Abstract

Partisipasi diartikan sebagai mengambil peranan dalam dunia politik (Efriza, 2012). Partisipasi perempuan dalam dunia politik masih rendah, hal ini dikarenakan oleh beberapa hal diantaranya adalah budaya patriarki dan jargon politik yang tidak memihak pada perempuan. Pemilu merupakan kesempatan bagi rakyat untuk ikut berpartisipasi dalam dunia politik. Hal ini juga berlaku bagi kaum perempuan yang tidak hanya bisa berpartisipasi sebagai pemilih, tapi juga dalam bentuk lainnya. Penelitian ini bertujuan untuk mengetahui bentuk-bentuk partisipasi politik perempuan dalam menyukseskan pemilu legislatif tahun 2014. Kelurahan Sungai Lekop adalah lokasi yang dipilih dalam penelitian ini. Penelitian ini menggunakan metode kualitatif, dengan teknik pengumpulan data berupa wawancara mendalam terhadap informan, observasi, dan studi pustaka terhadap data primer maupun sekunder. Dari hasil penelitian diketahui bahwa bentuk-bentuk partisipasi politik perempuan dalam menyukseskan pemilu legislatif tahun 2014 di Kelurahan Sungai Lekop adalah sebagai pemilih, tim sukses, saksi, mengikuti kegiatan sosialisasi caleg dan PPS, menjadi anggota PPDP dan anggota KPPS. Adapun faktor-faktor yang mempengaruhi partisipasi politik perempuan adalah kesadaran akan hak dan kewajiban dalam pemilu, manfaat adanya pemilu, kepercayaan terhadap sistem pemilu, kepercayaan terhadap caleg, tingkat pendidikan, tingkat pekerjaan, pengaruh keluarga dan lingkungan dan pengalaman berorganisasi.

Abstract

Sebagai dasar Negara (ground norm)-nya bangsa Indonesia, Pancasila telah terbukti sebagai salah satu media pemersatu dalam kehidupan bermasyarakat, berbangsa dan bernegara di Indonesia. Melalui kelima sila yang terkandung didalam Pancasila, menjadikan pondasi kehidupan bernegara di Indonesia menjadi kokoh terhadap ancaman yang datang baik dari luar maupun dari dalam. Dalam konteks hukum, khususnya dalam pembentukkan peraturan perundang-undangan, Pancasila semestinya diletakkan dalam wilayah sumber hukum materiil dari pembentukkan peraturan perundang-undangan. Semestinya, nilai-nilai yang terkandung di dalam Pancasila harus digali secara lebih rinci dalam pembahasan terhadap landasan filosofis maupun sosiologis dari proses pembentukkan peraturan perundang-undangan.

Abstract

Salah satu upaya yang dilakukan oleh Kementrian Hukum dan HAM Republik Indonesia pada program asimilasi dimasa Covid 19 dengan mengeluarkan Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 32 Tahun 2020 tentang Syarat dan Tata Cara Pemberian Asimilasi, Pembebasan Bersyarat, Cuti Menjelang Bebas, dan Cuti Bersyarat Bagi Narapidana dan Anak Dalam Rangka Pencegahan dan Penanggulangan Penyebaran Covid-19. Pembebasan terhadap narapidana dilakukan dengan pertimbangan rawannya penyebaran Covid-19. Melalui penelitian ini melihat apakah implementasi peraturan tersebut pada Rumah Tahanan Tanjungbalai Karimun telah sesuai atau ditemukan permasalahan baru. Penelitian ini menggunakan metode deskriptif analitis dan pendekatan perundang-undangan. Hasil penelitian ini menunjukan bahwa implementasi asimilasi pada Rumah Tahanan Tanjungbalai Karimun di masa pandemi Covid-19 telah sesuai dengan Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 32 Tahun 2020 tentang Syarat dan Tata Cara Pemberian Asimilasi, Pembebasan Bersyarat, Cuti Menjelang Bebas, dan Cuti Bersyarat Bagi Narapidana dan Anak Dalam Rangka Pencegahan dan Penanggulangan Penyebaran Covid-19.

Abstract

The complex policy on authority management between central and local government has appeared to be hot issue from each periods of the constitution implementation on the local governance. With the enactment of the newly issued Local Governance Law Number 23 Year 2014, has indirectly influenced legal products on which previously effective whether to district or head district law. Problem of this research is how authority management between central, provincial and district/municipal government is answered based on the Law Number 23 Year 2014 and the impacts on authority transformation in terms of ocean and mining affair. Basically, this research theoritically attempts to apply several approaches by integrating between more macro and micro systemic study, although not entirely practised. Law Number 23 Year 2014 implies a more de-constructing rather than reconstructing relationship between central and local government, by reducing authority of head district/city mayor in the development. Decentralization intrument has turned resources management of which previously held on the hand of district/city authority presently taken over by the provincial level of government, for instance : mining license shift for class C mined products and the sea territorial limit. Thus, the 2014 Local Governance Law makes necessary to cause juridical adjustment for the local legal products mainly related to certain authorities which are transferred from the provincial to district or regency level. Abstract

Since 1999 until 2015, Riau Archipelago Province was a regency. Riau Archipelago had passed development process for six times. In 1999, Karimun Regency, Natuna Regency and Batam City were formed. In 2001, the administrative city of Tanjung Pinang was formed. In 2003, Lingga Regency was formed, and In 2008 Anambas Archipelago Regency was legalized. Until this time, the dynamic of development in Riau Archipelago Province is still powerful. The fact there are five of seven Regencies / cities are in effort to be developed. This dynamic of development also happened in Lingga Regency, eventhought with the smallest Regional Fund Budget in Riau Archipelago Province. the purpose of this study is to explain the efficient estimation and time for new autonomy region increament in Lingga Regency. The parameter of region systemation which is used in this study is based on outonomy region systemation in big design of region systemation in indonesia of 2010-2025 which considered the geography dimension, demography dimension and system dimension. this study concludes based on the dimension of geography, economy, financial system, public administration system, and regional government management system, Natuna Regency is able for one new autonomy region increment. however, based on dimension of demography, security and defence system, and politic and culture social system, Lingga Regency is not recommended for new autonomy Region increment. totally, maximum amount estimation of new autonomy region increment in Lingga until 2025 is only one new autonomy region. Abstract

For the implementation of the duties and functions of the Regional Representatives Council (DPRD) Riau Archipelago Province efficiently and effectively, to be supported by the availability of fittings Council, one of which is the formation of working committees. Concerns regarding the performance of Commission II Economic Affairs and Finance House of Representatives (DPRD) Riau Islands province, such as the ability to understand the material substance of legislation drawn up based on the analysis aspect of philosophical, juridical and sociological, and skill knowledge in the field of legal-drafting, the mastery of the basic principles accounting, performance budgeting, budget preparation techniques and benefits. Formulation of the problem addressed in this research that the performance of members of the Commission II How the economy and financial Sector Legislative Council (DPRD) Riau Archipelago Province. As well as what factors are inhibiting performance improvement II Committee member for Economic Affairs and Finance Islands Provincial Parliament. The research method used is descriptive qualitative research, which is the process of organizing and sorting data into patterns and categories as well as the basic outline of the unit, so it can be stated theme as suggested by the data. The results were quite good performance of members of the Commission II of the economy and financial Regional Representatives Council (DPRD) Riau Archipelago Province. The results, the researchers concluded that the performance of the members of the Commission II of the economy and financial Regional Representatives Council (DPRD) Riau Archipelago Province in the execution of their duties, both in the legislative function, budget and oversight functions showed fairly good condition. Factors inhibiting performance of members of the Board of Commission II, such as the quality of human resources member of the Commission II for economy and finance DPRD Riau Archipelago Province less, disciplinary board members are still low, the lack of implementation of punishmant to members of the Board who are not performing their duties and the number of members of the Commission II are not comparable in their respective sectors. Abstract

State of Indonesia is a country of Islands (Archipelago State), which consists of small islands as well as large and sea area larger than the land area. Geographical conditions is certainly going to require various forms of policies and legislation that have maritime pattern. Experience State of Indonesia ± 69 years gives a description of that in terms of public policy and legislation are born tend to be oriented on the mainland (continental oriented) from the ocean (archipelago oriented). Maritime should be viewed as an object that contains covers many areas of life in which between one and interrelated with other fields. In the "maritime" there are many areas that can be developed such as the legal, cultural, social, engineering and marine fisheries and of course itself. Already after the 1945 amendment ought be the starting point in the unification of maritime perception saw it as having the benefit of the various aspects. Support the legislation in drafting the legal framework of maritime Indonesia's development should be one of the priorities in the development of law in Indonesia is better. Change of paradigm and mindset of the management of the State of aspects of the legislation that is based on a maritime course must be started from a higher rule, the Constitution or the Constitution of Republic of Indonesia in 1945. Abstract

Law Number 23 Year 2014 About the local government, said that the Regional (district / city) can form the districts in order to improve the coordination of governance, public services, and the empowerment of village communities / villages. Karimun Regency is one of regencies in Riau Islands Province, which borders directly with Singapore. The geographical position of Karimun regency consists of several islands large and small impede access to public services. Therefore, expansion of the existing sub-district is one alternative solution in order to improve the welfare of society. The purpose of this research is to study the prospective analysis of the division of the sub-district of the District Parent Sugie Moro based on Government Regulation No. 19 Year 2008 on the District. The design study is descriptive analysis with qualitative and quantitative approach, where data in the form of empirical reality analyzed qualitatively by describing and considering the provisions of the normative, theoretical judgment or views of experts and key informants related to expansion efforts districts. The results of this study are candidates for the District Sugie Besar only meet one of three requirements formation of districts, namely the requirements of the technical requirements. As for the physical requirements of the administrative and territorial unfulfilled. Candidates for the technical requirements of the District of Sugie Besar Acquire Score 368 which is in the category and Recommended Able to be formed into new districts. While the District Parent Moro after bloomed (formed District of Sugie Besar) they meet one of three requirements of establishing districts as set out in Regulation No. 19 Year 2008 on the District, namely the requirement of technical requirements, while for the administrative and physical cantonal requirements are not met. For the technical requirements, the District Parent Moro obtain a score of 391 in the category Ability and Recommended. The conclusion from this study is that although only meet one of three requirements formation of districts, the Government of Karimun Regency will still be able to carry out the formation of the District Candidate Sugie Besar. It is possible as a rule, that the district / city government can be formed districts in the region that includes one or more islands, which requirements are exempt from the administrative requirements, terms of physical territoriality, and technical requirements as those mentioned with consideration to the effectiveness and efficiency of service delivery and community empowerment village on the remote islands and / or outer. Abstract

The change of system in this Republic is not necessarily followed by cultural change (behavioral culture) of society and apparatus. The conception of the state of welfare state law can not be felt maximally by the society, given the amount of state money lost due to acts of corruption committed by a handful of people. Law enforcement efforts against corruption must go hand in hand with efforts to change the behavior patterns of people who are happy to commit acts of corruption. The research problem is how to build a political system that is not vulnerable to corruption (Perspective of Cultural Change (Culture) Versus System Change (Structural)). The research methodology used is normative legal research (Doctrinal Reseach). The conclusions obtained include: apart from strengthening the system in the form of institutional strengthening and legislation, strengthening the efforts of preventing corruption through the improvement of anti-corruption community behavior must go hand in hand. Efforts to eradicate corruption from the aspect of behavior change is not an easy thing, but it takes a long time since the changed is the behavior of the society that has been entrenched. The approach to behavioral change in society of corruption perceptions should be changed by building a new perception that corruption is an act that can be very harmful to the state and society. Keywords: Corruption, System, Culture Perubahan sistem di Republik ini tidak serta merta diikuti dengan perubahan kultural (budaya perilaku) masyarakat dan aparat. Konsepsi negara hukum welfare state belum dapat dirasakan secara maksimal oleh masyarakat, mengingat banyaknya uang negara yang hilang akibat tindakan korupsi yang dilakukan oleh segelintir orang. Upaya penegakkan hukum terhadap tindak pidana korupsi harus berjalan beriringan dengan upaya merubah pola perilaku masyarakat yang senang dalam melakukan tindakan korupsi. Permasalahan penelitian adalah bagaimana Membangun Sistem Politik yang Tidak Rentan Korupsi (Perspektif Perubahan Budaya (Kultural) Versus Perubahan Sistem (Struktural)). Metodologi penelitian yang digunakan adalah penelitian hukum normatif (Doctrinal Reseach). Kesimpulan yang diperoleh antara lain; selain dari penguatan sistem berupa penguatan kelembagaan dan peraturan perundang-undangan, penguatan terhadap upaya pencegahan korupsi melalui pembenahan perilaku masyarakat yang anti korupsi harus berjalan beriringan. Upaya memberantas korupsi dari aspek perubahan perilaku masyarakat bukanlah suatu hal yang mudah, akan tetapi membutuhkan waktu yang lama mengingat yang dirubah adalah perilaku masyarakat yang sudah membudaya. Pendekatan perubahan perilaku masyarakat akan persepsi korupsi semestinya dirubah dengan membangun persepsi baru bahwa korupsi adalah perbuatan yang sangat dapat merugikan negara dan masyarakat.
