Abstract

This article aims to answer what is the scope of pretrial in statutory regulations and whether expiration can be used as an excuse to file a pretrial lawsuit. By using legal research methods through statutory, conceptual, and case-based approaches, this article concludes that the absence of a clear categorization regarding the formal and material aspects of the expiration case creates a dilemma. In its development, expiration has begun to be recognized as a formal reason which incidentally does not touch the subject matter of the case, an thus can be used as a pretrial excuse. This can be seen in the Pre-trial Decision Number: 143/Pid.Prap/2016/PN.Jkt.Sel. Ultimately, this article suggests the need for a clear regulation in the Perma regarding the categorization of formal and material aspects in pretrial hearings.

Abstract

The Indonesian Trade Secrets Law Number 30/2000 (ITS Law) postulates exemptions for acts that are not considered infringements to protect trade secrets. One of them is the reverse engineering of other people’s trade secrets. The problem is that the ITS Law does not limit the extent to which reverse engineering can be justified. The absence of these limitations also allows attempts to disclose trade secrets under the pretext of reverse engineering. This problem ultimately results in the absence of legal certainty for the protection against trade secret disclosure, which is the sole responsibility of the trade secret owner. This article aims to re-analyze the protection provided by the ITS Law and examine the extent to which the limitations on reverse engineering can be justified in the ITS Law. This article used normative juridical research methods combined with statutory, conceptual, and case approaches. It revealed a paradox in the protection of trade secrets against the possibility of trade secret disclosure. This article concluded that changes are necessary to the ITS Law, specifically by adjusting to the basic principles of IPR protection, limiting the extent to which the reverse engineering of other people’s trade secrets can be justified, and adding a “Good Faith” clause in performing reverse engineering actions.

Abstract

In the futuristic era, transportation is one of the essential necessities for society. The dynamism of urban and rural life makes all groups of people need adequate and usable accommodation in general. However, land transportation infrastructure in Indonesia is not maximally available so it requires a lot of development. The construction of transportation infrastructure requires enormous costs, so the solution that can be used is to use a financing scheme. One of the simpler financing schemes is direct lending. The purpose of this research are to explain two main topics. First, is to analyze the legal relation of the parties in providing direct lending to finance transportation infrastructure. Second, is to determine the legal remedies that the government can take when the borrowers default on lending to finance transportation infrastructure. The type of research used is doctrinal legal research so as to produce a clear and detailed legal analysis regarding direct lending to finance land transportation infrastructure. When a borrower, who has been bound in an agreement with a lender, breach of contract, the borrower can be subject to two options of legal remedies.

Abstract

The development and industrialization of the new capital city "Nusantara" which aims to realize equitable development, has an impact on reducing forest and marine sustainability, related to environmental rights and rights to the environment as mandated in Article 28H of The 1945 Constitution. In addition, this development also threatens national defense because the archipelago is adjacent to international borders, thus triggering territorial disputes between countries. The research uses normative legal research methods with the statute and conceptual approach. This research purposed to analyze the preservation of forests and seas, security, and defense as a result of the development and industrialization of the new capital city "Nusantara" based on the Sustainable Development Goals (SDGs). The result showed that implementing the development and automation of the new capital city "Nusantara" must pay attention to the values of Pancasila and the 1945 Constitution. In addition, the management and conservation of forests and seas need to refer to the 15th SDGs goal and the 16th SDG related to defense. and national security.

Abstract

This study aims to analyze the construction of the cancellation of the land purchase agreement and legal protection for the seller in land purchases before the custody. The study used statute, case, and conceptual approaches. It focuses on the concept of custody and good faith. After analyzing the relevant legal sources, it is known that, on the one hand, Article 447 of the Indonesian Civil Code allows for the retroactive application of the custody in some conditions: (1) the custody is due to unwise, mental disorder, and irrational; and (2) the reasons underlying the custody had existed at the time the legal action is taken. The implementation of Article 447 can cancel land purchases made before the custody. On the other hand, the state must protect the buyer’s principle of good faith even though the seller is an unauthorized person. Article 447 must be applied because (1) the Indonesian Civil Code is a positive law that must be enforced; (2) people who are placed under custody are more at risk of experiencing losses in land purchases, and (3) construction of good faith land buyers cannot be applied because there are fewer parties.DOI: https://doi.org/10.22304/pjih.v9n2.a6

Abstract

Public service is a series of actions carried out in order to meet the service needs of each citizen. In the department of corrections, public service arrangements also hold an essential element in creating a quality environment. It is on the reason that prisoners as god's creatures are also entitled to proper service as is guaranteed by article 34 verses (3) of Constitution 1945. On the other hand, in implementing abovementioned, service in correctional service is not actually implemented properly. This is due to many factors, such as shortage of prison officers, overcrowded prison, and other factors.  Based on abovementioned, the author formulated 2 (two) legal problems: a) the prisoner's right to good public service under the Correctional Service Act; and b) AUPB applications upon service arrangements in the penitentiary. The method of research is legal research. It is concluded that: a) eventhough a convict has committed an offense, the state has to ensure he gets proper service during his time; b) Public service officers in prison should always refer its conduct to the General Principles of Good Governance such as impartiality, good service, and principle to not commit abuse of power. Abstract

From time to time, it is considered that Constitutional Amendments are lack of public participation and contains political aspects. Therefore, many nations regulate certain provisions to ensure that the Constitutional Amendments are merely for public order and welfare. One of the provision is the temporal unamendability. In the shape of deliberation requirements, which is essentially the involvement of the public in submitting constitutional amendments within a certain time limit. Indonesian Law doesn’t recognize the concept of deliberation requirements, therefore, the authors will analyze Sweden and South Korean Law, two countries that are also using civil law system and have regulated deliberation requirements in submitting constitutional amendments. This paper will discuss two problems: 1) the legal provisions for constitutional amendments in Indonesia, Sweden, and South Korea, and 2) the guarantee model for public participation in constitutional amendments using the deliberation requirements model. This paper uses legal research method, with a conceptual, statutory, and comparative approach. The results show that Sweden and South Korean Law have involved both the public and the Representative Body to determine wether constitutional amendment will be performed, meanwhile Indonesia hasn’t involve the public to vote for a constitutional amendments. Therefore, to guarantee public participation in constitutional amendments, the authors provide a model which include the public participation through vote or referendum to decide a constitutional amendments and a period of time to file for constitutional amendment.

Abstract

Each country is unique in running its system of government. One of these uniqueness is related to the executive's authority in the formation of laws, where even though the State both uses a presidential system of government, there are differences in authority. This difference can be seen in Indonesia and America, where even though these countries both use a presidential system of government, there are differences in executive authority. In order to understand the ratio legis, there are differences, even though the 2 (two) countries both use presidential government systems, this research was conducted. The formulation of the problems in this study are 1) the characteristics of the presidential government system and 2) the authority of the president as an executive in the formation of laws in the presidential system in Indonesia and the United States. This research is a legal research with a statutory approach, a conceptual approach, and a comparative approach.

Abstract

National development planning model with its long-term time dimension in Indonesia is carried out with the National Long-Term Development Plan (RPJPN) which replaces the Planned Overall National Development (PNSB) and the General Outlines of the Principles of the State (GBHN). Based on the analysis of the data obtained, it can be seen that since 2004 the use of the RPJN has turned out to cause fluctuating dynamics in the existing development outcomes. The occurred changes resulted in inconsistencies in the direction of development when there was a change of state development actors such as President, Governor, Regent/ Mayor, and other state institutions. The reason for this is that there is no permanent structure that can be used as a reference for a long-term development program that will be carried out by the managing state institutions, particularly the government. Based on this, the aim of this study was to create a form of reformulation of the principles of the state. This research was a normative research with a statutory, historical and conceptual approaches. To answer this problem, the idea of the state principles was born which departed from combining the advantages of PNSB, GBHN, and RPJPN which were then packaged into a new state principle system, with ideological principle and technocratic strategy.

Abstract

One thing specific in the criminal acts of domestic violence lies in the provisions of Article 55 of the PKDRT Law. The article requires minimal evidence to prove the defendant’s guilt, which is ample in the form of the victim’s witness statement plus other related evidence. Therefore, when the examination can bring a witness other than the victim’s witness, the testimony of the witness and the testimony of the victim’s witness are considered ample evidence in the trial. However, in its implementation, efforts to strengthen another witness statement as a piece of evidence in the PKDRT Law have not been balanced with complete arrangements, especially with regard to the witness’s evidence, namely the enactment of Article 168 of the Criminal Procedure Code in the PKDRT Law. Based on this background, this study will analyze the position of witnesses in criminal law and the position of witnesses in criminal acts of domestic violence. This study aims to review the role of witness statements in law enforcement against domestic violence crimes and how the law regulates it. The normative legal research method is used to answer these problems. With the increased number of cases of domestic violence that occur every day and the difficulty of collecting evidence to prove the crime of domestic violence, it is necessary to formulate the regulation of witness statements in the crime of domestic violence either through PERMA or the revision of the PKDRT Law. AbstrakSalah satu kekhususan dalam tindak pidana KDRT terletak pada ketentuan Pasal 55 UU PKDRT. Pasal tersebut mensyaratkan minimal alat bukti untuk membuktikan kesalahan terdakwa, yaitu cukup dengan keterangan saksi korban ditambah dengan alat bukti lainnya. Dengan demikian, ketika dalam pembuktian dapat menghadirkan seorang saksi selain saksi korban, maka keterangan saksi dan keterangan saksi korban sudah dianggap sebagai alat bukti yang cukup dalam persidangan. Namun pada implementasinya, upaya penguatan alat bukti saksi dalam UU PKDRT belum diimbangi dengan pengaturan yang lengkap terutama berkaitan dengan alat bukti saksi, yaitu berlakunya Pasal 168 KUHAP dalam UU PKDRT. Berdasarkan latar belakang tersebut, maka tulisan ini akan menganalisis kedudukan saksi dalam hukum pidana dan kedudukan saksi dalamtindak pidana kekerasan dalam rumah tangga. Hal ini bertujuan untuk meninjau peran keterangan saksi dalam penegakan hukum terhadap tindak pidana KDRT dan bagaimana hukum mengatur hal tersebut. Metode penelitian hukum normatif digunakan untuk menjawab permasalahan tersebut. Dengan banyaknya kasus KDRT yang terjadi tiap harinya dan sulitnya pengumpulan alat bukti untuk membuktikan tindak pidana KDRT, maka perlu memformulasikan pengaturan keterangan saksi dalam tindak pidana KDRT baik melalui PERMA maupun revisi UU PKDRT.
