Abstract

This paper aims to examine the cause of public engagement ineffectiveness in the policy of arrangement and empowerment for street vendors in Garut Kota subdistrict. The research method used is descriptive qualitative. Based on the results of the study, it can be concluded that public engagement in this policy has not been effective, because it has not been related to: 1) Context and Settings; 2) Sponsors, Conveners, and Their Motivations for Direct Public Engagement; 3) Process Design; and 4) Outcomes. Regarding Context and Settings, there are no specific rules for public engagement. Public engagement has become a formality to fulfill the principles of democratic governance, but most of the local government decisions and actions that are considered crucial in this policy do not represent street vendors desire. Regarding Sponsors, Conveners, and Their Motivations for Direct Public Engagement, public engagement in the policy does not have sponsors yet in its sustainability, as for those who are organizers of public engagement in this policy based on the Regent’s Decree, especially in the fields that give positions to street vendors to be engaged as implementing elements. Some information, related to Process Design and Outcomes, is challenging to obtain. In substance, the author does not find information that is genuinely relevant to the aspects contained therein. The author recommends that a comprehensive review be carried out to formulate the Implementation Guidelines and Technical Guidelines based on the elements set out in the framework of direct public engagement as a guideline for conducting public engagement.

Abstract

Penelitian ini menyoroti masalah kebijakan penataan pasar modern dalam hal ini mini market yang belum berjalan sesuai harapan. Ditemukan banyak pelanggaran yang menyebabkan para pedagang tradisional tersudutkan bahkan tidak sedikit yang gulung tikar. Lokasi penelitian ini di kawasan pemukiman Kecamatan Antapani yang tediri dari empat kelurahan yaitu; Kelurahan Antapani Wetan, Kelurahan Antapani Kulon, Kelurahan Antapani Tengan dan Kelurahan Antapani Kidul. Pendekatan yang dilakukan dalam penelitian ini adalah kualitatif. Data diperoleh melalui indepth interview, observasi, studi literature dan pengumpulan data sekunder. Adapun informan pada penelitian ini adalah pejabat perijinan BPPT, Disperindag KUKM, Camat Antapani, Minimarket dan Ritel Tradisional di Kecamatan Antapani. Berdasarkan hasil penelitian, diketahui bahwa implementasi Kebijakan Penataan minimarket belum berjalan sesuai dengan harapan. Perkembangan usaha ritel modern masih mendominasi perekonomian masyarakat. Belum ada usaha yang berhasil secara signifikan memberdayakan para pedagang tradisional agar siap bersaing merebut pasar potensial yaitu konsumen yang bermukim di sekitar kawasan perumahan tersebut.Pelanggaran demi pelanggaran masih terjadi. Berdampak pada penurunan omzet yang sangat tajam melampaui angka 70% yang membuat pelaku ekonomi yang lemah ini tersudutkan dan tidak sedikit yang gulung tikar. Dari hasil penelitian di lapangan, penulis menemukan salah satu poin penting dalam mendukung pelaksanaan kebijakan ini melalui memperkuat pola kemitraan. Model kemitraan yang kuat akan menjadi penopang utama kelancaran implementasi kebijakan. Dalam penelitian ini, penulis mengajukan “Model Kemitraan MRT,” sebagai model alternatif dalam mengatasi hambatan dan masalah implementasi Kebijakan Penataan Pasar Tradisional, Pusat Perbelanjaan dan Toko Modern yang diamanatkan Perda Kota Bandung Nomor 2 Tahun 2009. Abstract

Terjadi fenomena yang menarik sekaligus memprihatinkan setelah hampir tiga tahun penerapan kebijakan otonomi daerah. Kondisi ini menggambarkan kelemahan yang ada dalam UU no. 22 tahun 1999 tentang Pemerintahan Daerah. Bermunculan perda-perda bermasalah yang kontra produktif karena terlalu berorientasi pada peningkatan PAD. Pemerintah Pusat tidak mampu mengendalikannya mengingat kewenangan yang diberikan sangat terbatas. Beberapa hal penyebabnya adalah : (1) Semangat reformasi yang tinggi mewarnai penyusunan UU no. 22 tahun 1999, sehingga memberikan kelonggaran yang berlebihan pada Pemda untuk membuat perda. (2) Kewenangan yang diberikan kepada Pemerintah Pusat melalui Tim Pengkaji Perda (TPPD) untuk melakukan verifikasi terhadap perda sangat terbatas hanya 45 (empat puluh lima) hari, padahal ribuan perda yang harus diverifikasi. (3) Belum ada petunjuk pelaksanaan bagi pemda dalam merumuskan sebuah perda. (4) Semangat yang tinggi Pemda memanfaatkan momentum reformasi. Kata Kunci : Otonomi Daerah, Perda
