Abstract

Child marriages are common throughout Indonesia. This is due to a strong influence of Indonesian customs and religion that strongly influence the lives of its people. It is worth pointing that marriage age arrangements in Indonesian Marriage Law reinforces that legal age for men is 19 years and 16 years for women. The 2012 statistics show that Indonesia is the 37th highest in the world in child marriage, while at the Southeast Asian level, this country ranks second after Cambodia. The ranking went up dramatically since in 2016, based on UNICEF, Indonesia ranked the 7th in child marriage worldwide. This means that the practice of child marriage in Indonesia happens, especially to women at the age of 18 years, and there is no discrimination related to the age of marriage. Against this matter, there has been a file for judicial review that demands marriage age for men and women to be pegged at the age of 18 years. However, the Judge of the Constitutional Court, through Decision Number 30-74/PUU-XII/2014, states that age of marriage remains valid for the 19-year-old for man and 16-year-old for women. The struggle does not stop there because at this time, there a national movement of STOP CHILD MARRIAGE formed by civil organisations in cooperation with the Commission of Child Protection and Ministry of Woman Empowerment and Child Protection. This movement sees that the practice of child marriage is a national emergency problem that must be addressed seriously. Further, this movement demands immediate enactment of government regulation in favour of the law which must promptly revise the Marriage Law, especially related to the marriage age.

Abstract

Clinical trials are an important instrument in the development of science and technology in the health field that aims to produce safe and effective medical interventions. The implementation of research involving human subjects cannot be carried out without clear guidelines, ethical standards, and legal frameworks. In the Indonesian context, various stages and procedures have been established to ensure that clinical trials, including the Tuberculosis (TB) vaccine clinical trials that have been carried out, run in accordance with legal principles and medical ethics. This study uses a normative juridical method by relying on secondary data through library research. The focus of the analysis is directed at laws and regulations, public policies, and official documents that regulate the management of vaccine clinical trials in Indonesia. The results of the study show that: First, the implementation of TB vaccine clinical trials in Indonesia must be based on the provisions of national health law by upholding the principles of utility, morality, religious values, moral norms and oriental norms, as well as compliance with all relevant laws and regulations. Second, public health interests can be the basis for restricting individual rights in the implementation of clinical trials, as long as there is strong scientific evidence regarding the potential for the rapid and dangerous spread of infectious diseases, so that the action is proportionate and has legal legitimacy.

Abstract

The rapid growth of e-commerce in Indonesia has increased the volume of marketplace transactions, leading to a surge in consumer disputes. However, current dispute resolution mechanisms remain conventional and ineffective in addressing the unique challenges of digital transactions. This study aims to analyze the implementation of Online Dispute Resolution (ODR) as an alternative mechanism for resolving consumer disputes in marketplace transactions, and to examine the urgency of establishing a comprehensive legal framework for ODR in Indonesia. Employing a normative juridical approach, this research reviews primary and secondary legal materials, including laws, regulations, and relevant literature, with qualitative descriptive analysis. The findings reveal that Indonesia lacks specific ODR regulations, limiting its optimal application despite its recognition in existing laws. Implementing ODR can enhance consumer access to justice by providing faster, simpler, cost-effective dispute resolution methods. The study emphasizes the need for comprehensive legal reforms to regulate ODR procedures, institutional responsibilities, data security, and the enforceability of ODR decisions. Strengthening the legal basis for ODR will improve consumer protection, legal certainty, and public trust in digital transactions, supporting a fairer digital economy.

Abstract

This study examines the implications of the Supreme Court Circular Letter (SEMA) No. 3 of 2023 on the application of the paritas creditorium principle in bankruptcy cases involving apartment developers in Indonesia. The regulation has created a normative tension between the universal nature of bankruptcy law under Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligation and the judicial restriction imposed by SEMA, which states that bankruptcy petitions against apartment developers do not fulfill the requirement of simple proof. Using a normative juridical methodology with descriptive-analytical specifications, this research is grounded in literature studies of primary, secondary, and tertiary legal sources, supported by case analysis and expert interviews. The findings reveal that SEMA No. 3 of 2023 substantially degrades the implementation of the paritas creditorium principle, limits creditors’ access to collective debt resolution mechanisms, and creates legal uncertainty through dualism of norms between statutory provisions and judicial circulars. As a result, creditors—particularly consumer creditors—are compelled to seek alternative legal remedies through civil litigation, including class action lawsuits accompanied by conservatoir beslag and execution mechanisms. This study contributes to the development of bankruptcy law discourse and offers practical recommendations to restore fairness, certainty, and effectiveness in resolving debt disputes involving apartment developers.

Abstract

The principle of judicial passivity is a fundamental tenet in Indonesian civil procedural law; however, judges are not passive throughout all trial stages and may adopt an active role at times. Similarly, judges in religious courts—judicial bodies under the Supreme Court—have begun to apply the principle of active judging. This raises the question of whether such judicial activism conflicts with civil procedural regulations in Indonesia. This paper examines the implementation of the Dominus Litis principle (active judge) within Religious Courts by analyzing various judicial decisions and considerations. Employing a qualitative juridical descriptive approach, the research finds that panels of judges in Religious Courts actively apply the Dominus Litis principle during conciliation, evidence assessment, legal counseling, and the mobile court program.
