Abstract

Penelitian ini mengkaji tentang mengupayakan adanya perlindungan hukum dilakukan bank terhadap rahasia nasabah dengan ketentuan-ketentuan hukum berdasarkan Undang-Undang Nomor 10 Tahun 1998 tentang rahasia bank dan mengkaji cara mudah mencegah kebocoran data dari nasabah bank. penelitian ini menggunakan data hukum yaitu evidensi hukum primer dan evidensi hukum sekunder. Penelitian ini fokus pada penelitian kepustakaan yang artinya menyelami lebih dalam peraturan perundang-undangan yang berlaku. Perlindungan hukum terhadap nasabah sebagai konsumen perbankan sangatlah penting, mengingat kedudukan pengusaha dan konsumen dalam hal ini bank dan nasabah seringkali timpang. Maka diaturnya peraturan tentang upaya perlindungan terhadap rahasia bank ini dapat dimanfaatkan sebaik-baiknya untuk terus mencegah adanya kebocoran data dari nasabah bank.

Abstract

A Technological advances have a broad impact on every aspect of people's lives, including the legal system, especially the e-court system which is a form of the government service system. The aim of the electronic justice system is to simplify the justice system by enabling online registration of cases, payments, summons and hearings. People had to waste time and energy traveling to and from court buildings before e-courts were available, making this service inefficient and ineffective. However, there are a number of obstacles to the use of E-Court, including lack of public outreach and education, limited human resources, and gaps in access to information and communication technology. Normative juridical research is the backbone of this research while also relying on secondary data. For this research, we also consulted secondary sources, such as government records and scientific publications, to gather information. The results found that the use of E-Court as a court service in Indonesia provides benefits including increased efficiency and effectiveness of justice, greater public trust in the justice system.

Abstract

Online transactions are a form of information technology development that provides convenience and benefits for businesses and consumers. However, online transactions also raise various legal issues, especially related to consumer protection. This research aims to examine the economic law review of consumer protection in online transactions in Indonesia. The research method used is descriptive analytical method with normative juridical approach. The data used is secondary data obtained from various sources of information on the internet, such as laws, regulations, journals, articles, and reports. The results show that consumer protection in online transactions in Indonesia is still not optimal, because there are still legal gaps, discrepancies between law and reality, and low legal awareness and responsibility of business actors and consumers. This research recommends the need to improve the quality and quantity of regulations, effective law enforcement, as well as education and advocacy for businesses and consumers in online transactions.

Abstract

Economic law and sustainable development are two interrelated concepts that influence public policies in ASEAN countries. This research aims to analyze the relationship between economic law and sustainable development in ASEAN countries, as well as the challenges and opportunities faced by these countries in implementing the principles of sustainable economic law. The research method used is a normative juridical approach, namely by examining laws and regulations, official documents, and related literature relating to economic law and sustainable development in ASEAN countries. The results show that there are variations in the level of engagement and commitment of ASEAN countries in realizing economic law and sustainable development, depending on factors such as social, political, economic, and environmental conditions in each country. The research also identifies several important issues that need to be addressed by ASEAN countries, such as the need for legal harmonization, enhanced regional cooperation, protection of human rights, community empowerment, and effective law enforcement. This research provides recommendations to improve the quality and effectiveness of economic law and sustainable development in ASEAN countries, and its implications for social welfare and justice in the region.

Abstract

International cooperation plays a vital role in fostering economic growth, technological advancement, and industrial integration. This study aims to analyze the potential of bilateral cooperation between Indonesia and Germany in the aviation industry, focusing on the N219 aircraft project. The research employs a qualitative approach through a review of data from theses, journals, and online sources, supporting an in-depth exploration of cooperation mechanisms, challenges, and opportunities. The findings indicate that this collaboration strengthens Indonesia's position in the international supply chain by advancing technological capabilities and enhancing the aviation industry. Furthermore, Germany's support in technology and supply chain integration boosts the global competitiveness of the N219 project. Key challenges include regulatory harmonization and workforce development. However, the opportunities for sustainable innovation and economic growth are highly promising, positioning this partnership as a strategic model in high-tech sectors.

Abstract

This research analyses the contribution of judicial decisions as a legal protection tool in the civil dispute resolution process in Indonesia. The focus of this research is to examine the manner in which judicial decisions provide legal clarity, fairness, and benefit to disputants. Using a normative juridical approach, the research explores relevant laws, legal precedents, and legal theories. The findings of the research show that judicial decisions play an important role in providing legal protection through three dimensions: first, as a source of legal certainty that binds all parties; second, as a representation of substantial justice to address the imbalance between parties; and third, as a dispute resolution tool that provides social benefits. The research also shows that the success of judges' decisions as a means of legal protection still faces various challenges, namely: inconsistencies in the application of precedents, variations in legal considerations, and problems in implementing decisions. The research recommends that there should be increased independence of the courts, standardisation in legal reasoning, and changes in the enforcement system to strengthen the role of judgments as a legal protection tool in civil disputes.

Abstract

Divorce is a legal event with far-reaching effects, not only on the couple, but also on the children who are part of the family. One of the most intricate impacts is the emergence of child custody disputes (hadhanah), which frequently become the primary focus in the judicial process. The objective of this article is to undertake a juridical analysis of the settlement of child custody disputes in divorce cases based on Indonesian civil procedural law. The present research employs a normative juridical method, characterized by a statutory approach and an examination of pertinent literature. The results indicate that, despite the existence of positive legal regulations in Indonesia, specifically Law No. 1/1974 on Marriage, the Compilation of Islamic Law (KHI), and Law No. 35/2014 on Child Protection, the implementation of these laws in practice continues to encounter significant challenges. These findings indicate a necessity for an adaptive approach to civil procedural law and the synchronization of legal regulations to ensure the protection of children's interests in the divorce legal process.

Abstract

Penelitian ini menganalisis peran E-Court dalam penyelesaian perkara perceraian di Pengadilan Agama Bogor. Pemanfaatan informasi teknologi dalam sistem peradilan, khususnya melalui E-Court, diharapkan dapat meningkatkan efisiensi, transparansi, dan aksesibilitas bagi pihak yang berperkara. Namun penerapannya dalam perkara perceraian memerlukan kajian yang mendalam mengingat sensitifitas dan kompleksitas hukum acaranya. Penelitian ini menggunakan metode penelitian hukum empiris-normatif dengan pendekatan kualitatif (studi pustaka atau telaah pustaka). Pengumpulan data dilakukan melalui studi pengumpulan data dari berbagai sumber tertulis seperti buku, jurnal, dan terbitan lain untuk memahami suatu topik atau permasalahan tertentu. Hasil penelitian menunjukkan bahwa E-Court telah berperan signifikan dalam mempercepat proses pendaftaran, pembayaran, pemanggilan, dan konferensi perkara perceraian. Hal ini memberikan kontribusi terhadap efisiensi waktu dan biaya bagi para pihak. Meskipun demikian, terdapat beberapa tantangan yang menghadang, antara lain kesiapan infrastruktur teknologi, tingkat literasi digital para pihak, dan regulasi terhadap praktik konferensi secara elektronik, khususnya dalam hal mediasi dan pembuktian.

Abstract

International economic law is a branch of international law that regulates economic relations between countries. In the era of globalization, international economic law faces various challenges and opportunities that affect Indonesia as a developing country. The purpose of this article is to analyze the challenges and opportunities of international economic law for Indonesia, as well as to provide suggestions for developing a fairer and more inclusive international economic law. The method used is a literature study by reviewing various sources of information, such as journals, books, and reports. The results show that the challenges of international economic law for Indonesia include increased economic competition, the emergence of new trends in the global economy, and the existence of power imbalances between countries. The opportunities of international economic law for Indonesia include the great potential in the tourism sector, increased international cooperation, and the utilization of digital technology. The conclusion that can be drawn is that Indonesia needs to continue to adapt to the development of international economic law, as well as play an active role in contributing ideas and solutions to create a fairer and more inclusive international economic law.

Abstract

Micro, Small and Medium Enterprises (MSMEs) is an economic sector that plays an important role in improving the welfare of the people in Indonesia. However, MSMEs still face various obstacles, one of which is the legal aspect. This research aims to examine the role of Islamic economic law in improving the welfare of MSMEs in Indonesia. The research method used is qualitative, using literature studies and interviews with several Islamic MSME actors. The results show that Islamic economic law has a positive role in improving the welfare of MSMEs, both in terms of economic, social, and spiritual aspects. Islamic economic law provides principles that are in accordance with Islamic values, such as justice, balance, transparency, accountability, and social responsibility. Islamic economic law also provides legal protection for MSMEs, both in terms of licensing, agreements, and dispute resolution. Thus, Islamic economic law can be one of the solutions to overcome the problems of MSMEs and improve the welfare of the people in Indonesia.
