Abstract

Penelitian ini mengkaji penegakan hukum lingkungan dari perspektif sosiologi hukum dengan menitikberatkan pada respons masyarakat terhadap kerusakan lingkungan akibat aktivitas industri pembukaan lahan jagung di wilayah Wawo. Penelitian menggunakan metode empiris dengan jenis penelitian yuridis sosiologis. Data diperoleh melalui wawancara mendalam, observasi lapangan, dan studi dokumen. Hasil penelitian menunjukkan bahwa pembukaan lahan dilakukan berdasarkan legalitas administratif, namun tetap menimbulkan dampak ekologis yang signifikan, seperti perubahan iklim mikro, krisis air bersih, dan peningkatan risiko banjir. Penegakan hukum lingkungan cenderung bersifat formalistik dan belum menyentuh perlindungan lingkungan secara substantif. Respons masyarakat menunjukkan sikap ambivalen antara kepentingan ekonomi dan kesadaran ekologis, di mana masyarakat lebih memilih strategi adaptasi dibandingkan tuntutan hukum. Penelitian ini menegaskan bahwa efektivitas penegakan hukum lingkungan dipengaruhi oleh struktur sosial, budaya hukum, dan ketergantungan ekonomi masyarakat, sehingga diperlukan pendekatan penegakan hukum yang lebih berkeadilan dan berkelanjutan.

Abstract

Tindakan main hakim sendiri (eigenrichting) merupakan fenomena sosial yang terus berulang dalam masyarakat Indonesia dan mencerminkan relasi problematis antara hukum, masyarakat, dan negara. Dalam perspektif sosiologi hukum, keberlanjutan praktik ini menunjukkan adanya pergeseran legitimasi sosial dari hukum formal menuju praktik sosial berbasis komunitas. Penelitian ini bertujuan untuk menganalisis konstruksi legitimasi sosial terhadap tindakan main hakim sendiri serta menjelaskan pengaruh lemahnya supremasi hukum terhadap penerimaan sosial atas praktik tersebut. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian yuridis sosiologis melalui kajian norma hukum, praktik sosial, dan literatur ilmiah yang relevan. Hasil penelitian menunjukkan bahwa tindakan main hakim sendiri tidak hanya dipahami sebagai pelanggaran hukum, tetapi juga sebagai praktik sosial yang memperoleh pembenaran moral dan penerimaan kolektif akibat rendahnya kepercayaan masyarakat terhadap penegakan hukum. Lemahnya supremasi hukum memperkuat legitimasi sosial terhadap kekerasan kolektif dengan mengurangi otoritas hukum formal. Oleh karena itu, penguatan supremasi hukum, peningkatan kesadaran hukum, penerapan keadilan restoratif, dan perbaikan komunikasi hukum menjadi langkah penting dalam menekan legitimasi sosial terhadap tindakan main hakim sendiri.

Abstract

This research stems from the academic problem of the limitations of the normative-dogmatic approach in criminal law, which tends to reduce the analysis of the crime of detention to merely fulfilling the elements of the crime, without elaborating on the perpetrator's motives and goals as complex social constructs. In fact, the dynamics of unlawful deprivation of liberty cannot be separated from power relations, opportunity structures, and individual rationality within a specific social context. This research aims to construct the motives and goals of perpetrators of the crime of detention through a synthesis of criminal law and modern realist criminological perspectives, specifically within the framework of Left Realism and Right Realism. The method used is library research with a normative-conceptual approach and theoretical analysis, through a systematic review of international criminal law and criminology literature. The results indicate that the perpetrator's motives reflect structural pressures and social dynamics, while the goals reflect a rational orientation in exploiting criminal opportunities. This theoretical synthesis produces a new construction model that expands the analysis of subjective elements in criminal law and provides academic and practical implications for the development of criminal policies that are more contextual, preventative, and responsive to the root causes of social problems.

Abstract

Restitution as a mechanism for restoring the rights of victims in juvenile criminal justice systems has garnered significant scholarly attention, yet its application in Indonesian legal practice remains inconsistent and theoretically underdeveloped. This study examines the ratio decidendi underlying judicial decisions that impose restitution in juvenile criminal cases, critically analyzed through the lens of restorative justice theory. Employing a normative juridical methodology complemented by a comparative approach, this research systematically analyzes a corpus of judicial decisions from Indonesian courts, relevant statutory frameworks, and international human rights instruments pertaining to child victims of crime. The findings reveal that Indonesian courts have yet to establish a coherent and uniform ratio decidendi in imposing restitution upon juvenile offenders; judicial reasoning is frequently characterized by discretionary and inconsistent application of legal principles, inadequate balancing of the punitive and rehabilitative imperatives, and insufficient consideration of the victim-centered dimensions of restorative justice. This study further demonstrates that the extant legislative architecture most notably Law Number 11 of 2012 on the Juvenile Criminal Justice System provides an enabling normative foundation for restorative-based restitution, yet systemic implementation gaps persist due to the absence of structured judicial guidelines, limited prosecutorial capacity, and underdeveloped victim support infrastructure. This article contributes to the academic discourse by formulating a comprehensive ratio decidendi framework specifically tailored for restitution in juvenile cases, integrating the principles of proportionality, rehabilitation, reparation, and victim participation. The study concludes with policy recommendations directed at legislators, the Supreme Court of Indonesia, and law enforcement institutions to strengthen the normative and practical framework for restorative restitution in the Indonesian juvenile justice system.

Abstract

This study examines the construction of the ratio decidendi and the significance of the dissenting opinion in the Constitutional Court Decision Number 15/PUU-XXIII/2025 which states that the prosecutor's immunity rights as regulated in Article 8 paragraph (5) of Law Number 11 of 2021 concerning the Prosecutor's Office of the Republic of Indonesia are conditionally unconstitutional. Through a juridical-normative approach with the decision analysis method, this study aims to describe the legal arguments that form the basis of the majority decision and analyze the contribution of the dissenting opinion delivered by Constitutional Justices Arief Hidayat and M. Guntur Hamzah in enriching the discourse of constitutional law. The results of the study indicate that the ratio decidendi of this decision is built on the basis of the principle of equality before the law as guaranteed by Article 27 paragraph (1) and Article 28D paragraph (1) of the 1945 Constitution of the Republic of Indonesia, which emphasizes that legal protection for prosecutors must not be transformed into absolute immunity. The Court constructed a conditional constitutional interpretation by providing exceptions in cases of red-handed arrest, sufficient preliminary evidence, or specific criminal offenses. Meanwhile, the dissenting opinion offered an alternative perspective, viewing the provision as a functional protection mechanism for prosecutors in carrying out their duties and authorities and as part of strengthening the principle of checks and balances in the judicial system. This study concludes that the dissenting opinion has strategic significance as a living document that can serve as a reference for future legal developments, while also demonstrating the deliberative dynamics in the Constitutional Court's decision-making as the guardian of the constitution.

Abstract

Perkembangan teknologi digital menimbulkan berbagai permasalahan dalam penegakan hukum di Indonesia, seperti meningkatnya kejahatan siber, keterbatasan regulasi yang adaptif, serta rendahnya kesiapan aparat penegak hukum dalam menghadapi pelanggaran hukum berbasis digital. Penelitian ini bertujuan untuk menganalisis dinamika hukum serta tantangan dan peluang penegakan hukum di era digital. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang- undangan, konseptual, dan analitis melalui kajian terhadap regulasi dan literatur hukum yang relevan. Hasil penelitian menunjukkan bahwa meskipun penegakan hukum di era digital menghadapi berbagai tantangan, digitalisasi sistem peradilan dan pemanfaatan teknologi informasi memberikan peluang strategis untuk meningkatkan efisiensi, transparansi, dan akuntabilitas. Sehingga diperlukan pembaruan regulasi dan peningkatan kapasitas aparat penegak hukum agar penegakan hukum di era digital dapat berjalan secara efektif dan berkeadilan.

Abstract

This research This study aims to analyze the role of civil law in resolving land disputes by emphasizing three main aspects: the construction of lawsuits, evidence, and the implications of court decisions. The focus of the study is directed at how these three aspects are interrelated in providing legal certainty while also ensuring substantive justice for the disputing parties. This article falls under qualitative library research. The methodology applied is a juridical-normative study by examining legislation, legal doctrines, and jurisprudence related to land disputes. The resolution of land disputes through civil law highlights the importance of lawsuit construction, evidence, and court decisions as interdependent stages. Clear lawsuits and consistent evidence serve as the basis for judges to balance legal formalism with substantive justice. Court decisions have broad implications, not only for the legal certainty of land ownership but also for public trust in the legal system and social stability.

Abstract

Through legal doctrinal research, this paper investigates the normative construction and philosophical foundations of integrating restorative justice in the Indonesian criminal justice system. This study uses legislative, comparative, and conceptual methods to assess the legal structure, consistency, and prospects for the implementation of the National Criminal Code (Law No. 1/2023) and the Criminal Procedure Law (Kitab Undang-Undang Hukum Acara Pidana/KUHAP). The results of the study show a fairly comprehensive normative framework with a strong philosophical foundation based on Pancasila, supported by constitutional clauses and customary law traditions. In particular, this study found that the paradigm transformation from retributive to restorative is reflected in the goal of punishment that emphasizes the restoration of social relationships, the reintegration of perpetrators, and the protection of victims. However, the effectiveness of implementation still faces challenges in the form of regulatory disharmony, limited capacity of law enforcement officials, and the lack of optimal monitoring and evaluation mechanisms for the implementation of restorative agreements. In addition, there are normative gaps related to loss recovery standards, protection of vulnerable groups, and integration of customary law in formal judicial practice. This condition shows that although conceptually restorative justice has acquired strong normative legitimacy, its implementation still requires institutional strengthening and policy harmonization. To ensure effective, equitable, and protection-oriented implementation of human rights, this study proposes a framework for the Pancasila-Based Integrated Restorative Justice System and offers legal policy recommendations that emphasize the integration of structural, substantial, cultural, and procedural dimensions in the national criminal justice system.

Abstract

Freedom of expression in public is a constitutional right and a fundamental right that occupies a central position in the building of a democratic rule of law. However, its implementation in Indonesia is still marked by tension between normative guarantees and widespread restrictive practices, especially since the public sphere shifted to the digital realm. This article aims to reinterpret the meaning of freedom of expression in public by weaving together three perspectives simultaneously: positive law, substantive democratic theory, and international human rights principles, an interdisciplinary approach rarely integrated in previous studies that tended to be partial to only one domain. This research uses a normative juridical method with a legislative approach, a conceptual approach, and a comparative approach to international human rights norms, supported by an examination of the latest Constitutional Court decisions and the policies of the National Human Rights Commission. The results of the study indicate that the Indonesian legal framework, starting from Article 28E paragraph (3) of the 1945 Constitution to Law Number 9 of 1998, has provided adequate textual guarantees, but the interpretation of the phrase limitation in various derivative regulations, especially the Electronic Information and Transactions Law, is still elastic and has the potential to be misused to silence legitimate criticism. The novelty of this research lies in the construction of a three-layer analytical framework, namely the constitutional layer, the deliberative democracy layer, and the international human rights limitation clause layer, which are used simultaneously to assess the legitimacy of each form of restriction on freedom of expression, in contrast to previous research which generally only highlights the criminal aspect or the human rights aspect separately. This article recommends a more precise reformulation of the norm of limitation, strengthening independent oversight of law enforcement in the digital space, and internalizing the Siracusa proportionality principle into Indonesian judicial practice as a strategic step to strengthen the consolidation of substantive democracy.
