Abstract

The absence of term limits for legislative members has resulted in a pattern of power entrenchment, thus hampering the process of leadership regeneration and strengthening oligarchic tendencies within parliament. The absence of term limits in the Law of MD3 opens up space for power entrenchment, the formation of political dynasties, conflicts of interest, and a decline in the integrity of representation, reflected in the increasing constituency disconnect, the phenomenon of self-serving legislation, and the high number of legislative corruption cases. Therefore, a comprehensive design is needed to formulate a term limit model that aligns with the constitutional mandate. The study uses normative legal methods through legislative and conceptual approaches, examining the 1945 Constitution, the MD3 Law, the Election Law, Constitutional Court decisions, as well as the theories of constitutionalism, Habermas's deliberative democracy, and Madison's theory of power limitations. The analysis is conducted descriptively-analytical and interpretative-normative to build a cohesive legal argument. The results show that constitutionally, term limits can be justified as an integral part of the principle of power limitation and legal certainty; the current absence of norms has been shown to reduce the effectiveness of the representation function and open up opportunities for abuse of authority. From a leadership regeneration perspective, term limits increase the plurality of political actors, reduce incumbency advantage, and encourage policy innovation, while simultaneously breaking patronage networks that hamper oversight functions. Meanwhile, from a checks and balances perspective, term limits can strengthen the collegial independence of the House of Representatives (DPR) and increase the credibility of its oversight function over the executive, but they need to be designed proportionally to avoid creating an expertise gap or disrupting policy continuity.

Abstract

This research is motivated by the increasing problem of abandoned land and absentee land, which indicates the ineffective enforcement of the land regulatory framework despite the comprehensive formulation of normative frameworks such as the Basic Agrarian Law (UUPA), Government Regulation No. 20 of 2021, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency (BPN) No. 20 of 2021. Uncultivated land and agricultural land ownership by owners not domiciled in the area result in inefficient use of space, increase the risk of agrarian conflict, and reduce the social function of land, as seen in Jonggon Jaya Village. This research aims to analyze the effectiveness of land regulatory framework enforcement, identify legal and administrative factors that hinder the handling of abandoned land and absentee land, and formulate strategies and formulations for strengthening the legal framework that is more responsive to local agrarian dynamics. The method used was sociological juridical research, combining normative analysis of land regulations with empirical findings through interviews, field observations, and review of land administration documents. These were then analyzed using Lawrence M. Friedman's legal system theory (structure, substance, and legal culture). The research results indicated that weaknesses in law enforcement stem from weak institutional capacity, fragmentation of legal substance, the absence of objective parameters for determining abandoned land, and low community compliance with land management obligations. To address these issues, this study offered five innovative policy formulations: the formulation of the Integrated Land Utilization Index (IULT), the development of Conditional Management Rights, the implementation of an electronic domicile verification system (E-DOM), the establishment of a Local Land Activation Fund, and the implementation of digital, electronically proven administrative protocols. These findings emphasize that strengthening the land regulatory framework requires synergy between normative reform, modernization of the administrative system, and strengthening of the community's legal culture to achieve sustainable agrarian justice.

Abstract

Introduction: Indonesia, as a state governed by the rule of law, upholds equality before the law and the protection of human rights as fundamental principles. However, the rapid development of digital technology has created new challenges, particularly the emergence of electronic sexual violence, which has raised significant public concern. Although Law Number: 12 of 2022 regulates such crimes, judicial practice reveals sentencing disparities that undermine legal certainty and victim protection.Purposes of the Research: This study aims to analyze the causes of judicial sentencing disparities in cases of electronic sexual violence and examine their implications for law enforcement in Indonesia.Methods of the Research: The research employs a normative juridical method with a library research approach. Data were collected from primary legal materials such as statutory regulations, secondary legal materials including literature, doctrines, and previous studies, as well as tertiary legal materials such as legal dictionaries and encyclopedias.Findings of the Research: The findings indicate the existence of disparities in three court decisions that applied similar provisions but resulted in significantly different sentences. Factors contributing to these disparities include differences in judicial interpretation, the application of individualized sentencing principles, and non-juridical considerations. Such disparities have serious implications, including diminished legal certainty, reduced deterrence for offenders, weakened victim protection, and declining public trust in the judiciary. Therefore, the establishment of consistent, transparent, and victim-oriented sentencing guidelines is essential to ensure substantive justice in Indonesia’s criminal justice system.

Abstract

Era disrupsi yang ditandai oleh kemajuan teknologi digital dan perubahan sosial-ekonomi telah menimbulkan krisis moral dalam sistem hukum, di mana hukum sering kehilangan orientasi etiknya dan terjebak dalam formalisme positivistik. Kondisi ini menunjukkan urgensi perlunya fondasi moral baru bagi hukum yang tidak hanya sah secara formal, tetapi juga adil secara substantif. Penelitian ini bertujuan untuk mengkaji peran hukum kodrat sebagai dasar moral dalam merespons krisis hukum kontemporer di Indonesia. Metode penelitian yang digunakan adalah pendekatan normatif-filosofis dengan spesifikasi deskriptif-analitis, melalui studi kepustakaan terhadap berbagai literatur hukum dan filsafat. Kebaruan penelitian ini terletak pada upaya mengaktualisasikan prinsip-prinsip hukum kodrat seperti keadilan, akal budi, dan kebaikan umum dalam sistem hukum nasional sebagai respons terhadap krisis nilai di era disrupsi. Hasil penelitian menunjukkan bahwa hukum kodrat mampu menjadi kerangka konseptual yang mengintegrasikan moralitas dan legalitas, serta menuntun hukum positif agar tidak kehilangan legitimasi etiknya. Penerapan nilai-nilai hukum kodrat dalam pembentukan, penegakan, dan pendidikan hukum di Indonesia diyakini dapat memperkuat integritas moral hukum dan mewujudkan tatanan hukum yang berkeadilan, bermartabat, dan berorientasi pada kemaslahatan umum.

Abstract

The Indonesian Constitutional Court Decision Number 135/PUU-XXI/2024 marks a fundamental change in Indonesia's constitutional and electoral law system by annulling the application of the full concurrent elections concept which combines the National General Election (Pemilu) and the Regional Head Election (Pilkada)—as regulated in Law Number 7 of 2017 concerning General Elections. The Court determined that the unification of national and local election schedules contradicts the principle of regional autonomy (otonomi daerah) and blurs the meaning of popular sovereignty at the local level as guaranteed by Article 18 of the 1945 Constitution (UUD 1945). Through this ruling, the Court ordered that Pilkada must be held separately from the national Pemilu, issuing a conditionally constitutional verdict that reinterprets Article 201 of the Election Law to prevent a legal vacuum (rechtsvacuum). This research utilizes a normative juridical approach with descriptive and conceptual analysis methods, through a review of relevant laws and regulations, Constitutional Court decisions, and academic literature. The analysis results indicate that the Court’s considerations encompass three main dimensions: (1) Philosophical, relating to the protection of popular sovereignty in the regions; (2) Sociological, concerning the workload of election organizers and the validity of election results; and (3) Juridical, regarding the balance between efficiency and the principle of substantive democracy. The juridical implications of this decision include a change in the electoral system from full concurrent to separated elections, the need for legal harmonization between the Election Law and its implementing regulations, and the formation of a new political cycle (year “X” for the National Pemilu and “X+2” for the National Simultaneous Pilkada). From the regional autonomy perspective, the separation of election timing positively impacts the strengthening of local political identity, increased space for the articulation of regional aspirations, and the opening of opportunities for regional head candidates from smaller or independent parties. Conversely, new challenges also arise, such as increased political and budgetary costs, the potential for political transactions in the nomination process, and policy fragmentation between the central and regional governments. Overall, Constitutional Court Decision No. 135/PUU-XXI/2024 not only affects the technical aspects of election administration but also reconstructs the relationship between the central and regional governments within the context of Indonesia's constitutional democracy. This decision serves as a crucial momentum for lawmakers to rearrange the concurrent election system to better align with the principles of regional autonomy, electoral justice, and government effectiveness.

Abstract

Restrictions on freedom of religion within Indonesia’s legal system continue to generate normative and practical debates, particularly due to regulatory practices that tend to be repressive and discriminatory toward certain religious groups. This situation reflects an ongoing tension between the protection of fundamental rights and the state’s interest in maintaining social order. This study aims to analyze freedom of religion in Indonesia from a utilitarian perspective, specifically through John Stuart Mill’s harm principle, and to propose a legal reformulation oriented toward justice and the promotion of the common good. The research employs a normative legal method using philosophical and conceptual approaches, drawing on statutory regulations, legal doctrines, and utilitarian legal philosophy. The findings indicate that current restrictions on religious freedom in Indonesia are inconsistent with utilitarian principles, as they often undermine the greatest happiness of those affected without clear evidence of actual harm to society at large. The proposed legal reform includes revising discriminatory regulations, simplifying the licensing procedures for houses of worship in a non-discriminatory manner, and accelerating the establishment of a National Regulatory Body as a mechanism for legal harmonization. The application of the harm principle in public policymaking has significant implications for strengthening the protection of religious freedom, balancing individual liberty with social order, and fostering a more just and welfare-oriented legal system.

Abstract

Pesatnya transformasi digital telah memunculkan pacing problem, yakni kondisi ketika perkembangan teknologi berlangsung jauh lebih cepat dibandingkan kemampuan hukum untuk beradaptasi. Fenomena ini berdampak signifikan pada proses pembentukan peraturan perundang-undangan, khususnya terkait mekanisme partisipasi publik yang semakin terdigitalisasi. Penelitian ini bertujuan untuk menganalisis validitas konstitusional partisipasi publik digital dalam proses legislasi serta urgensi pengembangan model legislasi adaptif di Indonesia. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan. Fokus kajian diarahkan pada Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan serta Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 yang menegaskan pentingnya meaningful participation dalam pembentukan undang-undang. Hasil penelitian menunjukkan bahwa praktik partisipasi publik berbasis digital yang saat ini diterapkan masih bersifat prosedural dan rentan terjebak pada fenomena click-activism, di mana keterlibatan publik hanya diukur dari kuantitas interaksi tanpa jaminan kualitas deliberasi. Ketiadaan mekanisme verifikasi identitas yang memadai serta tidak adanya kewajiban pemberian umpan balik dari pembentuk undang-undang menyebabkan hak publik untuk didengar, dipertimbangkan, dan memperoleh penjelasan tidak terpenuhi secara optimal. Selain itu, struktur hierarki peraturan perundang-undangan yang kaku turut menciptakan Collingridge Dilemma, yang menghambat kemampuan hukum untuk merespons inovasi teknologi secara tepat waktu. Penelitian ini menyimpulkan bahwa digitalisasi proses legislasi tidak boleh berhenti pada aspek prosedural semata, melainkan harus diarahkan pada pemenuhan substansi demokrasi konstitusional. Oleh karena itu, artikel ini merekomendasikan pelembagaan konsep Regulatory Sandbox dalam sistem hukum nasional serta revisi ketentuan partisipasi publik agar mencakup mekanisme umpan balik terverifikasi yang bersifat wajib, guna memastikan hukum tetap adaptif, responsif, dan demokratis di era digital.

Abstract

Penelitian ini membahas Putusan Mahkamah Konstitusi Nomor 24/PUU-XXII/2024 yang memberikan pembaruan hukum terhadap praktik beracara di Peradilan Tata Usaha Negara (PTUN) serta mengkaji implikasi tidak dibatasinya kewenangan Peninjauan Kembali (PK) oleh pejabat atau badan TUN terhadap perlindungan hak konstitusional warga negara. Permasalahan muncul karena pejabat atau badan TUN tidak memiliki batasan kewenangan dalam mengajukan PK, yang menimbulkan ketimpangan kedudukan hukum, hilangnya asas kepastian hukum bagi pemohon, dan potensi penyalahgunaan instrumen hukum oleh pemerintah. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan kasus, berfokus pada analisis Putusan Mahkamah Konstitusi tersebut. Hasil penelitian menunjukkan bahwa Mahkamah Konstitusi telah mengoreksi Pasal 132 ayat (1) UU PTUN dengan menegaskan pejabat atau badan TUN tidak lagi berwenang mengajukan PK. Pembatasan ini memperkuat finalitas putusan, asas keadilan, serta mencegah penyalahgunaan PK untuk menunda eksekusi putusan inkracht.

Abstract

Berdasarkan hasil penelitian mengenai penegakan hukum pidana terhadap pelaku pelecehan seksual dengan gangguan fetisisme, dapat disimpulkan bahwa permasalahannya terletak pada penafsiran hukum dalam kasus kejahatan kesusilaan, khususnya yang berkaitan dengan gangguan fetisisme, yang belum diatur secara jelas dalam peraturan perundang-undangan. Poin utama meliputi ketiadaan definisi komprehensif dalam hukum, pentingnya penafsiran hukum yang tepat oleh hakim untuk mencapai keadilan substantif, konsep hukum progresif yang menekankan adaptasi terhadap perkembangan masyarakat, serta tantangan dalam mewujudkan keadilan substantif dalam penegakan hukum. Rekomendasi yang diajukan mencakup perlunya revisi hukum agar dapat lebih mengakomodasi kasus-kasus kompleks seperti ini. Penelitian ini juga menunjukkan bahwa gangguan fetisisme, sebagaimana dijelaskan dalam DSM-5, menyoroti kompleksitas dalam menangani kasus kejahatan seksual yang melibatkan hasrat terhadap objek atau bagian tubuh yang umumnya tidak bersifat erotis. Rekomendasi untuk mengatasi ambiguitas hukum termasuk revisi KUHP atau Undang-Undang Tindak Pidana Kekerasan Seksual (UU TPKS) untuk memastikan perlindungan hukum yang memadai terhadap pelecehan seksual yang dilakukan oleh individu dengan gangguan fetisisme di Indonesia.

Abstract

Proses pengadaan tanah untuk kepentingan umum memegang peranan penting dalam menunjang pelaksanaan pembangunan nasional, termasuk di Kecamatan Muara Bengkal. Penelitian ini bertujuan untuk mengkaji sejauh mana pelaksanaan pengadaan tanah di wilayah tersebut telah sesuai dengan ketentuan Undang-Undang Nomor 2 Tahun 2012 tentang Pengadaan Tanah bagi Pembangunan untuk Kepentingan Umum. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif, melalui analisis terhadap regulasi yang berlaku dan kondisi riil di lapangan. Temuan penelitian mengindikasikan bahwa secara umum, pelaksanaan pengadaan tanah telah mengikuti kerangka hukum yang ada, namun masih dijumpai sejumlah kendala seperti minimnya pemahaman masyarakat mengenai hak-haknya, permasalahan administratif, dan keterlambatan dalam pemberian kompensasi. Oleh karena itu, dibutuhkan peningkatan sinergi antar instansi terkait serta penyuluhan hukum yang berkelanjutan kepada masyarakat guna menjamin pengadaan tanah berlangsung secara adil dan sesuai dengan prinsip kepastian hukum.
