Abstract

The development of information and communication technology has had a positive impact on people's lives, but over time the forms of criminal acts have become increasingly diverse, from traditional to modern, one of which is the Crime of Pornography. The problem is how the factors influence the crime of pornography and what are the criteria for perpetrators and victims in the crime of pornography. This study uses a normative legal method with a statutory and conceptual approach. The result is that there are criteria for limiting perpetrators and victims in the crime of pornography, which can be said to be a perpetrator if everyone has been proven to produce, make, reproduce, duplicate, distribute, broadcast, import, export, offer, trade, rent and distribute pornography as regulated in the Pornography Law. Furthermore, it can be said to be a victim if someone becomes the object of a crime of Pornography, in addition, the victim is a person who experiences physical, mental, and/or economic suffering caused by a crime. A victim can also be said to be a perpetrator if he gives consent to the occurrence of a crime of pornography related to him. Therefore, there needs to be an update, especially in the Pornography Law which regulates the criteria for limiting perpetrators and victims, such as a victim can become a perpetrator if he/she agrees to commit a pornographic crime in addition to the perpetrator committing the crime as in Article 4 paragraph (1) of the Pornography Law. Thus, there needs to be a change in the Pornography Law to emphasize the role and limitations of perpetrators and victims so that this can provide legal certainty and benefits to perpetrators and victims of pornographic crimes

Abstract

Abstrak: Permasalahan sampah yang terjadi di Indonesia semakin hari semakin memprihatinkan. Masih banyak sampah yang dikelola dengan tidak memperhatikan prinsip 3R (Reduce, Reuse, Recycle) dan menyebabkan tercemarnya lingkungan hidup. Oleh karena itu tim menyelenggarakan sebuah penyuluhan yang bertujuan untuk mengedukasi masyarakat bagaimana pentingnya menjaga lingkungan dan cara menjaga lingkungan dimulai dari setiap individu. Metode yang digunakan dalam pelaksanaan penyuluhan kali ini adalah perpaduan antara pendidikan masyarakat dan pelatihan. Hasil dari kegiatan ini adalah rata-rata 36,66% telah mengerti apa itu lingkungan hidup, bagaimana pencemaran lingkungan hidup bisa terjadi, dan dampak dari pencemaran lingkungan hidup serta masyarakat juga mengetahui cara mencegah pencemaran lingkungan dengan mengikuti program pelestarian lingkungan yaitu mendaur ulang sampah plastik menjadi tote bag.Abstract:  The problem of waste that occurs in Indonesia is getting worse day by day. There is still a lot of waste managed without paying attention to the 3R principle (Reduce, Reuse, Recycle), which causes environmental pollution. Therefore, the team organized outreach to educate the public on how important it is to protect the environment and how to protect the environment, starting with each individual. The method used in implementing this extension is a combination of community education and training. The results of this activity are an average of 36.66% have understood the environment, how environmental pollution can occur, and the impact of environmental pollution. The community also knows how to prevent environmental pollution by participating in environmental conservation programs, namely recycling plastic waste be a tote bag.

Abstract

Krisis ekonomi yang diakibatkan oleh COVID-19 telah berimbas pada kebijakan merumahkan para pekerja/buruh. Tidak kurang dari 1,1 juta pekerja/buruh dirumahkan sejalan dengan pemberlakuan kebijakan lockdown. Kebijakan merumahkan ini bertentangan dengan Undang-undang Ketenagakerjaan, khususnya mengabaikan hak-hak pekerja/buruh. Tujuan tulisan ini melengkapi kekurangan dari studi terdahulu dengan mengkaji secara seksama bagaimana tindakan merumahkan bertentangan dengan nilai-nilai dasar hukum yang mengatur ketenagakerjaan. Metode yang digunakan bersifat kualitatif yang didasarkan pada pemetaan berita-berita online yang dipilih secara random berdasarkan tema berita yang memenuhi kriteria focus penelitian serta data statistic tentang banyaknya perusahaan yang merumahkan pekerja/buruh pada masa pandemic COVID-19. Kemudian diklasifikasikan secara sistematis untuk membuktikan adanya pelanggaran hukum dalam praktik merumahkan pekerja/buruh mengakibatkan pekerja/buruh mengalami tidak dapat menuntut hak-haknya dan disisi lain pengusaha tidak melaksanakan kewajiban hukumnya, berakhirnya kontrak kerja sebelum masanya, dan menghalangi hak pekerja/buruh untuk menyampaikan aspirasinya. Hasil penelitian memperlihatkan bahwa kebijakan pada masa pandemic perlu dievaluasi, karena pengalaman masyarakat menjalani masa pandemic tidak menjadi perhatian dalam membuat kebijakan. Kesimpulan penting dari kajian ini adalah perlunya suatu pemahaman subjektif tentang pekerja/buruh yang mengalami kebijakan dirumahkan, sebagai alternatif pada pemahaman umum dan bersifat top down.The economic crisis caused by COVID-19 has an impact on the policy of laying off workers/laborers. No less than 1.1 million workers/laborers were laid-off in line with the implementation of the lockdown policy. This housing policy is contrary to the Manpower Act, particularly ignoring the rights of workers/laborers. The purpose of this paper is to fill in the deficiencies of previous studies by examining carefully how the act of housing is contrary to the basic legal values governing manpower. The method used is qualitative which is based on mapping online news that is randomly selected based on news themes that meet the research focus criteria as well as statistical data about the number of companies laying off workers/laborers during the COVID-19 pandemic. Then it is classified systematically to prove there is a violation of law in the practice of laying off workers/laborers causing workers/laborers to experience being unable to claim their rights and on the other hand employers not carrying out their legal obligations, ending work contracts prematurely, and hindering workers/laborers' rights to express their aspirations. The results of the study show that policies during a pandemic need to be evaluated because the experience of the community during a pandemic is not a concern in making policies. An important conclusion from this study is the need for a subjective understanding of workers/laborers who have experienced the laid-off policy, as an alternative to general understanding and is top-down.

Abstract

Introduction: Perpetrators of obscene acts have carried out various criminal acts. Obscene acts are included in sexual violence that results in physical and psychological suffering.Purposes of the Research: This study aims to analyze the fulfillment of the rights of victims of obscene acts, whether it is appropriate or not. This is based on the phenomenon of indecent acts; the more extended the number of victims increases.Methods of the Research: This study uses a normative juridical method with a statute and case approach.Results of the Research: The results of the study indicate that the rights of victims of obscene acts have been regulated and guaranteed in the 1945 Constitution of the Republic of Indonesia, the Law on Human Rights, the Law for the Protection of Witnesses and Victims and the Act on the Crime of Sexual Violence. However, the problem is in the fulfillment of these rights, even though constitutionally, the duties and obligations of fulfilling the rights of victims are borne by the State, which in this case is in the components of the Criminal Justice System, the Ministry of Law and Human Rights, the Ministry of Women's Empowerment and Child Protection, The National Commission on Human Rights, the National Commission on Violence Against Women and the Witness and Victim Protection Agency. The importance of supervision and compliance with the application of rights in everyday life will determine how successful the State is in carrying out its obligations in fulfilling the requests of victims. So it is essential to cooperate between Ministries, Institutions, National Commissions, and law enforcement officials to realize the fulfillment of the rights of victims of criminal acts of obscenity.

Abstract

This article aims to analyze the legal protection for victims of domestic violence through the Restraining Order mechanism. In addition, this article also aims to provide recommendations for legal improvements so that the use of the Restraining Order mechanism can be more effective. In Indonesia, the mechanism of Restraining Order has not been regulated in detail in the law. Law No. 23/2004 on the Elimination of Domestic Violence has mentioned the existence of a protection order against victims that can be given by the police or the court, but this protection order is not well implemented. Therefore, the urgency of this article is to provide definitive protection to victims of domestic violence through the mechanism of Detention Orders. This article is a normative legal research. The novelty of this article is about analyzing the use of Restraining Order punishment in Common Law countries, as well as providing suggestions regarding the clarity of Restraining Order Implementation in Indonesia. The results of this study indicate that the Restraining Order mechanism used by Common Law countries is more effective in providing protection to victims of domestic violence because basically the legal protection of victims of domestic violence in Indonesia only relies on Law Number 23 Year 2004 which the contents of the Law are still not fully effective in protecting victims of domestic violence.

Abstract

Permasalahan mitra merujuk pada minimnya legalitas usaha, salah satunya adalah Sertifikasi Produksi Pangan Industri Rumah Tangga (SPP-IRT). Tujuan dari program Pengabdian Kepada Masyarakat ini adalah pekerjaan layak dan pertumbuhan ekonomi. Untuk memaksimalkan pertumbuhan ekonomi, maka pekerjaan yang layak dan lingkungan kerja yang sehat harus dijamin agar investasi dan konsumsi terus berjalan. Salah satu poin penting dalam pertumbuhan ekonomi adalah dengan pemenuhan legalitas oleh Pelaku UMKM industri rumah tangga dalam bentuk SPP-IRT. Metode yang digunakan adalah Community Development dengan melakukan upaya pengembangan pemberdayaan masyarakat dengan menjadikan masyarakat sebagai subyek dan sekaligus obyek pembangunan dan melibatkan masyarakat secara langsung dalam berbagai kegiatan pengabdian masyarakat sebagai upaya meningkatkan peran serta masyarakat dalam pembangunan demi kepentingan masyarakat itu sendiri. Hasilnya, pelaku usaha berhasil untuk di dampingi dalam pendaftaran Nomor Induk Berusaha dan SPP-IRT. SPP-IRT menjadi ukuran bahwa pelaku usaha khususnya Industri Rumah Tangga telah memenuhi syarat dan standar keamanan tertentu dalam rangka produksi dan peredaran produk pangan

Abstract

Sikap bela negara itu sendiri merupakan kekuatan Negara Indonesia bagi proses pembangunan nasional menuju tujuan nasional dan merupakan kondisi yang harus diwujudkan agar proses pencapaian tujuan nasional tersebut dapat berjalan dengan sukses. Oleh karena itu, diperlukan suatu konsepsi ketahanan nasional yang sesuai dengan karakteristik bangsa Indonesia. Dengan adanya kesadaran akan Bela Negara, kita harus dapat memiliki sikap dan prilaku yang sesuai kejuangan, cinta tanah air serta rela berkorban bagi nusa dan bangsa. Dalam kaitannya dengan pemuda penerus bangsa sangat penting ditanamkan sikap cinta tanah air sejak dini sehingga kecintaan mereka terhadap bangsa dan negara lebih meyakini dan lebih dalam. Sumber daya manusia menjadi titik sentral potensi bangsa yang berperan melaksanakan pembangunan dan mengatasi segala bentuk ancaman, baik dari dalam ataupun dari luar negeri. Pertengkaran antar pelajar menjadi perhatian utama dalam lingkungan pendidikan di berbagai negara. Oleh sebab itu, Adapun kegiatan yang akan dilaksanakan antara lain penguatan Bela Negara; sosialisasi Peraturan Perundang-Undangan Pidana; dan pelaksanaan model pembelajaran Role Play. Kegiatan penguatan bela negara yang dilaksanakan di tingkat SMA terbukti berhasil mencapai tujuan yang ditetapkan, ditandai dengan meningkatnya pemahaman dan kesadaran siswa terhadap pentingnya peran mereka dalam menjaga keutuhan bangsa. Kegiatan ini juga mendapat respons positif dari para peserta, guru, dan pihak sekolah, yang menilai bahwa materi serta metode yang digunakan mampu membangkitkan semangat nasionalisme dan tanggung jawab sebagai warga negara.

Abstract

This research discusses the rights of workers / laborers during the COVID-19 pandemic and what if the employers do not meet these rights. Problem which is more in-depth about the employment that emerged during this pandemic, namely the occurrence of massive layoffs. The research was conducted using the Normative Juridical method. By applying the Statute Approach, Conceptual Approach, and Case Approach, the results show that employers have not been able to fulfill workers / labor rights during the COVID-19 pandemic. There are companies that have not implemented the clean lifestyle and occupational health standards K3 protection such as masks, hand sanitizer and personal protective equipment. Prevention and handling policies are still not optimal, the principle of maintaining social distancing has not been implemented optimally, there are still many workers who are jostling for work when they come to work, not to mention during the trip to work in public transportation.  This situation makes them vulnerable to infection. However, they still have to go to work because of the risk of losing their income. Efforts that can be made if wages are not paid are to take the route or methods as regulated in Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes. The basis of a dispute between a worker/ laborer and an entrepreneur is a dispute over rights.

Abstract

The practice of prostitution is a practice that is contrary to the principles of norms and ethics. It is often considered a practice that disrupts public order. This study aims to examine more deeply the development of prostitution in Indonesia and how to criminalize prostitution service users in Indonesia. This paper uses a normative legal research method, with a statutory approach, a conceptual approach, and a case approach. The results of the study show that increasingly sophisticated information and communication technology encourages the emergence of various new modus operandi in the practice of prostitution. Actors who previously had to do it face-to-face and meet in person at certain places when transacting can now do so by utilizing the features and various social media platforms available on smartphones. A large number of social media users encourages the increasing number of cases of prostitution in Indonesia. What's more, not everyone involved in this practice can be convicted, even if it's easy for users of prostitution services to escape the law, it's not a strange thing. This condition is caused by the absence of clear and firm regulations against prostitution service users, therefore, it is necessary to criminalize prostitution service users in the positive legal system in Indonesia to provide fear and deterrent effect for the perpetrators.

Abstract

This article aims to analyze the legal protection for victims of domestic abandonment through restitution fulfillment. It is because imprisonment in the case of domestic abandonment basically cannot accommodate the economic losses suffered by the victims. Legal protection for victims should also focus on restoring the economic losses incurred during the abandonment. Therefore, the urgency of this article is the attempt to fulfill restitution for victims as the manifestation of the victim’s right. This article is normative legal research. The novelty of this article is about the attempt to fulfill restitution, which is studied based on positive law in Indonesia and the problems were analyzed using Gustav Radburch's legal theory on the principle of priority in three legal objectives. The research results indicate that one of the challenges of restitution fulfillment in the current legal system is when the victims are not submitting the restitution request before or even after a court verdict. Hence, the judges in their verdict cannot accommodate this restitution for the victims and they cannot receive their rights of restitution. Because of that it is expected that the attempt of restitution fulfillment will accommodate the economic losses suffered by victims during abandonment.
