Abstract

Land conflicts in Indonesia, especially in Jambi Province, have become an urgent issue affecting the ownership and management of agricultural land, forests and natural resources. This problem involves various parties and requires serious handling to reduce social tensions, increase justice, and ensure environmental sustainability. This research aims to explore trends, obstacles, and adaptive solutions in resolving land conflicts in Jambi Province, Indonesia. The research method used is qualitative, involving data collection stages through interviews, observation, and documentation of land conflict cases from various official sources. Nvivo 12 Plus was also used in this study to help code the data. The research findings highlight the complexity and escalation of the urgency of land conflicts in Jambi Province, which are widespread in the plantation and forestry sectors involving a large number of companies in various industrial sectors. The main obstacles faced in resolving conflicts include social tensions, legal uncertainty, lack of coordination, limited resources, lack of public awareness, rapid economic growth, and policy complexity. To overcome this challenge, adaptive and sustainable steps are needed, including strengthening the legal framework, increasing coordination between institutions, and community participation through inclusive dialogue. In addition, human rights and justice-based approaches are integrated to support sustainable conflict resolution while strengthening local capacity to be actively involved in the conflict resolution process. This research provides important insights for future policymakers, researchers, and practitioners. This research also provides important insights for formulating more effective and sustainable policies in dealing with land conflicts in Jambi Province, by integrating approaches based on human rights, justice and community participation.

Abstract

The number of investigations into criminal illegal logging carried out by the Batanghari Police has increased from year to year. Therefore, the problem of illegal logging in Batanghari Regency must be immediately addressed as well as possible so as not to further damage the forests in Batanghari Regency. There is concern that if the forests in Batanghari Regency, which play a major role in supporting human life, are damaged by the actions of certain individuals, then natural disasters will be difficult to avoid. Apart from that, ecosystem life will be greatly disrupted and lives will also be affected. The aim of this investigation is to clarify the process of investigating trees without permits (illegal logging). This type of research carried out by the author is the result of a discussion investigation, the following conclusions can be drawn. Batanghari police investigators conducted an investigation into the criminal act of felling trees without a permit in Batanghari district, arrested the suspect, secured evidence, and interrogated him at the police office. TKP, Execution of additional files followed up, examination of suspects, examination of witnesses and TKP continued to the investigation level evidentiary process by Batanghari Police Detectives. The obstacles faced by Batanghari Police investigators in investigating the crime of felling trees without permission in Batanghari Regency include limited investigative resources, difficulty in reaching illegal logging locations, the escape of the perpetrators and the involvement of the community itself. and transporters, but also collectors and financiers when carrying out investigations.

Abstract

This study aims to identify and analyze the types of acts or crimes that can be subject to criminal supervision sanctions in Indonesia and the Netherlands, as well as to provide a comprehensive understanding of the application of criminal supervision sanctions in the Indonesian and Dutch criminal law systems, so that it can be used as input for the development of national criminal law. The type of research used is normative juridical research, using legislative approach methods, comparative approaches, and conceptual approaches. The results of this study indicate that in Indonesia, the new Criminal Code stipulates criminal supervision sanctions for defendants with a maximum sentence of 5 years in prison, and a supervision period of no more than 3 years. Meanwhile, in the Netherlands, it is regulated in the Wetboek van Strafrecht for defendants who are threatened with a sentence of more than 2 years, a maximum of 4 years with a probationary period of 3 years and a maximum of 10 years, and in Indonesia the implementation is carried out by the Judicial Institution, the Prosecutor's Office, and the Correctional Institution. Meanwhile, in the Netherlands, supervision is carried out in a more structured manner by the Reclassering Institution together with the Public Prosecutor based on the Wetboek van Strafvordering, so the system is more systematic than in Indonesia. It is hoped that Indonesia will establish a special institution for criminal supervision to be more structured and systematic, and will immediately ratify the Criminal Code. ABSTRAK Penelitian ini bertujuan, untuk mengetahui dan menganalisis jenis-jenis perbuatan atau tindak pidana yang dapat dikenakan sanksi Pidana Pengawasan di Indonesia dan Belanda, dan untuk memberikan pemahaman yang komprehensif mengenai penerapan pidana pengawasan dalam sistem hukum pidana Indonesia dan Belanda, sehingga dapat menjadi bahan masukan bagi pengembangan hukum pidana nasional. Jenis penelitian yang digunakan yaitu penelitian yuridis normatif, dengan menggunakan metode pendekatan perundang-undangan, pendekatan komparatif dan pendekatan konseptual. Hasil dari penelitian ini menunjukan bahwa di Indonesia, Kitab Undang-Undang Hukum Pidana baru menetapkan pidana pengawasan bagi Terdakwa dengan ancaman hukuman paling lama 5 tahun penjara, dan pidana pengawasannya tidak lebih dari 3 tahun. Sedangkan di Belanda, diatur dalam Wetboek van Strafrecht bagi Terdakwa yang diancam dengan pidana lebih dari 2 tahun maksimal 4 tahun dengan masa percobaan 3 tahun dan paling lama 10 tahun, dan di Indonesia pelaksanaannya dilakukan oleh Lembaga Peradilan, Kejaksaan, dan Badan Pemasyarakatan. Sementara di Belanda, pengawasan dijalankan secara lebih terstruktur oleh Lembaga Reclassering bersama Jaksa berdasarkan Wetboek van Strafvordering, sehingga sistemnya lebih sistematis dibanding di Indonesia. Diharapkan di Indonesia membentuk lembaga khusus untuk pidana pengawasan agar lebih terstruktur dan sistematis, dan segera mengesahkan Kitab Undang-Undang Hukum Acara Pidana

Abstract

The advancement of information technology has brought significant changes in various aspects of life, including in religious-based educational environments such as Islamic boarding schools (pesantren). These institutions are not immune to such threats, considering the ease of access to the internet and digital devices. Although technology offers many benefits, its development also increases the risk of cybercrimes, including online gambling. This activity aims to provide legal understanding related to cybercrime in general and online gambling in particular, as well as to equip students (santri) with life skills and encourage their active participation in preventing and combating such crimes. The motives behind cybercrimes are generally not limited to economic factors alone but can also stem from intellectual motives. From an economic perspective, online gambling is a prevalent form of cybercrime in Jambi Province, especially among children, teenagers, and civil servants. Many students and teachers are still unaware that certain online activities can constitute crimes, including online gambling—both in terms of their legal aspects, impacts, and efforts for prevention. Jambi Province, in particular, has been identified as having one of the highest numbers of online gambling cases in Indonesia. The methods used include socialization, simulation, and interactive discussions. After participating in this legal education program, it is expected that the students will not only refrain from engaging in online gambling but also become pioneers of digital da’wah, promoting positive values and encouraging the community to lead a healthier and more Islamic lifestyle. Kemajuan teknologi informasi telah membawa perubahan signifikan dalam berbagai aspek kehidupan, termasuk di lingkungan pendidikan berbasis keagamaan seperti pesantren. Lingkungan pesantren pun tidak luput dari ancaman ini, mengingat kemudahan akses terhadap internet dan perangkat digital. Meskipun memberikan manfaat, perkembangan teknologi juga meningkatkan risiko terjadinya kejahatan siber termasuk judi online. Kegiatan ini bertujuan untuk memberikan pemahaman hukum mengenai kejahatan siber pada umumnya serta judi online khususnya. serta membekali para santri dengan lifeskill dan partisipasi aktif dalam mencegah serta menanggulangi kejahatan ini. Motif pelaku kejahatan siber pada umumnya bukannya hanya sekedar motif ekonomi semata namun juga kejahatan ini dilakukan dengan motif intelektual. Dari motif ekonomi, judi online merupakan kejahatan siber yang marak terjadi di Provinsi jambi khususnya oleh anak dan remaja serta ASN. Banyak santri dan tenaga pengajar belum memahami bahwa beberapa tindakan di internet bisa termasuk kejahatan termasuk judi online, baik itu aspek hukum, dampak serta bagaimana Upaya penanggulangannya. bahwa Provinsi Jambi khususnya merupakan Provinsi kasus judi online tertinggi di Indonesia Metode yang dilakukan berupa sosialisasi, simulasi dan tanya jawab. Perubahan literasi digital khususnya aspek hukum digital berdampak pada santri, dan juga diharapkan santri menjadi pelopor dakwah digital yang menyebarkan nilai-nilai kebaikan dan mengajak masyarakat untuk hidup lebih sehat dan Islami

Abstract

This article aims to analyse the application of Restorative Justice in investigating narcotics crimes in the Jambi Police Jurisdiction and the obstacles encountered. The approach of restorative justice in the investigation of narcotics crimes in Indonesia is becoming increasingly popular, specifically in the context of handling addicts and victims of narcotics abuse to restore the conditions before the crime occurred, with a focus on rehabilitation and restoration of the relationship between perpetrators and victims (victimless). As empirical juridical research, this article refers to observing the operation of law in society. The results of this study indicate that the application of restorative justice for narcotic abusers must be carried out by referring to the criteria established in the National Police Regulation (Perkapolri) No. 8 of 2021 at the request of the family concerned, followed by an assessment of the perpetrator. However, there are impediments to implementing Restorative Justice, such as a lack of human resources with specific competencies and qualifications, as well as a lack of facilities for narcotics law enforcement at the Jambi Police Narcotics Unit. Therefore, considering that the application of Restorative Justice is time-limited, intense cooperation is needed for all parties who conduct assessments related to scheduling and human resources so that the application of restorative justice can be carried out in time. Furthermore, the Jambi Police Narcotics Unit's support facilities for law enforcement of narcotics crimes must be enhanced further to facilitate the realization of restorative justice.
