Abstract

The Office of Religious Affairs (KUA) is a government agency with the authority to register marriages among Muslims. For those who marry according to Islam, the registration is carried out at the KUA together with the marriage ceremony. Currently, there is a proposal to expand the role of the KUA as a marriage recorder not only for Muslims but for all religions proposed by the Minister of Religion. This proposal certainly raises pros and cons from various parties, both in society, government officials and religious leaders.. This research was conducted using a normative legal research method by searching for literature materials, both primary, secondary and tertiary legal materials related to this research study. This research was conducted to examine the urgency of revitalizing the role of the KUA as an institution for registering marriages for all religions and how the realization of this KUA role is with the revitalization of the role of the KUA. From the research conducted, the urgency of revitalizing the role of the KUA is related to efficiency in implementing marriage registration, but in terms of realization it is still difficult to do because many aspects must be restructured if the KUA is to be the only institution for registering marriages for all religions

Abstract

This article examines the corporate responsibilities of Indonesian state-owned enterprises (BUMN) concerning employee status following a spin-off, specifically the transformation of PT Perkebunan Nusantara III (Persero) Operational Medan into PT Perkebunan Nusantara IV Regional I. Spin-offs often involve organizational restructuring, which may impact employees’ employment status, contracts, and entitlements. Current Indonesian labor regulations, including the Labor Law and the Omnibus Law, do not provide explicit legal certainty for employees in spin-off scenarios, while the Limited Liability Company Law primarily governs asset and liability allocation rather than employee rights. This study analyzes the legal framework, company practices, and challenges in safeguarding employees’ rights during the spin-off process. The findings indicate that employees face uncertainty regarding job security, benefits, and contractual terms due to ambiguous clauses in existing agreements and insufficient regulatory guidance. To address these issues, the study recommends establishing specific regulations for spin-offs, ensuring continuity of employment contracts, strengthening labor supervision, involving trade unions in decision-making, and providing training programs to enhance employee resilience. Government involvement is also critical to monitor compliance and mediate potential disputes. In conclusion, creating clear legal frameworks and corporate policies for spin-offs is essential to guarantee employees’ legal certainty, uphold industrial harmony, and fulfill BUMN’s social responsibilities. Proper implementation ensures that operational efficiency is balanced with the protection of employee rights, promoting sustainable business practices in state-owned enterprises.

Abstract

The formation of laws and regulations in Indonesia in recent years has raised concerns regarding the rise of autocratic legalism—a practice where law is used as a tool to legitimize undemocratic power, often sidelining public participation and weakening checks and balances. This study aims to analyze the potential of applying the Regulatory Impact Assessment (RIA) framework as a means to prevent such practices in the legislative process. Using a normative juridical method with a conceptual and statutory approach, this research examines the alignment between current legislative mechanisms in Indonesia and the principles of RIA. The findings show that the absence of comprehensive stages such as policy option analysis, cost-benefit evaluation, and public consultation in Indonesia’s law-making process facilitates the emergence of autocratic legalism. By adopting RIA systematically, transparency, accountability, and inclusivity in the formation of legislation can be enhanced, thus safeguarding democratic governance and public interest.

Abstract

Indonesia currently has Law Number 11 of 2012 concerning the Criminal Justice System for Children (UU-SPPA) to provide protection for children who need special protection such as child offenders, victims and witnesses. In fact, the implementation of the UU-SPPA actually only focuses on children as perpetrators. This not only shows that justice for children is still not upright especially for children who are victims of sexual violence. This is evident from the findings of a study conducted in 2019 entitled "The Effectiveness of the Convention on the Rights of the Child Victims of Sexual Violence". This study found that although Indonesia already has 2 government regulations governing the fulfillment of victims of sexual violence in the form of compensation and or restitution, none of the decisions of the Medan District Court and Lubuk Pakam contain the rights of victims. The decisions of the Medan District Court and Lubuk Pakam throughout 2018 were oriented towards providing penalties for the perpetrators. The two Government Regulations which are guidelines for implementing the Law are (a) Government Regulation of the Republic of Indonesia Number 7 of 2018 concerning Provision of Compensation, Restitution and Assistance to Witnesses and Victims; and (b) Government Regulation of the Republic of Indonesia Number 43 Year 2017 Concerning Implementation of Restitution for Children Who Are Victims of Criminal Acts. These two Government Regulations are the basic ingredients for the implementation of the 2019 Mandatory Servant Lecturer service dedication. This situation is the basis of community service in two districts namely Medan Baru and Medan Sunggal. Law Enforcement Officials (APH) in this case the police and the community not only obtain new information about victims' rights but also increase their awareness to guarantee the rights of children victims of sexual violence are requested in legal proceedings for perpetrators. Furthermore, the Police and the community hope that the information on these two Government Regulations can be continued both by the Regional Government Organization (OPD) and other institutions such as the Civil Society Organization (CSO) in Medan.

Abstract

Abstract: Working abroad or what is called Migration is a step taken by workers in Indonesia to improve the quality of life, so as to obtain a decent life. The current PMI number has positive and negative values. Problems regarding PMI will continue to arise if PMI abroad are not given any protection. This Normative Research discussesProtection of Indonesian Migrant Workers as an indicator of fulfilling human rights according to International Law, The role of the ILO in implementing Employment Standards related to Social Security Protection for Migrant Workers, Social Security Program Policy for PMI in Malaysia. The method used in writing this thesis is Normative Juridical research, namely research using secondary data which is primary, secondary and tertiary legal materials through international agreements, legal regulations, legal books and the internet. The data analysis used is a qualitative data analysis method. Based on this, the author can conclude that International Law provides protection for social security rights as an indicator of fulfilling human rights for every migrant worker by ratifying the UDHR which specifically addresses human rights issues. In the international scope, protection is also provided through international organizations that collaborate with various multilateral institutions to establish employment standards for workers. Indonesia has a policy to provide protection for PMI in the form of Law no. 18 of 2017 concerning the Protection of Indonesian Migrant Workers which contains provisions that placement and protection are integrated within the authority of the Ministry of Manpower as well as providing more in-depth guidance and advocacy regarding the Agreement between workers and employers in order to increase legal awareness and better legal protection for prospective PMI’s.

Abstract

Remittances generated by migrant workers, particularly those from Indonesia, play a significant role in supporting the economic stability of households and national economies. However, the magnitude of these contributions contrasts sharply with the limited legal and social protection available to migrant workers. This research examines the key factors underlying the persistent impasse in migrant worker protection policies within ASEAN and explores potential strategies for improvement through a comparative assessment of the European Union experience. Using normative juridical methods that combine conceptual, regulatory, and comparative analyses, the study evaluates ASEAN legal instruments and compares them with the European Union framework for protecting migrant workers. The analysis identifies three main causes of policy stagnation in ASEAN. First, the region lacks binding obligations that require member states to adopt uniform minimum standards. Second, existing enforcement mechanisms are weak and do not ensure consistent implementation. Third, member states resist the establishment of supranational authority, limiting opportunities for stronger regional governance. Despite these challenges, functional adaptation through the selective adoption of European Union practices offers viable options, including harmonizing minimum standards, establishing regional complaint procedures, and facilitating the portability of social rights. The research concludes that a gradual and priority based approach, especially for high risk sectors, can enhance migrant worker protection while remaining consistent with the principles of the ASEAN Way.

Abstract

Legal protection is defined as the recognition of the dignity, honour and human rights of legal subjects based on applicable legal provisions, covering both preventive and repressive aspects. This study specifically highlights the scope of legal protection for domestic workers, especially those working abroad. The crucial issue is the absence of specific laws that regulate and protect domestic workers, both at home and abroad, which results in domestic workers being vulnerable to exploitation and human rights violations. The research method used in this thesis is normative juridical. The main approach is the statute approach, reinforced by a conceptual and comparative approach. Data was collected through document/library studies (books, regulations, journals) and supported by interviews at BP2MI and PT. Wira Usaha Kreasi. This research is descriptive and analytical, linking existing regulations with relevant legal theories. The results of the study confirm that although domestic workers are much needed, they do not have adequate legal protection due to the absence of specific laws governing them, especially migrant domestic workers. This study emphasises the importance of government support in protecting the rights of domestic workers. The main recommendation is to pass the Draft Law (RUU) on Domestic Workers in accordance with the spirit of ILO Convention No. 189 on Decent Work. The government is encouraged to provide comprehensive social security and legal protection, as well as to impose strict sanctions on P3MI (Indonesian Migrant Worker Placement Companies) that neglect their responsibilities towards migrant domestic workers.

Abstract

This paper aims to present an analysis of bullying that occurs in adolescents using the perspective of symbolic interactionism. The perspective focuses on social interaction, process, and meaning construction. This paper also discusses the complexity of bullying issues sociologically. The definition of bullying eventually becomes dynamic and is influenced by the process of observers in seeing the social interactions that occur. The factor of bullying becomes a crucial variable to fully understand the occurrence of bullying in adolescents. This paper uses qualitative research with a phenomenological approach with purposive sampling technique.

Abstract

Compliance with traffic laws is a key indicator in ensuring order and safety on the roads. Traffic violations continue to occur in various regions, including Aceh Tenggara, particularly among Generation Z. This generation is characterized as dynamic, critical of authority, and highly influenced by social media in shaping their perceptions and behaviors. This phenomenon indicates that repressive law enforcement approaches are no longer fully effective without the support of social legitimacy toward authorities and law enforcement actions. This study aims to analyze the influence of perceived police legitimacy on traffic law compliance among Generation Z. Police legitimacy is understood as the public’s trust in the authority of law enforcement officers to uphold the law fairly, with integrity, and transparently. This research employs a qualitative approach grounded in the social constructivism paradigm of Peter Berger and Thomas Luckmann to understand how social reality is constructed through interactions between individuals and authoritative institutions. The findings show that perceptions of police legitimacy significantly influence compliance levels. Thus, the study affirms that social legitimacy cannot be built solely through formal authority and sanctions, but also through humanistic communication, equitable services, and the presence of officers who embody moral exemplarity within society.

Abstract

Asset confiscation serves as an instrument of social control to eliminate unlawfully obtained profits while simultaneously redressing institutional losses. However, in practice, significant discrepancies often arise between prosecutors' demands and judges' decisions. In a number of decisions, prosecutors consider that the evidence linking assets to the crime has not been met and therefore demand that the assets be returned to the defendant, while judges use judicial discretion to confiscate and return the assets to the victim, based on considerations not fully revealed in the formal evidentiary process. Conversely, there are also cases where prosecutors demand confiscation of assets because they are considered the proceeds or means of a crime, but judges decide differently, rejecting the confiscation because they consider that there is insufficient evidence or a strong causal relationship between the assets and the crime charged. Through a sociology of law approach and jurisprudential analysis, this study finds that this discrepancy is a manifestation of a conflict of authority between two centers of authority in the criminal justice system. Using Ralf Dahrendorf's conflict perspective, this study emphasizes the importance of increasing the transparency of judicial deliberations and the sociological capacity of law enforcement officials to minimize structural tensions between the authority of prosecutors and judges.
