Abstract

Insurance is a risk transfer agreement that is often used by society to this day, and is also used by leasing companies to reduce the risk of default that may occur in leasing financing activities. However, leasing companies often require prospective financing recipients to insure their lives. Is there an obligation for life insurance for the lessee in the main lease agreement? This is the core issue that will be addressed. This research uses a normative type with a descriptive nature, by qualitatively analyzing secondary data including primary legal materials and secondary legal materials directly related to insurance law and financing law obtained through visits to the Trisakti University Faculty of Law Library and internet searches. Credit life insurance is categorized as voluntary insurance that prioritizes the agreement of the parties in concluding the insurance, so the insurance obligation stipulated in a Lease Agreement is a mistake against the fulfillment of the halal causa requirement and the principle of freedom of contract, which results in the Lease Agreement being null and void by law, and the lessee is not required to have life insurance. The Leasing Company (lessor) can only offer the prospective lessee the option to choose credit life insurance or not.

Abstract

This study examines the identification process and challenges in supporting students with special needs at SDN 31 Pekanbaru, an inclusive elementary school. Using a qualitative case study approach, data were collected through classroom observations, interviews, document analysis, and standardized screening tools. Teachers and researchers assessed students from Grades 1 to 6 and identified five students with special needs: three slow learners and two with ADHD. Findings indicate that the school lacks a formal identification procedure, relying instead on parental reports and personal observations. The absence of specialized training also poses challenges in providing effective interventions. Key challenges include inadequate teacher preparedness, limited resources, and low parental involvement due to social stigma and financial constraints. Although inclusive education policies exist, the current curriculum does not fully accommodate students with diverse learning needs. This study recommends structured teacher training, increased resource allocation, and educational programs for parents. Further research should explore the long-term impact of inclusive education, the effectiveness of teacher training, and strategies to enhance parental involvement in fostering a more inclusive learning environment

Abstract

Measuring chlorophyll content in plants is one of the main points that has never been ignored in various plant biology and agronomy research studies. Chlorophyll content is a parameter of growth and development, diagnosis of nutritional status, and response to environmental conditions. This study aimed to compare and determine the relationship between SPAD-502 chlorophyll meter readings and chlorophyll content obtained from acetone extraction followed by spectrophotometry measurement. Various leaves with different colors and thicknesses were used to determine the reliability of SPAD readings across diverse morphological traits. The results showed higher SPAD readings in leaves with a greener color. SPAD value was found to have a good linear relationship (r 0.8 and R2 0.64) and a positive correlation with total chlorophyll content, though variations due to leaf thickness suggest the need for correction factors. Furthermore, SPAD has potential as a rapid, non-destructive tool for monitoring plant health and nutrient status in agriculture, plant breeding, and horticulture. This tool can contribute to optimizing crop yield and managing fertilization practice, especially where the maintaining leaf integrity is essential for both commercial and aesthetic value. Species-specific calibration models are recommended to enhance measurement accuracy.

Abstract

In this legal study, the author is interested in examining the implementation of financing with the musyarakah mutanaqisah contract at Bank OCBC NISP Syariah Mataram, which encountered problems between the bank and the debtor. The identified problem in this study is how the musyarakah contract is regulated in Islamic financing, and whether the Decision of the Mataram Religious Court Number 128/Pdt.G/2022/PA.Mtr. is in accordance with Islamic banking regulations. The legal research method used is normative legal research, conducted by collecting primary, secondary, and tertiary legal sources, analyzing data qualitatively, and drawing conclusions using deductive logic. Based on the results and conclusion of the study, it is concluded that Bank OCBC NISP Syariah Mataram must carry out its function as a fund distributor in financing products based on DSN-MUI Fatwa No.05/DSN-MUI/IV/2000, and that Bank OCBC NISP Syariah Mataram was not lawful in executing the auction of mortgage rights over land or a house because it failed to notify the debtor and conducted the execution without a court decision. This study concludes that Bank OCBC NISP Syariah Mataram acted inconsistently with Islamic banking provisions in the execution of mortgage rights against Sigid Wisnu Hernawan as the debtor, as the procedures outlined in Law Number 4 of 1996 on Mortgage Rights were not followed. Moreover, in this case, the panel of judges at the appellate level did not consider the validity of the mortgage execution auction.

Abstract

This study examines the legal situation of debt collection by Dana Pay later services versus emergency contacts in the financial technology (Fintech) sector in Indonesia. Pay later fintech services, which provide easy access to credit, often raise problems in debt collection practices, especially when emergency contacts become the target of service providers' collection efforts. This research aims to analyze the legal situation of emergency contact holders and assess the compliance of debt collection practices with current regulations, such as OJK Circular No. 19/SEOJK. 06/2023 concerning the ethics of confinement. The research uses a legal normative approach by analyzing secondary data, including laws, legal theories, and case studies. The results show that debt collection from emergency contacts, who have no legal obligations related to the loan, is against the regulations of theĀ OK. Such practices potentially violate privacy rights and create psychological pressure on emergency contact holders. Therefore, there is a need to strengthen the regulation and supervision of fintech providers to ensure compliance with ethical standards of debt collection in Indonesia.
