Abstract

The perfume industry relies heavily on innovation and unique formulations, yet in Indonesia many micro and small businesses sell inexpensive refill perfumes that imitate well-known scents, raising concerns about trade secret infringement. This study assesses the effectiveness of legal protections for perfume formulations in Indonesia, South Korea, and France through a juridical-normative, comparative, and case study approach. The findings show that Indonesia’s protections under its Trade Secret, Trademark, and Patent laws remain weak due to limited enforcement and low awareness, while South Korea’s Unfair Competition Prevention and Trade Secret Protection Act and France’s implementation of Directive (EU) 2016/943 provide stronger mechanisms for safeguarding business secrets. The study offers a comparative framework that can guide the development of a more effective trade secret regime for perfume formulations in Indonesia.

Abstract

This study aims to compare the application of illicit enrichment regulations and concepts between Australia and Indonesia and their implications in reducing corruption cases in both countries. The research method used is normative legal research with a Statute Approach, Conceptual Approach, and Comparative Approach. The legal materials used include primary legal materials, namely laws and regulations relevant to the issues under study. In addition, secondary legal materials consist of textbooks discussing various legal issues, scientific journals, works from legal circles, and research results. Tertiary legal materials are used as supplements, namely through the Internet. The data collection method used is library research. The results of the study show that illicit enrichment will be a breakthrough in the anti-corruption system in Indonesia. Although Indonesia has ratified the UNCAC, this ratification does not accommodate the concept of illicit enrichment. so that implementing illicit enrichment can be a good step, reflecting on Australia's success in indicating corruption earlier by looking at the increase and/or imbalance between the wealth of state officials and their legitimate income. In its implications, the Anti-Corruption Law can be the right legal framework for injecting the concept of illicit enrichment.

Abstract

Dewasa ini pelanggaran hak cipta makin sering terjadi, tak terkecuali penggandaan buku. Kurangnya efektivitas hukum menyebabkan penggandaan buku makin marak terjadi, bahkan di fotocopy dilakukan secara terang-terangan. Penulisan ini akan membahas tentang pengaturan pidana hak cipta buku di Indonesia dan penyelesaian sengketa pidana penggandaan buku di Indonesia sebagai upaya pemberantasan penggandaan hak cipta buku di Indonesia. Tulisan ini menggunakan metode yuridis normatif melalui studi kepustakaan dengan menelaah data sekunder, berupa peraturan perundang-undangan atau dokumen hukum lainnya, dan hasil penelitian, pengkajian, serta referensi lainnya yang berkaitan dengan permasalahan. Kesimpulan dari tulisan ini adalah harus digencarkannya penyelesaian perkara hak cipta buku ke ranah pidana mengingat tujuan hukum pidana adalah memberikan efek jera baik kepada pelaku dan efek rasa takut bagi seseorang yang akan melakukan perbuatan yang sama, sarannya adalah Kepolisian, Kejaksaan, dan Pengadilan dapat memaksimalkan hukum pidana sebagai upaya pemberantasan penggandaan buku di Indonesia. Selain itu juga dapat dilakukannya sosialisasi penyelesaian perkara pidana dengan tuntutan ganti rugi kepada masyarakat. Kata Kunci: Penjatuhan sanksi, Pemberantasan, Karya cipta buku.

Abstract

This study examines the effectiveness of administrative sanctions in the form of blocking company access through the AHU Online system in increasing compliance with Beneficial Ownership (BO) reporting in order to realize corporate transparency in Indonesia, which is motivated by the still low compliance of companies in reporting BO data, which has only reached 50.27% of the total entities registered with the Directorate General of AHU. This study uses a normative juridical method with a statutory, conceptual, and case approach, as well as secondary data in the form of regulations and related legal literature. The results of the study indicate that the access blocking policy has provided a preventive effect on non-compliance with BO reporting, but its effectiveness is still hampered by weak data integration between agencies, technical system constraints, low awareness of business actors and even government officials. Therefore, it is necessary to strengthen digital verification, improve coordination between agencies, professionalism of public officials, and the establishment of a special authority for the AHU system to ensure data integrity and openness, so that public transparency and trust in the legal system and the business world can be increased.

Abstract

This study aims to analyze the challenges in implementing direct licensing within Indonesia’s music royalty management system and to assess its conformity with Law Number 28 of 2014 on Copyright and its implementing regulations. The main issue discussed is the absence of a clear legal framework governing direct licensing mechanisms, which leads to an imbalance between the economic rights of creators and the authority of the National Collective Management Organization (LMKN). This research employs a normative juridical approach with a qualitative descriptive analysis method, using literature studies of relevant legislation, legal doctrines, and actual cases such as the royalty disputes involving Agnez Mo and Ari Bias. The findings indicate that direct licensing has the potential to enhance legal certainty, transparency, and efficiency for creators, yet its implementation remains hindered by overlapping regulations and weak institutional infrastructure. Therefore, legal reform through the revision of the Copyright Law and its derivative regulations is necessary to explicitly recognize direct licensing as a legitimate mechanism in royalty management. Furthermore, strengthening the role of the Directorate General of Intellectual Property (DJKI) and transforming LMKN into an accountable facilitating body are essential steps toward establishing a fair and transparent royalty system that effectively protects the rights of music creators in Indonesia.

Abstract

The local bag industry faces significant challenges in protecting Intellectual Property Rights (IPR) due to design similarities with well-known brands, which are closely related to the sustainability of the national economy. This study aims to analyze the convergence of trademark, industrial design, and geographical indication protections within the local bag industry and to identify solutions to address design-similarity issues. This research employs a normative juridical method, complemented by a literature review and in-depth interviews with experts from the Directorate General of Intellectual Property, drawing on statutory, conceptual, and sociological approaches. The findings indicate that the convergence of IPR protection across these three regimes provides complementary safeguards that strengthen the legal position of local bag products and enhance their competitiveness in the global market. However, its effectiveness remains constrained by low awareness of IPR registration, high registration costs, and weak law enforcement. Through this layered protection framework, local bag entrepreneurs can gain stronger protection, promote innovation, and reinforce the economic and cultural values unique to Indonesia, thereby contributing to the development of the national creative economy.

Abstract

Ekosistem startup di Indonesia menghadapi tantangan pendanaan akibat penurunan investasi dan lemahnya perlindungan hukum di pasar modal. Penelitian ini bertujuan untuk mengkaji peran Otoritas Jasa Keuangan (OJK) melalui POJK No. 65/POJK.04/2020 dalam meningkatkan perlindungan investor serta menilai dampaknya terhadap kesiapan investasi (investment readiness) startup. Dengan menggunakan metode yuridis normatif serta pendekatan perundang-undangan, kasus, dan konseptual, penelitian ini menganalisis keterkaitan mekanisme pengembalian keuntungan tidak sah (disgorgement) dengan kepercayaan investor. Hasil penelitian menunjukkan bahwa pengaturan disgorgement, dana kompensasi kerugian investor, dan kewenangan remedial OJK memperkuat kepastian hukum, meningkatkan transparansi, dan mendorong kedisiplinan tata kelola startup. Mekanisme ini berdampak langsung pada peningkatan kepercayaan investor karena memberikan jaminan pemulihan kerugian, meskipun implementasinya masih menghadapi tantangan kapasitas pengawasan dan kompleksitas model bisnis digital. Dengan demikian, POJK No. 65/POJK.04/2020 tidak hanya menjadi instrumen perlindungan investor, tetapi juga berfungsi strategis dalam memperkuat investment readiness serta menciptakan iklim investasi startup yang lebih aman dan berkelanjutan.
