Abstract

This study examines the extent to which Islamic legal norms regard polygamy as a permissible marital practice, and how feminist legal perspectives assess such practice within the framework of gender equality and the protection of women’s rights. The research is directed by two principal legal questions: (1) What is the comparative analysis of polygamy under the Marriage Law when viewed from the standpoint of Islamic Law and Feminist Legal Theory? and (2) How is the concept of justice for women subjected to polygamous marriages assessed under Islamic Law and Feminist perspectives? This study employs a normative legal research design using a qualitative  descriptive analysis. Data were obtained through a literature-based method involving statutory materials, authoritative legal texts, scholarly works, and relevant academic articles. An analytical approach was adopted to interpret the meaning and scope of terms contained in legislative provisions, while data collection was conducted through comprehensive doctrinal and literature review to assemble all relevant legal information. The findings of this research demonstrate both differences and points of convergence between Islamic Law and Feminist perspectives regarding the legal and ethical status of polygamy. Under Islamic Law, polygamy is deemed permissible subject to strict substantive and procedural conditions, including the husband’s ability to uphold justice among his wives, both materially and emotionally. In practice, however, the failure to fulfil the principle of justice often results in discrimination and harm toward women. Conversely, from a Feminist perspective, polygamy is viewed as an inherently inequitable institution that reinforces patriarchal structures and places women in subordinate positions, socially, economically, and emotionally. Therefore, in order to achieve justice from both legal and gender-equality standpoints, a reinterpretation and reassessment of existing marital regulations is necessary to ensure greater responsiveness to gender justice and stronger protection of women’s rights.

Abstract

Kinerja guru dan tenaga kependidikan (tendik) merupakan faktor kunci dalam pencapaian mutu pendidikan di lingkungan yayasan pendidikan. Salah satu upaya strategis untuk meningkatkan kinerja tersebut adalah melalui penerapan proses rekrutmen, seleksi, dan pengelolaan kompetensi yang efektif. Penelitian ini bertujuan untuk memahami secara mendalam bagaimana praktik rekrutmen, seleksi, dan kompetensi berperan dalam membentuk kinerja guru dan tenaga kependidikan di Yayasan Al-Muhajirin Nikomas Gemilang. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus. Data dikumpulkan melalui wawancara mendalam, observasi, dan studi dokumentasi yang melibatkan pengelola yayasan, kepala sekolah, guru, dan tenaga kependidikan. Analisis data dilakukan dengan teknik reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa proses rekrutmen dan seleksi yang belum sepenuhnya berbasis kompetensi berdampak pada variasi kualitas kinerja guru dan tendik. Selain itu, kompetensi profesional, pedagogik, dan administratif sangat dipengaruhi oleh pengalaman kerja serta peluang pengembangan yang diberikan oleh yayasan. Penelitian ini menyimpulkan bahwa peningkatan kinerja guru dan tenaga kependidikan memerlukan sistem rekrutmen dan seleksi yang lebih terstruktur serta strategi pengembangan kompetensi yang berkelanjutan.

Abstract

This article examines the utilization of restorative justice as an alternative to misdemeanor crimes in the criminal justice system at the Police sector Purwareja Klampok level. The aim of this research is to analyze the effectiveness and challenges faced in implementing the principles of restorative justice to address criminal offenses at the Police sector level. This research adopts a normative juridical approach and utilizes both secondary and primary data sources. Secondary data is obtained through literature research, while primary data is gathered through observations and interviews, involving key stakeholders such as police officers, victims, offenders, and community members, to obtain a comprehensive understanding of the implementation of restorative justice in Police sector Purwareja Klampok. The findings of this study highlight the potential benefits of restorative justice in facilitating victim-offender reconciliation, involving the community, and promoting rehabilitation. Additionally, the research reveals limitations and barriers in the application of restorative justice, including limited resources, inadequate awareness and understanding among stakeholders, and the need for capacity development and training. Based on data analysis, this article provides recommendations to enhance the implementation of restorative justice at the Police sector Purwareja Klampok level. In conclusion, this research contributes to the existing literature on restorative justice by offering insights into its application as an alternative to misdemeanor crimes in the criminal justice system at the Police sector Purwareja Klampok level. The study emphasizes the importance of promoting a more balanced and comprehensive approach to justice that focuses on repairing harm, fostering accountability, and restoring social harmony within the community.
