Abstract

Land has a very close relationship with humans. The existence of customary rights shows that customary rights have a place and recognition from the State as long as in reality they still exist. The adat community of Gunung Sahilan village, Gunung Sahilan sub-district, Kampar district, is one of the indigenous communities that has a customary land conflict. With regard to the use and management of customary lands in the area of the indigenous communities of Gunung Sahilan village, Gunung Sahilan sub-district, Kampar regency there should be coordination with ninik mamak. but in reality, the role of ninik mamak is no longer applied.This type of research can be classified in the type of sociological (empirical) legal research, because in this study the authors directly conduct research at the location or place of study in order to provide a complete and clear picture of the problem under study.This research was carried out in the Sahilan Darussalam region, Kampar Kiri Kampar Regency, because the location of the Gunung Sahilan Kenegerian Customary Institution, while the population and sample were the Gunung Sahilan Kenegerian Customary Institution, Ninik Mamak, the Sahilan Darussalam Customary Density, the Sahillan Darusalam Village Head and the Indigenous Peoples kenegerian Sahilan Darussalam. Data sources used are primary data and secondary data. Data collection techniques in this study were interviews, questionnaires, and literature review. The conclusions that can be obtained from the results of the study are: First, the management of customary land in indigenous peoples in Kenegerian Sahilan Darussalam, Sahilan District, Kampar Regency has begun to fade with the times and has started not referring to the provisions in the customary law of indigenous peoples in Kenegerian Sahilan Darussalam, Sahilan District, Kampar Regency.Keywords: Existence, Landslides, Indigenous Peoples, Kenegerian Mount Sahilan

Abstract

So the role of Adat Melayu Riau Rokan Hulu becomes important to review considering rules governing the functioning of the institutions of Riau Malay custom Rokan Hulu is still described in General. Indigenous institutions in this case has a great opportunity to be the place or means in resolving disputes in non litigation.Interest thesis writer namely; First, to know the role of Rokan Hulu, Riau Malay Customs in the dispute resolution process of garden persukuan Malay tambusai kuala mahato with PT. Torusganda in the Rokan Hulu; Second, to know the constraints of Riau Malay Customs Institutions of Rokan Hulu in the dispute resolution process of garden persukuan Malay tambusai kuala mahato with PT. Torusganda in the Rokan Hulu. Types of legal research that used the author is kind of juridical sociological research. A legal sociological research or empirical research, this is the type of research objectives of the law. From the results of research, there are two things which can be inferred. First, the Riau Malay Customs Institutions of Rokan Hulu does not yet have the authority to say clearly in the position of the mechanism in resolving disputes of indigenous issues. The form of seriousness in defending the interests of indigenous rights related customary land is still not published by the Government so that the position of indigenous institutions in solving plantation Malays Kuala Tambusai Mahato as just the mediator, judge and could not decide. The position of the indigenous institution still governed in General and customary institutions make extensive has not been able to resolveJOM Fakultas Hukum Volume V Edisi 2 Juli-Desember 2018 2this issue in totality. Second, Constraints that occurred in the settlement of problems of plantation persukuan Melayu Kuala Tambusai Mahato conducted by LAMR Rokan Hulu is influenced by two factors, namely the internal factors and external factors. These factors greatly affect the performance of members of the indigenous institutions in carrying out its work. Abstract

Economic Enterprises-Village Savings and Loans hereinafter called UED-SP, the Village Empowerment Program (PPD), which made the Central Government to improve the economies of rural communities. Legal Basis On UED-SP is set on Government Affairs Regulation No. 6 of 1998 on Rural Economic Enterprises - Savings and Loans. Minister Regulation No. 6 of 1998 on Rural Economic Enterprises - Savings and Loans provide an understanding UED-SP is an institution engaged in the field of savings and loans and is owned by the village community / village cultivated and managed by village communities / villages.The aim of this thesis to determine the cause of the debtor in default on UED-SP Taskin Space as well as to determine the completion of the problems for debtors who are in default on UED-SP Taskin Angkasa.Jenis research that will be used is the sociological research, sociological research is research that examines aspects legal to look at legislation in force and compares with the implementation on the ground by means of a survey. The location study was conducted in UED-SP Taskin held at Desa Angkasa District of Bandar Petalangan Pelalawan. Characteristically research descriptive. The data source is the legal data on the use of primary, secondary and tertiary.It can be concluded, Factor causes of bad loans in UED-SP Taskin Space writer get consists of the following: factors derived from the UED-SP (Management and Authority), First, business less careful in analyzing the debtor's credit request. Second, the excessive extension of credit (over financing) on the needs of the debtor. Third, lack of supervision on loans. The next factor is derived from the internal debtors: First, Customer misuse of credit. Second, the customer is less able to manage their business. Third, the customer bad faith. And external factors beyond the ability UED-SP and the debtor: First, natural disasters. Second, Termination (PHK). Third, The decline in selling prices of agricultural products. While the completion of the problems for debtors who are in default on UED-SP Taskin Space never seizure and sale of collateral debtors. It is based on the decision of the village consultation meetings. Following the completion of the problems of the borrowers who are in default: First, the decrease in Interest Rate. Second, the extension of credit period. Third, Sales part or all of the guarantee by the debtor. Fourth, the Sale of Goods Warranty conducted by UED-SP Taskin Space. Abstract

Pusako or the property of Pusako is all tangible wealth (materil), which is inherited to the sons of niece in Minangkabau. The distribution of high estate must conform to the lineage of family ancestry (Ranji). However, the fact that occurs in the division of high heirlooms there is a conflict where one of the parties who receive a high heirloom is not suitable based on the goods. The purpose of this research is to know the position of traditional Batali's incense in the division of the high estate of Mamak to frankness in Kenagarian Tabek Panjang Sub-district of Agam Regency West Sumatera Province and to know the completion of Dispute in the division of the high estate of the Mamak to the frankness of custom Batali in Kenagarian Tabek Panjang Kecamatan Baso Regency of West Sumatera province.This type of research can be classified sociological, because in this research the author directly conducts research on the location or place studied to provide a complete and clear picture of the problem studied. This research was conducted Agarian long Tabek subdistrict Baso regency of West Sumatera Province, while the population and samples are the whole party related to the problems studied in this research, data sources Used primary data, data skunders, and tertier data, data collection techniques in this study with interviews and literature studies.The results of the study can be concluded two things. First, in the Kenagarian Tabek Panjang Kecamatan Baso Regency of West Sumatera Province, the position of indigenous Batali in the division of the high estate has less attention from the Ninik Mamak to fight for its rights. Secondly, the settlement of disputes in the division of the high estate of the Mamak to the frankness in Kenagarian Tabek Panjang District of Baso Agam Province of Sumatra is done by the procedure, namely: in a virtuous way, batanggo down, starting from Inter Ninik Mamak tribe, but if not find the bright point of the problem, then the plaintiff to appeal the level of KAN, plaintiff and defendant will present a witness. Abstract

The position and authority of the guardian in marriage is an important to do. As we known, he is entitled to be trustee of marriage for the bride. If there are no guardian nasab to married her then she should married by guardian judge.The conclusion that can be obtained from this research are, the most factors happened that caused guardian judge become a trustee of the bride when implementation of the marriage in Religious Affair Office Marpoyan Damai Pekanbaru City starting from 2013-2015 because there are no more guardian nasab, the guardian nasab living so far away from the bride, and disharmony relationship between them. Abstract

The Republic of Indonesia is the State of Agriculture, the composition of the life of the people including the economy derived from the agriculture. As an agricultural country, of course the land problem is needed because of places of farming and gardening, as well as places of business, residence and also burial ground. If we discuss the land issue in West Sumatra, we can not help but worry about the Minangkabau Customary Law because the land is an inseparable part of the law itself.Inter-communal land dispute between peoples also experienced by indigenous peoples in Nagari Supayang Salimpaung Subdistrict Tanah Datarpersengketaan Regency is the struggle of treasure treasure that is the land of the house which resulted to the quarrel between the Datuk Cumano (Parikcancang Piliang) and Datuk Tianso (Suku Salo Caniago). Abstract

The Social Security Administering Body is a legal entity established toorganize a social security program. The social security program is the BPJShealth program and the employment BPJS program. In this study, the authorsspecialize in the research of the BPJS Employment program. BPJS Manpower is alegal entity formed to organize a program of employment injury, pension, pension,and death insurance, where the program must be implemented for each employer.But in practice there are still employers who have not fulfilled their obligations toregister themselves and their employees to be participants of the BPJSEmployment program.In this case relate to the implementation of its obligations as an employerto register himself and his employees become participants of the program BPJSEmployment at the Foundation of Education Beerseba Huria Kristen BatakProtestant Sukajadi Pekanbaru City. The purpose of writing this thesis, namely:First, the implementation of the obligation of Beerseba Education FoundationHKBP Sukajadi Pekanbaru City against workers in the program of the EmployersSocial Security Employment Agency. Secondly, the efforts undertaken by BeersebaEducation Foundation HKBP Sukajadi Pekanbaru City against workers infulfilling the Program Organizer of Social Security Employment. This type ofresearch can be classified in the type of sociological juridical research, becausein this study the authors directly conduct research on the location or place understudy. This research was conducted at Beerseba Education Foundation HKBPSukajadi Pekanbaru City, while population and sample are all parties related tothe problem under study, data source used, primary data, secondary data, datacollection techniques in this study with questionnaires, interviews, and Literaturereview.From the results of research problems there are 2 main things that can beconcluded. Pertamai, the implementation of its obligations Yayasan as anemployer to give the right for every workforce to register its employees andthemselves become participants BPJS Employment program is not implemented inaccordance with applicable regulations. Second, the Foundation's ignorance ofthe presence of the Employment BPJS program for workers. Suggestion Writer,First, To the Government through Organ BPJS Employment should be betteragain to conduct supervision and more firmly again in giving sanctions fordisobedient performers. Abstract

Marital marriage is a marriage that is prohibited in indigenous Batak Mandailing, because it is considered to be from the same lineage which means having blood relation. There are three customary marriage systems: eksogamy, endogamy and eleutherogamy. Batak mandailing community belong to the exogamy marriage system, a man is prohibited from marrying a woman of the same age or as a man. A man must marry a woman out of her family. The purpose of this thesis writing is first: to know the causes of prohibited marriage in the village simanosor south tapanuli. secondly, to find out the customary sanctions given to married offenders in the village simanosor south tapanuli district.The type of research can be classified in the type of sociological research, because in this study the authors directly conduct research on the location or place studied in order to provide a complete and clear picture of the problems studied. This research was conducted in the village Simanosor south tapanuli. Descriptive, research with the source Primary, Secondary, and tertiary, while the population and sample are marital offenders, customary leaders and villagers Simanosor. Teknik data collection of interviews, questionnaires and literature review.From the results of research there are two main things that can be concluded, first: the cause of the prohibition of marriage is due to the belief that people who have same clan. Secondly: the customary sanction given to the married offenders is offering betel in the customary assembly session, as a sacrifice requesting forgiveness for wrong, paying customary sanction to prospective in-laws, families and customary chiefs by cutting a buffalo, eaten together by Dalihan na Tolu, women who do marriage should reshuffle their clan from the mother’s side of the husband through the process of traditional ceremonies, not allowed to live village or from the community environment. This penalty is given if not able to meet the fine of one buffalo. The writer’s suggestion is, firstly: the activeness of the adat leaders to teach and guide community to understand the values of adat law and the meaning of the ban of marriage semarga. Secondly: in the application of sanctions must be more assertive aimed to give effect jeragar people are afraid to violate the provisions of customary law one of them doing marriage as a family.Keywords: mandailing customary law, marriage of sunrnsi, adat sanction.

Abstract

Under the terms of the applicable purchase of land rights must be donebefore PPAT but in everyday life was still a lot going on transfer of rights on landthat was done under the hand in the sense of not carried out according toregulations, such things surely would be very detrimental to the buyer , becausehe can only control the rights to land just physically but not legally. Last holdersrequesting decisions regarding selling without PPAT deed, the District CourtPekanbaru used as the basis for recording a transfer rights in the District LandOffice / Municipality.This research method used is normative. Normative law research method isthe method or methods used in legal research done by examining existing librarymaterials. This study discusses the law synchronizing data used is secondary data,ie data that support the information or support the completeness of the primarydata is done by means of literature or literature. Data analysis used the normativequalitative analysis presented in narrative form further analyzed to obtain claritysettlement of the problem, then the conclusions drawn deductively, from the thingsthat are common toward the things that are special.Results from this study is the Basic Legal Considerations Pekanbaru DistrictCourt Judge Case Number: 156 / Pdt.G / 2011 / PN. PBR is not yet synchronized,since the court decision has permanent legal force, it has the same effect andfunction of the deed of sale made by PPAT.Consequently Court Decision No. 156 / Pdt.G / PN.Pbr can be used asevidence to be recorded in the land book and flipped called a certificate on behalfof the buyer. land court judge in the District Court should be the Chairman shouldbe able to issue a "determination", not a "decision". Agreement on cooperation made between PD. Dumai Bersemai Port (BUMD) with PT. TigaBersaudara Port has fulfilled the legal requirements of an agreement as stipulated in Article 1320 of theCivil Code. But over time, this agreement has become null and void, because the second party is PD. DumaiBersemai Port canceled the agreement, and unilaterally decided the agreement, this happened because PT.Tiga Bersaudara Port on the implementation of the practice of cooperation agreements between PD. DumaiBersemai Port is seeded with PT. Tiga Bersaudara Port did not side with PT. Dumai Bersemai Port as thesecond party in this agreement, and PT. Tiga Bersaudara Port has defaulted by not paying a profit sharingfund of 7.5% to PD. Dumai Bersemai Port.The author sets the main problem as follows about whether the factors causing the default betweenPD. Dumai Bersemai Port (BUMD) with PT. Tiga Bersaudara Port thatthere had been a unilateral termination of the contract by the Administrative Services CooperationAgreement of the Ship Guiding Service in the Special Terminal of PT. Sari Dumai Sejati, PT. Semen Padangand PT. Pacific Indopalm in Class 1 Dumai Compulsory Waters, the parties agreed to remind themselves ofa special bond contained in an agreement.
