Abstract

Tulisan ini dilatarbelakangi oleh adanya perbedaan pandangan dalam melihat kedudukan nilai moral dalam ilmu hukum. Permasalahan yang menarik dikaji adalah “bagaimanakah eksistensi nilai moral dalam ilmu hukum menurut optik paradigma Hukum Kodrat dan paradigma Positivisme? Hasil pembahasan menunjukkan bahwa aliran Hukum Kodrat melihat fakta dan nilai serta ilmu pengetahuan dan pertimbangan moral sangat berbeda dengan aliran Positivisme Hukum. Menurut optik aliran Hukum Kodrat, nilai-nilai moral memberikan ruh/jiwa bagi keabsahan norma hukum, sedangkan menurut optik aliran Positivisme Hukum, hukum harus dipisahkan dari moral, hukum tidak ada sangkut pautnya dengan moral. Simpulan artikel ini menegaskan bahwa untuk memahami eksistensi nilai moral dalam ilmu hukum sangat ditentukan oleh optik aliran hukum yang dipergunakannya.

Abstract

The phenomenon of inter-gang brawls among teenagers, particularly those involving children in Indonesia, has become a complex and serious social issue. This research provides an in-depth criminological analysis of the prevalence of these brawls, focusing on the digital era's role in shaping and accelerating the dynamics of this deviant behavior. The study identifies both internal and external causal factors. Internally, involved adolescents often experience an identity crisis, possess weak self-control, and struggle with environmental adjustment. Their inability to manage emotions and seek positive recognition pushes them to find outlets in deviant groups. Externally, unfavorable family environments and the influence of deviant peer groups are significant contributing factors. What distinguishes this modern phenomenon is the catalytic role of digital technology, especially social media. Platforms like Instagram and TikTok have become primary arenas for provocation, challenges, and coordination of brawls, even enabling live broadcasts that can influence other adolescents to participate. The lack of parental supervision over children's social media use exacerbates these negative impacts. To address this, a comprehensive approach is necessary, encompassing pre-emptive (early prevention), preventive (ongoing prevention), and repressive (law enforcement with rehabilitation) efforts. This approach involves families, schools, communities, and law enforcement agencies, with an emphasis on restorative justice for children in conflict with the law.

Abstract

Community Service Order an alternative sentencing aimed at reducing dependence on imprisonment while restoring social balance within the community. This study examines how the Community Service Order can represent the values of social justice as reflected in the fifth principle of Pancasila. The study analyzed the philosophical, juridical, and penological bases of Community Service Order as well as its legal implications within the framework of the 2023 Criminal Code. In this juridical-normative study, philosophical and penological approaches were used based on the analysis of legislation, legal literature, and the thoughts of criminal law experts. The results show that Community Service Order has the potential to balance community protection, victims' interests, and offender rehabilitation. In addition, this punishment reflects the values of distributive and corrective justice in line with the principles of social justice in Pancasila. Therefore, Community Service Order does not only function as an alternative sanction but also as a criminal policy instrument that supports the development of a more humane, restorative, and socially just Indonesian penal system.
