Abstract

Abstract General Principles Good governance can be a claim in the State Administrative Court even though the existence of AAUPB can be said to be juridical and not formal as described in Article 53 Paragraph 2 of Act Number 51 of 2009 concerning State Administrative Courts. In the life of the AAUPB community can be used as a basis for seeking justice, where if the community feels aggrieved by a State Administrative Decree that does not at all refer to the AAUPB and burdensome the community in making decisions or regulations applied in community life. The problems studied are: Application and how the functions that should be played by AAUPB in the decision and form of legal logic from the side of PTUN judges. If you look at the concept of a Dutch country that implements good governance, in Indonesia the entry into force of AAUPB by looking at the theoretical basis applied in the AAUPB, State Administrative Courts, and Article 53 Paragraph 2 of Law Number 51 of 2009. Results of the study: 1) In the research 06 / G / 2017 / PTUN.DPS the role of AAUPB can be seen in the principle of accuracy, the principle of legal certainty and the principle of professionalism in which officials who are authorized to make decisions regardless of the prevailing historical value. Because in terms of the principle of legal certainty, the principle of professionalism, and the principle of accuracy the decisions issued are burdensome, in this case the community is given the decision issued by the competent authority, 2) in the implementation of the AAUPB to decide a case or dispute that occurs in the Administrative Court The AAUPB country acts as a test tool used by PTUN judges to decide on a case. Conclusions from this study: 1) In the decision No. 06 / G / 2017 / PTUN.DPS implementation or AAUPB function has been running to see from the logic of the panel of judges in implementing AAUPB to decide on a dispute, 2) The judge has acted actively in searching for causes and what which becomes a case by applying AAUPB in a consideration to decide on disputes that occur, without forgetting Emersonfraise that can be used by the government in making a decision that applies to the community. Suggestions from researchers: 1) AAUPB that is used or as a basis for testing instruments for PTUN judges in deciding a case should always be accompanied by regulations that apply in accordance with legislation, 2) the panel of judges must clearly use the legal logic by applying AAUPB as Test equipment decides on a dispute that occurs in the realm of the State Administrative Court. Dalam kehidupan masyarakat AAUPB dapat dijadikan dasar untuk mencari keadilan, dimana jika masyarakat merasa dirugikan dengan Keputusan Tata Usaha Negara yang tidak Sama sekali mengacu pada AAUPB dan memberatkan masyarakat dalam membuat keputusan atau peraturan yang diterapkan dalam kehidupan bermasyarakat. Permasalahan yang dikaji yaitu: Penerapan dan bagaimana fungsi yang seharusnya diperankan AAUPB dalam putusan dan bentuk logika hukum dari sisi hakim PTUN. Jika melihat dari konsep negara belanda yang menerapkan good governance, di Indonesia berlakunya AAUPB dengan melihat landasan teori yang diterapkan dalam AAUPB, Peradilan Tata Usaha Negara, Pasal 53 Ayat 2 Undang-Undang Nomor 51 Tahun 2009. Hasil penelitian: 1) Dalam penelitian Putusan Nomor 06/G/2017/PTUN.DPS peran AAUPB dapat terlihat di dalam asas kecermatan, asas kepastian hukum dan asas profesionalitas yang dimana pejabat yang berwenang membuat keputusan tanpa melihat nilai historis yang berlaku. Karena ditinjau dari asas kepastian hukum, asas profesionalitas, dan asas kecermatan putusan yang dikeluarkan memberatkan, dalam hal ini masyarakatlah yang diberatkan oleh putusan yang dikeluarkan oleh pejabat yang berwenang, 2) dalam penerapan AAUPB untuk memutus suatu perkara atau sengketa yang terjadi di Peradilan Tata Usaha Negara AAUPB berperan sebagai alat uji yang digunakan oleh hakim PTUN untuk memutus seuatu perkara. Simpulan dari penelitian ini: 1) Dalam putusan No 06/G/2017/PTUN.DPS penerpan atau fungsi AAUPB sudah berjalan melihat dari sisi logika majelis hakim dalam menerapkan AAUPB untuk memutus suatu sengketa, 2) Hakim sudah bertindak aktif dalam mencari sebab dan apa yang menjadi perkara dengan menerapkan AAUPB dalam suatu pertimbangan untuk memutus sengketa yang terjadi, tanpa melupakan freies emerssen yang dapat digunakan oleh pemerintah dalam membuat suatu keputusan yang berlaku bagi masyarakat. Saran dari peneliti: 1) AAUPB yang dijadikan atau sebagai dasar alat uji bagi majelis hakim PTUN dalam memutus suatu perkara harusnya selalu didampingi dengan peraturan yang berlaku sesuai dengan perundang-undangan, 2) majelis hakim harus secara jelas dalam menggunakan logika hukum dengan menerapkan AAUPB sebagai alat uji memutus suatu sengketa yang terjadi di ranah Peradilan Tata Usaha Negara. Abstract

Abstract-The development and advancement of an industry in trade which is increasingly rapidly influencing the world economy, especially in international trade through exports and imports. The Bill of Lading in Indonesian is known as the "agreement" which is the most important shipping document in the process of shipping goods by sea transportation to reduce responsibility for the risks that will arise in international trade. Bill of Lading (B / L) is one of the important documents of the Letter of Credit (L / C) as a means of payment transactions for exporters and importers. So that the formulation of the problem used: 1) What is the role of the Bill of Lading documents in export-import activities? 2) What is the procedure for applying the Bill of Lading documents in export-import activities? The research method used is the normative legal research method so that the problem approach used is the legislation approach, and conceptual approach, and uses primary, secondary, and tertiary legal materials. So that the legal material collection technique used is the documentation technique by processing and analyzing legal materials that have been collected using legal arguments. The results of this study can be concluded that the regulation of the Bill of Lading (B / L) can be seen through the provisions of Article 506, the Commercial Law (KUHD); Article 25 paragraph (1) of Law No. 39 of 2007 concerning Excise. Abstract

Abstract-Village or what is called by another name or an area that is thick with tradition and relatively independent. Based on this, the village must be recognized and understood as a legal community unit that has rights and authority in managing and managing village funding and the community to achieve village welfare. Related to the expansion of the village, formulation of the problem can be made as follows: what are the local government policies on managing village fund allocation and how is community participation in managing village fund allocation. This paper was made to find at local govermmeny policies and community participation in the management of village fund allocations based on statutory regulations. Management of village fund allocation, namely the overall activities which include planning, implementation, administration, reporting, and accountability of The village funds. The type of research used is normative research. The village fund allocation has been regulated in article 72 paragraph 1 latter C and article 72 paragraph 3 of law number 6 of 2014 concerning village states that one source of village income is part of the results of regional taxes and retribution of the regency / city and regional tax and retribution. City at least 10% (ten percent) of regional taxes and levies. Therefore, there is a need for local government policies and community participation to oversee the implementation of village funds. Keywords: Management, village funds, village management. Abstrak-Desa atau yang disebut dengan nama lain merupakan suatu daerah yang kental akan tradisi serta relatif mandiri. Desa harus diakui keberadaannya dan disadari sebagai satuan masyarakat hukum yang mempunyai hak serta kekuasaan dalam mengatur dan mengurus pendanaan desa serta masyarakat guna meningkatkan pembangunan dan pemberdayaan masyarakat untuk mencapai kesejahteraan desa. Dalam hal ini maka dapat dirumuskan masalah yaitu: bagaimana kebijakan pemerintah daerah dalam pengelolaan alokasi dana desa serta bagaimana partisipasi masyarakat dalam pengelolaan alokasi dana desa. Tulisan ini dibuat untuk mengetahui kebijakan pemerintah daerah serta partisipasi masyarakat dalam pengelolaan alokasi dana desa berdasarkan peraturan perundang undangan. Pengelolaan alokasi dana desa yaitu kegiatan yang meliputi perencanaan, pelaksanaan, penatausahaan, pelaporan dan pertanggung jawaban dana desa. Jenis penelitian yang digunakan yaitu penelitian normatif. Alokasi dana desa diatur didalam Pasal 72 Ayat (1) huruf c dan Pasal 72 ayat (3) Undang-Undang Nomor 6 Tahun 2014 Tentang Desa menyebutkan ada bagian sumber pendapatan desa adalah bagian dari hasil pajak daerah serta retribusi daerah kabupaten/kota dan bagian hasil pajak daerah dan retribusi daerah kabupaten kota paling sedikit 10% (sepuluh perseratus) dari pajak dan retribusi daerah. Oleh karena itu perlu adanya kebijakan pemerintah daerah serta partisipasi masyarakat untuk mengawasi jalannya alokasi dana desa. Kata kunci: Pengelolaan, dana desa, pemerintah desa.

Abstract

The problem of village boundaries is indeed often a debate in several areas in Bali, especially those that occur in Tabanan Regency. In Tabanan, boundary problems occur between Bealalang Village, Kediri District, Tabanan Regency and Pangkung Tibah Village, Kediri District, Tabanan Regency. The chaos of the boundary between Belalang and Pangkung Tibah villages began to erupt in 2009. The conflict began with a claim of 18 hectares of land in subak Belong in the Pangkungtibah area. Claims from the locusts are based on ancestral inheritance. This action had ended in the fencing of disputed land. the formulation of the problem in this study is as follows: How to Resolve State Administrative Disputes Through the efforts of State Administrative Courts on Settlement of Village Boundary Cases (Case Study of Decision Number: 12 / G / 2011 / PTUN.Dps.) and How the Judges consider decisions in the Case of a Suit Against the Settlement of a Village Boundary Case (Case Study of Decision Number: 12 / G / 2011 / PTUN.Dps.). The type of research used is the type of normative legal research. The results of the study in this discussion are as follows: State Administration Dispute Resolution Through the efforts of State Administrative Courts to Settle Village Boundary Cases (Case Study of Decision Number: 12 / G / 2011 / PTUN.Dps.) Has not fulfilled legal certainty and a sense of justice, this can be seen from the refusal by the Supreme Court. Abstract

This thesis has a background through democracy that its implementation with elections held by the KPU with its authority at each stage of its election can form KPU regulations and stipulate KPU regulations Number 20 Year 2018 and in the process is considered to violate the higher regulations namely Number Election Law 7 of 2017 here regulates the prohibition of former corruption inmates to become candidates for DPR and DPRD members so that they can explain to the public the noble intentions of the institution towards the noble ideals of the nation about eradicating corruption. This has been a debate in the community, political elites and state institutions. What is the background of the formation of KPU regulations Number 20 Year 2018 and what are the implications of the Supreme Court's decision Number 46 P / HUM / 2018 this study is a normative legal research that is prescriptive and technical or applied. The research approach uses a legal approach and a case approach. The type of research data is secondary data with primary legal material and secondary legal material. Data collection techniques in the form of library studies and data analysis techniques used are deduction with syllogism methods. Through scrutiny of laws and regulations related to the Election Law No. 7 of 2017. After the research material was obtained and collected, the material can be concluded if the background and moral factors of the KPU form the KPU Regulation is in order to obey the noble ideals of the nation in eradicating corruption and giving the public legislative candidates with integrity and being able to carry out the decisions of the Supreme Court through forming KPU regulations No. 31 of 2018 as a substitute.

Abstract

The government in collaboration with the tourism business world, including travel agents and the public, has an obligation to provide support for tourism activities to run safely and must always refer to the legal aspects as a form of protection in the field of tourism for tourists. This is because in Article 26 letter (d) of Law No. 10 of 2009 concerning Tourism is expressly stated that tourism entrepreneurs have an obligation in providing comfort, hospitality, and providing a sense of security to tourists. However, the Act does not explain in detail the responsibilities of the travel agency to tourists. This study discusses two problems, namely 1). What is the form of legal protection for tourists in travel in Badung Regency and 2). What is the responsibility of the travel agency for tourists in Badung Regency. The type of research used in this journal is empirical legal research is legal research that starts from the gap between das solen and das sein, where there is a gap between the theoretical situation and the legal facts that occur in society. The approach used is the sociology of law which also studies the interrelationship between law and other social phenomena. Regarding the form of legal protection for tourists in tourist trips in Badung Regency, namely by providing legal protection, comfort and security to tourists, including providing facilities for elderly and disabled tourists, and getting a safety guarantee in the form of insurance for activities that have high risk. The form of responsibility of a travel bureau if there is a problem with the comfort of tourists, the travel usually always anticipates by improving services and racing on business standards certification for the travel bureau.

Abstract

Abstract—Crime of CPNS fraud is common in both remote and urban areas. This is due to the large number of people who think that work as a civil servant is a safe and secure job. The discussion of this paper includes; What are the factors that lead to criminal acts of fraud from the point of view of law and society, how are sanctions and responsibilities of perpetrators of criminal acts of fraud CPNS. This research is normative research. Legal materials obtained from from the Warmadewa University Faculty of Law Library and the Krisna Law Office Library. Factors influencing fraudulent acts are lack of burden of sanctions or lack of commensurate penalties and poverty factors. Case studies in this paper are taken from the decisions of the Denpasar District Court (Decision Number: 382 / PID.B / 2018 / PN DPS); perpetrators of criminal offenses of CPNS that were enforced article 378 of the Criminal Code concerning fraudulent crimes with sanctions of a maximum of four (4) years in prison. This type of fraud can damage the character and morals of the nation, so the government should pay more attention to it and for the perpetrators to be given appropriate punishment in order to get a deterrent effect. The community is also expected to help law enforcement officials by reporting it if they know that this action was carried out and that law enforcement officers should provide protection for informer.

Abstract

Land purchasing is an activity taken by government in order to build public fasilities, purchasing also done by giving some compesation to society that affected. During purchasing activity never runs smooth , where mostly some people who gets land purchase is not santisfied with the amount of compensation that given by government. Regarding those matters, we may conclude there are 2 problems those are : 1. What Is the juridical basis for land acquistion in the public interest?, 2. How is the mechanism of compesation in land purchasing for public that held by goverment ?. Research that an be used to solve the problem is normatif research method by studying the valid rules. Juridis platform land purchasing is President policy no 71 year 2012 about land enforcement to public needs, the regulation no 2 year 2012 about land purchasing for public developing. Compensation mechanism on land purchasing must be based on the forum between committee and the right holder of the land or plants that’s exist on it, that during the interpretation or the quotation the amount of compensation should be agreed and must be based on the local public price.

Abstract

Corruption is an extraordinary crime (extraordinary crime) of the government and when law enforcement in its handling must have a strong determination and power. One of the criminal acts of corruption is illegal levies, acts of retribution which are a social phenomenon that existed before the Indonesian State became independent. Along with the development of technology and information on developments in the era of globalization has a huge influence on human life and civilization. Stimulates the human mind, giving rise to various problems that have positive and negative effects. These problems can be examined as follows: 1) what is the role of the community in eradicating Illegal Levies as a Corruption Crime? 2) How is Law Enforcement of Illegal Levies as a Corruption Crime at the Badung Regency Transportation Service? This presentation uses Empirical research methods, and requires primary data as the main data in addition to secondary data. The role of the community in efforts to prevent and eradicate Corruption Crime is contained in article 41 (1) Law No. 20 of 2001 changes to Law No. 31 of 1999 The Corruption Act which we know more about the Law on the Eradication of Corruption Crime. Prevention and eradication of Corruption Crimes in the form of seeking, obtaining, providing data or information on Corruption Crimes and the right to submit suggestions and opinions responsibly for the prevention and eradication of Corruption Crimes. Wild levies are actions that are intentionally carried out to enrich themselves, groups, or corporations.

Abstract

One of the threats to our environment is the problem of plastic waste. Plastic waste is a global problem that is currently getting more attention from many countries. Realizing this, it is necessary to have a regulation that reduces the increasing use of plastic. To reduce the increasing use of plastic, the Denpasar City Government has made a plastic waste reduction program through reducing the use of plastic bags. This regulation is in the form of the stipulation of Mayor Regulation Number 36 of 2018 concerning Reducing the Use of Plastic Bags. There are 2 (two) main problems that will be studied in this study including 1) How is the application of Denpasar Mayor Regulation Number 36 of 2018 to traditional market business actors?, 2) What efforts are being made by the Denpasar City Government to make plastic bag reduction effective? The research method used in this study is empirical legal research with a sociological juridical approach. The application of Denpasar City Regulation Number 36 of 2018 for business actors in traditional markets cannot be carried out to the maximum, this is because not all business actors in traditional markets can carry out these buying and selling activities by not using plastic bags. Denpasar City to make the reduction of plastic bags effective is to carry out socialization and also provide administrative sanctions for those who violate.
