Abstract

Gubug Belodan Village is located in the scope of the Tabanan Regency area with a strategic location on the edge of the city, has a high lure to be used as a residential or commercial area which certainly greatly affects the agricultural land in Gubug Belodan Hamlet where the land used is finally in a shifting condition. Based on this, how is the granting of building approval (PBG) in the green belt area? And how is the policy of granting building approval (PBG) in the green belt of Gubug Belodan Hamlet, Tabanan Regency? This research uses empirical legal research. The green line, which is a public infrastructure and facilities, the establishment of buildings on the green line must have PBG based on Law No. 28/2002 on Building. Regarding the green belt development policy, it is also explained in the Tabanan Regency Regional Regulation No. 6/2014 concerning the Green Belt Area which provides an understanding that the establishment of buildings is not allowed permanently or not which is contrary to the functional and use of the defense area concerned in the green belt area, except with the permission of the Regent with the recommendation of the DPRD.

Abstract

In its implementation, billboards often use public facilities that should not function as a place or means of promotion. This results in irregularities in the licensing field with the Government such as in Badung Regency. Based on this, how is the implementation of billboard installation in Badung Regency? And how is the control of the implementation of billboard installation in Badung Regency? Research writing uses empirical legal methods. Based on Badung Regent Regulation Number 80 of 2014, the installation of billboards must pay attention to aesthetics, ethics and beauty, where in Badung Regency there is still a lot of overlap in the practice of installation places. In this case, the Badung Regency Government has a Master Plan (location of billboard distribution) to issue permits for the implementation of billboards that are not in accordance with the rules, by making repressive and preventive efforts such as demolition and socialization of the rules for billboards and processing billboard permits.

Abstract

Immoral acts by foreigners in tourist destinations must receive sanctions based on regulations in the Criminal Code and sanctions based on customary law. The problem is, 1) what are the legal regulations for foreigners who commit immoral acts in tourist destinations? and 2) How the judge considered decision Number 66/Pid.B/2021/PN. Sgr about immoral crimes committed by foreigners in tourist destinations? This research describes the legal regulations and considerations of judges in deciding cases of acts of decency by foreign citizens in tourist destinations. This research uses deductive legal logic which is analyzed descriptively through a statute approach, conceptual approach and case approach. This research shows that the legal regulations for foreigners who carry out decency acts in tourist destinations are part of the regulations for decency acts in the Criminal Code and customary law. The judge's decision considerations are based on legal and non-legal factors. The relationship between the two lies in the application of criminal sanctions and the judge's consideration in making a decision.

Abstract

In Indonesia, there is a strong and steady development of roads, buildings and public facilities that will be very useful for the community in the future. However, in mineral exploitation activities there are still people who violate these regulations by committing criminal detention. The formulation of the problem is:1) how is the licensing arrangement for rock and nonmetal mineral mining companies? 2) What are the administrative sanctions for arresting entrepreneurs who carry out exploitation of non-metal minerals and rocks? This researchs uses normative legal research methods using legislation and document research methods by analysing and examining current legal regulations as a basis for problem solving. The results show that legal provisions related to criminal sanctions against licences to own and cultivate non-metal minerals and rocks are implied in the Criminal Code and regulated in Law Number 3 of 2020, amending and adding a number of articles in Law Number 4 of 2020. 2009, Articles 158 and 160 related to Non-Metal and Stone Mining, Government Regulation Number 5 of 2021 concerning the Implementation of Business Licences. In this case, there are sanctions and fines if business entities commit preventive violations in the exploitation of non-metal minerals and rocks.

Abstract

In Indonesia, technological progress is very rapid, but some people take advantage of this by committing criminal acts. This will have an impact on the protection of personal data. CyberCyber security in the form of wiretapping has a very important role. The formulation of the problem raised is 1) how is the regulation of the use of "zero-clickzero-click" tapping tools in cybercyber crimecrime cases, and 2) how are the implications of the use of "zero-clickzero-click" tapping tools in handling cybercyber crimecrime cases on personal data security? The research conducted is normative juridical, which is a deductive research that begins with analyzing the articles in the governing legislation. The results of the research show that the act of wiretapping is regulated in Article 5 Paragraph (2) and Article 31 Paragraph (3) of the Electronic Information and Transaction Law, there is an expansion of evidence where legally, wiretapping is a legal action. The act of wiretapping is contrary to human rights in the protection of personal data, so the government guarantees data confidentiality for victims which has been regulated in Article 17 of the Minister of Communication and Information Technology Regulation Number: 11/PER/M.KOMINFO/02/2006 relating to Technical Tapping.

Abstract

Income tax is a direct tax levied by the central and state governments. The problem formulations in this study include: 1. How are income tax offenses regulated? What are the penalties for income tax violators? The research method applied in this research is normative legal research, using a statutory approach and case studies. Based on the results of the research, it can be concluded that Law Number 36 of 2008 concerning Income Tax has regulated the principles of calculating income tax such as who is subject to tax, what is the purpose of the tax, and different applicable tax rates. Violations of laws and regulations in the field of taxation committed by taxpayers are regulated in Articles 38 and 39 of Law Number 28 of 2007 concerning General Regulations and Procedures for Taxation, as well as Article 43A of Law Number 7 of 2007 In tax law, criminal sanctions apply, including fines, imprisonment, and confinement. The use or management of administrative and criminal sanctions in the field of taxation is explained in Law Number 28 of 2007 concerning General Regulations and Tax Procedures as stated in Articles 38 and 39.

Abstract

The industrial revolution will change human lifestyles, as people interact with each other and work from manual to digital. The OSS RBA institution offers a variety of business licenses, including Electronically Integrated Business Licensing and Online Single Submission Risk Based Approach (OSS RBA). The OSS RBA system allows micro, small, medium and large business owners to apply for business licenses online. The formulation of the problem to be discussed is (1) How is the Implementation of Digital-Based Business Licensing at the Bangli Regency Investment and One-Stop Integrated Services Office? And (2) how are the obstacles and efforts made by the Bangli Regency One-Stop Investment and Integrated Services Office in streamlining digital-based business licensing services? This research uses interview techniques as part of an empirical legal research design. Business licensing is based on two laws and regulations: Government Regulation Number 5 of 2021 which regulates the implementation of risk-based licensing, and Government Regulation Number 6 of 2021 which regulates the implementation of regional licensing.

Abstract

Denpasar City, a popular tourist destination, is struggling to maintain peace and order due to rapid urbanization and an influx of migrants. This has led to an increasing number of job seekers exceeding the job opportunities available in the city. The problems in writing this thesis are (1) How is the implementation of the control of vagrants and beggars by the Pamong Praja Police Unit in Denpasar City? and (2) How are the obstacles faced by the Pamong Praja Police Unit in controlling vagrants and beggars in Denpasar City. The research method used is an empirical method by collecting data through interviews with related parties, document analysis, and direct observation of the curbing process. The results showed that the curbing and handling of vagrants and beggars in Denpasar City has not gone well, seen from the many activities of vagrants and beggars in Denpasar City so that it still disturbs public order. The obstacles of the Civil Service Police Unit in controlling vagrants and beggars are divided into Juridical and Non-Juridical obstacles. The Denpasar City Government is still trying to deal with the social problems of vagrants and beggars by means of preventive, refrensive, and rehabilitation.

Abstract

Dalam Negara Kesatuan Republik Indonesia, terdapat Pemerintahan pusat dan Pemerintahan daerah yang masing – masing memiliki tugas dan wewenangnya sendiri di dalam dalam urusan Pemerintahan. Adanya otonomi daerah menjadikan Pemerintahan daerah memiliki kewenangan dalam menjalankan urusan-urusan Pemerintahan. Permasalahannya adalah : (1) Bagaimanakah dasar kewenangan pemerintah daerah dalam menjalankan urusan pemerintahan? Dan (2) Bagaimanakah ruang lingkup urusan pemerintahan yang dijalankan oleh pemerintah daerah? Penelitian ini bertujuan untuk menguji kedua fondasi otoritas pemerintah daerah dalam mengelola urusan pemerintah dan untuk menganalisis implementasi aktual dari urusan ini. Metode hukum normatif digunakan dalam penelitian ini. UU No. 23 Tahun 2014 memungkinkan pemerintah daerah di Indonesia memiliki kendali atas urusan regional berdasarkan kebutuhan spesifik mereka. Ini mengkategorikan urusan pemerintah daerah menjadi kategori absolut, bersama, dan umum, yang selaras dengan prinsip - prinsip desentralisasi, dekonsentrasi, dan bantuan. Konsep ini mengakui perbedaan signifikan antara pemerintah pusat dan daerah, mengakui bahwa daerah dapat mengelola sumber daya dan masalah secara mandiri Masyarakat dapat terlibat dalam pengambilan keputusan tentang urusan pemerintah melalui forum, konsultasi publik, dan platform lainnya. Pemerintah meningkatkan koordinasi antara otoritas regional dan pusat untuk memastikan tata kelola yang stabil. Komunikasi dan kolaborasi yang efektif diperlukan.

Abstract

Demonstrasi sebagai implementasi kebebasan menyampaikan pendapat ialah hak konstitusional yang dijamin didalam UUD Negara Republik Indonesia Tahun 1945 dan tertuang lebih lanjut dalam insrumen hukum nasional lainnya, seperti Undang-Undang Nomor 9 Tahun 1998 tentang Kemerdekaan Menyampaikan Pendapat di Muka Umum dan Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Namun, pelaksanaan aksi demonstrasi sering kali dihadapkan pada tindakan represif aparat kepolisian yang tidak proporsional sehingga menimbulkan dugaan pelanggaran HAM. Penelitian ini bertujuan untuk mengetahui pengaturan hukum mengenai tindakan represif aparat kepolisian dalam pengamanan aksi demonstrasi serta menganalisis bentuk pelanggaran hak asasi manusia yang dapat timbul dari tindakan tersebut. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual melalui studi terhadap berbagai bahan hukum primer, sekunder, dan tersier. Hasil penelitian membuktikan bahwa secara normatif dalam pengamanan, kepolisian wajib mengedepankan prinsip legalitas, kebutuhan, dan proporsionalitas, serta menempatkan tindakan represif sebagai upaya terakhir. Namun, tindakan represif yang dilaksanakan secara berlebihan dan tidak proporsional berpotensi melanggar HAM, sebagaimana dijamin dalam UU No. 39 Tahun 1999 mengenai Hak Asasi Manusia dan instrument hukum lainnya. Terdapat konflik norma antara jaminan kebebasan berpendapat dan kewenangan penggunaan kekuatan oleh aparat, yang menjadikan ketidakpastian hukum dan membuka peluang penyalahgunaan kewenangan. Oleh karena itu, diperlukan harmonisasi peraturan serta penerapan pendekatan yang lebih humanis dan berbasis hak asasi manusia dalam penanganan aksi demonstrasi.
