Abstract

The growing number of parents working outside the home makes the family function as a place to educate the child less. Often, parents submit parenting and children's education to other people (institutions or institutions) that grow a lot of mushrown, especially in large cities such as the daycare places of Ananda Kota Pekanbaru.This type of research is sociological, because in this research the author directly conducts research on the location or place studied to provide a complete and clear picture of the problem studiedBased on the results of the research problem there are two points that can be concluded, first, the existence of the legal relationship between the owner of the nursery with parents is the relationship in carrying out the child care Agreement. The owner of the nursery and the parents here as the owners of rights and obligations where the objective is the achievement of services that must be given the owner to the child who deposited and the child/parent as the subject/perpetrator of activities and owners as Facilitator so that the parents can say as a service user and the owner of a nursery as a service provider. Secondly, the owner of the nursery does not carry out its responsibilities in fulfilling the facilities and infrastructure as well as in the administration process. The facilities and infrastructures that have not been fulfilled are not yet maintain good hygiene and lack of standard feasibility. The nursery owners of the Ananda House also do not have a standard operational procedure (SOP), and do not make an annual report. Author's suggestion, first, is expected to the daycare owner to foster awareness about the importance of knowing and fulfilling the standard of worthiness for a daycare for safety and comfort for children who be stored at. Second, it is expected to the relevant service to further improve the supervision of daycare that stands in Pekanbaru city such as increasing the performance of the viewer to more actively supervise and foster a nursery that does not comply with Standards of eligibility and provide strict sanctions for daycare that does not improve its facilities and infrastructure.Keywords: Responsibility - The daycare - Pekanbaru

Abstract

Marriage raises legal relations with the child born, the Marriage Act in Article 46, paragraph 2 states: if a child has grown, he is obliged to maintain according to his ability, parents and family in straight line upwards, if they need his help.The problems that the author made the basis in the study is how the implementation of the obligations of children against parents according to Law Number 1 Year 1974 About Marriage, and what is the factor of children entrust parents in the Technical Implementation Unit Social Service Tresna Werdha Khusnul Khotimah Pekanbaru. The research method used is descriptive sociological juridical. Source of data used in this research that comes from primary and secondary data. Data analysis uses qualitative data analysis and draw conclusion with deductive method.The results of this study on the implementation of the obligations of children to parents in Technical Implementation Unit of Social Services Tresna Werdha Khusnul Khotimah Pekanbaru when referring to Law Number 1 Year 1974 About Marriage that regulates the obligation of children to parents still found many deficiencies in the implementation. Where there are still children who neglect their parents and entrust to the nursing home. And the reason the child entrusted the parents there are three because of financial factors, the health of parents, and the work of children in the work. The conclusion of Law No. 1 of 1974 concerning Marriage in Article 46 paragraph (2) is implicitly explained about the obligation of the child to provide for his or her parents: the word "nurture" depends on the child's awareness, circumstances and situation.Keywords: Children, Obligations, Parents.

Abstract

One of human needs is marriage, because marriage is a requirement with respect to the physical and mental demands of a human being. Physical demands meant is sexual intercourse between men and women, while the spiritual demands in question is the creation of happiness because of affection between men and women. All of the above can be incorporated into a legal bond called Marriage. Based on Article 1 of Law No. 1 of 1974 About Marriage, hereinafter called the Marriage Act, the definition of marriage is the emotional and physical bond between a man and a woman as husband and wife with the intention of forming a family (household) were happy and everlasting based on God. To perform a marriage there must be harmony and conditions to be met, one of which is the guardian of marriage. If the marriage guardian adlal or reluctant to become guardian of marriage it is necessary to judge guardian. In this case relating to the Determination of Adlal Guardian No. 086/Pdt.P/2013/PA.Pbr in the Religious Court of Pekanbaru.The purpose of this thesis, namely: First, to know the basic consideration of Judge in determining the wali adlal in the Religious Court of Pekanbaru. Second, to determine the factors that led to the refusal to be a guardian of marriage for parents. This type of research can be classified in this type of sociological juridical research because in this study the authors directly conduct research on the location or point examined in order to provide a complete and clear picture of the issues examined.From the research results can be concluded. First, the judge in determining a guardian was adlal in case Number: 086/Pdt.P/2013/PA.Pbr is based on thorough consideration and comprehensive. Consideration of normative-juridical accordance with the legislation in force, namely Law No. 1 of 1974 About Marriage and the Compilation of Islamic Law which, in the case trustee adlal The Petitioner and her husband have fulfilled the terms of a marriage according to the laws and Islamic Shari'ah, and there is no prohibition/obstacles in implementing marriage. Second, the factors that led to the refusal to be a guardian of marriage for parents in case the mayor Determination Adlal with Number: 086/ Pdt.P/2013/PA.Pbr. Of guardians that the Applicant's father refused to be a guardian of marriage for prospective bridegroom less educated and work as a barber. Writer’s advice, first, it is expected that the judge in determining the adlal trustee determination not only create legal certainty, but also expediency and fairness as the highest legal ideals. Abstract

Marital marriage is a marriage that is prohibited in indigenous Batak Mandailing, because it is considered to be from the same lineage which means having blood relation. There are three customary marriage systems: eksogamy, endogamy and eleutherogamy. Batak mandailing community belong to the exogamy marriage system, a man is prohibited from marrying a woman of the same age or as a man. A man must marry a woman out of her family. The purpose of this thesis writing is first: to know the causes of prohibited marriage in the village simanosor south tapanuli. secondly, to find out the customary sanctions given to married offenders in the village simanosor south tapanuli district.The type of research can be classified in the type of sociological research, because in this study the authors directly conduct research on the location or place studied in order to provide a complete and clear picture of the problems studied. This research was conducted in the village Simanosor south tapanuli. Descriptive, research with the source Primary, Secondary, and tertiary, while the population and sample are marital offenders, customary leaders and villagers Simanosor. Teknik data collection of interviews, questionnaires and literature review.From the results of research there are two main things that can be concluded, first: the cause of the prohibition of marriage is due to the belief that people who have same clan. Secondly: the customary sanction given to the married offenders is offering betel in the customary assembly session, as a sacrifice requesting forgiveness for wrong, paying customary sanction to prospective in-laws, families and customary chiefs by cutting a buffalo, eaten together by Dalihan na Tolu, women who do marriage should reshuffle their clan from the mother’s side of the husband through the process of traditional ceremonies, not allowed to live village or from the community environment. This penalty is given if not able to meet the fine of one buffalo. The writer’s suggestion is, firstly: the activeness of the adat leaders to teach and guide community to understand the values of adat law and the meaning of the ban of marriage semarga. Secondly: in the application of sanctions must be more assertive aimed to give effect jeragar people are afraid to violate the provisions of customary law one of them doing marriage as a family.Keywords: mandailing customary law, marriage of sunrnsi, adat sanction.

Abstract

Land is an important element of the formation of the State, in achieving the goals of the State, government intervention is needed, but the cultural diversity of each region is one of the obstacles to the implementation of national law, pawning land is one of the land transactions that still exists and is the needs of Indonesian indigenous peoples including customary law Minangkabau. Where transactions are carried out by Minangkabau indigenous people especially in Kanagarian Koto Tinggi, Agam Regency where many transactions have taken place for decades without any time limit, either orally or in writing.The purpose of this research is to find out how the implementation of the existing pawn apprenticeships in Koto Tinggi Kanagarian and what are the legal consequences of the implementation of the pawn apprenticeship. This type of research is sociological juridical, analytic descriptive research. The research location was Kanagarian Koto Tinggi, Baso Subdistrict, Agam Regency, West Sumatra Province. Data sources used, primary data, secondary data and tertiary data. Data collection techniques with interviews and literature review.From the results of this study, it was concluded that, first, the pawning process in Koto Tinggi Kanagarian began with the agreement of families and people who would pawn the fields and the implementation did not use a time limit. Second, it has been going on for decades ago redemption is based on the price of gold at the time of redemption so that debtors are unable to cut down especially the middle to lower class because the price of gold has gradually increased in price. The author's suggestion is, first, the Government of Agam Regency, West Sumatra Province in general, make a written rule regarding the implementation of pawning apprenticeships, so that with this regulation facilitate the implementation of pawning apprenticeships by the Minangkabau community and mutual benefit between the parties. Second, the Government must be able to socialize, so that the purpose of Article 7 of Law No. 56 of 1960 concerning the Determination of Agricultural Land Area can be achieved.Keywords: Pawn Merchants - Customary Law - In Minangkabau

Abstract

The existence of customary law communities is recognized in Article 18B and Article 28I paragraph (3) of the 1945 Constitution. However, there are still actions that can reduce this right, namely the Forestry Law which categorizes Customary Forest under State Forest. This has resulted in a conflict between the two forests. On this matter, the Constitutional Court issued Constitutional Court Decision Number 35 / PUU-X / 2012 recognizing the rights of indigenous peoples to their customary forests. This recognition is provided as long as in reality the customary law community concerned still exists and its existence is recognized. The objectives of this thesis are: First, the existence (existence) of the customary land of the Muara Sakal customary law community (Muaro Sako) in Pelalawan Regency after the Constitutional Court Decision No. 35 / PUU-X / 2012; Second, the inhibiting factor for the existence of the ulayat lands of the customary law community of Muara Sakal (Muaro Sako) in Pelalawan Regency the legal efforts made to maintain the existence of these ulayat lands.This type of research can be classified as a sociological juridical research type, because in this study the author directly conducted research at the location or place being studied in order to provide a complete and clear picture of the problem under study. This research was conducted at the Customary Law Community of Muara Sakal (Muaro Sako), in Langgam Village, Langgam District, Pelalawan Regency. The data sources used were primary data, secondary data, tertiary data with interview data collection techniques and literature study.Conclusions can be drawn, first, the existence / existence of the customary law community community rights in Muara Sakal, Langgam sub-district, Pelalawan district, this is indicated by the existence of the customary law community Muara Sakal as the subject of customary rights, there is still Muara Sakal customary land as the object of customary rights, and still there is a relationship between the subject and the object of customary rights. Second, the absence of a Regional Regulation or Regent Decree that provides legal certainty and regulates the protection of customary rights in Pelalawan Regency, especially the ulayat rights / ulayat land of the Muara Sakal customary community (Muaro Sako), as well as the Muara Sakal customary law community have made a number of legal efforts. to obtain legal certainty in the protection and recognition of their customary rights, but it has yet to produce results.Keywords: Existence - customary rights - Muara Sakal customary community

Abstract

Humans created god in the two types of men and women who have an interest and need each other to form a marital bond to form a family. Inheritance system is one way of transfer of ownership of property and material rights of the heir to the heir. Inheritance law karo society is patrilineal patrilineal, the division of his estate is also distinguished. Legacy that is not moving, such as land, houses given to boys, while the legacy that moves like pakean and gold given to the woman. Giving legacy is the biological child of the testator. While the child who is a foster child inheritance obtained limited to the proceeds of livelihood and excluding inheritance. The existence of a foster child in the middle of the Batak Karo interesting to discuss because if the adoptive parents died boys are entitled to inherit from his adoptive parents.This study is the direct legal research sociological researchers to conduct research on the location completely and clearly about the issues examined by interviewing the head and the Karo Batak Karo Batak people. The result of this study is the first that the village Ajibuhara a foster son has fully inherited the position and rights of property search adoptive parents but are not entitled to inherit treasures like biological children through the procedures and customary provisions applicable. Second, the implementation of village Ajibuhara adoption should be done with the intent to bring the event adatdengan other communities know that there has been no event of adoption of the village. Suggestions of this study is the first, to the people who have adopted children in order to perform all procedures according to customary adoption and inheritance so that the position adopted child becomes clear. Abstract

Lease is an agreement, whereby one party binds itself to provide enjoyment of an item to another party for a certain period of time, with payment of a price agreed by that party. For those who rent out, the rights and obligations are to obtain payment in exchange for services and deliver the rental goods to the lessee. While the rights and obligations of the lessee are to obtain the use of the leased goods and to pay the rent periodically. If the rights and obligations of each party are not fulfilled, it can be called default. The agreement will terminate if the rights and obligations of the lessor and the lessee have been carried out in accordance with the agreement.The location of this research is the Regional Company Bimex Bengkulu. This study aims to identify and analyze the implementation of a car/motorcycle laundry rental contract between a Bimex Bengkulu Regional Company and a tenant in the city of Bengkulu and to find out the form of settlement of a car/motorcycle laundry rental contract default between a Bimex Regional Company and a tenant in the city of Bengkulu.This research is an empirical juridical research, the population is Bimex Regional Companies and tenants, the samples are Director of General Affairs and Finance of Bimex Regional Companies, Head of General Division of Bimex Regional Companies and tenants. Sources of data in this study are primary, secondary, and tertiary data. The data collection techniques used were library research, interviews, and documentation. The analysis carried out is an analysis of a qualitative approach.Based on the results of this study the authors concluded that at the time of execution of the contract the lessee did not carry out his obligations in accordance with the contract. The tenant always breaks his promise and also does not become a good head of household so that by not implementing an honest and proper attitude, it causes losses for the Bimex Regional Company.Keywords: Contract, Lease, Default

Abstract

BP4 merupakan sebuah lembaga yang bertujuan untuk mempertinggi mutuperkawinan guna mewujudkan keluarga sakinah menurut ajaran Islam untukmencapai masyarakat dan bangsa Indonesia yang maju, mandiri, bahagia,sejahtera materil dan spriritual. BP4 Kecamatan Singingi memiliki tugas yangsalah satunya yaitu penyelesaian masalah keluarga. Berdasarkan hasil penelitiandi Kecamatan Singingi angka perceraian terutama cerai gugat yang setiaptahunnya selalu terjadi peningkatan, untuk itu bimbingan dari peran BP4 itusendiri sangat diperlukan dan diharapkan akan memberikan dampak yang baiksehingga cerai gugat di Kecamatan Singingi dapat di kurangi.Tujuan penelitian ini sendiri mengkaji efektivitas BP4 dalam upayanyauntuk mengurangi cerai gugat di Kecamatan Singingi Kabupaten KuantanSingingi, serta faktor penghambat apa saja yang dialami BP4 Kecamatan Singingidalam pelaksanaan tugas BP4 itu sendiri.Jenis penelitian ini dapat digolongkan dalam penelitian sosiologis yaitupenelitian yang hendak melihat korelasi antara hukum dengan masyarakat,sehingga mampu mengungkap efektifitas berlakunya hukum dalam masyarakatdan mengidentifikasi hukum yang tidak tertulis yang berlaku pada masyarakat.Dari hasil penelitian dapat disimpulkan bahwa, dalam upaya penyelesaianmasalah perkawinan, BP4 menganjurkan terlebih dahulu permasalahan tersebutdibawa ke BP4. Peran BP4 disini ialah memberikan mediasi yang bertujuan untukmemberikan penasehatan, penyuluhan, konsultasi, dan bimbingan agar masalahkeluarga tersebut dapat ditemukan jalan keluarnya dan kemudian cerai gugat tidakakan terjadi. Akan tetapi, efektivitas BP4 ini belum berjalan dengan baik,disebabkan beberapa faktor penghambat yaitu kurang lengkapnya sarana danprasarana seperti kantor BP4, alat-alat elektronik seperti computer, printer bahkanmeja dan kursi sebagai penunjang kinerja pegawai BP4, serta kurangnyasosialisasi kepada masyarakat dan kurangnya kesadaran para pihak.

Abstract

Land has a very close relationship with humans. The importance of the meaning of land for human life is because human life cannot be separated from the soil at all. The phenomenon of ulayat land disputes coming to the surface is largely the result of land acquisition for development purposes. One of the land dispute cases is the ulayat land dispute between the residents of the village of Koto Tuo, sub-district XIII, Koto Kampar and PT. Sumatra Agro Tunas.This type of research can be classified in the type of sociological law research (empirical), because in this study the author directly conducts research on the location or place under study in order to provide a complete and clear picture of the problem being studied. This research was conducted in the village of Koto Tuo, District XIII, Koto Kampar, which aims to find out how the implementation of the peace agreement between the Osang Jati farmer group and PT. Sumatra Agro Tunas while the population and sample are the Village Head of Koto Tuo, District XIII Koto Kampar, Ninik Mamak, District XIII Koto Kampar, Director of PT. Sumatra Agro Tunas and Head of the Osang Jaya Farmers Group. Sources of data used are primary data, and secondary data. Data collection techniques in this study were interviews, and literature review.The conclusions that can be obtained from the results of the study are First, Settlement of customary land disputes in the village of Koto Tuo, XIII district of Koto Kampar between the Osang Jati farmer group and PT. Sumatra Agro Tunas did not run well. PT. Sumatra Agro Tunas is not subject to the agreed points of agreement and does not carry out the agreed obligations. Second, the obstacle to resolving the customary land dispute in the village of Koto Tuo, District XIII, Koto Kampar, between the Osang Jati farmer group and PT. Sumatra Agro Tunas, among others, consists of not implementing the results of the agreement by PT. Sumatra Agro Tunas, Lack of authority of the Kampar district government and the lack of details on the position of the parties and Third, Efforts made in resolving ulayat land disputes in the village of Koto Tuo, subdistrict XIII, Koto Kampar, between the Osang Jati farmer group and PT. Sumatera Agro Tunas, among others, the Kampar district government, has mediated in resolving the conflict between the residents of Koto Tuo Village, XIII Koto Kampar District and PT.
