau. A potential solution is to empower the community during the harvest season by processing the abundant snake fruit into products like chips, diamonds, dodol, jenang, syrup, bakpia, candied fruit, and other innovative foods. The initiative aims to empower the salak farming community in Banjar Seminai Village, Siak Regency, by enhancing their marketing skills for salak products. This includes training and mentoring in manual and online marketing, packaging, and branding. The participatory approach engages farmers at every stage, resulting in improved knowledge and skills in marketing salak products and increased income. This empowerment aims to promote salak products from Banjar Seminai Village and positively impact the local economy.

Abstract

Hak Asasi Manusia adalah hak dasar manusia, yang ada dan merupakan karunia Tuhan Yang Maha Kuasa, Hak Asasi Manusia merupakan hak natural oleh karena itu hak asasi manusia tidak dapat dicabut oleh manusia lain sesama makhluk hidup. Didalam Hak Asasi Manusia juga terdapat Hak Anak. Anak juga termasuk kedalam tunas, potensi, dan generasi muda penerus cita-cita bangsa, memiliki peran dan strategis dan mempunyai ciri serta sifat khusus yang menjamin kelangsungsan eksitensi bangsa dan negara masa depan. Perlindungan hukum terhadap anak merupakan tolak ukur peradaban bangsa karena wajib diusahakan sesuai dengan Nusa dan Bangsa. Perlindungan Anak yaitu untuk menjamin dan melindungi Anak dan hak-haknya agar dapat hidup, tumbuh, berkembang, dan berpatisipasi secara optimal sesuai dengan harkat dan martabat kemanusiaan serta mendapat perlindungan dari kekerasan dan diskriminasi. Jenis Penelitian ini adalah penelitian Sosiologis. Tujuan dilakukannya penelitian ini adalah untuk mengetahui perlindungan hak anak sebagai peserta didik di lingkungan sekolah dalam prespektif peraturan per Undang-Undangan dan konsep perlindungan hak anak sebagai peserta didik di dalam hal atribut dari sisi peraturan Per Undang-Undangan. Penelitian ini dilakukan langsung di salah satu sekolah yang berada di Kota Padang, Sumatera Barat, guna mendapatkan gambaran dan informasi yang lengkap dan jelas tentang masalah yang diteliti. Penelitian tersebut di lakukan di sekolah SMKN 2 Kota Padang. Guna untuk mendapatkan Infotmasi yang jelas tentang adanya anak di sekolah tersebut di suruh untuk memakai jilbab, sedangkan anak tersebut beragama Non-Muslim maka dari itu peneliti melakukan dengan mengajukan beberapa pertanyaan (wawancara). Berdasarkan dari hasil penelitian tersebut didapatkan kesimpulan bahwasannya benar adanya di panggil murid tersebut agar memakai jilbab di sekolah karena dominan di sekolah banyak nya anak yang tidak memakai jilbab. Tetapi anak tersebut tidak mau karena anak tersebut bukan kewajibannya untuk memakai jilbab di karenakan itu tidak sesuai keyakinan anak tersebut.

Abstract

In order to implement the maximum national vaccination program, President Joko Widodo issued Presidential Regulation (Perpres) Number 14 of 2021 concerning Amendments to Presidential Decree Number 99 of 2020 concerning Procurement of Vaccines and Implementation of Vaccinations in the Context of Overcoming the 2019 Corona Virus Disease (Covid-19) Pandemic. The Presidential Decree contains provisions governing the procurement of vaccines and the implementation of vaccinations in the context of dealing with the Covid-19 pandemic. Regarding administrative sanctions, it is one of the things regulated in this regulation. The administrative sanctions in question are aimed at people who have previously been declared as target recipients of the Covid-19 vaccine and basically this is contrary to Law No. 36 of 2019. People who then refuse to receive Covid-19 vaccination may be given administrative sanctions. These sanctions are stated in Article 13A paragraph (4) which states: "Every person who has been designated as a target recipient of the Covid-19 vaccine who does not take part in the Covid-19 vaccination as intended in paragraph (2) may be subject to administrative sanctions, in the form of, Postponement or termination of the provision of social security or social assistance. Postponement or termination of government administration services, and/or fines. This research method uses a normative juridical review method. This research is expected to increase knowledge for writers and readers regarding the Covid-19 Vaccination Policy Based on Presidential Regulation Number 14 of 2021 Amendments to Presidential Regulation Number 99 of 2020 concerning Implementation and Procurement of Vaccinations in Efforts to Control the Covid Virus -19.The legal policy that the public will accept if they refuse to be given the Covid-19 vaccine, in Article 13A paragraph 4 and paragraph 2, is that every person who has been designated as a target recipient of the Covid-19 vaccine who does not take part in the Covid-19 vaccination, may be subject to administrative sanctions in the form of: postponement or termination of the provision of social security or social assistance; Delays in administrative services cause obstacles to the implementation of controlling the spread of Covid-19. In addition to being subject to sanctions, sanctions can be imposed in accordance with the provisions of Law Number 4 of 1984 concerning infectious disease outbreaks. The appropriate government policy regarding the issue of implementing vaccination in efforts to contain the Covid-19 virus is to review Presidential Decree No. 14 Article 13 A regarding the obligation that every citizen is obliged to carry out vaccination and if this is not carried out, administrative sanctions will be imposed; re-collect data regarding vaccination recipients, especially the elderly and people who have congenital diseases; and aligning the presidential decree with the contents of Health Law Number 36 of 2009 that every citizen has the right to determine the health facilities they will receive without any coercion from any party.

Abstract

The 1945 Constitution (UUD 1945) is one of the sources of Indonesianlaw. The age limit is stated in Article 169 letter q of Law Number 7 of 2017concerning Elections so it is felt to be inappropriate because the ConstitutionalCourt is a judicial institution or negative legislator, which means it does notimmediately make new rules and add legal norms to Law Number 7 2017concerning General Elections. The Constitutional Court has no authority toreplace or insert new norms into the content (paragraphs, articles and/or parts)of laws that have been declared contrary to the 1945 Constitution and thereforedo not have binding legal force.This type of legal research can be categorized as using a normative type oflegal research. Normative legal research is library legal research. The datasources used are secondary data consisting of primary legal materials, secondarylegal materials and tertiary legal materials. The data collection technique comesfrom the library research method. After the data is collected, conclusions aredrawnFrom the results of the research, 2 (two) main things were obtained,namely first, even though a judicial tip occurred, a criminal act or violation of thecode of ethics committed by a judge, does not make the Constitutional Court'sdecision invalid or wrong. Second, in this case the role of the ConstitutionalCourt is as a judicial institution which has the task of examining laws that arealready in force or that have been passed.Keyword: Constitutional Court, Ethics, Conflict of Interest

Abstract

This research analyzes juridically the regulation and ideal criteria of theSelection Committee for the Supervisory Board of the Corruption EradicationCommission (KPK) based on Law Number 19 of 2019 concerning the SecondAmendment to Law Number 30 of 2002 concerning the KPK. The existence of theKPK Supervisory Board has been met with pros and cons because it is consideredto be able to affect the independence of the anti-corruption institution. Theformation of the Supervisory Board is feared to actually erode the authority andinternal supervisory function of the KPK and disrupt the corruption eradicationprocess.This research is a normative legal research with a qualitative approachthat examines secondary data in the form of primary and secondary legalmaterials. Primary data is obtained from relevant laws and regulations such asLaw Number 19 of 2019 and its derivative regulations, while secondary data isfrom legal literature such as books, scientific journals, research results, andscientific articles. The thinking method used is the deductive method to drawconclusions from general statements to specific ones, and inductive to concludefrom specific matters to general ones.This research analyzes juridically the regulation of the SelectionCommittee for the Supervisory Board of the Corruption Eradication Commission(KPK) based on Law Number 19 of 2019 concerning the Second Amendment toLaw Number 30 of 2002 and examines the ideal criteria for the selectioncommittee..
