Abstract

This normative legal study analyzes the legal compliance of motor vehicle drivers within the context of Law No. 22 of 2009 concerning Road Traffic and Transport. The research focuses on the disruption between ideal norms and their real-world implementation, where low legal awareness and social factors are the main obstacles. This study asserts that compliance is not merely a civil obligation but an essential aspect of citizen participation in maintaining public order. The research delves into the mechanisms of law enforcement for traffic violations, ranging from administrative fines to criminal liability. It emphasizes that the effectiveness of regulations depends heavily on three pillars: the legal substance (the Law itself), the legal structure (enforcement institutions), and the legal culture (public awareness). The strategic recommendations from this study include the digital transformation of law enforcement through electronic ticketing (e-tilang), the optimization of progressive legal education, and the adaptation of regulations to keep pace with technological advancements and mobility. Overall, these findings underscore the urgency of multi-stakeholder synergy to ensure legal certainty and traffic safety

Abstract

Perdagangan ilegal satwa liar merupakan kejahatan lingkungan yang mengancam kelestarian biodiversitas di Indonesia. Bekantan (Nasalis larvatus), sebagai primata endemik Kalimantan yang dilindungi, menjadi sasaran penyelundupan karena tingginya nilai ekonomis. Penelitian ini bertujuan untuk menganalisis pertimbangan hukum hakim dalam menjatuhkan putusan serta bentuk pertanggungjawaban pidana pelaku penyelundupan hewan bekantan dalam Putusan Pengadilan Negeri Martapura No. 104/Pid.Sus/LH. Penelitian ini menerapkan metode yuridis normatif dengan pendekatan melalui peraturan perundang-undangan dan studi kasus. Sumber data primer berasal dari salinan putusan pengadilan, sementara data sekunder dikumpulkan dari berbagai literatur hukum, peraturan perundang-undangan, serta dokumen pendukung lainnya. Telaah yang digunakan yaitu telaah kasus dan perundang-undangan (Statute Approach). Hasil penelitian menunjukkan bahwa hakim mempertimbangkan secara cermat unsur kesengajaan, status hukum satwa bekantan, dan keterlibatan terdakwa. Bentuk pertanggungjawaban pidana yang dikenakan adalah pertanggungjawaban pidana individual berdasarkan asas kesalahan (schuld), namun belum mencerminkan prinsip keadilan ekologis secara menyeluruh. Penelitian ini diharapkan menjadi referensi dalam pengembangan hukum pidana lingkungan dan penegakan hukum terhadap penyelundupan satwa dilindungi di Indonesia.

Abstract

Penelitian ini bertujuan menganalisis kedudukan hukum Petok D dalam sistem hukum agraria Indonesia dan menjelaskan perannya dalam praktik penguasaan serta penyelesaian sengketa tanah bengkok di tingkat desa. Pertanyaan utama yang ingin dijawab adalah sejauh mana Petok D memiliki kekuatan pembuktian hukum dan bagaimana implikasinya bagi masyarakat pemegang tanah. Penelitian ini menggunakan desain penelitian hukum empiris dengan pendekatan yuridis sosiologis dan bersifat kualitatif. Data dikumpulkan melalui wawancara mendalam dengan masyarakat pemegang Petok D, aparatur desa, dan pejabat pertanahan, disertai observasi lapangan dan studi kepustakaan terhadap peraturan perundang-undangan, doktrin, serta yurisprudensi. Analisis data dilakukan secara deskriptif kualitatif dengan mengaitkan temuan empiris dan norma hukum yang berlaku. Hasil penelitian menunjukkan bahwa Petok D tidak memiliki kekuatan hukum sebagai bukti kepemilikan hak atas tanah, melainkan hanya bernilai sebagai bukti administratif penguasaan. Ketergantungan masyarakat terhadap Petok D menciptakan kepastian hukum semu dan meningkatkan kerentanan sengketa. Temuan ini berkontribusi pada pemahaman empiris mengenai pluralisme hukum pertanahan dan menegaskan perlunya percepatan legalisasi tanah. Kesimpulan penelitian menekankan pentingnya pendekatan sosio-legal dalam kebijakan pertanahan serta merekomendasikan penelitian lanjutan terkait model legalisasi tanah berbasis komunitas.

Abstract

This study aims to analyse the forms of legal liability applicable to minors who operate motorcycles and cause fatalities in traffic accidents, as well as to examine the possibility of legal action against their parents. The phenomenon of underage individuals driving on public roads raises serious legal and social concerns, as it not only endangers traffic safety but also generates questions regarding the appropriate legal subject to be held responsible when accidents occur. This research employs an empirical legal research method, which relies on real-world data obtained through interviews, observations, and document analysis to examine how the law is applied in practice. The findings indicate that within the juvenile criminal justice system, legal accountability must prioritise the best interests of the child, respect for the child’s views, and the application of restorative justice through diversion mechanisms. Case resolution is directed toward reconciliation between the victim and the child offender, avoiding deprivation of liberty, and fostering a sense of responsibility in the child. Furthermore, the study identifies the potential for parental liability where parents are proven to have provided opportunities, means, or assistance that facilitated the commission of the criminal act, as stipulated in Articles 56 and 57 of the Indonesian Criminal Code. Accordingly, this study underscores the importance of fair law enforcement that remains oriented toward child protection, while also recognising parents as parties who may bear legal responsibility under certain conditions.

Abstract

The concept of a Justice Collaborator (JC) has become an important instrument in criminal law enforcement, particularly in uncovering complex crimes. A justice collaborator refers to a perpetrator who cooperates with law enforcement authorities by providing significant information to reveal a criminal act and identify other perpetrators. In Indonesia, the recognition of justice collaborators is regulated in Law Number 13 of 2006 as amended by Law Number 31 of 2014 concerning the Protection of Witnesses and Victims, as well as Supreme Court Circular Letter Number 4 of 2011. This study examines the implementation of the rights of justice collaborators to obtain sentence reduction in cases of murder and analyzes the legal considerations applied by judges in granting such leniency. This research employs a normative legal method using statutory and conceptual approaches. Primary legal materials consist of relevant laws and regulations, while secondary materials include legal doctrines and scholarly articles. The data are analyzed qualitatively through descriptive analysis. The results indicate that although justice collaborators are legally entitled to special protection and the possibility of sentence reduction, their implementation in murder cases is not automatic and depends heavily on judicial discretion. Judges consider several factors, including the significance of the information provided, the role of the offender in the crime, and the consistency of cooperation during the investigation and trial process. The study concludes that clearer legal standards and consistent judicial application are necessary to ensure legal certainty and fairness in granting sentence reductions to justice collaborators in murder cases.

Abstract

The recognition of children born out of wedlock remains a significant legal issue within the framework of Indonesian positive law. Children, as subjects of law, are entitled to protection and equal treatment regardless of the circumstances of their birth. However, prior to the Constitutional Court Decision Number 46/PUU-VIII/2010, children born outside lawful marriage were legally recognized as having civil relations only with their mother and her family, resulting in limited access to paternal rights. This normative juridical research employs a statute and conceptual approach to examine the legal regulation and protection of children born out of wedlock under Indonesian law. The study analyzes the Civil Code, the Marriage Law, the Population Administration Law, and relevant Constitutional Court rulings. The findings indicate that, following the Constitutional Court’s decision, children born out of wedlock may establish civil legal relations with their biological father, provided that biological paternity is proven through lawful evidence, including scientific methods such as DNA testing. Nevertheless, practical challenges remain, particularly concerning procedural requirements and judicial discretion, which may hinder full legal protection. Therefore, stronger regulatory harmonization and legal certainty are necessary to ensure comprehensive protection of children’s civil rights.

Abstract

Land fraud involving certified ownership titles poses significant threats to legal certainty in Indonesia, with cases surging from 4,000 in 2021 to nearly 8,000 in 2025 per Ministry of ATR/BPN data. Enforcement under Article 378 of the Criminal Code prioritizes imprisonment over victim restitution, as evident in High Court Decision No. 873/Pid/2021/PT SBY, leaving victims without full recovery. This study aims to analyze legal certainty for victims of certified land sale fraud and propose restorative justice enhancements. It employs normative juridical research with statutory, case, and conceptual approaches. The population comprises relevant laws, doctrines, and court decisions; purposive sampling selects the aforementioned decision, KUHP Article 378, KUHAP Article 98, and supporting literature. Primary data from regulations and secondary from books/journals are analyzed qualitatively via description, classification, and legal syllogism. Findings reveal inadequate restitution integration, resulting in partial justice and prison overcrowding. In conclusion, restitution should be mandated as principal punishment in property crimes to balance retribution and restoration.

Abstract

This study examines the role of the police in managing evidence during the investigation process at Mojokerto Police Resort. Evidence management is a crucial aspect of criminal law enforcement, whose success is influenced by procedural accuracy, officer integrity, and an accountable storage system. Based on normative legal research methods with statutory and legal theory approaches, it was found that evidence management at Mojokerto Police Resort has largely complied with the provisions of the Criminal Procedure Code (KUHAP), Police Regulation No. 10 of 2010, and Ministry of Law and Human Rights Regulation No. 16 of 2014. However, there are still practices of evidence utilization by certain officers under the pretext of official needs, which contradict the principle of chain of custody and pose a risk of legal violations. Therefore, strengthening accountability and internal supervision is necessary to ensure the integrity of evidence. This study contributes to the development of police policy and the improvement of evidence management governance in a juridical and professional manner

Abstract

This study analyzes criminal sanctions for juvenile offenders committing aggravated theft based on Decision No. 1/Pid.Sus-Anak/2024/PN.Mtw amid a surge in juvenile delinquency cases reaching 14,000 in the first semester of 2025, driven by economic, social, and peer influences, where child protection principles often conflict with imprisonment despite the Juvenile Justice System Law (UU SPPA) promoting restorative justice; its objective is to examine the application of these principles and the judge's ratio decidendi with recommendations for optimization. Employing a normative legal approach (statute and case methods) with qualitative descriptive analysis, the population encompasses all child protection regulations and district court decisions across Indonesia, purposively sampling the Muara Teweh decision; instruments include primary documents (laws, rulings, Litmas reports) and secondary literature, analyzed descriptively through description, classification, and interpretation. Findings reveal procedural compliance (identity protection, legal assistance, Litmas) but substantive shortcomings due to a 3-month reduced prison sentence, with diversion hindered by the 7-year threat under Article 363 of the Criminal Code; the judge's ratio decidendi integrates juridical, factual, and philosophical considerations prioritizing the best interest of the child via LPKA guidance, recommending non-custodial alternatives and diversion threshold revisions.

Abstract

The development of financial technology (fintech) has changed consumption patterns in society, including among students. One popular innovation is the PayLater feature, which allows users to make transactions with delayed payment. However, this convenience may create legal and financial risks if it is not supported by adequate financial literacy and legal understanding. This study aims to analyze the role of legal education in improving students' financial literacy and in promoting the responsible use of PayLater services. The research uses a normative juridical method with a statutory approach by examining several regulations, including Law Number 8 of 1999 on Consumer Protection, the Electronic Information and Transactions Law, and Government Regulation on the Implementation of Electronic Systems and Transactions. The results show that legal education increases students’ awareness of their rights and obligations as digital consumers. Understanding PayLater regulations can also help prevent excessive consumption and misuse of digital services. Therefore, integrating legal education with financial literacy is important to foster a generation of young people who are legally aware and financially responsible in using digital financial services.
