Abstract

This research is motivated increasingly high demand for land will lead to many problems arising. To ensure fairness required the public land ownership legal institutions are bound raw legal rules. Badan Pertanahan Nasional Pekanbaru is the government agency that handles issues related on land.In solving the problems of existing land disputes, Badan Pertanahan Nasional Pekanbaru promote mediation in resolving land disputes. Because solving problems of land with paths mediation resulted in a decision win win solution and promote kinship between the two parties to the dispute. With that way justice can be expected to materialize. Issues that will be examined in this study are: first, How is the implementation of mediation in Badan Pertanahan Nasional Pekanbaru? Secondly, how effectiveness of Badan Pertanahan Nasional Pekanbaru as a mediator in the settlement of a land dispute to the parties in the city of Pekanbaru? Third, What efforts should be made by Badan Pertanahan Nasional Pekanbaru in land dispute resolution with mediation in Pekanbaru city? This type of research is a sociological law research. Source of data used are primary data and secondary data, data collection techniques using interviews with 9 respondents who have and are undergoing the process of settlement of the land dispute in Badan Pertanahan Nasional Pekanbaru and conducted interview with the head section of disputes, conflicts and cases and interview with Kasub Section of Disputes, conflict and cases at Badan Pertanahan Nasional Pekanbaru and literature study.In this study the authors used a qualitative analysis, in drawing conclusions using inductive method of thinking. Results from this study were first, Through the implementation of the Land Dispute Resolution Mediation with the implementation of the research results of mediation in Badan Pertanahan Nasional Pekanbaru either. Second, The effectiveness of Badan Pertanahan Nasional Pekanbaru as a mediator in Land Dispute Resolution in Badan Pertanahan Nasional Pekanbaru has been effective to solving the problems of existing land disputes with mediation. Third, Efforts Conducted by the National Land Agency in Pekanbaru City Land Dispute Settlement in Mediation has a maximum in the resolution of existing problems. By looking at the results of the research as a whole, very precise paths promoting mediation in resolving the land dispute case.Keywords: DisputeResolution-Land-Mediation

Abstract

Registering a trademark is very important for entrepreneurs today. Trademarks include company names and logos, names and symbols of certain products from companies and company slogans. As you know, there are still many digital startups that have not registered their trademarks. In fact, the existence of IPR certificates is considered quite important to protect its business from piracy, imitation or other problems and when there are investors who are interested in working together. Where IPR in general or trademark specifically is the foundation of a digital startup company Regulations related to brands are regulated in Law Number 20 Year 2016 Regarding Trademarks and Geographical Indications. Even though the various phenomena present show the enormous potential of the creative economy, it turns out that there are not many startups who consider IC to be an important issue, which is the problem at hand.The purpose of this thesis is; First, legal protection of trademark rights at digital startup companies that do not register trademarks in Bandung. Second, barriers faced against trademark rights in digital startup companies that do not register trademarks, Third, solutions or efforts made by the Creative Economy Agency. This type of research is sociological juridical research, which is research that emphasizes the legal aspects of the subject matter to be discussed, related to the reality in the field.From the results of research and discussion, there are three main things that can be concluded, First, legal protection of the rights to trademarks in digital startup companies that do not register trademarks can be done, based on the provisions of Article 21 paragraphs (1) letters b and c which contain the application refusal registration and be strengthened by Article 76 regarding the claim for cancellation of the mark. Second, the obstacles faced by digital startups in trademark registration are the lack of knowledge and understanding of the importance of IP protection, the lack of understanding of IP by the organizers and the Time Management related to trademark registration. Third, solutions or efforts made by Bekraf to increase awareness of digital startup companies on trademark registration by holding programs such as Facilitation of IPR registration, IPR protection seminars for ecraf products and IPR socialization etc.Keywords : Trademark, Startup Digital,Trademark Registrasion.

Abstract

Fishermen are jobs that have a high level of risk, such as bad weather changes and problems that can occur when fishing, and spending money to meet the needs of daily life. The purpose of this study was to study the guarantee of safety for small fishermen through independent fishermen insurance, find out the rights and obligations between the guarantor and small fishermen in obtaining Safety. Fisherman insurance is regulated in the Law on Insurance Number 40 of 2014. Specific regulations on fisheries insurance concerning Law Number 7 of 2016 concerning Protection and Empowerment of Fishermen Insurance for Fishers, Fish Farmers, and Salt Farmers. This study specifically discusses fisherman insurance for small fishing communities. Entering a fisheries insurance agreement is carried out with premium payments paid by small fishermen, without government subsidies / assistance.The research carried out is a sociological legal research that is research that starts with the process of revealing the truth using basic concepts in sociology known as science, and taken from secondary data by processing data from primary legal materials, secondary legal materials, and legal materials tertiary. Research location in Bengkalis Regency, Riau Province. The recommendations used are juridical-sociological, namely research conducted on real situations in the Department of Maritime Affairs and Fisheries (DKP) and local fishermen in the Bengkalis Regency fisheries area.The results of this study regarding the research work agreement by PT Asuransi Jasa Indonesia (Jasindo) Pekanbaru Branch. Implementation of the rights of fishermen in obtaining safety here is less than the awareness and knowledge of the people in Bengkalis Regency to improve the clauses in the policy the Insurer does not give an understanding to small fishermen about things that are excluded in insurance coverage. To the PT Asuransi Jasindo Pekanbaru Branch to explain things that are excluded in the independent fisheries insurance policy, so that the rights of small fishermen can be accounted for according to the Law.Keywords: Fishermen Insurance, PT Asuransi Jasindo, Small Fishermen

Abstract

Since Indonesia was founded, the people of Indonesia have realized that work is a basic need of citizens. One of the job opportunities is offered to people who have specialist knowledge especially nursing and work in hospital. In his consideration, the authors took place at Aulia Hospital Pekanbaru, the caregiver was male and female. They are not entitled to such rights as set forth in the Manpower Act and other government regulations relating to protection, in particular the rights to be obtained for male and female nurses working at night.The purpose of this research is First, the implementation of legal protection against nurses who work at night at Aulia Hospital Pekanbaru based on Law Number 13 Year 2003 About Manpower. Second, constraints and efforts faced by the parties in the implementation of legal protection against nurses who work at night in Aulia Hospital Pekanbaru. This type of research is sociological research. This research was conducted at Aulia Hospital Pekanbaru. The population is the nursing manager and contract nurse. The data used are primary data and secondary data. Data collection techniques are interviews, questionnaires and literature study.From the results of research there are two things that can be concluded. First, the implementation of the legal protection of nurses who work at night in Aulia Hospital Pekanbaru is still not fulfilled, namely the right to get food and drink, the right to get security during work, and the right available shuttle facility workers. Secondly, the efforts and obstacles to fulfill the right of nurse, Aulia Hospital Pekanbaru's obstacle is the lack of understanding of the regulation in Law Number 13 Year 2003 on manpower so as not to explain in detail the right of nurse, the nurse does not know the right what they should get at work. It should make an agreement that contains all the rights and obligations of both applied during the employment relationship, until the workers know all of their rights that should be earned while working and the employers know their duties and what they should do to give the nurse right.Key Words: Legal protection of nurses at night, male nurses and female nurses - Aulia Hospital Pekanbaru Pekanbaru

Abstract

Under Article 7, and Article 17 of the BAL states that the possession of land exceeding the limit is not permitted. The purpose of this regulation is to avoid the practice of landlords and to enhance the lives of farmers. This article is described further in Law no. 56 Prp Year 1960 About Stipulation of Land Area of Agriculture. In that Article stipulates that a person or persons in whose life a family together shall only be allowed to control the land of his own and that of the other person or his own with the other person whose total shall not exceed the maximum limit specified in the Law -What. With regard to the population, area and other factors areas are categorized quite densely ie 250-400 inhabitants per Km can only have land not more than 7.5 Ha for rice field and 9 Ha for dry land. However, the facts are still found that some people owning agricultural land exceed the maximum limit set by the law.The problem that the author made the basis in the study is how the implementation of the determination of agricultural land in the village of Girisako, how the legal effect on land ownership exceeds the maximum limit in the village girisako, and what government efforts in dealing with ownership of land exceeding the maximum limit in the village girisako. The research method used is descriptive sociological juridical. Source of data used in this research that comes from primary and secondary data. Data analysis uses qualitative data analysis and draw conclusions with deductive methods.The results of this study indicate the implementation of Article 17 of the BAL on the maximum limit of land ownership in the village girisako still a lot happening. This is due to public ignorance of regulations on the maximum agricultural land. The lack of supervision and the absence of government efforts is also a very important factor in the enforcement of this regulation. The conclusion of this research is that the government should review the regulation on the determination of agricultural land area. The land office needs to monitor the control of agricultural land so that in the future the implementation of the maximum limit of agricultural land can be done well.Keywords: Implementation-Limit Maximum Area- Agricultural Land

Abstract

One of the growing industrial activities in Bengkalis is the business in the field of production of Traditional / Traditional Foods. Currently known for some typical / traditional foods that are in demand, including dodol, Bolu, Onion chips and others. But there are entrepreneurs of the products sold there who have not registered their brands. Whereas the consequences of not registering a trademark enable the occurrence of counterfeiting or unfair competition which is also greatly felt by business actors and protection of the trademark is also very necessary. The purpose of community service activities is to provide socialization and understanding to the public about the importance of trademark registration and trademark registration procedures. This activity can also increase knowledge competence, skills, community motivation, and role in trademark registration. The importance of providing assistance to the community in protecting the products they produce. The initial activity was initiated by taking information from the community about food products in the Pangangalan Jambi village. Data collection techniques carried out by interview, observation and document analysis. The existence of local products produced by the community in Pangkalan Jmabi Village has made this village a choice in community service activities. Community service activities carried out through personal and community approaches. The results of community service activities showed the enthusiasm of the community attending a series of activities, and the active role of the community was quite good. Activities carried out continuously and continuously have a positive impact on community growth and development.

Abstract

Underage marriages are marriages that occur where a man or woman who has not reached the age required by applicable law, that is, if the male has reached the age of 19 and the woman has reached the age of 16. The purpose of community service activities is to provide socialization and understanding to the public about the impact of early marriage in terms of legal, health and education aspects. This activity can also improve knowledge competence, skills, community motivation, and play a role in the formation of a prosperous family village development team. Data collection techniques carried out by interview, observation and document analysis. The results of this community service show the enthusiasm of the community to attend a series of activities, and the active role of the community is quite good. Improved understanding of the community is divided into 3 categories, namely, the village prosperous village development team, health development and Education development. Activities carried out continuously and continuously have a positive impact on community growth and development.

Abstract

There are several problems in the community with children in the fields of Education, Law and Health. There are still children under 18 years of age who are exploited as commercial sexual workers; children in conflict with the law, children aged 10-18 Years work in the informal sector, children who leave primary school before graduating or do not continue to the next level due to access and economy; adoption cases are carried out outside the standard population administration procedures; the discovery of stunted children. So, it is necessary to increase public understanding regarding child protection. One of those who have the responsibility of providing protection to children is the parent, the service program is carried out by providing material related to the role of parents and society in providing protection to children. The delivery of this material aims to provide an understanding of child protection in terms of education, law and health so that the public can understand the importance of protecting children. This service activity in Tambun Village can be said to be successful. There was a request from the participants to continue this activity. The people of Tambun Village hope that for further activities, further training is given regarding the skills needed by parents and the community. To increase community understanding, the WA Group was also created, whose members are parents who have participated in the Socialization program, this group aims to be a forum for communication between the Service Team and the local community.

Abstract

As we know, the life of the people of Tanjung Pauh Hamlet, Tanjung Belit Village, Rokan Hulu Regency is still fairly traditional. The problem discussed in this research is concerned with the sugar palm farmers in Tanjung Pauh hamlet. The palm sugar produced is very popular with consumers because of its pure taste without a mixture of preservatives or chemicals, and because the manufacturing process prioritizes quality. It's just that due to a shortage of sap water, the production of palm sugar in Tanjung Pauh hamlet can be said to be very little to meet the needs of the community itself. Therefore, we tried to do research by conducting a survey of the location of the palm trees, the location of the palm sugar making, and collecting data on the needs of the palm farmers in Tanjung Pauh hamlet. This study aims to provide guidance to the community of Tanjung Pauh hamlet as a hamlet that has the potential to develop income through improving the quality and marketing of palm sugar. We gave a little idea to the palm farmers in Tanjung Pauh hamlet to produce palm sugar, which is palm sugar which is usually in the form of blocks, which is now being innovated into the form of ant sugar, in order to attract consumers' attention to love palm sugar in Tanjung Pauh hamlet.

Abstract

With the enactment of Law No. 5 of 1960 concerningthe Basic Agrarian fundamental changes to the agrar-ian law in Indonesia, especially in the area of land.As for the legal basis for the conversion of land rightsis the second part of the Act concerning the provisionsof the conversion consists of nine chapters that gov-ern the conversion of three types, namely: the conver-sion of land resulting from Indonesia’s rights, con-version rights to land former Autonomous and con-version of land rights from the rights of the west.
