Abstract

A Limited Liability Company is a form of legal entity in the economic field in Indonesia and is one of the pillars of national economic development. The capital structure in a company business entity consists of shares owned by people or parties with the same interests. As a business entity in the form of a legal entity, of course it has an interest as it exists in humans. The position of a limited liability company is a legal subject whose position, rights and obligations are the same as humans before the law, so that in carrying out its activities and activities, of course there are company organs that run it. the directors are one of the parties responsible for managing the company in accordance with the goals of the company. This is because the directors are trustees as well as agents for limited liability companies. It is said to be a trustee, because the directors manage the company's assets, and are said to be agents, because the directors act out for and on behalf of the company. Research conducted using normative research types and can also be called doctrinal legal research. Normative law research serves to provide juridical arguments when there is a vacuum, ambiguity, and conflict of norms. In general, the approach in normative legal research consists of: statutory approach, conceptual approach, legal history approach, comparative approach and case approach. In running the company, if the directors carry out their responsibilities in accordance with applicable regulations and also in good faith and the precautionary principle, then the losses suffered by the company are not the responsibility of the company's directors. However, if the company's losses arise from within the directors themselves, such as being negligent in carrying out their responsibilities, then the losses suffered by the company can ensnare the directors to their personal assets.

Abstract

The rapid development of information technology in recent decades has had a significant impact on various sectors, including the legal sector. One of the main impacts is the implementation of the e-Court system, which is a digitization of court procedures starting from case registration, fee payment, to trial that can be done online. This innovation is designed to overcome various challenges faced by the conventional justice system, such as convoluted bureaucracy, length of case resolution, and limited access for the general public. E-Court plays a role in improving the efficiency, transparency, and accessibility of legal processes. However, in addition to the various benefits it offers, the implementation of e-Court also brings new challenges, especially for advocates who need to adapt to the development of this technology. this study aims to analyze the impact of technology on legal practice, with a particular focus on the roles and challenges faced by advocates in the context of e-Court. Through a qualitative approach supported by literature studies and in-depth interviews with advocates, this article explores how technology is influencing the role of advocates in the modern legal process. The results show that although technology has accelerated case resolution, advocates are faced with a number of obstacles, such as limitations in digital literacy, difficulties in adopting new technologies, and concerns related to data security and client privacy. In addition, the limited infrastructure in some areas, especially in remote areas, is a challenge in the optimal implementation of e-Court. Furthermore, the study also revealed that e-Court can reduce direct interaction between advocates and courts, potentially affecting the quality of legal defense and representation. Therefore, strategic steps are needed so that advocates can quickly adapt to technological developments, including through training, skill improvement, and adequate infrastructure development. This article emphasizes the importance of clear and inclusive regulations in facing the challenges of digitalization in the legal sector, in order to create a more responsive, efficient, and fair judicial system in the digital era.

Abstract

This article aims to explain the causes of many laws and regulations regarding the establishment of houses of worship that cannot be implemented. Until now there are still people who reject the establishment of synagogues. Through research, we want to know the principles of the formation of laws and regulations and evaluation of the law on the establishment of houses of worship in Indonesia.  The results of the research can be used for the formation of laws on the establishment of better houses of worship. The sources of legal research used are primary and secondary legal materials. Primary legal materials include legislation and court decisions. Secondary legal materials include books, journals, legal dictionaries, as well as commentaries on court decisions. Research sources were collected in the city of Medan. From this research, it can be seen that the laws and regulations regarding the establishment of houses of worship have not paid attention to all the principles of the formation of laws and regulations. In the future, the formation of laws and regulations on the establishment of houses of worship must take into account all the principles of the formation of laws and regulations without exception

Abstract

The transition to digital approaches in church ministry has become imperative due to the swift advancement of information technology. This community engagement initiative was designed to strengthen the digital skills of HKBP ministry personnel in District XII Tanah Alas through structured training and intensive guidance. The program was executed through interactive presentations, focus group discussions (FGD), practical simulations involving digital tools, and evaluations conducted before and after the activities. Findings revealed that participants’ baseline digital capabilities were generally at a low to moderate level, yet experienced notable improvement following the intervention. Church staff began to exhibit proficiency in embedding digital technologies into everyday ministry, including using Zoom for virtual worship, leveraging social media for church-related communication, and employing applications for managing congregation data. The participants’ active involvement demonstrated their eagerness for a ministry model that is both adaptive and contextually grounded. This initiative further emphasized the long-term promise of digitalization in addressing geographical barriers and broadening the scope of church outreach. Sustained progress requires ongoing training and institutional backing to maintain relevance and coherence throughout the transformation journey. In conclusion, this initiative marks a foundational step for HKBP in cultivating a digitally-driven ministry ecosystem anchored in theological principles and cultural heritage.

Abstract

This study aims to see to what extent the application of the Picture and Picture cooperative learning model increasing students creativity at SMP Negeri 8 Pematang Siantar. The number of sempel as many as 40 people. This study used an experimental method, the data analysis technique used parametric statistics, namely the normality test used the chi square test, the homogeneity test used the F-test and the hypothesis test used the t-test. To find out to what extent the application of the Picture and Picture Cooperatif Learning Model in PAK Learning in Improving Student Creativity in Learning, the data analysis shows that the learning outcomes data are normally distributed and also homogeneous. Student creativity in the experimental class was higher than the control class, namely 142>125.8. The difference in student creativity between the experimental class and the control class is also significant because the results of the difference test (t test) obtained tcount greater than t table with a significant level of 5%, namely 2.779> 2.026. It can be conclude that the application of the Picture and Picture type of cooperative learning model has a significant effect on increasing the learning creativity of grade VII student at SMP Negeri 8 Pematang Siantar

Abstract

Anak sebagai saksi dalam perkara pidana merupakan pihak yang rentan menghadapi berbagai bentuk tekanan, baik psikologis maupun sosial, selama proses peradilan. Oleh karena itu, diperlukan perlindungan hukum yang komprehensif agar hak-hak anak tetap terjamin. Artikel ini bertujuan untuk mengkaji peran kejaksaan dalam memberikan perlindungan terhadap anak saksi, sekaligus menganalisis bentuk-bentuk perlindungan yang diterapkan dalam praktik peradilan pidana di Indonesia. Hasil kajian menunjukkan bahwa kejaksaan memiliki tanggung jawab strategis dalam memastikan anak saksi mendapat perlakuan khusus yang ramah anak, termasuk penggunaan bahasa sederhana saat pemeriksaan, penyediaan ruang khusus yang kondusif, pendampingan psikolog maupun penasihat hukum, serta pembatasan frekuensi pemeriksaan agar tidak menimbulkan beban berlebih. Selain itu, kejaksaan berupaya menghindarkan anak dari kontak langsung dengan tersangka guna mencegah intimidasi. Keseluruhan upaya tersebut sejalan dengan prinsip perlindungan anak dan asas kepentingan terbaik bagi anak. Dengan demikian, perlindungan hukum yang dijalankan oleh kejaksaan berperan penting dalam mewujudkan sistem peradilan pidana yang humanis, adil, dan ramah anak.

Abstract

This Study Carefully Examines the legal validity  of the protections and guarantees provided by the laws of employees who may lose their jobs without receiving formal written notice. There is a notable disparity: despite the regulatory framework (Law 13/2003,Law 6/2023 on job creation,and PP 35/2021) expressly requiring written procedures, unilateral verbal dismissal remains common. These acts essentially constitute the legal principle,the protective principle (in favorem laboris),and the procedural justice doctrine. Using statutes,conceptual, comparative,and case approaches, this study employs a normative legal methodology. This study focuses on the particular factual case of Novita Sari Naibaho. This analysis is further supported by a review of pertinent jurisprudence to analyze the legal implications,particularly the Serang Industrial Relations Court decision(No.21/Pdt. Sus-PHI/PHI/2025/PN.SRG). The discussion shows that the absence of a formal written notification renders the entire termination process invalid. This study concludes that any dismissal that does not comply with this crucial formal requirement is illegal. In the absence of a final,legally binding court decision,it is implied that the employment relationship is continuous, and the employee retains their full entitlement to all normative rights.

Abstract

Kasus ini menganalisis pertanggungjawaban pidana pengemudi yang menyebabkan kecelakaan lalu lintas fatal akibat kelalaian. Terdakwa FA mengemudikan kendaraan dalam kondisi mengantuk dengan kecepatan 70 km/jam dan menabrak sepeda motor yang dikendarai dua orang korban, mengakibatkan keduanya meninggal dunia. Setelah kejadian, terdakwa meninggalkan lokasi tanpa memberikan pertolongan dan baru tertangkap setelah dikejar warga. Terdakwa dikenakan dua dakwaan: pertama, kelalaian yang mengakibatkan kematian berdasarkan Pasal 310 Ayat (4) UU No. 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan; kedua, pelanggaran kewajiban pasca kecelakaan karena meninggalkan korban tanpa pertolongan. Visum menunjukkan kedua korban mengalami luka parah dan meninggal di lokasi atau dalam perjalanan ke rumah sakit. Kasus ini menyoroti pentingnya kesadaran pengemudi akan kondisi fisiknya dan tanggung jawab hukum setelah terjadi kecelakaan, dengan ancaman pidana maksimal enam tahun penjara dan denda dua belas juta rupiah.

Abstract

The fulfillment of a suspect’s right to effective legal assistance is a crucial element in ensuring a fair criminal justice system grounded in human rights protection. In practice, suspects often face an unequal position when dealing with law enforcement authorities, which highlights the importance of professional and continuous legal representation. This article aims to examine the role of law firms in guaranteeing suspects’ rights to effective legal assistance in criminal cases and to identify the obstacles encountered in its implementation. This study employs normative legal research using statutory and conceptual approaches. Legal materials consist of primary, secondary, and tertiary sources collected through library research and analyzed qualitatively through legal reasoning. The discussion reveals that law firms play a strategic role as institutions, media, and service providers that perform legal protection, legal education, defense planning, psychological assistance, supervision of judicial processes, and the pursuit of legal remedies. Nevertheless, the effectiveness of these roles is constrained by structural, institutional, and cultural challenges, including limited access, insufficient resources, external pressures, and a legal culture that does not fully support the role of defense counsel. Therefore, strengthening the institutional capacity of law firms and reforming the criminal justice system are essential steps toward ensuring effective legal assistance and achieving substantive justice for suspects.

Abstract

This paper uses a case study of Mataram District Court Decision Number 26/Pid.Sus.Anak/2022/PN.Mtr. to examine the legal factors judges take into account when imposing correctional sentences on juvenile offenders of drug offenses. The research focuses on how the integrated assessment results serve as a foundation for the judge's deliberations, how the restorative justice principle is applied, and how well correctional sentences support child rehabilitation and deter recidivism levels. This study employs a case study methodology in conjunction with a normative juridical legal research method. Primary legal materials, such as court rulings, as well as secondary legal materials, such as laws and regulations, scholarly publications, and pertinent legal literature, were examined in order to gather data for a literature review.The results show that the integrated assessment has a strategic role in helping judges understand the child's condition comprehensively, encompassing legal, medical, psychological, and social aspects. The judge's considerations in the decision are not only based on legal aspects such as evidence and positive legal provisions, but also consider non-legal factors such as the child's psychological condition, family background, and potential for rehabilitation and social reintegration. The application of correctional punishment in this decision reflects the implementation of the principles of the best interests of the child and restorative justice, which prioritize recovery over repressive punishment. Corrective punishment is considered more effective than imprisonment in preventing recidivism and supporting the rehabilitation of child drug abusers, as long as it is supported by optimal rehabilitation and ongoing supervision.
