Abstract

Abstract: Based on article 13 number 1 of Law Number 40 of 2004 concerning the National Social Security System, namely "Employers are required to gradually register themselves and their employees as participants with the social security organizing body, in accordance with the social security program followed". However, the fact in the field is that notaries as employers are still negligent in their obligations to register their employees in the BPJS Ketenagakerjaan program, one of the social security programs created by the government to improve the welfare of workers, which means that notaries do not comply with Law Number 30 of 2014 concerning the Regulation of Notary Positions Article 4 Number 1. The results of this study indicate that the reason notaries do not register their workers is due to the lack of knowledge about social security and the factor of administrative sanctions that are not firm and the lack of supervision of protection for workers who have been registered or have not been registered. then also notaries who do not care about the welfare of their workers. The suggestions in this study are as follows: Notaries are expected to submit to and comply with the SJSN Law which states that notaries are employers, and based on the SJSN Law and the BPJS Law, employers are required to register their employees in the BPJS Employment program, secondly, the sanctions for notaries who have not fulfilled social security for their employees are still too light so that they do not have a deterrent effect, thirdly, it is expected that notaries and their employees are active and continue to synergize in implementing applicable laws and regulations for the sake of mutual progress and prosperity. Keyword: Social Security, Notary Employees, BPJS Employment Abstrak: Berdasarkan pasal 13 angka 1 Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional yaitu “Pemberi kerja secara bertahap wajib mendaftarkan dirinya dan pekerjanya sebagai peserta kepada badan penyelenggara jaminan sosial, sesuai dengan program jaminan sosial yang diikuti”. Namun fakta dilapangan notaris sebagai pemberi kerja masih lalai akan kewajibannya untuk mendaftarkan pegawainya pada program BPJS Ketenagakerjaan salah satu program jaminan sosial yang dibuat pemerintah untuk mensejahterakan pekerja yang berarti notaris tidak patuh terhadap Undang-Undang Nomor 30 Tahun 2014 Tentang Peraturan Jabatan Notaris Pasal 4 Angka 1. Hasil penelitian ini menunjukan penyebab notaris tidak mendaftarkan pekerjanya karena minimnya pengetahuan tentang jaminan sosial serta faktor tidak tegasnya sanksi administratif dan kurangnya pengawasan terhadap perlindungan pada tenaga kerja yang sudah didaftarkan ataupun yang belum didaftarkan. kemudian juga notaris yang kurang memperdulikan kesejahteraan pekerjanya. Saran dalam penelitian ini adalah sebagai berikut Notaris diharapkan tunduk dan mematuhi UU SJSN yang menyatakan bahwa notaris merupakan pemberi kerja, dan berdasarkan UU SJSN dan UU BPJS pemberi kerja wajib mendaftarkan karyawannya pada program BPJS Ketenagakerjaan, kedua sanksi bagi notaris yang belum memenuhi jaminan sosial untuk pegawainya masih terlalu ringan sehingga tidak menimbulkan efek jera, ketiga Diharapkan notaris dan karyawannya aktif dan terus bersinergi dalam penerapan peraturan perundangan-undangan yang berlaku demi kemajuan dan kesejahteraan bersama. Kata kunci: Jaminan Sosial, Kesejahteraan, BPJS Ketenagakerjaan

Abstract

This article was conducted in the form of community service “training of trainer”. The goal of this activity is to improve youth knowledge, understanding, skills and roles in preventing sexual violence. This research involves the committee and members of mosque youth who trained in preventing sexual violence. Adult education methods are used in community service as well as legal research to analyze participation of mosque youth in preventing sexual violence at worship place use a legal, case and conceptual approach. The research found: (1) The number of sexual violence cases increases every year in susceptible locations such as public spaces, terminals/stations, roadsides/sidewalks, public transportation, mass or social media, residential areas, workplaces/offices and campuses. (2) The absence of worship place on susceptible locations list does not mean sexual harassment against women and children has not existed. It could be happened to anyone regardless of gender, age, religion or social background. (3) knowledge, understanding, ability and role to prevent sexual violence among mosque youth increased after participated and practice through "Let's Practice Being a Trainer/Facilitator on Sexual Violence Prevention ". As conclusions: (1) mosque youth have an important role to reduce the number of various forms of and/or prevent of sexual violence, (2) the Indonesian Mosque Youth Communication Agency (BKPRMI) has capacity and roles to improve the knowledge, ability and role of mosque youth in preventing sexual violence, especially in the mosque/prayer room area.

Abstract

This research examines the employment agreements between foreign state representatives and local workers that are not related to diplomatic functions and therefore do not enjoy diplomatic immunity. While industrial relations disputes typically arise between workers and company management, there have been instances of labor disputes between workers and foreign state representatives. This creates a connection between Indonesia's legal system and the principle of diplomatic immunity in international law. Despite Indonesia's ratification of the Vienna Conventions of 1961 and 1963 through Law No. 1 of 1982, there is currently no specific national legislation governing privileges and immunities. As a result, labor disputes involving diplomatic immunity are dependent on court judgments. The focus of this research is on the severance payment obligations stipulated in labor laws and the responsibility of foreign embassies as employers in Indonesia to make severance payments. The research methodology employed is normative research with a legislative approach. Through qualitative data analysis, the following conclusions were drawn: First, the existence of pension programs does not automatically negate the right to severance pay that workers should receive upon reaching retirement age. Second, the Employment Law is inconsistent in regulating severance payments and pension guarantees as they were initially regulated separately.

Abstract

The company plays a crucial role in driving Indonesia's economy, necessitating its sustainability for competitiveness in the global era. Company productivity, which hinges on worker welfare, is vital for maintaining a company's existence. Workers valued by their company will be more productive, as company productivity starts with work productivity. Achieving this requires tranquility and industrial peace in labor relations. This research explores the connection between worker and company productivity, and how company productivity can be achieved through harmonized industrial relations and strengthened communication in the globalization era. Using a normative juridical method, examining laws and regulations, the study highlights the importance of maintaining harmonious industrial relations for work and business peace. Equalizing perceptions between employers and workers and maintaining effective communication are crucial for this goal. Enhancing company productivity begins with business tranquility and aligns with improving workers' welfare. Such conditions are essential for sustaining the company as an economic driver in Indonesia. High productivity enables companies to exist and compete in the global era.

Abstract

Defamation is a violation that attacks a person's honor and image. In terms of legal sociology, this defamation case also needs to be used as well as using the theory of legal effectiveness in society, where to enforce the law not only law enforcement officers play an important role but also the community. As is the case when viewed from the study of the sociology of the law of defamation through social media, this is due to the culture of society that uses information and communication technology as a source of long-distance information and receives various information in seconds, so it is undeniable that with this development, various crimes will arise such as defamation through social media, as this act is also regulated in the ITE Law, namely Law Number 19 of 2016 concerning Law Number 11 of 2011, where there are rules regarding defamation through social media.

Abstract

The growth of start-ups in Indonesia in the GIG economic era brings new challenges related to social security protection for workers. This study aims to examine the legal protection of start-up workers in obtaining social security and decent working conditions, especially in the context of the risk of losing their job. The main problem raised is the lack of optimal regulations that protect startup workers who are generally informal and do not have formal employment relationships. The research method used is a normative legal method with a statute and conceptual approach, using primary, secondary, and tertiary legal materials. The results show that startup workers face high vulnerability to termination of employment (PHK) without adequate social security protection. Although there is a unemployment benefits program through the Job Creation Law, its implementation is not inclusive of non-formal workers. This study concludes the need for regulatory changes to be more inclusive, as well as the need to recognize the status of startup workers in the social protection system. Collaborative efforts between governments, startups, and digital platforms are essential to expand social security coverage, to ensure decent working conditions for all workers in the digital age and GIG economy.

Abstract

Pemutusan Hubungan Kerja dalam perusahaan terdapat pada Undang-Undang Nomor 13 Tahun 2013 Tentang Ketenagakerjaan dan peraturan perundang-undangan lainnya. Tujuan penelitian ini adalah untuk mengetahui pelaksanaan restrukturisasi perusahaan akibat Pemutusan Hubungan Kerja secara sepihak apakah menurut undang-undang sudah tepat atau belum, bagaimana penerapan hukum dalam pertimbangan hakim atas perkara dalam Putusan No : 260 K/Pdt.Sus-PHI/2014, dan bagaimana perlindungan hukum terhadap pekerja yang diputuskan hubungan kerja oleh pengusaha. Metode penelitian yang dipergunakan dalam penelitian tesis ini ialah metode penelitian hukum normatif dengan pendekatan kasus dan sifat penelitiannya kepustakaan (Library Research). Analisis data yang dilakukan dengan metode analisis kualitatif dan komprehensif. Berdasarkan penelitian peraturan perundang-undangan yang berlaku bahwa pelaksanaan pada Putusan No: 260 K/Pdt.Sus-PHI/2014 yang dilakukan perusahaan banyak mengalami kegagalan usaha yang baik, baik itu dari eksternal maupun internal karena restrukturisasi yang dilaksanakan tidak sesuai apa yang dilakukan pengusaha kepada pekerja. Hal ini didukung dengan hasil penelitian pada Putusan No : 260 K/Pdt.Sus-PHI/2014, Bahwa Asas –asas dalam keadilan tidak dilaksanakan dengan baik, serta perlindungan terhadap pekerja yang diputus hubungan kerjanya dengan pengusaha kurang responden apa yang mereka terima kurang baik menurut peraturan perundang-undangan maupun peraturan di perusahaan tersebut.

Abstract

Abstract: The right to associate is a constitutional right. In the context of employment, the existence of trade unions is an important instrument in fighting for workers' rights. However, in practice, freedom of association is often disrupted by union busting, which is a systematic effort made by certain parties to prevent the formation or continuation of trade unions. Union busting is carried out in various ways that are detrimental to workers' right to associate Based on Article 28 of Law No. 21 of 2000. The method used in this writing is the normative legal research method, which is a method that refers to legal norms carried out by means of literature studies related to the problems studied, this research is descriptive in nature, and the data is analyzed qualitatively. criminal law policy needs to be directed to formulate policies with formulations against Article 28 of Law No. 21 of 2000 to be more comprehensive and cover various forms of actions to obstruct freedom of association that are increasingly complex and varied, in addition, there is a need to strengthen constitutional protection of freedom of association by increasing the capacity of law enforcement officers, clarifying the boundaries between the criminal and industrial realms, and strengthening labor supervision so that workers' rights are protected in accordance with the 1945 Constitution.Keyword: Criminal Law Politics, Right to Association, Union Busting Abstrak: Hak berserikat merupakan hak konstitusional. Dalam konteks ketenagakerjaan, keberadaan serikat pekerja menjadi instrumen penting dalam memperjuangkan hak-hak pekerja. Namun, dalam praktiknya, kebebasan berserikat kerap kali terganggu oleh tindakan union busting, yaitu upaya sistematis yang dilakukan oleh pihak-pihak tertentu untuk menghalangi pembentukan atau keberlangsungan serikat pekerja. Union busting dilakukan dengan berbagai cara yang merugikan hak berserikat pekerja Berdasarkan Pasal 28 Undang-Undang No. 21 Tahun 2000. Metode yang digunakan dalam penulisan ini adalah metode penelitian yuridis normatif, yaitu metode yang mengacu pada norma-norma hukum yang dilakukan dengan cara studi kepustakaan yang berkaitan dengan permasalahan yang diteliti, penelitian ini memiliki sifat deskriptif, serta data yang dianalisis secara kualitatif.  kebijakan politik hukum pidana perlu diarahkan untuk merumuskan kebijakan dengan formulasi terhadap pasal 28 Undang-undang No. 21 Tahun 2000 agar lebih komprehensif dan mencakup berbagai bentuk tindakan penghalangan kebebasan berserikat yang semakin kompleks dan variatif selain itu, perlunya memperkuat perlindungan konstitusional kebebasan berserikat melalui peningkatan kapasitas aparat penegak hukum, kejelasan batas antara ranah pidana dan industrial, serta penguatan pengawasan ketenagakerjaan agar hak-hak pekerja terlindungi sesuai UUD 1945. Kata Kunci: Politik Hukum Pidana, Hak Berserikat, Union Busting

Abstract

Implementasi ketentuan hukum mengenai tenaga kerja alih daya (tenaga kerja alih daya dipekerjakan pada pekerjaan inti perusahaan) yang notabene merupakan wujud belum maksimalnya perlindungan hukum yang diberikan Pemerintah bagi tenaga kerja alih daya. Penelitian ini bertujuan untuk menganalisis guna mengetahui mengenai disharmonisasi pengaturan perlindungan hukum tenaga kerja alih daya sebagaimana diatur dalam ketentuan Pasal 66 Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, yang membatasi alih daya hanya pada pekerjaan penunjang, sering kali dilanggar dengan ditempatkannya tenaga kerja alih daya pada pekerjaan inti. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual, serta dianalisis secara deskriptif-kualitatif terhadap norma hukum positif yang berlaku serta fakta implementatif yang terjadi di lapangan. Sumber data diperoleh melalui studi kepustakaan serta dokumentasi terhadap putusan pengadilan dan regulasi yang relevan. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap tenaga kerja alih daya belum berjalan secara efektif akibat disharmonisasi antara UU Nomor 13 Tahun 2003 dan UU Nomor 6 Tahun 2023. Perlunya harmonisasi hukum ketenagakerjaan secara vertikal dan horizontal sangat mendesak dilakukan sebagai langkah strategis untuk mewujudkan kepastian hukum dan keadilan sosial bagi tenaga kerja alih daya di Indonesia.
