Abstract

Meaningful participation in lawmaking can be understood as important input or suggestions to ensure the validity and relevance of legal products. The idea of meaningful participation emphasizes the importance of the community's role in the law-making process, especially in the formation of ideal local regulations (Perda) to support the implementation of regional autonomy. This research aims to examine the application and implications of meaningful participation in the formation of ideal local regulations, using a juridical-normative approach through three approaches: 1) statutory approach, by examining relevant regulations; 2) conceptual approach, by examining the values contained in the underlying legal concepts. This research uses primary, secondary, and tertiary legal materials to produce an ideal local regulation model in the implementation of regional autonomy. The results show that meaningful community participation is a crucial element in creating local policies that are inclusive, transparent, and responsive to community needs. The process of local regulation formation must substantially involve the community, expand public participation mechanisms, and increase transparency and the role of the legislature. Thus, meaningful participation will strengthen the legal and social legitimacy of regulations, and support the creation of democratic and accountable regional autonomy. The formation of ideal local regulations not only ensures the achievement of effective and transparent governance, but also strengthens public trust in local governments. Public participation is not just a procedure, but must be understood as the core of democracy that emphasizes the right of the people to be heard, considered, and explained for the decisions taken.

Abstract

This study examines the dialectic between legal positivism and substantive justice within the framework of the Pancasila legal state paradigm as an effort to find a balance between legal certainty and substantive justice. The background of this study stems from the hegemony of legal positivism in Indonesia, which emphasizes formal and procedural legality, often neglecting the aspect of substantive justice that is at the core of the Pancasila legal ideal. In practice, law tends to stop at normative certainty (law in books), without touching on the values of humanity and justice that exist in society (law in action). The urgency of this study lies in the need to reposition Pancasila as a grundnorm and ethical foundation to return the orientation of Indonesian law to substantive justice, not merely formal justice. The research method used is juridical-normative with a legal philosophy and conceptual hermeneutics approach, which interprets law as das sollen (what should be). The results of the study show that rigid legal positivism has created a gap between legal certainty and substantive justice. The Pancasila legal paradigm presents itself as an integrative model that unites legal certainty and moral justice, positioning law not merely as an instrument of power, but as an ethical and spiritual means to uphold civilized justice. Thus, the Pancasila legal state offers a philosophical foundation for harmonizing positive norms and substantive values of justice in the national legal system.

Abstract

This study is a philosophical examination of Surabaya District Court Decision Number 916/Pdt.P/2022/PN Sby through the approach of Transcendental Law and Maqāṣid al-Syarī‘ah. The issue of interfaith marriage in the context of Indonesian law reflects the epistemological tension between legal positivism and the divine values that exist in society. The absence of explicit norms regarding the legality of interfaith marriage has encouraged judges to interpret the law formalistically, thereby depriving the law of its ethical and spiritual dimensions. The urgency of this study lies in the pressing need to present a transcendental legal paradigm, namely a law that combines legal rationality with moral values, maqāṣid, and divine justice. This study uses a normative-philosophical legal approach through analysis of court decisions, Islamic legal doctrine, and the principles of modern and prophetic legal philosophy. The methods of analysis include descriptive, hermeneutic, and heuristic approaches to explore the transcendental meaning behind the legal arguments of the decisions. The novelty of this research lies in the formulation of an epistemological synthesis between transcendental law and maqāṣid al-sharī‘ah as an alternative paradigm in jurisprudential examination. The findings of this study show that the judges' considerations in this case are still trapped in procedural legalism, without regard to the principles of ḥifẓ al-dīn (protection of religion) and ḥifẓ al-nasl (protection of offspring), which are the basic objectives of Islamic law. Transcendental analysis reveals that law is not merely legally valid, but must achieve substantive justice that links legal certainty with moral and spiritual benefits. Thus, this study offers a conceptual model of “transcendental maqāṣid-based law” as a new direction for national legal reform based on Pancasila.

Abstract

This study aims to analyze the juridical aspects of the threshold provisions in the Pilkada by referring to the decision. The research method used is a normative research method with a case approach that focuses on analyzing the Constitutional Court Decision Number 60/PUUXXII/2024. The results of the analysis show that the Constitutional Court's decision provides a new interpretation of the threshold provisions, which has the potential to affect the constitutional rights of political parties and independent candidates in the Pilkada contestation. The implication of this decision is a significant change in the regional head nomination mechanism in Indonesia. The General Elections Commission (KPU) revised KPU Regulation Number 8 of 2024 to KPU Regulation Number 10 of 2024 to adjust the nomination regulations with democratic principles and applicable laws. Thus, this decision ensures the legality of regional head candidacy and increases the value of democracy in the 2024 simultaneous regional elections in Indonesia.

Abstract

The absence of term limits for legislative members has resulted in a pattern of power entrenchment, thus hampering the process of leadership regeneration and strengthening oligarchic tendencies within parliament. The absence of term limits in the Law of MD3 opens up space for power entrenchment, the formation of political dynasties, conflicts of interest, and a decline in the integrity of representation, reflected in the increasing constituency disconnect, the phenomenon of self-serving legislation, and the high number of legislative corruption cases. Therefore, a comprehensive design is needed to formulate a term limit model that aligns with the constitutional mandate. The study uses normative legal methods through legislative and conceptual approaches, examining the 1945 Constitution, the MD3 Law, the Election Law, Constitutional Court decisions, as well as the theories of constitutionalism, Habermas's deliberative democracy, and Madison's theory of power limitations. The analysis is conducted descriptively-analytical and interpretative-normative to build a cohesive legal argument. The results show that constitutionally, term limits can be justified as an integral part of the principle of power limitation and legal certainty; the current absence of norms has been shown to reduce the effectiveness of the representation function and open up opportunities for abuse of authority. From a leadership regeneration perspective, term limits increase the plurality of political actors, reduce incumbency advantage, and encourage policy innovation, while simultaneously breaking patronage networks that hamper oversight functions. Meanwhile, from a checks and balances perspective, term limits can strengthen the collegial independence of the House of Representatives (DPR) and increase the credibility of its oversight function over the executive, but they need to be designed proportionally to avoid creating an expertise gap or disrupting policy continuity. Overall, this study concludes that term limits for the DPR RI are not merely a restriction of political rights, but rather a constitutional necessity to strengthen the legitimacy of representation, improve the quality of public deliberation, and ensure a healthy balance of power in a presidential system. The most relevant policy models are a two-term limit with a re-entry gap, harmonization of election regulations and the position of the House of Representatives (DPR), and strengthening the capacity of parties and the legislative secretariat through a transitional approach and pilot policies before full national implementation.

Abstract

This research is motivated by the increasing problem of abandoned land and absentee land, which indicates the ineffective enforcement of the land regulatory framework despite the comprehensive formulation of normative frameworks such as the Basic Agrarian Law (UUPA), Government Regulation No. 20 of 2021, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency (BPN) No. 20 of 2021. Uncultivated land and agricultural land ownership by owners not domiciled in the area result in inefficient use of space, increase the risk of agrarian conflict, and reduce the social function of land, as seen in Jonggon Jaya Village. This research aims to analyze the effectiveness of land regulatory framework enforcement, identify legal and administrative factors that hinder the handling of abandoned land and absentee land, and formulate strategies and formulations for strengthening the legal framework that is more responsive to local agrarian dynamics. The method used was sociological juridical research, combining normative analysis of land regulations with empirical findings through interviews, field observations, and review of land administration documents. These were then analyzed using Lawrence M. Friedman's legal system theory (structure, substance, and legal culture). The research results indicated that weaknesses in law enforcement stem from weak institutional capacity, fragmentation of legal substance, the absence of objective parameters for determining abandoned land, and low community compliance with land management obligations. To address these issues, this study offered five innovative policy formulations: the formulation of the Integrated Land Utilization Index (IULT), the development of Conditional Management Rights, the implementation of an electronic domicile verification system (E-DOM), the establishment of a Local Land Activation Fund, and the implementation of digital, electronically proven administrative protocols. These findings emphasize that strengthening the land regulatory framework requires synergy between normative reform, modernization of the administrative system, and strengthening of the community's legal culture to achieve sustainable agrarian justice.

Abstract

Introduction: Indonesia, as a state governed by the rule of law, upholds equality before the law and the protection of human rights as fundamental principles. However, the rapid development of digital technology has created new challenges, particularly the emergence of electronic sexual violence, which has raised significant public concern. Although Law Number: 12 of 2022 regulates such crimes, judicial practice reveals sentencing disparities that undermine legal certainty and victim protection.Purposes of the Research: This study aims to analyze the causes of judicial sentencing disparities in cases of electronic sexual violence and examine their implications for law enforcement in Indonesia.Methods of the Research: The research employs a normative juridical method with a library research approach. Data were collected from primary legal materials such as statutory regulations, secondary legal materials including literature, doctrines, and previous studies, as well as tertiary legal materials such as legal dictionaries and encyclopedias.Findings of the Research: The findings indicate the existence of disparities in three court decisions that applied similar provisions but resulted in significantly different sentences. Factors contributing to these disparities include differences in judicial interpretation, the application of individualized sentencing principles, and non-juridical considerations. Such disparities have serious implications, including diminished legal certainty, reduced deterrence for offenders, weakened victim protection, and declining public trust in the judiciary. Therefore, the establishment of consistent, transparent, and victim-oriented sentencing guidelines is essential to ensure substantive justice in Indonesia’s criminal justice system.

Abstract

Era disrupsi yang ditandai oleh kemajuan teknologi digital dan perubahan sosial-ekonomi telah menimbulkan krisis moral dalam sistem hukum, di mana hukum sering kehilangan orientasi etiknya dan terjebak dalam formalisme positivistik. Kondisi ini menunjukkan urgensi perlunya fondasi moral baru bagi hukum yang tidak hanya sah secara formal, tetapi juga adil secara substantif. Penelitian ini bertujuan untuk mengkaji peran hukum kodrat sebagai dasar moral dalam merespons krisis hukum kontemporer di Indonesia. Metode penelitian yang digunakan adalah pendekatan normatif-filosofis dengan spesifikasi deskriptif-analitis, melalui studi kepustakaan terhadap berbagai literatur hukum dan filsafat. Kebaruan penelitian ini terletak pada upaya mengaktualisasikan prinsip-prinsip hukum kodrat seperti keadilan, akal budi, dan kebaikan umum dalam sistem hukum nasional sebagai respons terhadap krisis nilai di era disrupsi. Hasil penelitian menunjukkan bahwa hukum kodrat mampu menjadi kerangka konseptual yang mengintegrasikan moralitas dan legalitas, serta menuntun hukum positif agar tidak kehilangan legitimasi etiknya. Penerapan nilai-nilai hukum kodrat dalam pembentukan, penegakan, dan pendidikan hukum di Indonesia diyakini dapat memperkuat integritas moral hukum dan mewujudkan tatanan hukum yang berkeadilan, bermartabat, dan berorientasi pada kemaslahatan umum.
