Abstract

Hukum pengungsi internasional merupakan sebuah kajian yang terbilang baru dalam ranah hukum internassional. Dalam hukum pengungsi internasional terdapat Konvensi Pengungsi 1951 yang memuat terkait definisi, batasan, dan ruang lingkup dari pengungsi itu sendiri (Sakharina dkk., 2016). Prinsip non-refoulment merupakan landasan hukum utama dalam hukum pengungsi internasional. Namun terdapat juga klausul pengecualian dalam hukum pengungsi internasional yaitu Pasal 1F dalam membatasi penerapan asas non-refoulment. Tegasnya keberadaan klausul pengecualian ini menimbulkan dilema antara kewajiban proteksi dan kepentingan keamanan nasional. Penelitian ini bertujuan untuk menganalisis secara normatif bagaimana klausul pengecualian dapat membatasi prinsip non-refoulment dalam hukum pengungsi internasional

Abstract

Perkembangan teknologi informasi dan penggunaan media sosial yang semakin luas telah melahirkan berbagai bentuk kejahatan baru di ruang digital, termasuk tindak pidana pengancaman yang berkaitan dengan pembayaran utang. Fenomena ini menunjukkan bahwa praktik penagihan utang tidak jarang dilakukan melalui cara-cara yang melanggar hukum dan menimbulkan tekanan psikologis bagi korban. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap korban tindak pidana pengancaman melalui media sosial yang berkaitan dengan pembayaran utang serta untuk mengetahui akibat hukum terhadap pelaku dalam perspektif cybercrime. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual melalui studi kepustakaan terhadap berbagai sumber hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa perlindungan terhadap korban pengancaman melalui media sosial dapat diberikan melalui ketentuan dalam Kitab Undang-Undang Hukum Pidana dan Undang-Undang Informasi dan Transaksi Elektronik yang mengatur mengenai ancaman, intimidasi, dan penyalahgunaan teknologi informasi. Selain itu, tindakan pengancaman dalam penagihan utang melalui media sosial dapat dikualifikasikan sebagai tindak pidana cybercrime apabila memenuhi unsur-unsur pidana yang menimbulkan rasa takut atau kerugian bagi korban. Kesimpulan penelitian ini menegaskan bahwa penegakan hukum yang tegas serta peningkatan kesadaran hukum masyarakat menjadi faktor penting dalam memberikan perlindungan hukum yang efektif terhadap korban kejahatan di ruang digital.

Abstract

The development of modern armed conflicts shows the increasing involvement of civilians in hostilities, which has given rise to the phenomenon of civilian combatants and created ambiguity in the classification of subjects in International Humanitarian Law. This study aims to analyze the legal status of civilians involved in armed conflicts and the limits of legal protection inherent to them. The research method used is normative juridical with a legislative and conceptual approach, through an analysis of international legal instruments and relevant doctrines. The results show that civilian combatants are not explicitly recognized in international humanitarian law, thus creating uncertainty in determining their legal status. Furthermore, protection for civilians is conditional and can be temporarily lost when individuals engage in direct participation in hostilities, with limits determined by the principles of distinction and proportionality. These findings confirm that the limits of legal protection are dynamic and depend on individual actions in conflict. The implications of this study indicate the need for strengthened legal interpretation and more consistent implementation to ensure legal certainty and protection for civilians in modern armed conflicts.

Abstract

The rapid development of smart cities, integrating technologies like artificial intelligence (AI), the Internet of Things (IoT), and big data analytics, has transformed urban environments, improving public services and governance. However, this progress presents challenges in inclusivity, accountability, and equity, requiring updates to public service law to address emerging concerns. As digital technologies reshape governance, legal frameworks must balance innovation with citizens' rights protection. This study explores the intersection of law, technology, and society in smart cities, focusing on the implications of digital transformation on public service law. It identifies challenges in governance, including the digital divide, privacy protection, and data security. The research aims to propose an inclusive legal framework that supports technological innovation while promoting accountability and social equity in smart cities. A socio-legal approach is used, combining case studies, policy analysis, and stakeholder interviews. The findings reveal that while digital transformation improves efficiency, challenges remain in citizen participation and reducing inequalities. Successful smart city models, such as those in Barcelona and Tallinn, prioritize inclusivity, accountability, and participation. The study highlights the need for flexible, adaptive legal frameworks to ensure that smart cities are governed inclusively, transparently, and equitably.

Abstract

This article explores the concept and implementation of restorative justice in Indonesia, an approach currently at a crucial crossroads within the criminal justice system. Rather than solely focusing on punishment, restorative justice offers a path towards repairing relationships between victims, offenders, and the community, seeking solutions oriented around conflict resolution. Through comprehensive analysis, this paper identifies the philosophical foundations and regulations supporting the adoption of restorative justice, while dissecting the dynamics of its application across various levels of legal processes in Indonesia. However, this noble endeavor is not without its challenges, ranging from institutional resistance and uneven understanding to harmonization with the conventional criminal law framework. Behind every case lies a human story yearning for more substantive justice. Therefore, this article argues that the success of restorative justice does not merely lie in its legal umbrella, but in our ability to understand and embrace the human dimension in every dispute resolution process. Consequently, this paper recommends adaptive and collaborative strategies to strengthen the role of restorative justice, ensuring it can guide our criminal justice system towards a more just and dignified future for all parties.

Abstract

 The President’s use of personal funds to finance official state trips has sparked debate from the perspective of public finance law because it is carried out outside the mechanisms of the State Revenue and Expenditure Budget (APBN), which serves as the basis for the management of state finances. This study aims to analyze the legal implications of the President’s use of personal funds on the fulfillment of the principle of state finansial accountability and to provide an ideal solution in accordance with the provisions of applicable laws and regulations. This study is a normative legal study employing a statutory approach and a conceptual approach. Legal materials were obtained through a literature review and analyzed using a descriptive-qualitative methodology based on deductive reasoning. The results of the study indicate that the President’s use of personal funds to finance official travel has the potential to be inconsistent with the principle of accountability and the oversight and audit mechanisms of the State Audit Agency. This practice also has the potential to create legal uncertainty regarding the recording and accountability of state finances. Therefore, the financing of the President’s official travel should continue to be carried out through mechanisms available within the state financial system or by revising the Budget Implementation Form (DIPA), the Revised State Budget (APBN Perubahan), or through legitimate grant mechanisms, so that the principle of accountability in the management of state finances is upheld.

Abstract

This research aims to examine the provisions and status of probation as a principal punishment in the National Criminal Code, as well as its relevance to achieving the objectives of reforming the penal system in Indonesia. The research design employed is normative legal research using a legislative and conceptual approach. The data utilized consists of secondary data obtained through a literature review, analyzed using qualitative descriptive techniques. The results of the research show that probation under Law No. 1 of 2023 on the Criminal Code has been established as one of the principal penalties that can be directly imposed by a judge, thus no longer merely a component of conditional sentences as in the old Criminal Code. This regulation reflects a paradigm shift in sentencing from a retributive approach toward a rehabilitative and restorative approach by providing offenders with the opportunity to remain within the community under supervision. However, its implementation still faces challenges, including the absence of comprehensive technical regulations, potential conflicts of norms, and institutional limitations in carrying out supervision. Therefore, supervised probation holds significant relevance as a more humane sentencing alternative, although it requires strengthened regulations and a supervision system to ensure its effective and consistent application.
