Abstract

Until now, there is still no authority of the Constitutional Court to examine constitutional complaint cases, even though at least 30 (thirty) cases are declared unacceptable because the substance of the petition is constitutional complaint. In several countries, constitutional complaint has become one of the powers of the Constitutional Court as a legal remedy that citizens can take if there is a violation of their constitutional rights, such as in Germany and South Korea. Based on this background, the formulation of the problem in this is first, what is the urgency of adding constitutional complaint as the authority of the Constitutional Court of the Republic of Indonesia? Second, how is the legal construction of the implementation of constitutional complaint in Indonesia? This research is legal research with a statutory, conceptual, and comparative approach. This research will describe first, the urgency of adding constitutional complaint as the authority of the Constitutional Court of the Republic of Indonesia and second, the legal construction of the application of constitutional complaint in Indonesia by comparing the arrangement and implementation of constitutional complaint in other countries, namely Germany and South Korea.

Abstract

Street art is a work of art on the streets, which is usually in the form of graffiti or murals. Street art is generally made on other people's property without permission. This is what raises the problem of copyright protection and ownership of street art because there is a conflict between copyright and property rights and making street art without permission is a form of vandalism. Therefore, there is still debate about copyright protection for street art and there is still legal dualism in this regard. This paper aims, firstly to provide an analysis regarding copyright protection for illegal street art and secondly to analyze the ownership of street art attached to the property of other people. The research method of this paper is normative using statutory, comparative, case, and conceptual approaches. The results of this article are first, even though street art is an illegal act because it is vandalism, there is still copyright protection in it. Second, even though it is related to copyright ownership of street art, it remains with the Street Art Artists because it is their copyright, but the property rights of the owner of the property must also be protected.

Abstract

The Constitutional Court carrying out its duties regarding the constitutional review acts as a negative legislator which canceling laws that are contrary to the 1945 Constitution. This study examines the political shift of constitutional review law where the Constitutional Court only acts as a negative legislator, but nowadays Constitutional Court acts as a positive legislator. The research method used is normative research. The results of this study conclude that the Constitutional Court Ruling reflects the role of a positive legislator is a progressive and responsive decision to avoid legal chaos due to legal vacuum in society. However, it does not mean that the decision of the Constitutional Court can always be a positive legislator. Only in circumstances based on 3 (three) indicators, namely: a) Justice and benefit of the community; b) An urgent situation; c) Filling out legal vacancies (rechtvacuum) to avoid chaos or legal chaos in the community, then the Constitutional Court Decision can be a positive legislator so that there is still a balance in the check and balances system. Keywords: Constitutional Review, Positive Legislator, Negative Legislator

Abstract

This article aims to analyze the juridical implications of not registering marriages for legal protection for the community, because the existence of the PKDRT Law has not been fully able to guarantee legal protection. The writing method used is juridical-normative using a reform-oriented research typology, namely evaluating applicable rules by providing recommendations on these rules. This study concludes that there is a blurring of legal subjects that can be protected in the PKDRT Law due to differences of opinion regarding the validity of marriage based on the provisions in Article 2 of the Marriage Law. Moreover, there are differences in judges’ views on the validity of a marriage which are not recorded in several decisions of cases of domestic violence causing legal uncertainty. However, there is still an alternative for self-protection for victims of domestic violence whose marriages have not been registered, namely using the articles in the Criminal Code.

Abstract

Terdapat badan hukum baru, yaitu Badan Usaha Milik Desa (BUM Desa) yang didirikan unuksebesar-besarnya kesejahteraan masyarakat desa. Salah satu pemanfaatan terhadap BUM Desa ini adalah pemanfaatan energi terbarukan terhadap kegiatan BUM Desa ini, tetapi ternyata UU 30/2007 yang dikenal hanyalah desa, bukan BUM Desa, sehingga berarti ada kekosongan hukum terkait hal ini. Adapun rumusan masalah di dalam artikel ini pertama, ratio legis pemanfaatan energi bersih oleh BUM Desa dan kedua formulasi pengaturan pemanfaatan energi bersih oleh BUM Desa. Metode penelitian di dalam artikel ini adalah penelitian hukum (legal research).Adapun hasil artikel ini, pertama, Ratio legis pemanfaatan energi bersih oleh BUM Desa adalah agar dapat digunakannya energi bersih oleh desa secara efektif dan efisien, mengingat, desa menjadi ujung tombak pembangunan masyarakat pada level akar rumput, yang notabene dengan digunakannya energi terbarukan dari tingkat desa, sehingga desa menjadi desa mandiri energi akan menyebabkan efek domino ke kabupaten, kota, provinsi, bahkan menuju pengunaan mandiri energi secara nasional. Kedua, dalam membuat formulasi pengaturan pemanfaatan energi bersih oleh BUM Desa, maka ada 6 (enam) hal yang harus diperhatikan, yaitu Bentuk pengaturan, klasifikasi energi bersih,  kriteria BUM Desa, insentif, pengawasan, dan sanksi.

Abstract

Permasalahan sengketa konsumen e-commerce salah satunya berkaitan tidak dipenuhinya janji oleh pelaku usaha, dan tercermin dalam Pasal 8 huruf f, Pasal 9 huruf k, Pasal 13 ayat (1), dan Pasal 16 UU 8/1999.  Pada umumnya tidak dipenuhinya janji oleh pelaku usaha, dapat dikategorikan sebagai wanprestasi. Tetapi, dalam Pasal 62 UU 8/1999 terdapat pengaturan khusus sebagai perlindungan konsumen, yang memuat adanya sanksi pidana. Hal demikian menyebabkan permasalahan berupa kekaburan hukum upaya hukum perdata yang dapat dilakukan, dan kekosongan hukum terkait tata urutan prosedur hukum yang dapat digunakan secara sistematis. Rumusan masalah di dalam artikel ini pertama, karakteristik penyelesaian sengketa konsumen e-commerce terkait tidak dipenuhinya janji oleh pelaku usaha, dan kedua formulasi penyelesaian sengketa konsumen e-commerce yang sistematis terkait tidak dipenuhinya janji oleh pelaku usaha. Metode penelitian di dalam artikel ini adalah penelitian hukum (legal research), dengan pendekatan perundang-undangan dan pendekatan konseptual. Adapun sumber data yang digunakan adalah data sekunder dengan bahan hukum primer berupa peraturan perundang-undangan dan bahan hukum sekunder berupa buku, jurnal, hasil penelitian, dan pendapat ahli yang berkaitan dengan fokus artikel ini. Hasil temuan artikel ini adalah pertama, karakteristik penyelesaian sengketa konsumen e-commerce terkait tidak dipenuhinya janji oleh pelaku usaha dapat dilakukan dengan penyelesaian sengketa secara non-litigasi yakni melalui Badan Penyelesaian Sengketa Konsumen (BPSK), serta secara litigasi, melalui upaya hukum pidana, maupun upaya hukum perdata, berupa gugatan perbuatan melanggar hukum. Kedua, formulasi penyelesaian sengketa konsumen e-commerce yang sistematis terkait tidak dipenuhinya janji oleh pelaku usaha dalam konstruksi ius constituendum adalah wajib melalui mekanisme penyelesaian sengketa alternatif, yaitu BPSK, baru kemudian dapat melalui mekanisme litigasi, baik perdata atau pidana, tetapi sebaiknya menggunakan mekanisme pidana terlebih dahulu agar putusan pidana yang berkekuatan hukum tetap dapat digunakan sebagai alat bukti surat yang sempurna dalam gugatan perbuatan melanggar hukum yang dilakukan oleh pelaku usaha.

Abstract

The development and industrialization of the new capital city "Nusantara" which aims to realize equitable development, has an impact on reducing forest and marine sustainability, related to environmental rights and rights to the environment as mandated in Article 28H of The 1945 Constitution. In addition, this development also threatens national defense because the archipelago is adjacent to international borders, thus triggering territorial disputes between countries. The research uses normative legal research methods with the statute and conceptual approach. This research purposed to analyze the preservation of forests and seas, security, and defense as a result of the development and industrialization of the new capital city "Nusantara" based on the Sustainable Development Goals (SDGs). The result showed that implementing the development and automation of the new capital city "Nusantara" must pay attention to the values of Pancasila and the 1945 Constitution. In addition, the management and conservation of forests and seas need to refer to the 15th SDGs goal and the 16th SDG related to defense. and national security.

Abstract

Children hold a very important role in the development of a country. However, children are generally vulnerable; hence, protecting and ensuring children's rights must be a priority. One example of a condition where children’s rights are put at risk is when a child's residence becomes the object of a joint property lawsuit. In this case, the principle of the best interests of the child needs to be the main consideration in all matters of decision. This study aims to determine the characteristics of the best interests of the child principle in Islamic law and analyze the formulation of the judge's decision regarding the position of the child's residence, which is the object of a joint property lawsuit. This research is normative legal research, using primary and secondary legal materials. The result of this research shows that the principle of the best interests of the child initiated at the Convention on the Rights of the Child has become an important consideration in various laws and regulations in Indonesia, including the Compilation of Islamic Law to the Supreme Court Circular Letter (Surat Edaran Mahkamah Agung, SEMA). As an important principle to be applied in the joint property lawsuit, this study provides three views of the judge's decision formulation, namely: 1) The lawsuit is admissible as there is no explicit norm; 2) It is inadmissible as it is waiting for the child to enter adult age; and 3) It is admissible; however, the distribution is postponed till the child enters adult age. Through this study, the author agreed that the lawsuit is admissible by postponing the distribution until the child reaches adulthood. However, there needs to be some refinement regarding the position of SEMA and the clarity of adult age.

This article aims to analyze the systematic legal framework in terms of law enforcement against alleged defamation through electronic media. law enforcement in the event of alleged defamation through electronic media against a Limited Liability Company, considering that in the event of defamation against a Limited Liability Company, there are generally 2 (two) legal remedies that can be used. Abstract

Globalization, accompanied by advancements in science and technology, has increased the usage of social media in Indonesia. Currently, social media accounts serve not only as platforms for interaction but also as potential sources of significant economic value. Moreover, regulations concerning the inheritance of social media accounts remain unclear and vary across platforms. The research methodology employed utilizes the normative juridical method, incorporating conceptual and case approaches. This study involves analysis of laws, court decisions, and social media platform policies. The research findings indicate that an extensive interpretation of inheritance in civil law, by considering their economic value, encompasses social media accounts. However, the implementation of social media account inheritance encounters various obstacles, including inconsistent platform policies. Some platforms have facilitated account preservation as memorials, but clarity regarding access to content or account management is lacking. Concerns persist regarding legal protection for heirs concerning social media accounts as inheritance. In the context of Civil Law, clear legal protection is necessary to ensure that heirs' rights are fulfilled, especially in acquiring economic benefits from inherited social media accounts. Furthermore, this paper underscores the necessity for clearer regulations within Civil Law concerning the inheritance of social media accounts. Strong legal protection is required to ensure justice for heirs and facilitate the effective and efficient resolution of digital legacy.
