Abstract

The main issue of this research is how the implementation of the tradition of "fokompa kampana’a" in the engagement process in the Siompu District community of South Buton Regency from the perspective of Islamic law. This research is qualitative field research using Sharia and sociological approaches. The research results indicate that before the implementation of "fokompa kampana’a," two preliminary steps are taken, namely "posoloi" and "fotibua." The implementation of the tradition of "fokompa kampana’a" is conducted three times. First, "kafe’awutino lambu" as a proposal presentation. Second, "kafendua" is the formal engagement as a marker that both parties are engaged. Third, "woa’ano wua" or the engagement ceremony accompanied by the partial delivery of the dowry according to tradition. In general, the implementation of the tradition of "fokompa kampana’a" does not contradict Islamic law because many aspects align with Islamic teachings. Preserving the tradition of "fokompa kampana’a" as cultural wealth needs to be done while considering Islamic values and simplifying some processes and materials deemed burdensome according to the community's capabilities.

Abstract

This study discusses the adoption of children abandoned by their husbands from the perspective of Islamic law at the Sungguminasa Religious Court. The discussion in this study is (1) what are the legal considerations by the judge in determining the adoption of a child whose husband has died? (2) What is the review of Islamic law regarding the adoption of children by parents who have been left behind by their husbands? This research includes field research, namely qualitative field research with a research approach used is a normative-juridical approach, namely a research based on a legal provision and phenomena or events that occur in the field. Furthermore, to obtain data on this issue, the data collection methods used were interviews, documentation, library research and field research. Then, the data obtained was then analyzed and concluded. The results of this study indicate that legal considerations by judges in determining the adoption of children whose husbands have died (a case study at the Sungguminasa Religious Court), granting custody of their own children to applicants is a matter of the jurisdiction of the district court and religious court, which have been decided by the judge of the religious court based on evidence who had been asked to then be used as a basis and saw from both parties the applicant and the respondent whose child was later adopted by his own brother. The judge of the religious court refers to the rules and KHI of Islamic law to give a decision to the applicant so that the request is granted on the basis of the factor that the applicant has never been blessed with children until then her husband dies and a child is married as the heir of the family.

Abstract

The rise of child marriage often occurs in Indonesia especially in the watansoppeng religius court, increasing every year. Child marriage is a carried out by a couple whose age is less than the minimum age for marriage as determined. A child marriage as determined. A child marriage usually occurs dute to various factors including promiscuity, lack of parental guidance, so that their children will find a way so they can be happy, namely associating with people whose behavior is not seen (free). Outher factors are due to economic factors are due to economic factors, self-will factors, customs factors. This type of research includes field research located at the watansopppeng religious court using a syar’i approach. The findings of this study show that the exsistence of law No, 16 of 2019 is carried out and confirmed in accordance with the provisions of the law and is also guided by supreme court regulation No. 5 of 2019, in addition to age issues, judges must also consider child protection and the best interests of children. In 2021 where covid-19 still hit the demand for child marriage in soppeng, there was a drastic increase of 466 requests compared to 2022 of 330 requests.

Abstract

This research aims to explain Ibn Taymiyah's political thought in the history of Islamic politics and its implications for current Islamic political thought. especially the social setting that forms the basis of Ibn Taymiyah's thoughts about the political system and state offered by Ibn Taimiyah, and whether his theory is still relevant to current socio-political conditions. The method used in this research is a qualitative method with a type of library research, the approach used is historical-critical-philosophical, then the data sources in the research are primary and secondary data. Based on the data that has been collected and analyzed, the conclusions of this research show that Ibn Taymiyah with his courage abolished/rejected the leadership system of the caliphate and imamate, with his thesis that the regime upheld by the prophet was the nubuwwah regime and not the imamate, while the new imamate existed after the prophet died. shows that he has revolutionary and reformist ideas. He didn't want people to just be objects in a state, but he wanted people to be subjects of a state. For Ibnu Taymiyah, the mechanism/system for appointing the head of state is not very important, what is important is that the person occupying the position must be truly trustworthy and fair. Ibn Taimiyah required two things for a head of state, namely having the qualifications of strength (al-quwwah) and integrity (al-amanat). Strength and integrity are obtained through the mubaya'ah (oath of allegiance) given by the ahl al-Syawkah.

Abstract

The objective of this research was to examine the oversight conducted by the Government's Internal Control Apparatus (APIP) regarding the misuse of official authority within the Jeneponto District Government. This research employs a qualitative methodology with a sociological research approach. The informants include the Auditor of the Jeneponto Regency Government Internal Supervisory Apparatus, the Head of the Sub-Division of Discipline Development, Welfare, and Facilitation of the ASN Profession at the Jeneponto Regency Personnel and Human Resources Development Agency (BKPSDM), the Secretary and Acting Head of Treasury at the Jeneponto Regency Financial and Asset Management Agency, the Head of Budget at the Jeneponto Regency Financial and Asset Management Agency, and the Regent of Jeneponto. Data collection methods encompass observation, interviews, and documentation. Subsequently, the techniques for processing and analyzing data are executed through three distinct phases: data collection, data reduction, data presentation, and conclusion drawing. The outcomes indicate that: 1) The supervision by the Government Internal Supervisory Apparatus (APIP) over the abuse of authority in the Jeneponto Regency Government is not fully optimizing APIP's role in supervising, guiding, evaluating, and monitoring the duties and functions of regional apparatuses in the execution of bureaucratic activities. This is evidenced by the presence of several civil servants who have been implicated and directly involved in legal proceedings due to exceeding their official authority. 2) There is a shortage of qualified auditors, with the current number of personnel being insufficient relative to the number of civil servants requiring oversight across 11 sub-districts and 113 villages.

Abstract

Perkembangan zaman dan kemajuan teknologi telah melahirkan berbagai persoalan hukum baru yang belum ditemui pada masa lampau. Dalam menjawab tantangan ini, para ulama Muslim dituntut untuk menerapkan pendekatan yang dinamis dan kontekstual dalam istinbāṭ (penggalian) hukum Islam. Dimana kehidupan manusia bersifat dinamis bergerak maju menuju perubahan dalam berbagai aspek, disisi lain al-Qur’an dan hadis secara  kuantitatif terbatas jumlahnya untuk menjawab persoalan baru maka diperlukan teori penemuan hukum yang sesuai tuntutan dinamika sosial Salah satu pendekatan yang relevan adalah logika istiṣlāḥi (pertimbangan kemaslahatan). Logika istiṣlāḥi merupakan metodologi pengambilan keputusan hukum yang berlandaskan pada pencapaian kemaslahatan (maṣlaḥah) dan pencegahan kerusakan (sadd al-dzarā'i'). Pendekatan ini mengintegrasikan tujuan-tujuan syariat (maqāṣid al-syarī'ah) dengan realitas kontemporer untuk menghasilkan hukum yang sesuai dengan kebutuhan zaman. Dalam menyelesaikan persoalan hukum kontemporer, logika istiṣlāḥi menempuh beberapa langkah, antara lain: (1) mengidentifikasi persoalan hukum baru dan memahami konteksnya; (2) menganalisis dampak positif dan negatif dari berbagai alternatif solusi; (3) menimbang antara manfaat dan mudharat yang akan timbul; dan (4) memutuskan hukum yang paling sesuai untuk mewujudkan kemaslahatan umum. mempertimbangkan kondisi dan situasi, hingga mencermati alasan (‘illah ḥukum) tersebut

Abstract

This research aims to reveal and analyze the existence of Religious Courts as a robust and equal branch of judicial power alongside other courts, as regulated by the Judicial Power Law. Religious courts are one of the judicial bodies exercising judicial power to enforce law and justice for people seeking justice in specific cases involving Muslims, particularly in matters of marriage, inheritance, wills, gifts, endowments, zakat, infak, alms, and sharia economy. The factors supporting the existence of religious courts are based on changes in Law Number 7 of 1989 to Law Number 3 of 2006 and Law Number 50 of 2009 concerning Religious Courts. With these changes, the institutional existence of Religious Courts has been strengthened as their adjudicative authority has been expanded, making their institutional presence as solid as other courts. This expanded authority elevates the status of Religious Courts as a medium for maintaining their institutional existence. The hindering factors include the limited physical and non-physical facilities, such as human resources (HR) that are not evenly distributed in quality and quantity within the Religious Courts, and the fact that many judges in the Religious Courts do not yet fully master civil law and civil procedural law. The amendment of Law Number 50 of 2009 brought significant changes to the judiciary in Indonesia, including changes in the position and authority of religious judges. The position of judges post-amendment of Law Number 50 of 2009 is regulated by the Supreme Court, in accordance with Law Number 48 of 2009 concerning Judicial Power, which places Religious Courts alongside other courts under the Supreme Court. Additionally, the Judicial Commission exists to uphold the honor, dignity, and conduct of judges, providing external oversight of judges.

Abstract

It is also a foundation in a person's life, which should not be underestimated. So it needs caution and accuracy in it, so that it is in line with the sincere intentions and sense of responsibility of the person who runs it. Islam has set all the foundations and values that must be contained in this marriage, which aims to maintain its position and influence in human life. This study aims to explain the definition and pillars of marriage, especially lafaz ijab kabul, as well as Ibn Taymiyah's views on the marriage contract without lafaz ijab kabul.

Abstract

In the period before the arrival of Islam, it was known that women suffered greatly and lived in poverty, but after the introduction of Islam, it was able to change the discriminatory situation that occurred before and enable women to have a decent life equivalent to prosperity. male position. In this article we present an example of female leadership in Islamic law. This article aims to provide an understanding of the views that allow women to become leaders in a country with the same position as men. Using normative research methods or bibliographic legal research is used as a research method. The normative approach is used to study and analyze library materials or search for information identified with research materials as legally required materials related to the research materials being conducted.

Abstract
