Abstract

Abstrak: Peran karyawan dalam pembangunan nasional sangat besar dengan berbagai tantangan yang dihadapi. Oleh karenanya kepada mereka sangat perlu untuk diberikan perlindungan, pemeliharaan, dan peningkatan kesejahteraan. Dimana  saat ini Peraturan Perusahaan di PT PK Manufacturing Indonesia akan segera berakhir, sehingga perlu dilakukan perpanjangan kembali ke Disnakertransnas Kabupaten Karawang. Dengan adanya serikat pekerja di perusahaan maka pengusaha dapat mengajukan permohonan perpanjangan masa berlaku PP dengan pertimbangan perusahaan merubah status dari PP ke PKB. Pendekatan penelitian ini adalah kualitatif dengan jenis penelitian hukum yuridis empiris. Sumber data penelitian berasal dari data primer dan data sekunder. Teknik pengambilan data yaitu wawancara dan dokumentasi kepada Kepala Bidang Hubungan Industrrial, Karyawan HRD, Serikat Pekerja. Hasil penelitian menunjukkan bahwa (1) Pengusaha selalu mengajak Serikat Pekerja untuk melanjutkan peraturan perusahaan saat akan berakhir masa berlakunya dan Serikat Pekerja menyetujui hal tersebut mengingat saat penyusunan Peraturan Perusahaan dalam menentukan isinya terkait hak dan kewajiban kedua belah pihak diadakan secara berunding atas kepentingan para pihak sesuai dengan nilai-nilai Pancasila. (2) Prosedur Penyusunan Peraturan Perusahaan antara pengusaha dengan Serikat Pekerja yaitu (a) Pengusaha membuat draft perubahan PP; (b) Pengusaha memberikan draft perubahan PP kepada Serikat Pekerja agar didapatkan saran dan pertimbangan; (c) Pelaksanaan Perundingan PP antara Pengusaha dengan Serikat Pekerja; (d) Kesepakatan Hasil Perundingan; (e) Pengesahan PP oleh Pimpinan Perusahaan; (f) Pendaftaran PP di Dinas Tenaga Kerja dan Transmigrasi Kota Semarang; dan (g) Pelaksanaan PP oleh pihak-pihak terkait. (3) Faktor pendukung dalam proses penyusunan PP adanya sosialisasi/pengarahan dari Serikat Pekerja kepada anggotanya terkait dengan penyusunan PP; dan adanya dukungan penuh dari Disnakertrans Kota Karawang dalam pendaftaran PP.

Abstract

The harmonization of draft regional regulations is part of the stages of drafting the formation of laws and regulations to harmonize the substance of the draft laws and regulations and adapt them to the techniques of drafting laws and regulations, as an effort to minimize the occurrence of cancellation or revocation of regional regulations due to disharmony with regulations. related legislation. The formulation of the problem that will be described in this paper is how to implement the harmonization of regional legal products based on the provisions of the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 22 of 2018 concerning the Harmonization of Draft Laws and Regulations Formed in the Regions by the Designer of Legislation -Invitation. The method used in this research is a normative juridical research method. The results of the study indicate that in the process of forming regional regulations, they must go through the stages of harmonization by involving the drafting of laws and regulations. The results of the study show that there are still many regional regulations in the regions that have not gone through the harmonization stage, thus allowing the draft regional regulations that have been formed not to comply with the laws and regulations both formally and materially. Abstract

Terbitnya Instruksi Presiden Nomor 1 Tahun 2022 mewajibkan pembeli untuk terdaftar di BPJS Kesehatan dalam pendaftaran peralihan hak tanah karena jual beli, menambahkan persyaratan baru. Penelitian ini bertujuan mengevaluasi sinkronisasi regulasi keanggotaan BPJS Kesehatan dalam pendaftaran peralihan hak tanah, implementasi persyaratan oleh Kantor Badan Pertanahan Nasional Kota Medan, dan penundaan pelaksanaan. Penelitian normatif melibatkan wawancara dan studi literatur, menganalisis bahan hukum primer, sekunder, dan tersier secara kualitatif. Temuan menunjukkan sinkronisasi vertikal tidak praktis untuk Instruksi Presiden sebagai regulasi kebijakan. Sinkronisasi horizontal antara Undang-Undang Pokok Agraria Nomor 5 Tahun 1960 dan Undang-Undang Badan Penyelenggara Jaminan Sosial Nomor 24 Tahun 2011 kurang relevan. Kantor Badan Pertanahan Nasional Kota Medan awalnya menerapkan persyaratan kartu BPJS Kesehatan, namun surat edaran pada 18 Agustus 2022 mengindikasikan penundaan, menunjukkan ketidakselarasan. Penundaan sesuai karena Instruksi Presiden Nomor 1 Tahun 2022 tidak memiliki kekuatan hukum mengikat. Namun, surat edaran tidak menyebutkan durasi penundaan, menimbulkan ketidakpastian hukum dan masalah manfaat.

Abstract

The establishment of a Job Loss Security Program in The Stipulation of a Government Regulation instead of Law Number 2 Year 2022 concerning Job Creation protects workers who have experienced the severance of employment relationship. This form of protection, by International Labor Organization Convention 102 and Convention 168, is known as Unemployment Benefits. The Unemployment Benefit Scheme in Indonesia is implemented through the Job Loss Security Program. In its regulation under Article 45A of Law Number 50 Year 2004 concerning the National Social Security System in conjunction with the Job Creation Law,  the Job Loss Security Program only provides benefit protection to workers who experience severance of employment, in other words, to workers with employment relationships who are Wage Recipients Participants in the BPJS membership. The protection of the Job Loss Security Program to non-wage recipient participants in BPJS membership, consisting of workers outside of employment relationships, is still not covered due to the limitation of beneficiary rules only to workers who experience severance of employment relationships. The research method used is a normative juridical method with a descriptive nature. This study shows that the existing regulations only provide partial protection. Countries such as Denmark, Spain, Serbia, the People's Republic of China, and others have previously implemented mandatory or voluntary Unemployment Benefit schemes for non-employment relationship workers. In this study, these countries serve as a comparison for the Unemployment Benefit system between developed and developing countries that have implemented it beforehand. The Unemployment Benefit system previously applied to non-employment relationship workers in other countries is an opportunity for Indonesia to implement it as well. The urgency of Unemployment Benefits Social Security protection through the Unemployment Benefits Program is important as a form of state protection holistically.

Abstract

Fenomena judi online dan pencucian uang melalui pinjaman online telah menjadi isu serius di Indonesia, yang menunjukkan adanya ketidaksesuaian antara norma sosial dan hukum positif. Penelitian ini bertujuan untuk menganalisis fenomena tersebut melalui pendekatan sosiologi hukum guna memahami bagaimana celah dalam regulasi dan perkembangan teknologi finansial dimanfaatkan oleh pelaku kejahatan. Dengan menggunakan metode deskriptif-kualitatif dan pendekatan normatif, penelitian ini menemukan bahwa kurangnya respons hukum terhadap perkembangan teknologi digital membuat pelaku kejahatan leluasa menggunakan layanan pinjaman online sebagai sarana pencucian uang. Ketertinggalan hukum ini diperburuk oleh rendahnya kepercayaan masyarakat terhadap penegakan hukum, yang dapat mendorong ketidakpatuhan sosial. Rekomendasi dari penelitian ini meliputi reformasi regulasi pada UU ITE dan KUHP untuk lebih efektif dalam menangani kejahatan digital, peningkatan edukasi masyarakat mengenai risiko judi online dan pinjaman online ilegal, serta kolaborasi internasional dalam penegakan hukum terhadap kejahatan lintas batas. Dengan reformasi yang responsif terhadap aspek sosial, ekonomi, dan teknologi, hukum dapat berfungsi lebih efektif sebagai pengendali sosial di era digital.

Abstract

Narkotika merupakan zat yang berasal dari tanaman maupun non-tanaman yang memberikan efek bahagia, tenang, dan rileks bagi penggunanya. Namun, penggunaan narkoba secara berlebihan menyebabkan kecanduan, ketergantungan, bahkan kematian. Penyalahgunaan narkotika kini telah meluas ke berbagai lapisan masyarakat tanpa memandang usia, status sosial, atau pekerjaan. Di Kota Medan, terutama di kawasan yang dikenal sebagai "Kampung Narkoba," penggunaan narkoba menjadi masalah sosial serius yang mempengaruhi stabilitas ekonomi dan kesejahteraan masyarakat setempat. Penggerebekan kampung narkoba oleh aparat menjadi salah satu upaya yang ditempuh untuk menekan peredaran narkoba. Meski mampu meningkatkan rasa aman sementara dan mengurangi aktivitas narkoba, pendekatan ini juga memiliki dampak negatif. Trauma sosial, ketidakstabilan ekonomi, serta potensi kekerasan yang terjadi dalam penggerebekan kerap dialami oleh warga yang tidak terlibat langsung, termasuk anak-anak. Dari perspektif sosiologi hukum, penegakan hukum represif tanpa dukungan rehabilitasi dan pemberdayaan ekonomi masyarakat tidak cukup efektif untuk mengatasi masalah narkoba secara berkelanjutan. Oleh karena itu, dibutuhkan kerjasama intensif antara masyarakat dan pemerintah melalui pendekatan yang holistik, yang mencakup edukasi, rehabilitasi, dan pemberdayaan ekonomi, untuk menciptakan lingkungan yang lebih sehat dan bebas narkoba di Kota Medan.

Abstract

Social security, according to the ILO, is a protection system to protect people from social and economic risks. In Indonesia, the formal worker social security system does not yet cover the entire community, especially in the informal sector. For this reason, Indonesia introduced the Job Loss Guarantee (JKP) program to protect workers who lose their jobs, with cash benefits, labor market information, and training. This program was inspired by countries such as Malaysia and Japan that had already implemented it. Indonesia adopted ILO standards in Conventions 102 and 168 to improve social protection, including unemployment benefits and employment opportunities. The conclusion from the discussion of the JKP program in Indonesia, Malaysia, and Japan is that the JKP system in Indonesia still has several shortcomings, such as participation requirements in other social security programs that hinder registered workers, small cash benefits, and complicated procedures. Job training benefits are also not optimal. In Malaysia, the JKP program effectively protects workers in the formal and informal sectors with a benefit duration of between 3 to 6 months, while Japan provides varying benefits, with a duration of between 3 to 12 months. To increase the effectiveness of the Indonesian JKP, it is necessary to simplify the process and improve the administrative system so that more workers can access its benefits.

Abstract

In developed countries, social security is a priority. So much so that social security is one of the administrative requirements that must be fulfilled by every citizen. Social security, especially for  workers, should be placed on a primary scale because its function can help ensure the welfare of workers in the future. Indonesia is the country with the largest number of Muslims, but the development of social security is far behind, even though Islam has rules, including regarding social relations which are based on the concept of mutual help as contained in the zakat regulations. This situation is an opportunity, the obstacle lies in state regulations which do not yet require Indonesian Migrant Workers (PMI) to be participants in all existing programs, only requiring Accident Insurance (JKK) and Death Insurance (JKM), while Old Age Insurance/Pension Insurance (JHT) is optional. Another thing is that it is not easy for PMI who have worked in other countries to become participants, especially those who do not have a written contract, because one of the requirements is the existence of a written contract. This was complained about by PMI who worked in Malaysia through the forgiveness program from the Malaysian government. Using qualitative research methods, this research places the researcher as the key instrument. The data collection technique was carried out by combining results obtained through interviews, observation and literature study, combined with inductive data analysis.

Abstract

This article was conducted in the form of community service “training of trainer”. The goal of this activity is to improve youth knowledge, understanding, skills and roles in preventing sexual violence. This research involves the committee and members of mosque youth who trained in preventing sexual violence. Adult education methods are used in community service as well as legal research to analyze participation of mosque youth in preventing sexual violence at worship place use a legal, case and conceptual approach. The research found: (1) The number of sexual violence cases increases every year in susceptible locations such as public spaces, terminals/stations, roadsides/sidewalks, public transportation, mass or social media, residential areas, workplaces/offices and campuses. (2) The absence of worship place on susceptible locations list does not mean sexual harassment against women and children has not existed. It could be happened to anyone regardless of gender, age, religion or social background. (3) knowledge, understanding, ability and role to prevent sexual violence among mosque youth increased after participated and practice through "Let's Practice Being a Trainer/Facilitator on Sexual Violence Prevention ". As conclusions: (1) mosque youth have an important role to reduce the number of various forms of and/or prevent of sexual violence, (2) the Indonesian Mosque Youth Communication Agency (BKPRMI) has capacity and roles to improve the knowledge, ability and role of mosque youth in preventing sexual violence, especially in the mosque/prayer room area.

Abstract

Abstract: Based on article 13 number 1 of Law Number 40 of 2004 concerning the National Social Security System, namely "Employers are required to gradually register themselves and their employees as participants with the social security organizing body, in accordance with the social security program followed". However, the fact in the field is that notaries as employers are still negligent in their obligations to register their employees in the BPJS Ketenagakerjaan program, one of the social security programs created by the government to improve the welfare of workers, which means that notaries do not comply with Law Number 30 of 2014 concerning the Regulation of Notary Positions Article 4 Number 1. The results of this study indicate that the reason notaries do not register their workers is due to the lack of knowledge about social security and the factor of administrative sanctions that are not firm and the lack of supervision of protection for workers who have been registered or have not been registered. then also notaries who do not care about the welfare of their workers. The suggestions in this study are as follows: Notaries are expected to submit to and comply with the SJSN Law which states that notaries are employers, and based on the SJSN Law and the BPJS Law, employers are required to register their employees in the BPJS Employment program, secondly, the sanctions for notaries who have not fulfilled social security for their employees are still too light so that they do not have a deterrent effect, thirdly, it is expected that notaries and their employees are active and continue to synergize in implementing applicable laws and regulations for the sake of mutual progress and prosperity. Keyword: Social Security, Notary Employees, BPJS Employment Abstrak: Berdasarkan pasal 13 angka 1 Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional yaitu “Pemberi kerja secara bertahap wajib mendaftarkan dirinya dan pekerjanya sebagai peserta kepada badan penyelenggara jaminan sosial, sesuai dengan program jaminan sosial yang diikuti”. Namun fakta dilapangan notaris sebagai pemberi kerja masih lalai akan kewajibannya untuk mendaftarkan pegawainya pada program BPJS Ketenagakerjaan salah satu program jaminan sosial yang dibuat pemerintah untuk mensejahterakan pekerja yang berarti notaris tidak patuh terhadap Undang-Undang Nomor 30 Tahun 2014 Tentang Peraturan Jabatan Notaris Pasal 4 Angka 1. Hasil penelitian ini menunjukan penyebab notaris tidak mendaftarkan pekerjanya karena minimnya pengetahuan tentang jaminan sosial serta faktor tidak tegasnya sanksi administratif dan kurangnya pengawasan terhadap perlindungan pada tenaga kerja yang sudah didaftarkan ataupun yang belum didaftarkan. kemudian juga notaris yang kurang memperdulikan kesejahteraan pekerjanya. Saran dalam penelitian ini adalah sebagai berikut Notaris diharapkan tunduk dan mematuhi UU SJSN yang menyatakan bahwa notaris merupakan pemberi kerja, dan berdasarkan UU SJSN dan UU BPJS pemberi kerja wajib mendaftarkan karyawannya pada program BPJS Ketenagakerjaan, kedua sanksi bagi notaris yang belum memenuhi jaminan sosial untuk pegawainya masih terlalu ringan sehingga tidak menimbulkan efek jera, ketiga Diharapkan notaris dan karyawannya aktif dan terus bersinergi dalam penerapan peraturan perundangan-undangan yang berlaku demi kemajuan dan kesejahteraan bersama. Kata kunci: Jaminan Sosial, Kesejahteraan, BPJS Ketenagakerjaan
