Abstract

The rapid development of Artificial Intelligence (AI) technology has significantly transformed the fields of art and creative industries, particularly in musical creation. One of the most notable AI platforms capable of automatically generating music is Suno AI, which raises legal debates regarding its legal status and copyright protection for AI-generated works. This study aims to analyze the legal standing of Suno AI as a creator and examine the legal responsibilities related to musical works produced through artificial intelligence within the framework of Intellectual Property Rights (IPR). The research employs a normative juridical method with a statutory and conceptual approach, using data derived from legislation, legal literature, and relevant national and international case studies. The findings indicate that Suno AI cannot be recognized as a legal subject or creator, as it lacks consciousness and legal personality as required by Article 1 paragraph (2) jo. Article 31 of Law No. 28 of 2014 concerning Copyright. Therefore, AI functions merely as a technological tool, while legal rights and responsibilities rest entirely on humans, namely developers or users who control the system. In cases of copyright infringement, as stipulated in Articles 34 and 112 of the Copyright Law, human operators of the AI system bear legal responsibility, not the AI itself. Cases such as the lawsuit against Suno AI and Udio AI in the United States, as well as instances of AI-based music fraud in Indonesia, highlight the urgent need for adaptive and comprehensive legal regulations. This study concludes that Indonesia must establish a comprehensive legal framework on AI-generated creations to ensure legal certainty, protect the moral and economic rights of human creators, and promote the ethical and responsible use of AI technology in the music industry.

Abstract

Maraknya kasus penyalahgunaan data pribadi dalam praktik penagihan pinjaman online ilegal menimbulkan persoalan hukum serius, terutama karena tindakan tersebut dilakukan melalui intimidasi, ancaman, dan penyebaran informasi pribadi tanpa hak. Kondisi ini menempatkan korban dalam posisi yang rentan dan memerlukan analisis mendalam mengenai bagaimana perlindungan hukum bekerja dalam konteks kejahatan digital. Penelitian ini bertujuan untuk menganalisis bentuk penagihan tidak sah yang dilakukan pelaku pinjaman online ilegal, menelaah perlindungan hukum yang tersedia bagi korban berdasarkan peraturan perundang-undangan di Indonesia, serta mengkaji pertimbangan hukum hakim dalam Putusan No. 438/Pid.Sus/2020/PN Jakarta Utara terkait unsur penyalahgunaan data pribadi. Metode penelitian menggunakan studi literatur dengan menelaah putusan pengadilan, jurnal ilmiah, regulasi, serta penelitian terdahulu. Hasil penelitian menunjukkan bahwa penyalahgunaan data pribadi oleh pelaku pinjol ilegal dilakukan melalui penyebaran informasi kontak, ancaman verbal, dan tekanan psikologis yang melanggar prinsip privasi dan perlindungan konsumen. Analisis putusan menunjukkan bahwa hakim menilai tindakan tersebut memenuhi unsur pemerasan elektronik sebagaimana diatur dalam UU ITE, dan menjatuhkan pidana penjara serta denda untuk memberikan efek jera. Penelitian ini menegaskan bahwa perlindungan hukum bagi korban pinjol ilegal telah diakomodasi dalam berbagai regulasi, namun implementasinya masih memerlukan penguatan pengawasan dan edukasi masyarakat.

Abstract

Video game piracy through illegal download sites has become a serious issue that harms game developers and publishers, particularly concerning their copyright and economic rights. This research aims to analyze the role of the Ministry of Communication and Digital (Kemkomdigi) in addressing these sites, based on Law Number 28 of 2014 on Copyright and Law Number 11 of 2008 on Electronic Information and Transactions (ITE). The research method employed is normative legal research with a statutory and regulatory analysis approach. The results of the study indicate that Kemkomdigi plays a role in blocking access to piracy sites after receiving recommendations and reports from the Ministry of Law and Human Rights. However, challenges such as bureaucratic chains, lack of inter-agency coordination, and low public awareness continue to hinder the effectiveness of handling Illegal Video Game Download Sites. Kemkomdigi has developed the Content Moderation Compliance System (SAMAN) to enhance detection and blocking of illegal content. Long-term solutions to tackle piracy include public education, strengthening inter-agency cooperation, and advancing blocking technologies to create a digital environment free from piracy.

Abstract

This study concludes that the distribution of unauthorized iQIYI digital services through marketplaces creates inherent legal defects, as access remains revocable by the authorized provider, exposing consumers to the risk of unilateral account blocking and potential systematic losses. Accordingly, marketplaces should not be treated as passive intermediaries; their platform control and economic benefits justify the application of Absolute Responsibility for consumer losses arising from such transactions. This research employs a normative legal method, combining statutory and conceptual approaches, with a focus on Indonesian consumer protection law and electronic commerce regulation. The analysis demonstrates that intermediary-based liability models are inadequate to address risks inherent in non-physical and revocable digital services. To operationalize this accountability, marketplaces must ensure accurate risk disclosure, verify seller legitimacy, handle complaints effectively, and implement measurable loss-recovery mechanisms. Finally, regulatory alignment of the Government Regulation on Trade Through Electronic Systems with consumer protection principles, including enforceable algorithmic accountability, remains necessary to strengthen supervision and legal certainty in Indonesia's digital commerce ecosystem.
