Abstract

Investment in Non-Fungible Tokens (NFTs) is rapidly emerging in Indonesia, presenting both opportunities and challenges for the digital creative industry. As unique crypto assets, NFTs enable new ways to own and trade digital and physical goods, but current regulations, including the Commodity Futures Trading Law and Bappebti guidelines, do not fully address these transactions, creating legal gaps and increasing risks of fraud, money laundering, and market manipulation. Despite this, NFT communities like the Superlative Secret Society in Bali, supported by the Ministry of Creative Economy, have fostered creativity and economic activity. This study employs a normative juridical and comparative law approach to explore legal theories suitable for protecting NFT investments, finding that frameworks based on Ahmad M. Ramli’s transformative law and Mochtar Kusumaatmadja’s developmental law can ensure legal certainty, security, and fairness. The study concludes that comprehensive legal reforms are essential to safeguard investors and sustain the growth and international competitiveness of Indonesia’s digital creative industry.

Abstract

Seringkali masih terdapat gap antara dunia kampus dengan permasalahan yang nyata terjadi di masyarakat. Program pengabdian kepada masyarakat dilaksanakan untuk mensinkronisasikan keduanya. Universitas Padjadjaran memiliki program Pengabdian kepada Masyarakat yang terintegrasi dengan Praktik Kerja Lapangan (PKL) bagi mahasiswa dan magang. Pada periode 2023-2025, tim dari berbagai fakultas yang diketuai oleh Fakultas Hukum, menyelenggarakan pengabdian kepada masyarakat di Desa Ngamplangsari, Kecamatan Cilawu, Kabupaten Garut. Di wilayah ini, terdapat pelaku usaha kuliner lokal asal Garut yang berpotensi meningkatkan perekonomiannya namun masih terkendala dengan belum adanya merek dagang, misalnya. Tim dari Unpad memberikan pendampingan hukum untuk penelusuran hingga pendaftaran merek dagang. Untuk mengatasi permasalahan lingkungan, kegiatan ini berupaya untuk bersama-sama mencari solusi pengemasan pangan dan pengolahan limbah produksi yang ramah lingkungan. Strategi Branding yang menjadi ujung tombak hingga produk kuliner lokal para pelaku usaha tersebut sampai ke tangan konsumen perlu disentuh oleh para antropolog untuk memberikan story-telling. Abstract

This research originates from a legal dispute involving Keenan Nasution and Rudi Pekerti, the original composers of the song Nuansa Bening, who filed a lawsuit against singer Vidi Aldiano under Case Number 51/Pdt.Sus-HKI/Cipta/2025/PN Niaga Jakarta Pusat. The composers claimed they had not received any royalties for over 16 years, despite the song being performed publicly 31 times without their authorization, and sought compensation of IDR 24,500,000,000 (twenty-four billion five hundred million rupiah). They also requested the seizure of Vidi Aldiano’s property in Cilandak, South Jakarta. This study employs a normative juridical approach, focusing on secondary data through literature review, including primary legal materials (laws and regulations), secondary legal sources (expert opinions), and tertiary references (legal dictionaries and related materials). The research is descriptive-analytical in nature, using normative qualitative data analysis. The findings reveal that based on Law Number 28 of 2014 concerning Copyright, songwriters as copyright holders are entitled to both moral and economic rights, which are legally protected. If those rights are violated, legal protection for the creators can be pursued based on the principles of automatic protection, recognition of moral rights, and the overarching principles of justice and legal certainty.

Abstract

Collective trademarks can be an alternative for trademark protection for Micro, Small, and Medium Enterprises (MSMEs) considering the greater benefits compared to regular trademarks. In 2024, there was an increase in the number of collective trademark applications, indicating that the public, especially MSMEs, are becoming more aware of the importance of trademark protection. However, issues have been found in the legislation regarding collective trademarks. This article aims to formulate the appropriate arrangements of collective trademark legislation that align with the MSME climate in Indonesia to achieve legal certainty. The research method used is normative juridical with a statutory approach, a conceptual approach, and a comparative approach. The regulation of collective trademarks in Indonesia will be compared with Brazil based on Law No. 9.279 of May 14, 1996, as amended by Law No. 14.200 of September 2, 2021. This research found that Law Number 20 of 2016 still contains several issues, namely the ambiguity of norms and articles that lead to multiple interpretations among the public. The provisions on collective trademarks in the Regulation of the Minister of Law and Human Rights Number 67 of 2016 (MIG Law) regulate substance similar to that stated in the MIG Law, whereas it should provide a more detailed and technical explanation. On the other hand, Law Number 15 of 2001, which was the previous regulation before the enactment of the MIG Law, provides a more comprehensive regulation on collective trademarks compared to the MIG Law. Thus, the legislation regarding collective trademarks does not yet provide legal certainty. The comparison with Brazil provides recommendations for appropriate arrangements, indicating the need for revisions and improvements to the legislation on collective trademarks to meet the need for more adequate regulations.

Abstract

Background: The rapid advancement of digital technologies has transformed how cultural heritage is preserved, accessed, and disseminated. While digitalization offers new opportunities to revitalize traditional arts and engage younger generations, it raises concerns related to cultural authenticity, technical capacity, and ethical governance.Purpose: This study examines (1) how digital technologies contribute to the preservation and revitalization of traditional arts, (2) the key challenges faced by artists and cultural practitioners in adapting to digital environments, and (3) the collaborative strategies required to ensure culturally grounded and sustainable digitalization. Methods: A qualitative approach was employed using semi-structured interviews with five informants, including traditional artists, academics, and cultural practitioners involved in heritage-related activities in Indonesia. Data were analyzed thematically to identify recurring patterns related to digital preservation practices, challenges, and forms of collaboration.Results: Findings show that digitalization strengthens preservation by expanding accessibility, protecting fragile archives, and creating immersive experiences through technologies such as virtual reality and digital platforms. However, informants highlight significant constraints, including digital literacy gaps, inadequate infrastructure, financial barriers, and intellectual property risks. They emphasize that authentic cultural values must remain central in digital transformation. Effective digitalization requires multi-stakeholder collaboration—linking artists, communities, academics, government, and technology actors to ensure accuracy, cultural integrity, and sustainable implementation. Conclusions: Digital technologies hold meaningful potential for revitalizing traditional arts when applied ethically and collaboratively. Sustainable digital preservation requires culturally sensitive approaches, institutional support, and coordinated multi-stakeholder engagement. Future research should involve broader participant groups and comparative cultural contexts to deepen understanding of long-term digital preservation strategies.

Abstract

The development of modern commerce, characterized by the widespread use of standard contractual documents and electronic transactions, has given rise to the phenomenon of battle of forms, namely situations in which parties proceed with a transaction despite the existence of mutually inconsistent standard clauses. This phenomenon challenges the classical construction of contract formation under the Indonesian Civil Code (KUHPerdata), which is grounded in the theory of offer and acceptance requiring strict correspondence between the two. This study aims to analyze how the knock-out rule as stipulated in Article 2.1.22 of the UNIDROIT Principles of International Commercial Contracts (UPICC) contributes to legal certainty in resolving conflicts of standard terms and to examine its relevance within the Indonesian contract law system. Employing a normative juridical method with statutory and comparative approaches between the KUHPerdata and the UPICC as a soft law instrument, this research finds that the knock-out rule provides a more adaptive framework by recognizing the existence of a contract insofar as the parties have agreed on its essential elements, while disregarding conflicting clauses and replacing them with applicable gap-filling provisions. This principle maintains a balance between freedom of contract, good faith, and legal certainty, and has the potential to address normative gaps in Indonesian contract law while promoting harmonization with international commercial practice.

Abstract

Rapid technological advancements have outpaced legal frameworks in regulating autonomous warships, as United Nations Convention on the Law of the Sea (UNCLOS) human-centered definition fails to accommodate crewless or semi-autonomous vessels in modern naval operations. This study examines the legal implications of this definitional gap and explores how international law might evolve to address the governance of autonomous warships. Key issues include sovereignty, accountability, and compliance with existing maritime and wartime legal norms, such as whether a fully autonomous vessel can qualify as a warship under UNCLOS and what responsibilities states bear for their actions in conflict scenarios. Using a normative legal research design with doctrinal and conceptual approaches, the study analyzes UNCLOS, COLREGs, and SOLAS, employing deductive and analogical reasoning to compare autonomous vessels with technologies like remotely piloted UAVs. Autonomous warships do not fully qualify as warships under UNCLOS due to the absence of human command and crew, leading to ambiguities in liability, navigation compliance, cybersecurity risks, and humanitarian duties. However, remote operation and flag state discretion may allow classification, highlighting gaps in existing frameworks.

Abstract

Pasar seni rupa menempatkan lukisan sebagai komoditas bernilai tinggi, namun pelindungan hak ekonomi pelukis di pasar sekunder belum optimal karena dalam Pasal 11 ayat (1) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta (UUHC) masih menganut prinsip kehabisan hak sehingga pencipta kehilangan hak ekonomi setelah penjualan pertama. Sementara Pasal 18 mengatur pengembalian hak cipta setelah jangka waktu tertentu hanya berlaku terbatas pada ciptaan buku dan musik. Berdasarkan kondisi tersebut, menimbulkan permasalahan pelindungan hak ekonomi Pencipta melalui asas droit de suite serta penerapannya dalam perjanjian jual beli putus karya seni lukis menurut UUHC. Penelitian ini menggunakan metode penelitian yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Data diperoleh dari bahan hukum melalui studi pustaka dan wawancara, serta menggunakan perbandingan hukum Amerika Serikat dan Uni Eropa. Hasil penelitian menunjukkan bahwa, pertama, pelindungan hak ekonomi pencipta karya seni lukis melalui UUHC belum mengakomodasi asas droit de suite, karena prinsip kehabisan hak dalam Pasal 11 ayat (1) serta pengaturan jual beli putus dalam Pasal 18 belum memberikan jaminan hak ekonomi berkelanjutan atas penjualan kembali karya seni lukis di pasar sekunder. Kedua, penerapan asas droit de suite dalam perjanjian jual beli putus di Indonesia belum memiliki dasar normatif yang jelas, berbeda dengan Eropa yang tegas menjamin hak royalti penjualan kembali dan Amerika Serikat yang menekankan pelindungan personal antara seniman dan karyanya melalui hak moral. Penelitian ini merekomendasikan pembaruan kebijakan UUHC melalui adopsi eksplisit asas droit de suite demi menjamin keadilan ekonomi bagi pencipta seni lukis.

Abstract

Internal waters represent a vital maritime domain through which a State exercises sovereignty and ensures national security. However, their delimitation remains complex, particularly when intersecting with claims of historic title under international law. This study examines Indonesia’s authority, as an archipelagic State under Article 50 of the United Nations Convention on the Law of the Sea 1982, to designate Tomini Bay as a historic bay. Employing a normative legal method with a comparative approach, the research analyzes the legal framework governing internal waters, historic title, and relevant State practice. It further explores the legal implications of reclassifying Tomini Bay from archipelagic waters to internal waters. The findings highlight that such a designation requires strict adherence to customary international law criteria and may significantly affect sovereignty claims, navigational rights, and international recognition.

Abstract

Background: Sundanese traditional dance is an intangible cultural heritage that carries historical memory, embodied knowledge, aesthetic values, and collective identity. In the contemporary digital environment, this heritage faces intertwined challenges: declining regeneration among young people, weak documentation practices, limited digital capacity in community-based studios, and legal vulnerability caused by incomplete intellectual property protection. Purpose: This study aims to formulate and evaluate a holistic preservation strategy for Sundanese traditional dance by integrating digital archiving, community capacity building, intellectual property protection, and cultural sustainability planning. Methods: The study employed Community Action Research with Azka Studio Dance Community in Rancaekek, Bandung Regency. Data were collected through field observation, interviews with studio managers and participants, documentation studies, training records, metadata compilation, and reflective evaluation. The intervention was organized into four connected stages: diagnosing preservation gaps, planning community-based actions, implementing digitization and legal-literacy activities, and evaluating sustainability outcomes. Results: The intervention achieved the main targeted outputs: ten dance works were documented in high-definition video and described using cultural metadata; eight young digital cadres were trained to manage documentation workflows; thirty youths participated in dance regeneration activities; twenty artists received intellectual property training; five dance works were prepared for copyright registration; and digital dissemination through social media increased public visibility. Conclusion: The study demonstrates that preservation of intangible cultural heritage requires more than recording performances. A sustainable model depends on the integration of archival standards, community participation, legal awareness, and regeneration mechanisms. For Library and Information Science, the case contributes a practical model of community-based digital cultural archiving that connects documentation, metadata, access, rights management, and long-term stewardship.
