Abstract

Abstrak Tidak adanya legalitas dalam menjalankan usaha dapat menimbulkan permasalahan. Legalitas dibutuhkan untuk menjamin bahwa seorang Pelaku Usaha menjalankan usahanya dengan penuh tanggung jawab dan telah terdaftar pada Kementerian yang membidangi UMKM. Untuk mengatasi masalah ini, kegiatan Pengabdian Kepada Masyarakat ini bertujuan untuk memberikan solusi yang dapat meningkatkan aspek legalitas Pelaku Usaha. Kegiatan ini menggunakan metode  Participatory Rural Appraisal (PRA) adalah metode partisipatif yang digunakan untuk mengumpulkan informasi dan memahami kondisi sosial, ekonomi, dan lingkungan Masyarakat. Tahapan kegiatan yang dilaksanakan dimulai dari survei mitra, identifikasi permasalahan mitra, dan dilanjutkan dengan tahap pendampingan mitra. Hasil pengabdian kepada masyarakat menunjukkan bahwa adanya pendampingan terkait pendaftaran Perseroan Perorangan ini memberikan pengetahuan serta keterampilan guna memberikan kepastian hukum bagi Pelaku Usaha untuk meningkatkan perekonomian dengan bekerja sama dengan pihak-pihak lain yang berkepentingan. Dengan adanya Perseroan Perorangan diharapkan mampu untuk mendorong UMKM menjadi usaha yang berdaya saing global karena dapat meningkatkan kepercayaan diri pelaku usaha untuk dapat semakin maju dan berkembang secara Nasional maupun Internasional. Dengan dilaksanakannya kegiatan pengabdian kepada masyarakat ini, Pelaku Usaha telah terdaftar sebagai Perseroan Perorangan sebagaimana terdaftar pada Kementerian Hukum dan Hak Asasi Manusia Republik Indonesia. Beberapa kelebihan perseroan perorangan yaitu dapat bersaing dengan Perseroan Terbatas pada umumnya, cocok untuk usaha mikro dan kecil, yang masih pemula serta mau mengembangkan usaha sendiri. Selanjutnya, pelaku usaha bertindak sebagai direktur, terakhir bahwa status badan hukum diperoleh setelah mendaftarkan pernyataan pendirian secara online. Kata kunci: legalitas usaha; pelaku usaha; perseroan perorangan; UMKM. Abstract The absence of legality in running a business can cause problems. Legality is needed to guarantee that a Business Actor carries out his business with full responsibility and has been registered with the Ministry in charge of MSMEs. To overcome this problem, this Community Service activity aims to provide solutions that can improve the legality aspects of Business Actors. This activity uses the Participatory Rural Appraisal (PRA) method, which is a participatory method used to collect information and understand the social, economic and environmental conditions of society. The stages of activities carried out start from partner surveys, identification of partner problems, and continue with the partner mentoring stage. The results of community service show that the assistance related to the registration of Individual Companies provides knowledge and skills to provide legal certainty for Business Actors to improve the economy by collaborating with other interested parties. With the existence of Individual Companies, it is hoped that it will be able to encourage MSMEs to become globally competitive businesses because it can increase the self-confidence of business actors to be able to progress and develop nationally and internationally. By carrying out this community service activity, the Business Actor has been registered as an Individual Company as registered with the Ministry of Law and Human Rights of the Republic of Indonesia. Some of the advantages of individual companies are that they can compete with Limited Liability Companies in general, are suitable for micro and small businesses, which are still beginners and want to develop their own business. Next, the business actor acts as a director, finally the legal entity status is obtained after registering the statement of establishment online. Keywords: business legality; business actors; individual companies; MSMEs.

Abstract

This article examines the negative impact of the implementation of the revision of Law Number 19 of 2019 on the Corruption Eradication Commission (KPK) in Indonesia. The main focus is on a substantive comparison between the revised KPK Law and previous laws, highlighting significant changes in the KPK's leadership selection mechanism, authority and independence. This research also analyzes the impact of these revisions on the performance and performance of the Corruption Eradication Commission, including changes in organizational structure, transfer of authority, and the impact on handling corruption cases. This evaluation provides critical insight into these legal changes, with the hope of providing a better understanding of the challenges faced by the Corruption Eradication Commission in carrying out its crucial mission of eradicating corruption. These results can aim to identify errors in the formation of the revision of the Corruption Eradication Commission Law which was initiated in 2019 using a regulatory approach to the formation of legislation. This article was written normatively, namely a research method that focuses on the analysis of legal documents or literature as the main source. This method does not involve collecting primary data, but instead focuses on the study and interpretation of legal texts or related literature. These results are then closed with suggestions and recommendations given so that the revision of the Corruption Eradication Committee Law that has been attempted does not become an arbitrary legal instrument but remains a good implementation so as to create a climate of good governance for the legal atmosphere in Indonesia.

Abstract

Abstrak: Adanya stigma negatif dan sulitnya akses informasi bagi penyandang disabilitas menyulitkan mereka untuk memperoleh pekerjaan ataupun membuat usaha sendiri. Untuk mengatasi masalah ini, pengabdian kepada masyarakat ini bertujuan untuk memberikan solusi agi penyandang disabilitas yang kurang mendapatkan informasi terkait pendaftaran perseroan perorangan sehingga mereka cinderung kesulitan untuk memperoleh izin atas usaha yang mereka miliki adanya pengabdian ini tentu dapat meningkatkan taraf hidup mereka terutama dalam aspek ekonomi dengan adanya izin yang jelas terkait usaha mereka sehingga mereka dapat menjalankan usahanya dengan lancar. yang dapat meningkatkan taraf hidup mereka terutama dalam aspek ekonomi . Pada kegiatan ini, menggunakan metode survei yaitu suatu penelitian yang dilakukan untuk memperoleh data-data dari fenomena yang berlangsung dan mencari keterangan-keterangan secara factual dari suatu kelompok. Kemudian dilanjutkan dengan analisis pendampingan pendaftaran perseroan perorangan bagi penyandang disabilitas. Hasil pengabdian kepada masyarakat menunjukkan bahwa adanya pendampingan dan pelatihan terkait pendaftaran perseroan perorangan memberikan pengetahuan dan juga keterampilan yang diperlukan untuk memberikan perlindungan dan kepastian hukum dalam menjalankan usaha. Kegiatan pendaftaran perseroan perorangan ini menghasilkan 3 (tiga) buah Sertifikat Nomor Induk Berusaha dan 9 (Sembilan) Sertifikat Pendaftaran Pendirian Perseroan.Abstract: The existence of negative stigma and difficult access to information for people with disabilities makes it difficult for them to get a job or create their own business. To overcome this problem, this community service aims to provide solutions for people with disabilities who lack information related to individual company registration so that they have difficulty obtaining permits for their businesses the existence of this service can certainly improve their living standards, especially in the economic aspect with a clear permit related to their business so that they can run their business smoothly. In this activity, using the survey method is a study conducted to obtain data from ongoing phenomena and seek factual information from a group. Then followed by the analysis of assistance for individual company registration for persons with disabilities as many as 13 people. The results of community service show that assistance and training related to the registration of individual companies provide the knowledge and skills needed to provide protection and legal certainty in running a business. This individual company registration activity resulted in 3 (three) certificates of business Identification Number and 9 (nine) certificates of registration of Company establishment. Abstract

Obscenity is a criminal act that violates immorality. The judge's verdict is a very important in every process. The definition of obscenity in the judge's verdict often has different meanings. This is considered an obscene act that does not have a limit on the meaning of an act that can be said to be obscene and not. This article aims to examine the elements of obscene acts and the law enforcement. This study uses normative juridical research method, by analyzing existing data and reviewing the data. The results of this study are the regulations that have been in effect are considered not to have elements in more detail. Especially in 289 KUHP has a vital element.that have been in force are considered not to have elements in a more detailed and comprehensive manner. Law enforcement officials must prioritize a sense of justice for victims of sexual abuse in accordance with the actions that have been carried out. In this case, the government cooperates with other relevant agencies to provide counseling regarding the offense of sexual abuse so that people can be more careful and increase their awareness. In addition, it needs to be formulated in the Criminal Code or other regulations regarding obscene acts which have a broad meaningso that they include acts of intercourse. The provision of sanctions by law enforcement officials is also expected to take into account the deterrent effect that will be caused to the perpetrators, this can be done through the provision of maximum sanctions demands.

Abstract

Like Criminal acts in general, corruption also has legal subjects, namely humans and legal entities. However, with the development of the times, artificial intelligence (AI) has emerged, which is artificial intelligence. So, it is not impossible that artificial intelligence (AI) could commit a criminal act. One of them is a particular criminal act, namely the criminal act of corruption. This research aims to determine the position of artificial intelligence (AI) as a legal subject with a mind like a human. This research also aims to determine the criminal responsibility of artificial intelligence who commits an extraordinary crime, namely corruption. The type of research used in preparing this research is normative juridical research methods. Data collection in this research was carried out using library research methods. Until now, there are no clear regulations regarding the criminal responsibility of AI who commit criminal acts of corruption. This creates a legal vacuum that requires further attention from the authorities. Namun dengan perkembangan zaman, hadir artificial intelligence (AI) yang merupakan sebuah kecerdasan buatan. Maka bukanlah hal yang tidak mungkin bahwa artificial intelligence (AI) dapat melakukan sebuah tindak pidana. Salah satunya ialah tindak pidana khusus yaitu tindak pidana korupsi. Penelitian ini bertujuan untuk mengetahui posisi artificiall intellegent (AI) sebagai subjek hukum yang mana memiliki akal pikiran layaknya seorang manusia. Penelitian ini juga bertujuan untuk mengetahui pertanggungajawaban pidana artificiall intellegent yang melakukan suatu tindak pidana khusus, yakni tindak pidana korupsi. Jenis penelitian yang digunakan dalam penyusunan penelitian ini adalah menggunakan metode penelitian yuridis normatif. Pengumpulan data pada penelitian ini dilakukan dengan menggunakan metode penelitian kepustakaan (library research). Hingga saat ini, belum ada regulasi yang jelas mengenai pertanggungjawaban pidana AI yang melakukan tindak pidana korupsi. Hal ini menciptakan kekosongan hukum yang memerlukan perhatian lebih lanjut dari pihak berwenang. Artificiall intellegent (AI) harus diatur dengan tepat sesuai dengan perkembangan teknologi dan hukum pidana modern. Abstract

Di masa pandemi COVID-19 yang dimana hampir segala kegiatan manusia beralih menjadi online ini, platform sosial media menjadi sebuah kekuatan yang sangat besar. Melalui interaksi yang ada di sosial media, pengguna internet dapat menjalin hubungan nyaris tak terbatas serta tanpa dibatasi jarak dan waktu. Akibatnya, dengan segala kegiatan yang dilakukan secara online, kekerasan berbasis gender siber, salah satunya non-consensual pornography meningkat drastis. Oleh karena itu, diperlukan usaha untuk memerangi kasus tersebut. Usaha tersebut dilakukan dengan mengkaji lebih lanjut bagaimana penegakan hukum terhadap pelaku tindak pidana non-consensual pornography. Artikel ini bertujuan untuk mengkaji penanganan dan kebijakan pemerintah dalam memberantas non-consensual pornography. Penlitian ini menggunakan metode penelitian yuridis normatif, dengan menganalisis data yang sudah ada dan mengkaji data tersebut. Hasil penelitian ini adalah peraturan yang sudah berlaku dinilai belum berperspektif korban dan komprehensif. Aparat penegak hukum juga masih banyak yang kurang kompeten. Maka, pengesahan RUU PKS adalah jalan utama untuk memberikan kepastian hukum dan memberikan keadilan bagi korban.During the COVID-19 pandemic, where almost all human activities have turned online, social media platforms have become a huge force. Through interactions on social media, internet users can establish nearly unlimited relationships without being limited by distance and time. As a result, with all activities carried out online, cyber gender-based violence, one of which is non-consensual pornography, has increased dramatically. Therefore, efforts are needed to combat this case. This effort is carried out by further reviewing how law enforcement is carried out against perpetrators of non-consensual pornography crimes. This article aims to examine the handling and government policies in eradicating non-consensual pornography. This study was structured using normative juridical research method, by analyzing existing data and reviewing these data. The result of this study is that the regulations that have been in force are considered not to have a victim perspective and are comprehensive. There are still many pornography law enforcement officers who are incompetent. Thus, the ratification of RUU PKS is believed to be the main way to provide legal certainty and provide justice for victims.

Abstract

Limbah infeksius Covid-19 yang tidak ditangani dengan benar dikhawatirkan menjadi sumber penularan baru Covid-19. Beberapa regulasi yang ada, diantaranya UU PPLH, UU Pengelolaan Sampah dan Peraturan Menteri Lingkungan Hidup dan Kehutanan Republik Indonesia No: P.56/Menlhk-Setjen/2015 telah memberikan pedoman cara mengelola sampah dan/atau limbah, baik itu dari rumah tangga ataupun fasilitas pelayanan kesehatan. Pengelolaan limbah infeksius Covid-19 harus dilakukan sesuai dengan peraturan perundang-undangan, namun masyarakat belum sepenuhnya mengetahui cara pengelolaan yang benar sehingga limbah yang seharusnya ditangani dengan cara khusus justru bercampur dengan limbah rumah tangga. Sehingga, diperlukan adanya aturan hukum mengenai kewajiban pengelolaan limbah infeksius Covid-19 disertai sanksi pidana, sanksi administrasi dan penambahan fasilitas pengelolaan limbah. Akhirnya, penegakan hukum terhadap pelaku pencemaran limbah infeksius Covid-19 dapat diwujudkan jika terjalin hubungan kerjasama yang baik antara masyarakat dengan pemerintah, salah satunya pemerintah menyediakan tempat pembuangan limbah infeksisus Covid-19 yang aman. Covid-19 infectious waste that is not handled properly is feared to become a new source of transmission of Covid-19. Several existing regulations, including the PPLH Law, the Waste Management Law, and the Regulation of the Minister of Environment and Forestry of the Republic of Indonesia Number: P.56/Menlhk-Setjen/2015 have provided guidelines on how to manage waste or waste, both from households and facilities. Health services. Statutory regulations must carry out the management of Covid-19 infectious waste. Still, the public needs to know how to manage it properly, so waste that should be handled specially is mixed with household waste. Thus, it is necessary to have legal regulations regarding the obligation to manage Covid-19 infectious waste accompanied by criminal sanctions, administrative sanctions, and additional waste management facilities. Finally, law enforcement against perpetrators of contamination of Covid-19 infectious waste can be realized if there is a good cooperative relationship between the community and the government, one of which is the government providing safe disposal sites for Covid-19 infectious waste.

Abstract

Manusia dan lingkungan alam adalah satu kesatuan yang tak terpisahkan, namun bumi telah mengalami kerusakan yang mengkhawatirkan. Perubahan lingkungan seperti deforestasi, erosi, tsunami, dan dampak manusia seperti pemanasan global, menimbulkan masalah serius yang memengaruhi seluruh planet. Undang-Undang Lingkungan Hidup mendefinisikan kerusakan lingkungan sebagai perubahan fisik atau biologis tanpa mendukung pembangunan berkelanjutan. Lingkungan mencakup dua jenis, biotik dan abiotik, dan masalah lingkungan dapat digolongkan sebagai dampak alam atau campur tangan manusia. Masalah ini sering kali disebabkan oleh tindakan manusia yang tidak memperhatikan dampaknya pada lingkungan. Salah satu cara manusia mengekspresikan kepeduliannya terhadap lingkungan adalah dengan mematuhi undang-undang yang mengatur pengelolaan lingkungan. Penyuluhan kepada masyarakat tentang pengelolaan hutan mangrove di Pantai Tanjung Burung, Tangerang, bertujuan untuk meningkatkan kesadaran mereka tentang pentingnya melestarikan ekosistem ini, terutama dalam konteks hukum yang berlaku. Penyuluhan ini diikuti oleh praktik penanaman bibit mangrove, yang membantu masyarakat memahami secara nyata cara menjaga dan memanfaatkan ekosistem ini secara berkelanjutan. Melalui penyuluhan ini, diharapkan masyarakat dapat berperan aktif dalam menjaga kelestarian lingkungan, memberikan manfaat ekonomi, dan merawat hutan mangrove di Pantai Tanjung Burung.

Abstract

This research uses normative juridical methods. The research technique begins by sorting the laws and regulations governing Gender, and this is done to find out how available work facilities are in the Depok City Government. PPPA Ministerial Regulation No. 5 of 2015 concerning Providing Gender Responsive Work Facilities and Caring for Children in the Workplace, the aim is to fulfil the right to protection for women and children; Fulfillment of children's rights and guarantee children's growth and development; Environmental responsibility in the care and protection of children; Increase work productivity. The unavailability of lactation rooms, the availability of special waiting rooms for children in the workplace, and the implementation of curfews for female workers are the main focus, and this certainly supports SDS5, namely Gender Equality. Thus, workplaces must provide facilities and infrastructure that take into account the principles of gender equality and the best interests of children. The provision of gender-responsive facilities and infrastructure is intended to increase work productivity and pay attention to the best interests and growth and development processes of children. Apart from fulfilling and protecting the rights of women and children, this includes fulfilling the rights and protection of people with disabilities and the elderly. The result is that the Depok City Government has not yet demonstrated work facilities that have a gender perspective. Therefore, to accelerate this fulfilment, the Government should be able to utilize old, habitable buildings to fulfil work facilities with a gender perspective.

Abstract

Disparitas merupakan adanya perbedaan atau jarak terhadap putusan hakim mengenai kasus yang sama. Dengan kata lain adanya disparitas putusan hakim terhadap pelaku tindak pidana ujaran kebencian ini dapat menimbulkan ketidakadilan terhadap pelaku tindak pidana ujaran kebencian. Tujuan dalam penelitian ini yaitu untuk menganalisis faktor-faktor serta menganalisis mekanisme yang ideal dalam menyelesaikan disparitas putusan hakim terhadap pelaku tindak pidana tindak kekerasan yang dilakukan oleh masyarakat umum. Jenis penelitian yang digunakan yuridis normatif dengan pendekatan hukum-undangan dan pendekatan kasus.Hasil yang diperoleh dari penelitian ini yaitu terdapat beberapa faktor yang menjadi penyebab disparitas putusan hakim terhadap pelaku tindak pidana ujaran kebencian serta dalam meminimalisir terjadinya disparitas ini diperlukan mekanisme yang ideal dengan penerapannya mengatur pemidaan dalam penegakan hukum. Kesimpulan dalam penelitian ini terdapat faktor-faktor penyebab disparitas putusan hakim seperti faktor dari sistem hukum Indonesia yang menggunakan hukum perdata , faktor dari undang-undang, faktor dalam diri hakim itu sendiri, faktor yang bersumber dari pembuktian dalam perkara, faktor berdasarkan keputusan pertimbangan, dan faktor dari ketiadaan yang memandu pemidanaan.Dengan begitu diperlukan mekanisme ideal dalam penyelesaian disparitas putusan hakim terhadap pelaku tindak pidana ujaran kebencian dengan diberlakukannya pedoman pemidanaan dalam KUHP baru, serta perlu adanya penegakan hukum pidana dalam penyelesaian disparitas putusan hakim terhadap pelaku ujaran kebencian sesuai dengan pedoman pemidanaan dalam KUHP baru.
