Abstract

The use of a mark serves not only as a distinguishing factor for a company but also as a strategic tool for marketing and advertising. Color, as a crucial element in brand identity, has the ability to convey messages, influence consumer perceptions, and enhance brand value. Therefore, it is not uncommon for companies to seek protection for colors as trademarks to ensure a definite level of safeguarding. In Law Number 20 of 2016 concerning Trademarks and Geographical Indications in Indonesia, the registration of color is not explicitly recognized as a trademark that can be registered, but it is also not prohibited. The findings of this research indicate the importance of Indonesian law in allowing the registration of color as a trademark, considering that color has a strong identification power for consumers, and many companies have successfully created associations between colors and their marks through consistent usage.

Abstract

TikTok has now become an application that is widely used by all people and that it has become a trend. The application has a General Terms of Services which is the basis for using Tiktok. In the practice of uploading songs by users without realizing it, gives a juridical implication because users do not fully understand the provisions contained in the Terms of Services. Appropriately, before the user takes and modifies the work of the song which is then used for commercial use, the user already has a license or permission from the author. The problems studied are the legal consequences of uploading songs in this TikTok application which are commercialized without the permission of the Creator by the related users, as well as to see the legal efforts that can be taken by the Creator on songs that are commercialized without the permission of the Creator in this application. The research method used is juridical normative, namely an approach method that uses laws and legal principles as a means of solving the problems at hand. The results of the research conclude that currently, the violation of Copyright has changed from criminalization to remuneration, where the legal consequence of the Copyright infringement is non-compensation to the Creator due to commercial use of songs. Regarding the protection efforts, it can be done in several ways, namely recording, administrative legal remedies and supervision. In terms of fulfilling the rights of the Creator, legal remedies can be taken, namely preventive and repressive measures consisting of civil and criminal remedies. In addition, it can also be resolved by alternative dispute resolution and arbitration.

Abstract

Penelitian ini mengkaji pelindungan hukum dan optimalisasi potensi ekonomi Indikasi Geografis Kopi Robusta Java Bogor. Meskipun telah mendapatkan pelindungan hukum, potensi ekonomi produk Indikasi Geografis ini belum sepenuhnya terealisasi akibat tantangan dalam strategi pemasaran, rendahnya kesadaran konsumen, dan lemahnya penegakan regulasi Indikasi Geografis. Penelitian ini menggunakan pendekatan yuridis normatif dan yuridis sosiologis dengan menganalisis bahan hukum primer dan sekunder, serta studi lapangan melalui wawancara terpimpin. Hasil penelitian menunjukkan bahwa penerapan konsep traceability dan pendaftaran internasional dapat mengoptimalkan potensi ekonomi serta daya saing Kopi Robusta Java Bogor di pasar global. Selain itu, strategi jenama dan pemanfaatan platform digital direkomendasikan untuk memperluas jangkauan pasar dan meningkatkan pengenalan produk.

Abstract

Nuisance messages, a form of unsolicited communication, often occurs between drivers and users of online transportation application services. The transmission of such messages represent a violation of privacy, infringing upon users' autonomy to control the information they receive and potentially causing both psychological and physical harm. Despite the fact, Indonesian law lacks explicit normative regulations addressing nuisance messages. Facing this condition, online transportation application services must must ensure user safety by providing a mechanism for users to object and avoid receiving such messages. This study aims to address two primary questions. Firstly, what forms of legal protection are currently available against nuisance messages under Indonesian positive law? Secondly, how can online transportation application service providers implement the right to object in order to optimize the protection of user privacy and personal data? This study employed a juridical-normative method with descriptive analysis to address the questions. The results indicate that Indonesian positive law can only refer to whether messages are sent in good faith and whether spam messages are sent in bulk. These can cause misinterpretation for providers and users. However, nuisance messages sent during the provision of a service demonstrate bad faith on the part of the driver. Therefore, to protect users, online transportation application services should implement a right to object through an electronic contract, thereby granting users greater control and balance.

Abstract

Hak atas merek merupakan hak yang bersifat monopoli, yang hanya dapat digunakan oleh pemilik merek untuk menggunakan mereknya secara penuh tanpa adanya pihak lain tanpa seizinnya untuk menggunakan merek tersebut. Seiring perkembangan teknologi informasi dan komunikasi khususnya dalam penggunaan e-commerce sebagai sarana transaksi mengakibatkan hak atas merek yang bersifat monopoli dilanggar haknya. Merek terkenal yang telah memiliki citranya masing-masing seringkali mengadakan kolaborasi dengan merek terkenal lainnya untuk menghasilkan produk yang bersifat edisi terbatas, membuat produk tersebut tinggi peminat. Sayangnya kondisi ini dimanfaatkan oleh pihak lain untuk menjual produk kolaborasi antar merek terkenal serupa pada e-commerce dengan cara melanggar hak yang dimiliki oleh kedua merek terkenal. Permasalahan yang akan dikaji yaitu mengenai perbuatan hukum yang dilakukan oleh penjual produk co-branding dengan mengatasnamakan kedua merek terkenal dan akan dikaji juga mengenai tindakan hukum apa yang dapat dilakukan oleh kedua merek terkenal, sebagai pihak yang dilanggar haknya. Penelitian ini bertujuan untuk menentukan kualifikasi perbuatan hukum atas tindakan yang dilakukan oleh pelaku usaha yang menjual produk co-branding tanpa seizin pemegang hak merek serta ditujukan untuk menentukan tindakan hukum apa yang dapat dilakukan oleh kedua merek terkenal atas hak mereknya yang dilanggar. Penelitian ini dapat berguna baik secara teoritis maupun praktis, dalam hal menjawab permasalahan serupa. Dalam menjawab rumusan masalah yang diangkat, akan dikaji dengan metode penelitian yuridis normatif melalui peraturan perundang-undangan yakni Undang-undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dan Undang-undang Nomor 11 Tahun 2008 juncto Undang-undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik. Dari hasil penelitian dapat disimpulkan bahwa perbuatan yang dilakukan dengan melanggar hak merek kedua merek terkenal merupakan tindakan passing off serta terhadap merek yang dilanggar haknya memiliki hak untuk melindungi mereknya baik mengajukan gugatan secara perdata, pidana, adminsitrasi maupun dilakukan secara arbitrase dan alternatif penyelesaian sengketa.

Abstract

Digital transformation in the banking sector has led to the emergence of mobile banking services such as BRImo, owned by PT. Bank Rakyat Indonesia (Persero) Tbk., which offers customers easy financial transactions. However, behind this innovation, complex issues have arisen regarding compliance with the data minimization principle as stipulated in Law Number 27 of 2022 concerning Personal Data Protection (PDP Law) and the 2018 General Data Protection Regulation (GDPR). This research focuses on the compliance of the personal data processing consent mechanism in the BRImo application with the data minimization principle, as well as the legal consequences of non-compliance with this principle. The research was conducted using a normative juridical approach through a review of relevant laws, doctrines, and legal literature, as well as a sociological juridical approach. The results show that BRImo's non-compliance with the data minimization principle is reflected in the practice of bundled consent without granular options, minimal transparency regarding data purposes and retention, and limited user control to revoke or modify consent. This shifts data consent from a substantial function to a mere administrative formality, ultimately leading to potential criminal and administrative sanctions and reputational risks for service providers. Corrective measures require the implementation of granular consent, interactive privacy dashboards, strict data retention policies, the appointment of a Data Protection Officer (DPO), and internal education to ensure lawful, fair, and proportionate data processing.

Abstract

In the last four years, the number of illegal fishing cases in Indonesia has relatively increased. The government is still working hard to catch the perpetrators of fisheries crimes that roam Indonesian waters. The Ministry of Maritime Affairs and Fisheries (MMAF) reported that a Russian-flagged foreign fishing vessel named Run Zeng from China entered Indonesia's Exclusive Economic Zone (EEZ) to conduct illegal activities such as illegal, unreported and unregulated (IUU) fishing practices, the use of trawling, and the deactivation of the Automatic Identification System (AIS). International environmental law requires countries to comply with rights and obligations related to environmental protection at the global level, including the marine environment. This research aims to specifically highlight the analysis of the environmental aspects of international law against the illegal activities of the Run Zeng vessel in Indonesia. By using normative juridical research methodology, which emphasizes the analysis of library materials in the form of secondary data. The results of this study indicate that the Run Zeng ship has carried out various illegal activities that violate the provisions of international conventions and laws and regulations in Indonesia. In law enforcement, Indonesia has adequate legal instruments to handle cases of environmental pollution by foreign vessels through bilateral agreements and national laws. This case has implications for Indonesia's commitment to realizing sustainable development in the marine and fisheries management sector, especially SDGs 14 Life Below Water through the concept of blue economy as outlined in the five priority programs of the MMAF.

Abstract

Artikel ini bertujuan untuk merumuskan langkah pengelolaan pusat budaya yang sempat terkendala karena pandemik Covid-19. Provinsi Jawa Barat melalui Rencana Proyek Insfrastruktur Strategis tahun 2018-2023 telah merencanakan membangun Pusat Budaya di Kabupaten/Kota di Jawa Barat. Pada Tahun 2019 telah dibangun Pusat Budaya di Kabupaten Subang dan Kabupaten Sumedang. Pandemik Covid-19 menjadi tantangan bagi pembangunan pusat budaya yang telah dibangun dalam hal optimalisasi penggunaannya. Selain itu, artikel ini bertujuan untuk menentukan alternatif lain dalam meningkatkan fungsi pusat budaya yang telah ada akibat adanya realokasi anggaran pembangunan pusat budaya. Metode penelitian yang digunakan yaitu metode yuridis normatif dan yuridis sosiologis. Pengumpulan bahan hukum primer, sekunder dan tersier digunakan untuk menganalisis persoalan secara yuridis. Dilakukan pula penelitian lapangan di Kabupaten Subang dan wawancara dengan pemerintah daerah Kabupaten Sumedang untuk melengkapi aspek sosiologis dari penelitian ini. Hasil penelitian menunjukkan bahwa pengaturan hukum di tingkat nasional dan daerah telah memberikan justifikasi bagi Pembangunan Pusat Budaya. Perlu petunjuk pelaksana dan petunjuk teknis pemanfaatan Pusat Budaya untuk mencapai hasil akhir yang maksimal atas penggunaan Pusat Budaya ini oleh para pelaku budaya setempat. Dalam menyikapi realokasi anggaran, perlu dipertimbangkan merevitalisasi kantong-kantong budaya yang selama ini telah hidup di masyarakat selain membangun Pusat Budaya baru.

Abstract

Technology in human life lately is increasingly needed and continues to develop. One form of development that occurs is the emergence of the Live Streaming feature. This feature appears on various social media platforms. There are even new applications that are intended to do Live Broadcasting—unfortunately, not only positive things that emerged due to this development. There have been several cybercrimes (cyber laws) that have negatively influenced internet users. Among them is the emergence of internet pornography. There is much Live Streaming that contains pornography in Live Broadcasting applications. The approach method used in this research is normative juridical, by examining the literature and reviewing positive law, which relates to the Law of Technology, Information and Electronic Transactions, and the Law of Pornography. This research will study the most appropriate way to regulate how Live Streaming containing pornography is viewed from Law Number 11 of 2008 jo. Law Number 19 of 2016 concerning Information and Electronic Transactions (ITE act) and Law Number 44 of 2008 concerning Pornography (Pornography act) and actions that the Government can take to minimize pornographic content on Live Streaming on social media in Indonesia.

Abstract

Tak dapat disangkal, pesatnya perubahan dunia pada era globalisasi berpangkal dari teknologi informasi yang kian berkembang. Berbaurnya teknologi dengan telekomunikasi menimbulkan revolusi pada sistem informasi. Dahulu, untuk mengakses atau mengolah data dan informasi, manusia membutuhkan proses yang panjang. Kini, dunia seolah diberikan kemudahan dalam mengakses dan terhubung dengan beragam informasi dan data yang tersaji. Lain halnya dengan Rahasia Dagang sebagai bagian dari kekayaan intelektual yang bernilai ekonomi tinggi dalam kegiatan usaha di Indonesia. Nilai ekonomi dari Rahasia Dagang melekat karena adanya informasi yang sengaja untuk tidak diketahui oleh umum. Hal tersebut menjadikan elemen ini termasuk salah satu bagian yang cukup menarik atensi. Mengingat pada era ini, industri jasa telekomunikasi seolah menopang tanggung jawab besar untuk melindungi setiap data yang masuk ke dalam dunia digital. Terdapatnya resiko berupa kebocoran data yang bersifat rahasia menjadi problematika terhadap pelindungan data dalam industri jasa telekomunikasi. Dengan ini, digunakan metode penelitian yuridis normatif melalui pengumpulan data yang dilakukan secara daring. Penelitian ini menghasilkan sebuah rujukan perihal pengaturan yang tepat sesuai kebutuhan Indonesia dalam merespon pelindungan data sebagai rahasia dagang pada jasa telekomunikasi yang belum terakomodir dengan baik saat ini. Melalui optimalisasi keberadaan umbrella regulation dan penyusunan kebijakan khusus dalam sektor telekomunikasi berupa co-regulation atau self-regulation.
