Abstract

Sebagai negara anggota UNIDROIT, Indonesia diharapkan untuk dapat membuat kontrak internasional sesuai standar internasional. Mengadopsi standar internasional akan memberikan kemudahan bagi para pihak berkontrak terutama antara pihak Indonesia dengan pihak asing. Seperti yang telah dikodifikasi dalam Unidroit Principles on Internantional Commercial Contracts (2016) (“UPICC”), terdapat tahapan Counter Offer atau Penawaran Balik yang memperbolehkan para pihak untuk membalas Tawaran dengan modifikasi secara materil. Penawaran Balik jelas diatur dalam Pasal 2.1.11 UPICC dan umum dipraktikkan di negara-negara anggota UNIDROIT baik dalam membuat kontrak nasional ataupun kontrak internasional. Sebagai negara anggota UNIDROIT, Indonesia tidak mengatur mengenai prosedur Penawaran Balik. Kekosongan hukum pengaturan Penawaran Balik ini telah menimbulkan miskomunikasi dan kekeliruan dengan pihak asing terkait mekanisme perubahan materil yang benar. Tentunya bagi para pihak asing, kekeliruan yang timbul karena ketidakpahaman Penawaran Balik oleh pihak Indonesia dapat dimanfaatkan secara sepihak. Metode penelitian yang digunakan dalam tulisan ini adalah deskriptif analitis dengan menggunakan pendekatan yuridis normatif, yaitu mengkaji dan meneliti data primer yang terdiri atas KUHPerdata dan peraturan perundang-undangan yang berlaku, dan data sekunder yang terdiri atas kasus hukum dan literatur yang memuat teori-teori hukum dan praktik pelaksanaan hukum positif mengenai pokok permasalahan di atas. Teknik pengumpulan data yang digunakan adalah studi kepustakaan. Hasil penelitian yang ingin dicapai dalam tulisan ini, adalah adanya implementasi serta pemahaman komprehensif terkait ketentuan Counter Offer terutama dalam membentuk kontrak dengan pihak asing. Peneliti menyarankan agar kontrak yang dibuat dengan pihak asing tidak hanya disesuaikan dengan ketentuan Counter Offer dalam UPICC, tetapi juga disesuaikan dengan aturan Kitab Undang-undang Hukum Perdata.

Abstract

The use of a brand as a Twitter social media account is one way for brand owners to introduce their goods and/or services as well as a guarantee for their quality. The rise of fake Twitter accounts on behalf of the financial institution Bank Mandiri proves that trademark infringement does not only occur conventionally, but also through the scope of cyberspace. Writing this normative law aims to determine the qualifications for the act of using a bank's financial institution brand as a Twitter social media account and to determine what legal action should be taken by Bank Mandiri against those who use its brand without rights and permission. This research is a legal study employing the normative juridical approach method, a type of legal writing that is conducted by examining library data. The study applies a qualitative analysis method, connecting legal principles, norms, and theories to determine legal qualifications and consequences. The results show that using trademarks as social media accounts should be based on principles, including legal certainty, good faith, and neutrality within technology. Civil law measures offer a proportional legal remedy, seeking compensation for economic harm suffered. This study suggests the need for specific regulations to prohibit the registration and use of trademarks as social media accounts in the virtual space. This research contributes to the understanding of trademark protection in cyberspace, and provides legal guidance for financial institutions to address trademark misuse on social media platforms.

Abstract

Pasal 65 UUHC mengatur bahwa pencatatan hak cipta logo tidak lagi bisa dilakukan apabila logo tersebut telah digunakan sebagai merek, tetapi banyak pencatatan hak cipta logo yang terdaftar sebagai merek berhasil dilakukan. Hal ini menimbulkan ketumpulan penerapan Pasal 65 UUHC. Penelitian ini bertujuan untuk memperoleh kepastian hukum penerapan dan eksistensi Pasal 65 UUHC. Penelitian ini dilakukan dengan metode yuridis normatif. Hasil penelitian ini menunjukan bermuara pada benturan prinsip deklaratif hak cipta dengan Pasal 65 UUHC. Di sisi lain, pada dasarnya Pasal 65 UUHC memisahkan pelindungan hak cipta logo dan merek, yang artinya apabila suatu logo telah terdaftar sebagai merek, rezim hukum merek lah yang berlaku. Oleh karena itu, pencatatan hak cipta logo yang telah terdaftar sebagai merek tidaklah memiliki kekuatan hukum. Untuk memberikan penguatan kepastian hukum, perlu dilakukan upaya memperjelas pengaturan tumpang tindih pelindungan ini dengan menghapus Pasal 65 UUHC, atau justru memperkuat dengan dengan mengubah frasa “digunakan sebagai merek” dengan “didaftarkan sebagai merek”, atau setidaknya dimaknai demikian. Selain itu, diperlukan juga upaya integrasi Pasal 65 UUHC dengan UUMIG, serta optimalisasi peran DJKI dan peningkatan kesadaran masyarakat adanya Pasal 65 UUHC tersebut. Kesimpulan Penelitian ini menemukan bahwa penerapan Pasal 65 UUHC inkonsisten karena masih banyak pencatatan yang berhasil dilakukan meskipun memenuhi unsur Pasal 65 UUHC.

Abstract

Menghadapi perkembangan teknologi dengan maraknya platform digital serta layanan Over The Top (OTT), pelaksanaan hak ekonomi Lembaga Penyiaran menurut Undang-undang Hak Cipta nyatanya belum sepenuhnya berjalan dengan baik. Penelitian ini bertujuan untuk menganalisis perlindungan hak ekonomi lembaga penyiaran dalam kasus sengketa antara Haji Ukat Sukatma dan PT Indosiar Visual Mandiri, Tbk. Fokus penelitian adalah pada aspek hukum yang berkaitan dengan penggunaan konten ciptaan tanpa izin pencipta oleh lembaga penyiaran. Metode yang digunakan adalah pendekatan yuridis normatif dengan analisis data kualitatif. Hasil analisis menunjukkan bahwa Putusan Pengadilan Niaga memandang hak ekonomi lembaga penyiaran dijamin berdasarkan Undang-undang Hak Cipta, sedangkan Mahkamah Agung membatasi hak tersebut sesuai dengan ketentuan Undang-undang Penyiaran. Terkait akibat hukum, pengunggahan konten siaran di YouTube oleh lembaga penyiaran tanpa izin pencipta dikategorikan sebagai pelanggaran hak cipta. Diskusi juga mencakup upaya Kementerian Hukum dan HAM untuk mengatur lisensi lagu dan/atau musik. Penelitian ini memberikan kontribusi dalam memahami perkembangan hukum terkait hak ekonomi lembaga penyiaran dalam konteks teknologi digital dan platform OTT.

Abstract

Attention to biometric data security has become urgent for protecting user privacy. In the context of the Protection of Data Privacy (PDP) Law, biometric data are classified as specific data, requiring extra protection due to their unique, non-exchangeable characteristics. This study uses a normative approach, analyzing legislation and legal comparisons through regional and international regulations, to examine two issues: the position of biometric data as specific data under the Electronic Information and Transactions Law and PDP Law, and the technical solutions through privacy by design to protect biometric data. The research findings are: (1) Biometric data are correlated with privacy and personal rights, classifying them as specific data. Their use for public and private interests raises the potential for privacy violations. (2) Technical solutions through privacy by design can begin with implementing consent at the registration stage by personal data controllers, ensuring the processing of biometric data achieves specific purposes.

Abstract

The understanding of TikTok users tends to be less concerned about someone's creative work. This has led to the widespread practice of TikTok users using choreography creations for monetization on the TikTok platform without the creator's permission. This study aims to determine the legal protection for creators of Dance Challenge choreography regarding monetization on the TikTok platform based on Law Number 28 of 2014 on Copyrights and to determine dispute resolution for choreography owners regarding monetization of Dance Challenge choreography by others without permission on the TikTok platform based on applicable laws and regulations. This research was conducted using the normative juridical and socio-legal approach methods. The research was conducted by conducting both library and field research as the primary research materials. Based on the conducted research, the results show that TikTok users who create and upload choreography works on the TikTok platform automatically receive copyright protection for those choreography works. If a creator feels that their choreographic work has been monetized by others without their permission, the creator can report it through TikTok administration, alternative dispute resolution, arbitration, or legal proceedings.

Abstract

One of intellectual property that has legal protection in Indonesia is industrial design. In Indonesia, industrial design is closely related to the handicraft industry. In Indonesia there is already a registration of industrial designs that use handicraft designs such as traditional batik motif designs which are protected by copyright as an expression of traditional culture. This phenomenon is an overlapping and intersecting issue between the fields of copyright and industrial design. For this reason, legal studies are urgently needed to determine whether a traditional cultural expression can have industrial design novelty or not. This article uses a normative juridical approach, in the form of an analysis of legal principles of Indonesia’s law which is related to research problems. Based on the research results, traditional batik motifs fulfill the elements of an industrial design that can be registered and protected by the industrial design legal framework in Indonesia. The principle of novelty of industrial design can be implemented to filter the novelty of industrial design in selecting registration of traditional batik motifs as industrial designs. The legal protection of traditional batik motifs based on the Industrial Design Law has not been regulated comprehensively and clearly, the legal protection is only regulated as a disclosure of pre-existing industrial designs. A theoretical approach is needed in applying the articles regarding provisions for checking the novelty and registration of industrial designs related to communal intellectual property using the legal principles and theories that underlie the formation of the Industrial Design Law in Indonesia.

Abstract

Employees who are inventors often collaborate with employers to secure funding and facilities for patent research and development. In response to this development, the government established the Patent Law to protect the patent rights of employee inventors for patents resulting from their employment relationship. This study is a normative-sociological legal research. The aim of this research is to find the appropriate mechanism for creating a compensation agreement and fair and reasonable compensation standard for employee inventors. The subjects of this research are employee inventors and employers. The data collection method in this study are literature review and interviews. The data includes regulations, legal experts' opinions, dictionaries, encyclopedias, and others. Based on this research, it was found that there is uncertainty regarding the bargaining position of employee inventors in the agreement drafting process and the standards for providing compensation to employee inventors for the patents they produce. Therefore, a strong legal system is needed to regulate the forms and values of compensation which meet fair and reasonable standards to ensure legal certainty for employee inventors.

Abstract

This study discusses the importance of the protection of the Indication of Source for the Songkok Recca To Bone product from Bone Regency, South Sulawesi, which serves as both a local cultural identity and an economic asset for Micro, Small, and Medium Enterprises (MSMEs). Referring to Law No. 20 of 2016 on Trademarks and Indications of Source, this research examines the relationship between legal protection and local economic development to prevent violations and misuse of local products. Using normative legal and sociological methods, data was gathered through literature review and interviews. The findings indicate that protection of the Indication of Source positively impacts the MSMEs economy by marking products with origin labels. However, its implementation remains suboptimal due to the lack of support from the local government in monitoring and product registration. Recommendations include enhancing the local government's role in supporting MSMEs through data collection and formal protection to improve the competitiveness of products in the market.

Abstract

The protection of traditional cultural expressions within the concept of Communal Intellectual Property is an effort to preserve cultural aspects. One such expression needing protection is the Genggong Art of Sumedang. This research aims to understand the issues related to the Genggong Art of Sumedang, which has not yet received defensive protection as a Communal Intellectual Property object, and the legal provisions that can support its protection. Using a normative juridical and sociological juridical approach, the research collects primary data through field studies and interviews, and secondary data through literature studies, including relevant regulations and other secondary legal materials. The findings indicate that normative provisions on intellectual property in Indonesia have not been optimally implemented. This is due to a lack of socialization about the importance of communal intellectual property protection and an understanding of registration procedures. Therefore, optimal cooperation and coordination are needed both in the registration context between the originating community and the Sumedang Regency Government, as well as in promoting the importance of defensive protection of traditional cultural expressions between the Sumedang Regency Government and the Ministry of Law and Human Rights.
