Abstract

A request in a district court for annulment of an arbitration, or arbitral, award is a form of legal remedy that claims dissatisfaction with the award by one or more parties. It contravenes the provisions that stipulate the finality of the award and its permanently binding legal force. The attempt to invalidate the arbitral award seems to reflect the party’s (or parties’) disobedience to it. The research method here employed normative juridical review of various library materials consisting of primary legal sources from related laws and regulations, secondary materials which formed the explanations used in the analysis of the primary legal materials in the form of doctrine, academic views, judicial decisions, document searches, books, and scientific works. The legal material is identified and analyzed to achieve the objectives of the study. The results indicate that there is legal uncertainty related to the provision, specifically whether a district court can overturn a final arbitration award and that it carries the legal force to bind the parties. Therefore, it is necessary to create that certainty, and write off Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, article 70. Arbitrators are encouraged to act more professionally in examining and delivering fair arbitration awards without being tainted by false evidence or gimmicks.

Abstract

The State Constitution stipulates that the State recognizes and respects customary law community units and their traditional rights as long as they are still alive and following the development of the nation, society, and the Unitary State of the Republic of Indonesia as outlined by law. The outcomes of the second and fourth constitutional amendments and the constitution's three articles are strong evidence of the state's recognition of customary law in Indonesia. There are always issues, although customary lands are constitutionally and legally protected. Interviews are a component of this normatively-based legal research method. The formulation of the issue concerns the legal protection of indigenous peoples against ulayat rights and the urgency of registering ulayat land in Indonesia. The first conclusion of this study is that the constitution and laws protect the rights of indigenous peoples to customary land. However, the community and other parties against indigenous peoples must balance constitutional and regulatory protections. Second, it is not sufficient for indigenous peoples to recognize customary land; it must also be determined by the regional director and administered at the National Land Agency office so that administration is streamlined and information is made more accessible.

Abstract

Pemberlakuan Pembatasan Kegiatan Masyarakat (PPKM) telah diberlakukan sejak 3 juli 2021 dan terus diperpanjang hingga sekarang, PPKM memang dapat menurunkan jumlah terinfeksi covid-19 tetapi malah memperparah di sektor lainnya. Artikel ini bertujuan untuk mengetahui bagaimana kondisi masyarakat pasca diterbitkannya peraturan PPKM dan urgensi partisipasi masyarakat dalam proses pembentukan perturan PPKM dengan metode Yuridis normatif dan pendekatan Statue Approach dan Literature Review. PPKM yang terus menerus diperpanjang dan ternyata semakin terasanya efek negative dari kebijakan tersebut banyak masyarakat mulai melakukan tindakan-tindakan yang menyuarakan protesnya dengan berbagai bentuk. Maka dari itu sangat dibutuhkan peranan masyarakat dalam tahapan-tahapan pembuatan peraturan. Menurut teori Walfare State atau bisa disebut dengan “Negara Sejahtera” bila melibatkan partisipasi masyarakat yang akan merasakan dampak langsung dari aturan terebut. Oleh karena itu pemerintah diharuskan untuk menggunakan pendekatan secara Bottom-Up, yang berarti membentuk peraturan berdasarkan masukan dari rakyat yang akan disusun dan direalisasikan oleh pemerintah. Partisipasi masyarakat akan memberikan landasan yang lebih baik dan memberikan solusi disertai implementasi yang lebih efektif atas segala permasalahan khususnya pada golongan menengah kebawah.

Abstract

The development of technology and information technology has resulted in freedom of opinion and expression which often leads to hate speech. So it is necessary to have clear limits on what actions can be classified as hate speech and to determine whether a person can be held criminally responsible. It is known that hate speech that often occurs is usually related to insults, defamation, blasphemy, unpleasant acts, provocations, and attempts to incite. The research method used is normative juridical with a statutory approach and a conceptual approach. The results show that the criminal responsibility of the perpetrators of hate speech has been regulated in several laws and regulations including the 1945 Constitution of the Republic of Indonesia, the Criminal Code, Law 9/1998, Human Rights Law, ITE Law, Law 40/2008, in addition to There is Circular Letter Number SE/6/X/2015 concerning Handling Hate Speech. There is no understanding about how to properly use social media to be one of the causes of hate speech, resulting in negative impacts. Social media which has been a place to communicate has changed its function. So that the issue of hate speech must be addressed intelligently by the community so that people are not easily instigated by hate speech that occurs. It is necessary to instill an understanding that hate speech will have a negative impact that can damage the life of the nation and state. For this reason, efforts to resolve hate speech can be done through penal and non-penal efforts. The police as the front line in handling and eradicating hate speech cases are assisted by the Ministry of Communication and Information of the Republic of Indonesia. As well as the importance of participation by fellow social media users to remind each other if one of them takes actions that lead to hate speech, as the saying goes, prevention is better than cure.

Abstract

Prostitution is a complex problem because it intersects with so many aspects, especially in women’s rights. However, the complexity of the problem is not accompanied by legal certainty of regulations regarding prostitution. This paper aims to find out and understand how the problem of criminalization of prostitutes and users of prostitution services in Indonesia. This research method is normative juridical law research with a concept and legislation approach. Data used secondary data consisting of primary, secondary, and tertiary materials. The result found is a legal vacuum related to the regulation of prostitution actions so that prostitutes and users of prostitution services often escape the legal snare. The need for criminalization as a countermeasure against users of prostitution services that are key in the practice of prostitution and protecting women’s rights. As well as countermeasures by providing rehabilitation for prostitutes and in them to have skills and not fall back into the vortex of prostitution practices.

Abstract

Abstrak: Disahkannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (UU Cipta Kerja) diharapkan dapat mendukung dan membantu dalam pertumbuhan ekonomi pada masa pandemi Covid-19 maupun pasca endemi Covid-19. Secara umum semua sektor Usaha Mikro dan Kecil (UMK) memiliki permasalahan legalitas dan lemahnya strategi berbisnis serta minimnya informasi atas kemudahan dari Perusahaan Perseorangan khususnya dimasa pasca endemic Covid-19. Tujuan dari pengabdian melibatkan Perangkat Desa sebagai perpanjangan pengabdi untuk dapat tepat pada sasarannya yaitu UMKM yang membutuhkan, agar dapat ditindak lanjuti pada proses pendampingan secara real time. Berdasarkan hasil survey kepada perangkat Desa Mangunjaya, menghasilkan bahwa masyarakat Desa Mangunjaya membutuhkan peningkatan strategi pemasaran dan kesadaran hukum dagang untuk meningkatkan pendapat para pelaku UMKM di wilayah Desa Mangunjaya . Kegiatan pengabdian ini disusun menggunakan metode Plan - Do - Check - Action disertai pelaksanaan dialog dan praktik lapangan untuk menghasilkan bukti yang nyata kepada masyarakat Desa Mangunjaya. Penggunaan metode Plan - Do - Check - Action menjadi solusi praktis untuk pelaksanaan proses kegiatan. Pendampingan peningkatan kesadaran hukum yang dilaksanakan tim pengabdi menghasilkan 4 buah sertifikat Nomor Induk Berusaha. Sosialisasi peningkatan strategi bisnis menghasilkan peningkatan pengetahuan ilmu ekonomi kepada 85% peserta yang mengikuti kegiatan.Abstract: The enactment of Law Number 11 of 2020 concerning Job Creation (Job Creation Law) is expected to support and assist in economic growth during the Covid-19 pandemic and post-endemic Covid-19. In general, all Micro and Small Enterprises (MSE) sectors have problems with the nature and weak business strategy and lack of information on the convenience of Individual Companies, especially in the post-endemic period of Covid-19. Thepurpose of service involves the Village Apparatus as an extension of service to be able to be right on its target, namely MSMEs in need, so that it can be followed up on the mentoring process in real time. Based on the results of a survey of the Mangunjaya Village apparatus, it was found that the people of Mangunjaya Village need to improve marketing strategies and awareness of trade laws to increase the opinions of MSME actors in the Mangunjaya Village area. This service activity was prepared using the Plan - Do - Check - Action method accompanied by the implementation of dialogue and field practices to produce concrete evidence to the people of Mangunjaya Village. The use of the Plan - Do - Check - Action method is a practical solution for the implementation of the activity process. Assistance in increasing legal awareness carried out by the service team produced 4 Certificates of Business Identification Numbers. Socialization of improving business strategies resulted in an increase in knowledge of economics to 85% of participants who participated in the activity.

Abstract

Abstrak: Masalah yang terjadi adalah tentang pemenuhan hak-hak penyandang disabilitas dalam bidang ketenagakerjaan, sebagian dari mereka menganggap bahwa pemerintah tidak memberikan kesempatan untuk bekerja layaknya manusia pada umumnya. Nyatanya, hak-hak untuk bekerja bagi disabilitas telah ada pengaturannya dalam Undang-Undang Nomor 8 Tahun 2016. Sehingga, jelas bahwa kegiatan ini bertujuan untuk meningkatkan pengetahuan dan pemahaman mitra penyandang disabilitas di bidang ketenagakerjaan atas dasar persamaan hak. Metode pelaksanaan adalah Sosialisasi dengan tema“See Ability Not Disability”. Mitra adalah ‘penyandang disabilitas’ pada Balai Rehabilitasi Sosial Penyandang Disabilitas Sensorik Rungu Wicara (BRSPDSRW) Melati yang beralamat di Jl. Gebang Sari Nomor 38, RT. 02/RW. 05 Bambu Apus, Kecamatan Cipayung, Kota Jakarta Timur berjumlah 20 (dua puluh) orang. Monitoring dan evaluasi yang dilaksanakan adalah dalam bentuk wawancara kepada seluruh peserta Pengabdian. Hasil menunjukkan bahwa dari semua materi yang disampaikan oleh tim terdapat peningkatan pemahaman dan pengetahuan mitra terutama terhadap hak-hak penyandang disabilitas dalam bidang ketenagakerjaan sebesar 45%. Dengan dilaksanakannya kegiatan ini dapat memberikan manfaat yang besar terutama perhatian yang diberikan oleh pemerintah kepada penyandang disabilitas dalam bidang ketenagakerjaan. Selain itu, mitra semakin paham akan peluang kerja dan peluang usaha yang dapat dilakukan dengan mengembangkan potensi diri dan tentu hal ini membutuhkan kerja sama dengan ahlinya.Abstract: The problem that occurs is regarding the fulfillment of the rights of persons with disabilities in the field of employment, some of them think that the government does not provide opportunities to work like humans in general. In fact, the right to work for persons with disabilities has been regulated in Law Number 8 of 2016. Thus, it is clear that this activity aims to increase the knowledge and understanding of partners with disabilities in employment based on equal rights. The method of implementation is socialization with the theme "See Ability Not Disability". Partners are 'persons with disabilities' at the Melati Social Rehabilitation Center for Deaf Sensory Disabilities (BRSPDSRW) located on Jl. Gebang Sari Number 38, RT. 02/RW. 05 Bambu Apus, Cipayung District, East Jakarta City, totaling 20 (twenty) people. Monitoring and evaluation is carried out in the form of interviews with all participants in the Service. The results showed that from all the material presented by the team, there was an increase in understanding and knowledge of partners, especially regarding the rights of persons with disabilities in the field of employment by 45%. The implementation of this activity can provide great benefits, especially the attention given by the government to persons with disabilities in the field of employment. In addition, partners are increasingly aware of job opportunities and business opportunities that can be done by developing their potential and of course this requires cooperation with experts.

Abstract

This paper aims to analyze the construction of criminal law that is relevant to human rights (HAM) and establish progressive legal reinforcement in responding to current legal issues so that the problems of this paper can be focused on elements of recidivism, chemical castration, and progressive law. The research method uses normative research methods with a literature study approach and is then analyzed qualitatively. The results of the study conclude that progressive legal dialectic orients towards human welfare and happiness. Criminal law regulates violations and crimes that exist in acts of human behavior, indeed the concept of law in Indonesia adheres to civil law, which means that the substance and explanation are codified and recorded, so in the context of crimes of sexual violence that have been regulated in the Criminal Code (KUHP) , laws on child protection, and government regulations on chemical castration that are textually formulated (books). The legal principle views legal certainty, justice and usefulness, but in the context of the use of chemical castration on recidivists it seems paradoxical, on the one hand it wants to deter, on the other hand it wants to treat or recover.

Abstract

Anak dalam hidupnya seharusnya dapat tumbuh dan berkembang tanpa mengalami kekerasan. Oleh sebab itu perlu ada pemahaman dalam diri anak bahwa terjadinya kekerasan merupakan bentuk pelanggaran Undang-Undang Perlindungan Anak. Tidak banyak yang memahami bahwa sekecil apapun bentuk kekerasan dan diskriminasi yang di alami oleh anak akan mengakibatkan hancurnya kehidupannya. Banyak orang menganggap bahwa kekerasan dan diskriminasi adalah hal yang lumrah ketika seseorang dalam keadaan tertentu, dalam hal ini jika anak salah pergaulan, lingkungan yang tidak mendukung, dan bahkan karena faktor tidak punya orang tua. Hal seperti itu seakan menjadi pembenaran bahwa anak akan mendapatkan kekerasan dan diskriminasi. Pentingnya diadakan sosialisasi dan pendampingan diharapkan dapat menampung keluh dan kesah anak yang pernah mengalami kekerasan dan diskriminasi, sehingga ke depan bisa di antisipasi tentang bagaimana seharusnya pemerintah dalam mencegah terjadinya kekerasan dan diskriminasi pada anak. Oleh sebab itu, Pengabdi akan mengkaji tentang bentuk kekerasan yang dialami anak, pengertian dan bentuk perlindungan anak, dan pemahaman anak tentang kekerasan dalam hidupnya. Dalam rangka mendukung penulisan ini menggunakan metode dialog, diskusi dan pendampingan kepada para orang tua dan anak-anak di lingkungan Kelurahan Pangkalan Jati, Kecamatan Cinere, Kota Depok. Kegiatan dihadiri oleh 20 orang termasuk di dalamnya stakeholder dan pemuda karang taruna. Setelah semua proses selesai dilaksanakan diharapkan solusi yang ditawarkan akan menjadi obat bahwa peran kasih sayang antar sesama manusia menjadi hal yang berharga di dunia.

Abstract

The purpose of this study is to examine the implementation of abortion in Indonesia, especially for women who are victims of rape. The research method used is normative juridical. The results showed that a person could have an abortion when pregnancy occurs due to rape which can cause psychological trauma with the condition that the abortion is carried out before six weeks of pregnancy, calculated from the first day of the last menstruation. It is still found that abortions are carried out when the pregnancy is more than six weeks old. Not a few of those who carry out abortions are sentenced to criminal penalties, can say that the application of legal protection guaranteed by the law is far from perfect, especially law enforcement that is less partial to rape victims who choose the abortion route does not reflect the sense of justice, certainty and benefit be a legal goal. Therefore, legal protection for abortionists who are victims of rape must consider the best interests of the victims, and this can be realized when the Government carries out its obligations to protect and prevent abortions.
